Mayor Wilharber stated he may chose to petition for water and sewer as his property would not be <br /> in MUSA until 2005. <br /> Council Member Nelson questioned who would be responsible for providing either a tunnel or <br /> flashing lights at the pedestrian crossing at Centerville Road. Council Member Travis stated if a <br /> tunnel were added as a contingency for the development it was his belief the project would not <br /> proceed. Council Member Broussard Vickers stated she believed the tunnel may warrant a special <br /> fund raising project in the future. <br /> Mayor Wilharber stated the City may chose to obtain flashing lights at the pedestrian crossing on <br /> Centerville Road in order to avoid injuries. <br /> Mr. Hoeft stated that the Mayor's property would not be in the MUSA until 2005 and, therefore, <br /> the assessment may be deferred until that time. <br /> Mr. Hoeft stated that Council could approve the preliminary plat for the Pheasant Marsh PUD <br /> with the following stipulations attached: <br /> 1. Developer must obtain Rice Creek Watershed approval; <br /> 2. Developer must obtain a permit from Anoka County to access the development <br /> from Centerville Road; <br /> 3. Developer must obtain approval for the MUSA swap at developer expense; <br /> 4. Developer will be responsible for any fees associated with updating the City's <br /> Comprehensive Plan; <br /> 5. Developer must obtain design approval for the trailway from the City Engineer; <br /> 6. Developer must obtain approval of homeowner association documents relating to <br /> Outlots A, B, and C; <br /> 7. Developer must obtain City approval of resolution of the driveway /cul -de -sac issue <br /> for the exception properties to the north; and <br /> 8. Developer must obtain City approval of a developer agreement. <br /> Motion by Council Member Sweeney, seconded by Council Member Travis to approve the <br /> preliminary plat for the Pheasant Marsh PUD subject to the stipulations as outlined by Mr. <br /> Hoeft. The Developer would be required to pay park dedication fees of $1,800 per lot. All in <br /> favor. Vote - Ayes, 3 (Sweeney, Travis, Broussard Vickers) Nays, 1 (Nelson). Mayor <br /> Wilharber abstained from votin • . Motion carried. <br /> Council Member Broussard Vickers stated she would like the trailway to touch or run directly past <br /> the high ground or upland area in Outlot A as there may, at some point, be a park at that location. <br /> Mr. Cooper concurred and noted that it would be the most cost effective way to build the trailway. <br /> Lloyd Drilling (Rezone — 1873 Main Street) <br /> Mr. Drilling distributed a blueprint drawing of the proposed strip mall to Council. He indicated <br /> the strip mall would be approximately 10,000 square feet. <br /> Council Member Sweeney questioned whether Mr. Drilling had contacted Anoka County to obtain <br /> a permit for access onto Main Street. Mr. Drilling stated that the property currently has access to <br /> same. <br /> Page 8 of 14 <br />
