Special conditions and circumstances exist which are <br /> peculiar to the land, structure, or building involved <br /> and do not result from the actions of the petitioner; <br /> 2. Literal interpretation of the provisions of this <br /> ordinance would deprive the petitioner of rights <br /> commonly enjoyed by other properties in the same <br /> district under the terms of this ordinance; <br /> 3. Granting the variance requested will not confer on the <br /> applicant any special privilege that is denied by this <br /> ordinance to other lands, structures, or buildings in <br /> the same district; <br /> 4. The proposed variance will not impair an adequate <br /> supply of light and air to adjacent property, or <br /> unreasonable diminish or impair established property <br /> values within the surrounding area, or in any other <br /> respect impair the public health, safety, or welfare of <br /> the residents of the city; <br /> motion carried unanimously, <br /> Discussion of Pole Building Ordinance. Planning and Zoning has <br /> three options; to extend the current Moratorium Ordinance, or to <br /> adopt a new ordinance, either the one recommended by the City <br /> Planner or the Lino Lakes version , or drop the current <br /> Moratorium. <br /> Chairperson Tourville stated that the sample recommended by the <br /> Planner was too vague. He further stated that he felt that none <br /> of the Commission were against pole buildings in the commercial <br /> and industrial zones if they are "dressed up" a little. <br /> Discussion followed. <br /> Motion by Tourville, second by Vermeulen, to recommend to the <br /> City Council that the City extend the Moratorium Ordinance for <br /> six months and that further discussion of Planning and Zoning <br /> concerns and recommendations be on the agenda for the March P & Z <br /> • meeting, motion carried unanimously. <br /> The Commission did not see a need to discuss amending Ordinance <br /> #4 concerning Non - conforming Uses, Setbacks in the Commercial and <br /> Industrial zones, and Site Plan approvals of Commercial and <br /> Industrial zones.
