Said <br /> fee shall be a good faith estimate cf the actual costs to ce <br /> incurred by the City in processino the application. <br /> Subd. S. All applications for motorized recreational vehicle trails <br /> shall tre reviewed by the City Council. In determining whether to <br /> grant permission for a trail. the Council shall consider the <br /> followings <br /> 1. The public need for the proposed trail at the location and <br /> scale proposed. <br /> 2 Potential impact ❑f the trail on adjacent property owners. <br /> S. Potential impact of the proposed trail en future City <br /> development. <br /> 4. Potential impact of the proposed trail on envaronm_ntally <br /> sensitive areas. <br /> 5. the adequacy of the proposed trail to safely serve its <br /> intended wee. <br /> 6. Such other criteria as the situation may require. <br /> Subd. C. The City Council shall dory all applications ler motorized <br /> recreational trails when the applicant has not demonstrated to the <br /> satisfaction of the Council: <br /> 1. The need for the proposed trail. <br /> 2. The adequacy and safety of the proposed trail to serve its <br /> intended use. <br /> 1. The financial and operative ability of the applicant to <br /> construct, maintain and operate the trail as proposed. <br /> 4. that the trail will not cause undue hardship and /or <br /> unreasonaoly disrupt the peaceful enjoyment of the property <br /> owners adjacent to the proposed trail !❑,r the public). <br /> Subd. D. The City Council may grant permissior, for the construction• <br /> maintenance and operation of a proposed trail by resolution where it <br /> has determined, at its sole discretion, that such a trail is <br /> warranted, feasible, and in the best interest of the community. <br /> Subd. E. In granting permission for the construction, maintenance <br /> snd operation of s trail, the Council may grant, in the authorizing <br /> resolution, exemptions from certain provisions of the ordinance where <br /> the situation or design of the trail so warrant such exemptions in <br /> the best interest of the City. <br /> Subd. F. The Council may, in the authorizing resolution, place <br /> special restrictions, regulations and conditions an motorized <br /> recreational vehicle trails when the situation or design of the trail <br /> ao warrant. <br /> Subd. S. Should it appear to the Council that the terms and <br /> conditions which it has placed upon a trail are not being adhered to, <br /> or that they are not adequate, sufficient, or necessary to protect <br /> the health, safety, and welfare of the public, then the Council may, <br /> 5 <br />
