May 23, 2001 <br /> Council Meeting Minutes <br /> following Council Member Capra's suggestion, the developer would need to completely <br /> modify his plans. <br /> Mr. March stated that he suggested to Mr. Quigley to attempt to resolve the issue <br /> regarding maintaining Ojibway Drive prior to coming before Council. Mr. March <br /> suggested tabling this matter in an attempt to allow ample time for the meeting to occur. <br /> Council Member Broussard Vickers stated that most of the residents were unaware or did <br /> not understand the issues surrounding being responsible for a private street. Council <br /> Member Broussard Vickers stated that while these issues are civil issues, she feels if the <br /> City were to take responsibility for the road it would go a long way toward smoothing the <br /> way for the rest of the development. <br /> Mr. March stated that other communities have private streets and in his opinion, the City <br /> did not make a mistake with the original development and the private street. In Mr. <br /> March's opinion there would not be an issue if residents were members of one (1) <br /> association rather than two (2) or three (3). <br /> Mayor 5wedberg questioned whether Voyager Court was also a private road. Mr. March <br /> concurred. <br /> Council Member Nelson stated that she felt if the City assumed Ojibway Drive, it would <br /> - be setting a precedence. <br /> Council Member Capra stated that she had concerns with the width of the road. <br /> Mr. Hoeft stated that appears that the town home associations are trying to take the easy <br /> way out and request that the City assume responsibility for Ojibway Drive rather than <br /> coming to a mutual agreement between themselves. Mr. Hoeft stated that he does not <br /> mean to say that the request is inappropriate, but sees the matter as the City inheriting a <br /> potential problem. Mr. Hoeft recommended that the City look at what is in the best <br /> interest of the City as a whole, rather than the town home associations. <br /> Council Member Capra questioned whether the City had taken over any private roads in <br /> the past. Mr. March stated that the City had not. <br /> Motion � Mayor Swedberg, seconded by Council Member Capra to table this <br /> matter for further information. All in favor. Motion carried unanimouslv. <br /> 2. 21 Avenue Update <br /> Mr. March stated that he had scheduled a meeting with representatives from the City of <br /> Lino Lakes to discuss the feasibility report for this project. Mr. March stated that one (1) <br /> of the issues discussed is the fact that the City never signed the Joint Powers Agreement. <br /> Mr. March stated that the Joint Powers Agreement will be revised to take into <br /> consideration the City's standards for roadways and presented to Council for review. <br /> Page 4 of 12 <br />
