_ _ <br /> February 15, 2001 <br /> Council Meeting Minutes <br /> Council Member Capra questioned Mr. Peterson whether there would be enough "line of <br /> � sight" around the trees located in the front corner of the buiiding. Mr. Peterson felt that <br /> there would be based on the presented plan. Mr. Drilling stated that the trees could be <br /> moved if deemed appropriate by the County. <br /> Council Member Capra questioned whether Council would be reviewing the Developer's <br /> Agreernent presented at the previous Council meeting. Mr. March sta.ted he had copies of <br /> the document with the blanks filled in and reviewed same. Mr. March stated that Council <br /> would be given copies of the document for review prior to considering same at the next <br /> meeting. <br /> Council Member Capra questioned whether an eight (8) foot wide trailway meets City <br /> requirements. Mr. March explained that an eight (8) foot trailway is standard throughout <br /> the community and a ten (10) foot wide trailway is reserved for major east/west trails. <br /> Mr. March stated he had given the Anoka County trail information to Mr. Drilling's <br /> architect. <br /> Mr. March stated that Council needed to indicate a dollar amount for trail improvements <br /> to be made to the previously installed trail at the Apple Tree Square facility. <br /> Mr. Drilling questioned whether repairs to the trail were included in the Developer's <br /> Agreement for this properry. Mr. March explained Council wanted to see the trailway , <br /> completed in conjunction with this project. Mr. Drilling stated that he did not have a <br /> problem with same; however, additional factors may need to be considered, i.e., Anoka � <br /> County and the Rice Creek Watershed District. Mr. March stated he would like to <br /> escrow a dollar amount for completion of the trail and if the trailway was not completed, I <br /> the City could draw on the letter of credit. Mr. Drilling stated that he was unprepared for <br /> the City to tie the trailway project with the proposed project. Mr. Drilling questioned the <br /> estimated cost of same. <br /> Mr. March sta.ted that Mr. Peterson would provide the dollar amount for the trailway <br /> project. <br /> Mr. Drilling stated he was willing to spend $5,000 if the City was willing to contribute <br /> the remainder to complete the project. Mr. Drilling stated that he did not feel it was fair <br /> to tie this project in with the proposed project due to the trail being insta.11ed to standards <br /> and City requirements not being presented to him prior to installation. Mr. Drilling <br /> requested that the City remove the trailway repairs from the Developer's Contract. Mr. <br /> Drilling stated his willingness to work in conjunction with the City on the trailway and <br /> suggested that the City agree to a completion date of June 1, 2003 for the trailway. <br /> Council Member Capra questioned the appropriate action to be taken on this matter. Mr. <br /> Peterson sta.ted that trailway is not in the Anoka County right-of-way. Mr. March stated <br /> that Anoka County had stated that they would not require the ditch to remain there if the <br /> City uses a piping that meets their drainage requirements. <br /> Mayor Swedberg questioned whether approval of the site plan hinged on the western <br /> trailway issue being resolved. Mr. March stated that once the City approves the plan, the <br /> only assurance of completion of the western trailway would be Mr. Drilling's word that <br /> he will complete it. <br /> Page 5 of 18 <br />
