SUBJECT: BEDESIGNATION OF LOT LINE COMMON TO LOT 13 AND LOT 14, Block 12 — BURQUE <br /> ADDITION 11, CENTERVILLE, MINNESOTA. <br /> TO WHOM IT MAY CONCERN: <br /> PROBLEM(S) <br /> 1. Recently established location of actual lot line referenced above has revealed <br /> the fact property (small shed and garden area) originally thought to be within <br /> lot line constraints for lot 14, block 2 are actually encroaching on property <br /> belonging to lot 13, block 2 to a substantial degree. <br /> 2. There is approximately 27' between the south face of existing garage on lot 13 <br /> and the north face of existing garage on lot 164. However, existing lot line <br /> location will not allow property owner of lot 13 to expand garage to double <br /> car capacity without the need for an approximate 2' variance. <br /> SOLUTION: <br /> Both problems 11 and 662 above can be resolved to mutual benefit and satisfaction <br /> of both affected property owners by "redesignating" location of the common lot <br /> line per attached "sketch ". This proposed lot line redesignation will permit the <br /> owner of lot 663 to expand garage to approximate width of 21' staying within the <br /> requirement for the "code" established 10' side line set back and at the same time <br /> preserving the 10' set back for existing garage on lot 14. And, this lot line <br /> redesignation will allow property owner of lot 664 to maintain current locationof <br /> his shed and garden area and eliminate the now existing encroachment. <br /> (NOTE): Both property owners of lots 13 and 14 are aware there will be a need for <br /> "survey" work to accurately establish new location of lot line along with the need <br /> for new legal description to document this lot line change. All costs for these <br /> outside services to be shared equally by "then current" owners of lots 13 and 14. <br /> APPROVALS: <br /> The undersigned property owners of lots 13 and 164, block 2 of Burque addition 11 <br /> request the planning and zoning commission of Centerville, Minnesota review the <br /> above petition to allow common lot line redesignation as proposed (above) during <br /> their meeting scheduled for August 4, 1987 and pass a favorable recommendation to <br /> the City Council for their final approval at their meeting scheduled for August 5, <br /> 1987. Since any impact from the solution to the above described "problems" will <br /> be solely and totally inclusive on us as the affected property owners we cannot <br /> foresee nor do we anticipate any justifiable objection from any outside source(s). <br /> CONCURRENCE: <br /> We, the undersigned, being the legally established owners of lots 13 and 14, block <br /> 2, Burque addition 11, have a full and complete understanding of all of the above <br /> and share mutual agreement the above represents the only practical solution to <br /> both problems 11 and 12. Consideration from both the Centerville, Minnesota <br /> Planning and Zoning Commission and the City Council resulting in a final and <br /> favorable response will allow us (the respective property owners) to move forward <br /> in a manner best serving our collective /individual interests. <br /> Thank you. <br /> 4V MI <br /> (Owners of lot 13 block 12) (Owners of lot 14, block 12} <br /> Burque additi 11.
