Mr. Marcello expressed concern for changing the conservation district as he feels the area <br />should remain in a conservation district. <br /> <br />Council Liaison Broussard Vickers indicated that the Comprehensive Plan and the <br />Ordinance do not infer any special circumstances for the conservation district. <br /> <br />Mr. Lloyd Drilling of 7185 Mound Trail cautioned against removing the conservation <br />district designation because someone could go back to old aerial photographs of the area <br />and determine that it is not a natural wetland and it could be filled in. <br /> <br />Mr. Richard Thompson of 1657 Peltier Lake Drive indicated the City of Centerville runs <br />across part of Peltier and Centerville lakes and asked what the lake is zoned. <br /> <br />Chairperson Hanson indicated the DNR controls all the water in the state. He further <br />indicated that all water is publicly owned. <br /> <br />Mr. Al LaMotte commented that removing the conservation district leaves the possibility <br />that someone could put something in there. <br /> <br />Ms. Joan Sturgeon of 7257 Centerville Road indicated she did not want the City to take <br />away the conservation district as she enjoys the wetland and the wildlife it brings to her <br />backyard. <br /> <br />Commissioner DeVine indicated the Commission did not intend to impact any of the <br />things mentioned by Ms. Sturgeon with its proposed changes. He then commented that <br />the land is under water and not buildable. <br /> <br />Commissioner DeVine commented that Mr. Marcello and Mr. Drilling had raised a valid <br />concern regarding elimination of the conservation district that should be considered <br />before proceeding. <br /> <br />Mr. Ted Irkenback of 7377 Peltier Circle expressed concern that removing the <br />conservation district and replacing it with R-1 zoning would mean that someone could <br />build too close to the creek. Chairperson Hanson indicated that Rice Creek Watershed <br />District would govern building in the floodway. <br /> <br />Mr. Irkenback of 7377 Peltier Circle indicated he is concerned for the impact the change <br />would have on wildlife and concerned that the change would allow encroachment into the <br />creek area by developers. <br /> <br />Commissioner Wilharber indicated the whole area is in the flood plain which is <br />controlled by the Army Corp of Engineers, the Department of Natural Resources, and <br />Rice Creek Watershed District. He further commented that anything existing in the flood <br />plain, if destroyed, cannot be rebuilt. <br /> <br />Page 10 of 24 <br /> <br />
