It is more desirable to have two separate parcels. <br /> Chairperson Tourville noted it is his understanding that twin <br /> homes are required to have a common fire wall. The water leakage <br /> problems could possibly be a design problem. <br /> Sanna Buckbee, Assistant City Clerk, noted the drain tile may <br /> prohibit the use of the land as proposed. <br /> Mr. Hansen noted that it was his understanding the Mullins <br /> blocked off the drain tile and it did back up on someone else's <br /> property. <br /> Chairperson Tourville reviewed the four standards for <br /> recommending a variance and made the following comments: <br /> 65.03 -1 Special conditions and circumstances exist which <br /> are peculiar to the land, structure, or building <br /> involved and do not result from the actions of the <br /> petitioner; <br /> Comment: The actions of the petitioner will take a <br /> conforming lot and make two non - conforming lots. <br /> 65.03 -2 Literal interpretation of the provisions of this <br /> ordinance would deprive the petitioner of rights <br /> commonly enjoyed by other properties in the same <br /> district under the terms of this ordinance; <br /> Comment: The variance previously granted had two sewer <br /> stubs, it appears there are two sewer stubs, to <br /> this lot however both apear to be servicing the <br /> northern lot. <br /> 65.03 -3 Granting the variance requested will not confer on <br /> the applicant any special privilege that is denied <br /> by this ordinance to other lands, structures, or <br /> buildings in the same district; <br /> Comment: It appears granting the variance may create <br /> problems with the fair application of zoning <br /> standards. <br /> 65.03 -4 The proposed variance will not impair an adequate <br /> supply of light and air to adjacent property, or <br /> unreasonably diminish or impair established <br /> property values within the surrounding area, or in <br /> any other respect impair the public health, <br />
