Pursuant to due call and notice thereof, the Planning & Zoning <br /> Commission held their regular meeting on Tuesday, October <br /> 1, 1985 in City Hall. Acting Chairman Buesseler called <br /> the meeting to order at 7:10 P.M. Present: Welk, Murray. <br /> Absent: Lindgren, Chairman Tourville. <br /> Motion by Murray, second by Welk to accept the minutes <br /> of the September 3, 1985 meeting, motion carried unanimously. <br /> OLD BUSINESS: <br /> Discussion of Wild and Exotic Animal Ordinance. Clerk will <br /> type up first draft for discussion at next meeting. <br /> Discussion on new State legislation on animal control and <br /> how it relates to Centerville's Ordinance #24. <br /> - Ordinance #24 does not seem to be conflicting. <br /> - State law takes precedence over City Ordinance. <br /> Motion by Welk, second by Murray to leave Ordinance #24 <br /> as is for the reasons stated above, motion carried unanimously. <br /> Discussion on Ordinance #4 tabled until November meeting. <br /> Clerk will send notice to each commission member to remind <br /> them to come prepared to the November meeting to discuss <br /> Ordinance #4 - highlight problem areas, outline what want <br /> to accomplish, have steps to accomplish goals. <br /> Clerk will check with the City of Circle Pines on their <br /> fence related ordinance. <br /> NEW BUSINESS: <br /> Motio by Murray, second by Welk to send the following <br /> recommendations to the City Council on the Ordinance <br /> Providing An Abatement Procedure For Nuisances: <br /> - Intent of Ordinance is good; <br /> - Chief Building Official should read Building <br /> Inspector to be in conformance with our other <br /> ordinances; <br /> - Provides for no recourse if the decision is <br /> against the City rather than the property owner; <br /> - Question the interchangeability of the Hear Examiner <br /> and the City Council in the appeal procedure, should <br /> maybe consider appeal procedure from Ordinance #4; <br /> motion carried unanimously. <br /> Clerk will check with the City Attorney, City of Lino Lakes, <br /> and the City of Andover for information on the "Hearing <br /> Examiner ". <br /> Question of dirt at the Rehbein property on 20th Avenue <br /> South will be referred to the City Council. <br /> Motion by Welk, second by Murray to adjourn meeting. <br /> Meeting adjourned at 9:10 P.M. <br /> Respectively submitted, <br /> Debra Gonsior <br /> Clerk /Treasurer <br />
