If the Property or any portion thereof Is sold or trenaferred to a third party, the <br />special assessment as to that portion of the Property is due in f A. The Owners wilt retain the <br />right to a deferred payment of the special assessment for any portion of the Properly remaining <br />In their possession until the expiration of the period of deferment. <br />b.) After the period of the deferment expires, the special assessment, or any remaining <br />portion thereof, will be due and payable with the property bum beginning In 2015. <br />c.) Exoept as specifically stetted herein, payment of this special assessment shalt be <br />governed by Minnesota Statutes Chapter 429. <br />5.) The Owners waives any rights of appeal available pursuant to Minnesota Statute <br />Section 429.081. These rights include but are not Limited to waiving the right to appeal this <br />special assessment to a Court; waiving any daim that the special assessment exceeds the <br />benelit to the Property; and waiving all procedural and substantive objections to the 2009 Street <br />Improvement Project or special assessment. <br />B.) This Agreement shah be binding upon the Owners, and sueoessom or assign to the <br />Property. This Agreement may be recorded against the We to the Property. <br />7.) The Owners must sign this document before a notary, and it must be received at the <br />Centerville City Hall, 1880 Main Street, Centerville, MN 55038, 651 -3232, before the close <br />of business on February 25, 2009, otherwise the Agreement is null and void. <br />8.) Before signing this Agreement, the Owners have had the opportunity to seek <br />independent legal advice about the content and effect of entering Into this Agreement.
