The police department completed the checks in May of 2000. The report from the Police <br /> Department indicates that the above named establishment sold alcohol to an underage cooperating <br /> Emergency individual during the compliance check. <br /> Management/ <br /> Emergency <br /> Response M. S. Chapter 340A.415 provides that the commissioner of Public Safety or the liquor license issuing <br /> Commission authority may impose a civil penalty of not more than $2,000, or license suspension or revocation <br /> against a liquor licensee for the sale of alcohol to a minor individual. The report from the Police <br /> State Fire Department indicated no knowledge regarding a civil penalty being imposed by your city council <br /> Marshal/ against the above named establishment for the underage violation. Based on that information, it our <br /> peline safety understanding that no civil penalty has yet been imposed by your city council. If a civil penalty has <br /> State Patrol been imposed, we would greatly appreciate that infomtation as soon as possible. <br /> Traffic Safety The Alcohol and Gambling Enforcement Division strongly advises that local licensing officials handle <br /> this civil penalty matter within their communities. If your city council does not assume the <br /> responsibility for the civil penalty against the above named establishment within 90 days of the date of <br /> this letter, the Alcohol and Gambling Enforcement Division is prepared to apply the provisions of M. <br /> S. 340A.415 giving the commissioner the authority to impose a civil penalty against the liquor <br /> establishment that failed the compliance check. $500 is the first time offense penalty that our office <br /> routinely imposes against establishments that sell to minors, and is also our recommendation to cities <br /> and counties that handle the matter themselves. <br /> Please advise our office immediately regarding civil action taken by your city council against the above <br /> named establishment, by faxing at 651- 297 -5259, or writing to Marlene Kjelsberg, 444 Cedar Street, <br /> Suite 133, St. Paul, MN 55101. <br /> Sincerely, <br /> ALC OL AND GAMBLING ENFORCEMENT DIVISION <br /> TMENT OF PUBLIC SAFETY <br /> / <br /> Frank Ball.
