r <br /> Pursuant to due call and notice thereof, the Plannina and Zoning <br /> Commission of the City of Centerville held a Public Hearing on <br /> Tuesday, January 3, 1989 at City Hall. Chairman Tourville called <br /> the hearing to order at 6:40 p.m. Present: Welk, Drilling and <br /> Council liaison Peterson. Absent: Vermeulen and Lindgren. <br /> The purpose of the hearing was to hear all persons present <br /> regarding a request for variance from Ordinance #4, PTlCJ _4.- <br /> NON CONFORMING USES AND STRUCTURES, Section. 44.02 STRUCTURAL <br /> CHANGE to add on to the building, and a Special Use Permit for. <br /> #12. Construction Businesses, TABLE A, under 8-1 Commercial, USES <br /> PERMITTED ON SPECIA t JS PEPMIT for the property at 7087 - 20th <br /> Avenue South (Eagle Trucking). This notice is attached to and <br /> made a part of these minutes. <br /> Dick Hubers, owner of Eagle Trucking, presented drawings and <br /> plans for the addition. Hubers stated that the addition would be <br /> 48 feet long by 28 feet wide, and would be 20 feet from the side <br /> yard setback and 30 feet from the setback line of 20th Avenue. <br /> Drilling questioned the fact that the plan showed 27 feet from <br /> the street setback line. Hubers stated that he and the Building <br /> Inspector had measured the area and it is 30 feet. <br /> Commisssi_on referenced Clerk annotation concerning Building <br /> Inspector's interpretation of the footnote to Table B which <br /> states "Where adjacent structures have front yard setbacks <br /> different from those required, the front yard setback shall <br /> conform to the average setback of the adjacent structures." Mr. <br /> Hubers stated that he feels that his building is the first <br /> building on 20th Avenue South, because the Centerville Plaza on <br /> the corner of 20th Avenue and Main Street has a Main Street <br /> address. <br /> Chairman Tourville expressed concern of Ordinance #4 not <br /> addressing the difference between Contractor's Yard and <br /> Construction Businesses. Hubers stated that it is a construction <br /> business. <br /> A short discussion of past similar variances followed. <br /> Chairman Tourville asked for comments from the audience. None <br /> were made. No persons with property within 350 feet of the <br /> property in question were present. <br /> Motion by Drilling, second by Welk, to adjourn the hearing. <br /> Hearing adjourned at 7:04 p.m. <br /> Pursuant to due call and notice thereof, the Planning and Zoning <br /> Commission of the City of Centerville held a second public <br /> hearing on January 3, 1989, at City Hall. Chairman Tourville <br /> called the hearing to order at 7:06 p.m. Present: Welk, <br /> Vermeulen, Drilling, Lindgren and Council liaison Peterson. <br />
