Mayor Wilharber opened the public hearing at 6:07 p.m. <br /> Mr. March noted that several residents had paid their delinquent amounts prior to the <br /> public hearing. <br /> Council Member Sweeney questioned whether the City could hire a collection agency <br /> rather than certifying the delinquent amounts with Anoka County. <br /> Mr. March indicated that an assessment would be attached to the property whether or not <br /> the property owner filed bankruptcy. If a collection agency was used, and the City <br /> obtained a civil judgment, same could be discharged in the case of bankruptcy. City <br /> Attorney Hoeft confirmed. <br /> Council Member Sweeney stated that he was concerned that the list contained several <br /> property owners who consistently are delinquent. Council Member Sweeney questioned <br /> whether a property owner could write off the assessment as a property tax when filing <br /> taxes. City Attorney Hoeft indicated it would be improper to attempt to write off an <br /> assessment as a property tax. The property tax statement received from the County will <br /> differentiate between taxes and assessment amounts. <br /> Council Member Broussard Vickers expressed concern that the property owners with <br /> delinquent utilities are essentially receiving an interest free loan for minimal <br /> administrative fee of $25. Council Member Broussard Vickers questioned whether the <br /> administrative fee could be increased. City Attorney Hoeft confirmed, provided the City <br /> stayed within the allowable usury laws. <br /> Council Member Broussard Vickers questioned whether the names of individuals with <br /> delinquent utilities could be published. City Attorney Hoeft confirmed. Mr. March <br /> stated he would prefer to notify residents, prior to the public hearing process, that their <br /> names and addresses would be published if unpaid prior to that point. Mr. March felt that <br /> this may prompt residents to satisfy amounts that are delinquent. <br /> Motion by Council Member Broussard Vickers, seconded by Council Member <br /> Sweeney to close the public hearing All in favor. October 25, 2000 Meeting Minutes <br /> Mr. March requested the following modifications: Page 3, first paragraph, change "3x3" <br /> to "3 foot wide by 16 foot long ". As a side note, Mr. March informed Council that the <br /> property owners would repair their driveway in the spring and would like the City to <br /> repair the end of the driveway at the same time. Page 6, second paragraph, add "or if <br /> additional monies need to be expended"; Page 7, under the Administrator's Report in the <br /> Page 2 of 10 <br />
