r Pursuant to due call and notice thereof, the Plannina and Zoning Commission of the City of Centerville held a Public Hearing on Tuesday, January 3, 1989 at City Hall. Chairman Tourville called the hearing to order at 6:40 p.m. Present: Welk, Drilling and Council liaison Peterson. Absent: Vermeulen and Lindgren. The purpose of the hearing was to hear all persons present regarding a request for variance from Ordinance #4, PTlCJ _4.- NON CONFORMING USES AND STRUCTURES, Section. 44.02 STRUCTURAL CHANGE to add on to the building, and a Special Use Permit for. #12. Construction Businesses, TABLE A, under 8-1 Commercial, USES PERMITTED ON SPECIA t JS PEPMIT for the property at 7087 - 20th Avenue South (Eagle Trucking). This notice is attached to and made a part of these minutes. Dick Hubers, owner of Eagle Trucking, presented drawings and plans for the addition. Hubers stated that the addition would be 48 feet long by 28 feet wide, and would be 20 feet from the side yard setback and 30 feet from the setback line of 20th Avenue. Drilling questioned the fact that the plan showed 27 feet from the street setback line. Hubers stated that he and the Building Inspector had measured the area and it is 30 feet. Commisssi_on referenced Clerk annotation concerning Building Inspector's interpretation of the footnote to Table B which states "Where adjacent structures have front yard setbacks different from those required, the front yard setback shall conform to the average setback of the adjacent structures." Mr. Hubers stated that he feels that his building is the first building on 20th Avenue South, because the Centerville Plaza on the corner of 20th Avenue and Main Street has a Main Street address. Chairman Tourville expressed concern of Ordinance #4 not addressing the difference between Contractor's Yard and Construction Businesses. Hubers stated that it is a construction business. A short discussion of past similar variances followed. Chairman Tourville asked for comments from the audience. None were made. No persons with property within 350 feet of the property in question were present. Motion by Drilling, second by Welk, to adjourn the hearing.
