Planning & Zoning Commision, 7 -11 -95 <br /> A: Will go to Bob Burgstahler in property trade for easement. <br /> Patrick Fruth, 7384 Old 11 Road, questioned the road easement that is currently going <br /> to the back of his property. Rehbein replied that would not change, <br /> Bob Burgstahler, 7381 Old Mill Road, asked if the grading has been re- looked at. <br /> Burgstahler's concern is with Lot 3, Block 1; is there going to be an 80 foot retaining wall <br /> on the edge of the creek. Rehbein stated that MSA sent a letter to the city requiring the <br /> lot to have a retaining wall and the specifics of it. Burgstahler would like to see where the <br /> wall would be and also that the wall be installed before a building permit is issued for the <br /> lot. Burgstahler also questioned if Rice Creek and/or the DNR have requirements for a <br /> retaining wall on the creek. <br /> Patrick Fruth, 7384 Old Mill Road, questioned the watershed drainage. Rehbein stated <br /> that there will be a storm sewer between Block 3, Lots 5 & 6 from the back of the house <br /> across the street to the back of the house on Block 2. <br /> Bob Burgstahler stated that the holding pond was originally approved to drain the whole <br /> development therefore there should be no problem. <br /> Motion by Vermeulen, second by Welk to close the public hearing for the preliminary plat <br /> of Acorn Creek II at 7:28 p.m., motion carried unanimously. <br /> Little Rascal Public Hearing <br /> Little Rascal Public Hearing was called to order at 7:29 p.m. <br /> Tourville stated that the building at 1724 Main Street would require a special use permit in <br /> order to make fishing lures. The type of work is considered light industrial and the <br /> building is in a commercial zone. <br /> Scott Raschke stated they manufacture fishing lures; it is light industrial work. Some of it <br /> is subcontract and some they make ready for retail sale. Here is an example of steps taken <br /> when centrifugal molding is done: hooks are put in the mold, lead is poured in the mold <br /> (new or clean lead is used only), it is then racked in styrofoam, dipped in paint, then <br /> broken down and bagged. <br /> Little Rascal has been operating in the building since February 8, 1995, the previous <br /> occupants (Noble Welding) also required a special use permit. They did not know that the <br /> permit was issued to each company and therefore that they could not operate under the <br /> same permit. <br /> Tourville addressed the concerns outlined in a memo from the Fire Chief, Milo Bennett. <br /> 2 <br />
