r <br /> Pursuant to due call and notice thereof, the Planning and <br /> Zoning Commission of Centerville held a public hearing on <br /> July 1, 1986 at City Hall. Chairman Tourville called the <br /> meeting to order at 7:15 P.M. Present: Buesseler, Lindgren. <br /> Absent: Murray, Welk, Council Liaison. <br /> The purpose was to hear all persons present regarding a <br /> variance request to extend a garage outside the setback <br /> requirements of a corner lot at 1756 Peltier Lake Drive. <br /> Members of the audience expressed their opinion on this <br /> matter: <br /> Art Mohler, 1756 Peltier Lake Drive <br /> Ray Petersen, 7262 Main Street <br /> John Buckbee III, 3007 James Avenue North <br /> Motion by Buesseler, second by Lindgren to recommend to the <br /> City Council to grant a setback variance to Ordinance #4, <br /> Section 34.01 allowing a 14 foot addition be added to the <br /> garage on the Clearwater Drive side of 1756 Peltier Lake <br /> Drive, keeping the 50 foot setback off of Peltier Lake <br /> Drive, motion carried unanimously. <br /> This variance request seems to meet the required standards: <br /> - The lot configuration with the cul de sac on Clearwater <br /> Drive is unique to this property. <br /> - Literal interpretation would deprive him of rights <br /> enjoyed by others. <br /> - Granting this request will not confer special privi- <br /> leges. <br /> - This variance will not impair the property values, <br /> public health, safety or welfare of the residents of <br /> the City. <br /> In addition, average setbacks do not apply due to the unique <br /> location of this lot. Present: Buesseler, Lindgren. <br /> Absent: Welk, Murray, Council liaison. <br /> Motion by Buesseler, second by Lindgren to accept the minutes <br /> of the June 3, 1986 meeting, motion carried unanimously. <br /> Appearance of Ray Petersen, 7262 Main Street. Mr. Petersen <br /> was requested by the building inspector to appear with an <br /> application for a special use permit to operate a business <br /> out of his home. Discussion followed on whether or not this <br /> was in fact a home occupation or a home office. Mr. Petersen <br /> has a desk, file cabinet, typewriter and copy machine in his <br /> home, but performs the actual work of refurbishing dental <br /> equipment all over the United States, Canada and Mexico. <br /> No actual refurbishing is done at his residence. <br /> Commission member Buesseler was concerned that the Planning <br />
