Pursuant to due call and notice thereof, the Planning and Zoning <br /> Commission of the City of Centerville held a public hearing on <br /> Tuesday, November 24, 1987. Chairman Tourville called the <br /> hearing to order at 7:05 p.m. Present.: Lindgren, Vermeulen, <br /> Drilling, and Council liaison Laska. Absent: Welk. <br /> The purpose of the hearing was to hear all persons present <br /> regarding the possibility of granting a Variance to Ordinance #4, <br /> Article #4, NON - CONFORMING USE OF LAND, Section 42.03 -1 and TABLE <br /> B, SCHEDULE OF DISTRICT REGULATIONS under B -1 Commercial, by <br /> addition to the Rivard Electric building at 7087 Progress Road. <br /> Marcel Rivard, Jr., was present to represent Rivard Electric. He <br /> stated that at the time the building was erected it was <br /> conforming and lot setback requirements were later changed from <br /> 10 or 15 feet to 20 feet. <br /> There was no opposition to the variance request and it was noted <br /> that the property is zoned Commercial and is a Commercial Use. <br /> Hearing adjourned at 7:24. <br /> Pursuant 4 due call and notice thereof, the Planning and Zoning <br /> Commission held a Special Meeting to discuss changes to Ordinance <br /> #4. Chairman Tourville called the meeting to order at 7:25 D.M. <br /> Present: Lindgren, Vermeulen, Drilling, and Council liaison <br /> Laska. Absent: Welk. <br /> Motion by Vermeulen, second by Lindgren to recommend to the City <br /> Council that a variance to Ordinance #4, Article #4, NON - <br /> CONFORMING USE OF LAND, Section 42.03 -1 and TABLE B, SCHEDULE OF <br /> DISTRICT REGULATIONS under B -1 Commercial, be granted. The <br /> reasons being: <br /> 65.03 -1 - Special conditions and circumstances exist which <br /> are peculiar to the land, structure, or building <br /> involved and do not result from the actions of the <br /> petitioner; <br /> 65.03 -2 - Literal interpretation of the provisions of this <br /> ordinance would deprive the petitioner of rights <br /> commonly enjoyed by other properties in the same <br /> district under the terms of this ordinance; <br /> 65.03 -3 - Granting the variance requested will not confer on <br /> the *the- applicant any special privilege that is <br /> denied by this ordinance to other lands, <br /> structures, or buildings in the same district; <br /> 65.03 -4 - The proposed variance will not impair an adequate <br /> supply of light and air to adjacent property, or <br /> unreasonably diminish or impair established <br /> property values within the surrounding area, or in <br /> any other respect impair the public health, <br /> safety, or welfare of tphe residents of the city. <br /> Motion carried unanimously. <br />
