His parking lot <br /> is pretty much in as far as I can see. Was this <br /> appropriate? Isn't he supposed to wait for variance <br /> approval before starting this? Drainage. Looking at the <br /> way the new parking area has been set up. It all slants <br /> to the properties behind him. Is this appropriate? What <br /> happens once he blacktops this parking area and water <br /> problems occur on the properties directly behind him due <br /> to this fact? Will he have to redo this? And will it be <br /> readily enforced? <br /> 2. The property that the owner of Kelly's wishes to join to <br /> his bar property also has a house on it. Is house <br /> property now part of bar and if so, what are lot <br /> requirements even if commercial. Bill has left very <br /> little yard around this house. <br /> 3. Is City liable if variance granted without knowing that <br /> house is part of bar property? If lawsuit occurs, it is <br /> the taxpayers who pay this? <br /> 4. Bill Bisek claims he needs these two lots joined due to <br /> the fact that he would like to add on to Kelly's and he <br /> needs more parking. There has always been street parking <br /> available. After seeing where his volleyball courts and <br /> parking lot are going he doesn't have much room left for <br /> addition of bar. Even if he does need additional parking <br /> it seems the parking lot he has created is rather large. <br /> 5. Has the lot that he wishes to join to the bar been <br /> surveyed? The reason for this question is that if the <br /> Zoning and Planning Commission pass his variance, I <br /> strongly request a 10 foot privacy fence which you cannot <br /> see through and the owner of the bar must maintain both <br /> sides of the fence when maintenance is required. Also <br /> this fence should run the south property line and east <br /> property line as close to Main Street as allowed. Also <br /> no gates. <br /> 6. Noise - What time do bars or any other business that have <br /> outside activities have to stop when they are surrounded <br /> by a residential area? Is it 8:00 or 9:00 p.m.? Then I <br /> would like to request a change in the time bars or <br /> businesses have to stop outside activities and how often <br /> they are allowed to have these outside activities. <br /> According to Kelly's recent mailing concerning their <br /> upcoming outdoor activities beginning in May and <br /> throughout the summer they are going to be having <br /> volleyball games 4 times a week. How late is this <br /> allowed to be played until? A few times last summer he <br />
