Mrs. Dentz indicated that she was told by Ms. Bender that the matter was a civil matter <br />that the City would not get involved with. Mr. Palzer indicated it sounds like the <br />neighbor who has the fence thinks the fence is two feet off the property line. <br /> <br />Mr. Dentz indicated that the resident had the property surveyed and it is marked. He then <br />indicated that the fence runs right down the property line. <br /> <br />Mr. Palzer indicated the Committee may wish to look at how far back from the lake a <br />fence should be. Mr. Rehbein asked if the City should use the 75 feet from the lake for <br />fences as is used for structures. <br /> <br />Commissioner DeVine indicated that the problem is with enforcement. He then indicated <br />there are all types of issues and said it is very costly to hire an enforcement officer. <br /> <br />Council Liaison Broussard Vickers indicated that Mr. Palzer would check to see if the <br />owner of the fence feels that it is two feet off the property line. She then indicated if the <br />person agrees that it is on the property line then the City can proceed with enforcing the <br />Ordinance. <br /> <br />Mr. Jeremy Bates of 1977 South Robin Lane asked if a person needed a verbal agreement <br />to be allowed to place the fencing on the property line. Chairperson Hanson suggested <br />getting a written agreement for the fencing. <br /> <br />Diane Letender of 1397 Mound Trail indicated she would like to request a variance for a <br />lot split. <br /> <br />Chairperson Hanson indicated that Ms. Letender would need to come to City Hall to fill <br />out the paperwork and pay the fee required. He then indicated that a variance request <br />requires a public hearing that would be noticed for next month. <br /> <br />Commissioner McLean asked whether she wished to do a lot split or needed a variance. <br />Ms. Letender indicated she has enough property to split the lot on the lake side but is a <br />few feet short on the Mound Trail side so she thinks she needs a variance. <br /> <br />Commissioner DeVine suggested Ms. Letender stop into City Hall to ask Ms. Bender to <br />review the Ordinance to determine if it is a lot split matter or a lot split and a variance. <br /> <br />Commissioner McLean suggested verifying with staff but said he thought the minimum <br />lot width in R-2 was 80 feet. Mr. Palzer clarified that the minimum lot width in R-2 was <br />100 feet. <br /> <br />IV. OLD BUSINESS <br /> <br />1.
