X. ` CONSENT AGENDA <br /> Appointment of Ms. Lori Dorn to the EDC Committee <br /> Resolution 99 -04 Acorn Creek Park Development Grant Application <br /> Resolution 99-05 Laurie LaMotte Park Improvement Grant <br /> Resolution 99 -06 Establishing Earth Day <br /> Motion by Councilmember Nelson, seconded by Councilmember Sweeney to approve the consent <br /> agenda. Motion carried. <br /> XI. COMMITTEE REPORTS <br /> Tri City Task Force <br /> Mr. March noted the next meeting scheduled on March 30, 1999 at 7:00 p.m. Mayor Wilharber <br /> requested the Council's approval of the International Association of the Chief of Police formula. <br /> Motion by Councilmember Brenner, seconded by Councilmember Travis that the Council approve the <br /> International Association of Chief of Police formula for the CPLPD. Motion carried. <br /> XII. ADMINISTRATORS REPORT <br /> Mr. March requested Mr. Hoeft to explain the Uniform Housing Code (UHC) and how the board of <br /> appeals could be set up. Mr. Hoeft explained that the Council my find it beneficial to keep the board of <br /> appeals within the City organization, such as Planning and Zoning or the Council. However; the City <br /> may want to consider waiting, in order to fully understand the whole process and options that are <br /> available. The City of Minnetonka has set up a board of appeals within its government. Whereas, other <br /> Cities utilize the Planning Conunission or the Council to be the Board of Appeals. Furthermore, <br /> enforcement may be a concern and it may be too difficult for the Building Official to handle it alone. Mr. <br /> Hoeft warned the Council of potential discrimination threats if the process is not followed closely. The <br /> adoption of the UHC allows for the City to clean up troubled areas. The easiest way is to make the <br /> Council the appeal board. <br /> Motion by Councilmember Nelson, seconded by Councilmember Brenner to authorize staff to enforce the <br /> UHC on a complaint basis. The Building Official will monitor and regulate the code and make the <br /> Council the board of appeals. Motion carried. <br /> XIII. ADJOURNMENT <br /> Motion by Councilmember Sweeney, seconded by Councilmember Brenner to adjourn the March 24, <br /> 1999 Council Meeting.
