This letter proposes a continuation of <br />this mutually beneficial arrangement by allowing the District to install and operate, at its sole <br />expense, a cantilever stream gauge to measure the height of the creek under varying conditions. <br />The gauge would also be located behind city hall. Please find the attached aerial photo providing <br />a general representation of the proposed location of the new equipment, as well as a concept <br />drawing of the gauge. The gauge is a precision instrument that requires a very solid foundation, <br />so to install the equipment a District contractor will need to be onsite for about 2 days to dig a <br />hole and pour concrete for a footing. Installation of the gauge would follow. Other than the <br />presence of the gauge, the area would be returned to materially its preexisting condition. If <br />existing vegetation is harmed during installation, the District will re -seed using a standard native <br />plant mix. After the gauge is installed, the District would be able to temporarily remove it from <br />the footing if circumstances require. <br />The District proposes to operate the equipment, once installed, and to impose no obligation or <br />duty upon the city beyond the exercise of reasonable care to avoid damaging or interfering with <br />the equipment. Operation of the gauge will require District staff to access the equipment <br />anywhere from 1 -4 times per month during the open water season. The District agrees to hold <br />harmless the city, its officers, employees and agents, from any costs, damages or liabilities of <br />any nature that are the result of any action or inaction by the District associated with the <br />installation and operation of the gauge. <br />Please indicate that the council has agreed to the installation and operation of the cantilever <br />stream gauge adjacent to Clearwater Creek by having a city representative with the requisite <br />authority sign in the space below, then retaining a copy of this letter agreement for your records <br />and returning a copy to the District. <br />■ <br />
