Chairperson Tourville noted it is his understanding that twin homes are required to have a common fire wall. The water leakage problems could possibly be a design problem. Sanna Buckbee, Assistant City Clerk, noted the drain tile may prohibit the use of the land as proposed. Mr. Hansen noted that it was his understanding the Mullins blocked off the drain tile and it did back up on someone else's property. Chairperson Tourville reviewed the four standards for recommending a variance and made the following comments: 65.03 -1 Special conditions and circumstances exist which are peculiar to the land, structure, or building involved and do not result from the actions of the petitioner; Comment: The actions of the petitioner will take a conforming lot and make two non - conforming lots. 65.03 -2 Literal interpretation of the provisions of this ordinance would deprive the petitioner of rights commonly enjoyed by other properties in the same district under the terms of this ordinance; Comment: The variance previously granted had two sewer stubs, it appears there are two sewer stubs, to this lot however both apear to be servicing the northern lot. 65.03 -3 Granting the variance requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands, structures, or buildings in the same district; Comment: It appears granting the variance may create problems with the fair application of zoning standards. 65.03 -4 The proposed variance will not impair an adequate supply of light and air to adjacent property, or unreasonably diminish or impair established property values within the surrounding area, or in any other respect impair the public health,
