All land shown on the Final <br /> Development Plan as common open space must be conveyed to homeowners association <br /> or similar organization for the maintenance of the planned development. The common <br /> open space must be conveyed to the homeowners association or similar organization <br /> subject to covenants to be approved by the City Council which restrict the common open <br /> space to the uses specified on the final development plan, and which provide for the <br /> maintenance of the common open space in a manner which assures its continuing use for <br /> its intended purpose. <br /> Section 180 -280: Homeowners Association. If a homeowners association is created, <br /> the applicant shall submit plans at the time of final plan of development and documents <br /> which explain: <br /> A. Ownership and membership requirements; and <br /> B. Articles of incorporation and bylaws; and <br /> C. Time at which the developer turns the association over to the <br /> homeowners; and <br /> D. Approximate monthly or yearly association fee for homeowners; and <br /> E. Specific listing of items owned in common including such items as <br /> roads, recreation facilities, parking common open space ground, and <br /> utilities. <br /> Division 185: Variances <br /> Standards <br /> The Planning Com shall recommend a Variance and the Council shall order the <br /> issuance of such Variance only if it conforms to the following standards: <br /> A. Special conditions and circumstances exist which are peculiar to the <br /> land, structure, or building involved and do not result from the actions <br /> of the petitioner; and <br /> B. Literal interpretation of the provisions of this Ordinance would deppye <br /> the petitioner of nghts commonly; enjoyed by other properties ift the <br /> same district under the terms of this, Ordinance; and <br /> C.= . Granting the Variance requested will not confer on the applcant1ny <br /> special privilege that is denied by this Ordinance to other bride, <br /> structures, or buildings in the same district; and <br /> Page 55 of 62 <br />
