not owned by the owner or keeper of the animal, nor within 350 feet <br /> of any residential structure unless <br /> such waste is immediately covered with at least four (4) inches of <br /> dirt. <br /> 6 -506 Nondomestic Animals at Large. No person who owns, <br /> keeps, maintains, or harbors a nondomestic animal shall permit the <br /> same to leave the enclosure unless accompanied by and under the <br /> control of the owner or keeper. Any animal shall be deemed to be <br /> at large when it is outside of its enclosure and not accompanied by <br /> the owner, keeper, or their agent, except any nondomestic animal <br /> trained to return to its owner's premises shall be considered under <br /> its owner's control when released away from the owner's premises <br /> and flying thereto in the most direct route. <br /> 6 -507 Impounding of Nondomestic Animals. Any nondomestic <br /> animal kept in violation of this Chapter may be impounded by the <br /> Animal Control Officer and after being so impounded for five (5) <br /> days or more without being redeemed, may be destroyed or otherwise <br /> humanely disposed of. Any person reclaiming any such impounded <br /> animal shall pay the costs of impounding and keeping the same. At <br /> the time of impounding, the Animal Control Officer shall notify the <br /> owner, if known, by telephone or personal contact and by written <br /> notice to his or her last known address. If the owner is unknown, <br /> written notice containing a description of the animal shall be <br /> posted at the pound and at City Hall. The notice shall advise the <br /> owner that he or she has five (5) regular business days to claim <br /> the animal. Regular business day means any day during which the <br /> pound is open to the public not less than four (4) consecutive <br /> hours between the hours of 8:00 a.m. and 7:00 p.m. <br /> 6 -508 Violation. Each day's violation of the provisions of <br /> this Chapter shall constitute a separate offense and shall be <br /> punishable as such hereunder. <br /> 6 -509 Permits. The City Council may grant permits for the <br /> keeping of nondomestic animals for use in connection with an <br /> educational display thereof provided that the Council finds that <br /> such animals are not likely to be dangerous, that they will be kept <br /> in safe and sanitary surroundings, that they will not be maintained <br /> in an inhumane manner or be subjected to any inhumane treatment, <br /> and that their presence on the premises will not be a source of <br /> nuisance or annoyance to the occupants of adjacent property. In <br /> granting such permit, the Council may impose limitations on the <br /> permit to ensure that such animals will be kept under such <br /> conditions. It will be unlawful for any person having such a <br /> permit to keep such animals without maintaining such conditions or <br /> without abiding by the limitations imposed by the City Council. <br /> Any such permit shall be subject to immediate suspension by the <br /> Chief Building official if he determines that the animals are being <br /> kept in a manner which violates the terms of the permit. Such <br /> suspension shall remain in effect until the next subsequent meeting <br /> of the City Council. At such meeting the City Council may revoke <br /> such permit or may reinstate the same subject to such limitations <br /> as the Council shall deem necessary. <br /> 6 -500 -2 <br />
