• SUMMARY OF RESTRICTIVE COVENANTS FOR PAGENKOPF CORNER <br /> THIS IS INTENDED ONLY TO SERVE AS A SUMMARY OF THE COVENANTS. THERE ARE RESTRICTIONS <br /> CONTAINED IN THE COVENANTS WHICH ARE NOT INCLUDED IN THIS SUMMARY. TO THE EXTENT THAT <br /> THIS SUMMARY CONFLICTS WITH THE ACTUAL COVENANTS, THE COVENANTS CONTROL. IF YOU DO <br /> 1 <br /> NOT HAVE A COPY, YOU SHOULD OBTAIN A COPY OF THE COVENANTS. <br /> Type of House Each house shall be a single family residence, not exceeding two stories in height when <br /> measured from the front of the house. <br /> Driveways Driveways shall be a minimum of 12 feet in width and shall be constructed of brick, concrete, <br /> pavers or bituminous within 12 months of occupancy. Lots 6 and 7 share an entrance. <br /> Garage All homes shall have an attached garage with space tor two, three or four cars. This restriction shall <br /> not preclude an attached garage from being two stalls deep nor shall it preclude any storage areas <br /> incorporated into the lower level of the home not visible from the street. <br /> House Design The design shall exhibit more architectural merit, continuity, and distinction than found <br /> in conventional single family residential developments. Major attention shall be given t o trim, window <br /> placement, siding material, and garage door detail. <br /> All building plans shall be reviewed first by the Declarant. <br /> All exterior colors shall be natural or earth tones with approval by the Declarant. <br /> The area around the house (as defined in the covenants) shall be sodded. Each house shall have <br /> a minimum of $500.00 in landscaping and foundation shrubs installed in front of each home as <br /> screening for the foundation. The landscaping shall be completed within seven months of a <br /> certificate of occupancy being issued for the house. <br /> Easements Within the trail, utility and drainage easements on the plat no structures, plantings or other <br /> materials shall be placed so they may interfere with the purpose of the easement. <br /> Outside Storage No recreational vehicle, non- operative automobile, trailer, boat, snowmobile, fish house, <br /> fire wood, vehicle in excess of 9,000 pounds or structure of a temporary character shall be kept or stored <br /> outside of a building or garage. <br /> Fences No fences shall be constructed or located in the front yard. All other fences must conform t o the <br /> covenants. <br /> Animals No animals, livestock or poultry of any kind shall be raised, bred or kept on any lot except that <br /> dogs, cats or other household pets provided that they are not kept, bred or maintained for any <br /> commercial purpose. <br /> Accessory Buildings Only one storage, accessory building or shed shall be permitted on any lot providing that it; does not <br /> exceed 480 square feet, is not located within any setback area, is constructed of the same material and <br /> of the same color as the home and has an asphalt shingle roof and is of the same design as the house. <br /> Antennas Satellite dishes shall be permitted provided they don't extend 6 feet above the roof, are less <br /> than 36 inches in diameter and are screened from roadways and neighbors. <br /> Mailboxes Mailboxes shall be provided in a cluster configuration as approved by the City and the Post Office. <br /> Agricultural Area Some of the properties abutting this community are active agricultural areas. The City of Independence <br /> has passed an ordinance stating that certain agricultural operations do not constitute a nuisance, <br /> Enforcement Any person with a legal or equitable interest in the property subject to this Declaration including <br /> the City of Independence shall have the right to enforce all covenants. The Declarant shall not be <br /> required t o enforce the Covenants. <br />
