In addition, the business owners along 21 st Avenue are required to black top <br /> their parking lots when 21 st Avenue is paved. Therefore, Counciimember Buckbee suggested <br /> contacting the business owners on 21 st Avenue to inforna them of the potential assessment and <br /> black top requirements. Mr. Nyberg recommended tabling the issue. <br /> Councilmember Buckbee moved and it was seconded to table the 21 st Avenue u�Qrade. Motion <br /> carried unanimouslv. <br /> Tobacco Ordinance I � <br /> r �s. Gaustad addressed the proposed To�accc Q:dinance #E6. I��s. Gaustad stated the ardinarce <br /> was deveioped in accordance with the state laws and is similar to the �ircle Pines tobacco � <br /> ordinance. However, the ordinance has been tailored to the City of Centerville Ms. Gaustad � <br /> noted the ordinance meets with Acting Police Chief Joel Heckman's approval. In addition, all � <br /> license holders have been notified 30 days prior to CounciPs consideration. The Council diseussed the intension of �, <br /> the ordinance and procedures with violators. Ms. Gaustad commented on the state law which �� <br /> states: No vending macY�ines are allowed in establishments where children under the age of 18 i <br /> have access to the vending machine. Motion carried unanimouslv. <br /> Personnel Policv � <br /> NIr. March requested council direction on the interpretation of Personnel Policy, Section 11.2 <br /> Court Leave "Regular emplovees mav be absent with pa�when servin� jurv duty or when <br /> sub�oenaed as a witness in court or voiuntarilv servinQ as a witness in a case in which the City is a <br /> �artv" Mr. March noted the personnel policy does not indicate an allotment of time the City will <br /> pay for the above-mentioned leave. The Council requested legal councils' interpretation. Mr. <br /> Hellin�s understood the policy allows employees to be absent from work with pay if serving jury <br /> duty, subpoenaed or testifying on behalf of the City.
