Public Works Staff/LTnion Agreement
Motion bv Council Member Nelson seconded by Council Member Travis to table this item
for discussion at an executive session following the regular meeting. All in favor Motion
carried unanimously.
Hasiak Buildin Permit
Mr. March explained he had heard from the Hasiak's who had informed him they did not wish to
obtain a building permit due to financial constraints at this time of year.
Mr. Hoeft stated he had spoken to Mr. Palzer concerning the matter and it is unclear as to whether
or when the Hasiaks would obtain the buildzng permit. The City does have the legal remedy to
begin the process to declare the building a hazardous structure, which would require the Hasiaks to
either get the permit and have the wiring inspected or risk having the City tear down the building.
Mr. Hoeft recommended setting a timeline for the Hasiaks to obtain the building permit and then '
commencing a hazardous building action should the Hasiaks not obtain the permit.
Council Member Sweeney suggested a six (6) month time limit be set for the Hasiaks to obtain the
permit.
Council Member Broussard Vickers questioned whether the lean to had been torn down. Mr.
March indicated that it had not.
Council Member Broussard Vickers questioned if Staff believed the structure to be a hazard and
Mr. Hoeft stated that staff has been unable to inspect same without a building permit.
Council Member Broussard Vickers questioned the distance to the nearest house from the
structure and if the City had any legal liability in the case of a fire. Mr. Hoeft stated that there had
been no problems up to this point and no inspections had been completed.
Council Member Broussard Vickers stated she could understand not wanting to pay for the permit
but did not understand why the "lean to" had not been removed. Council Member Broussard
Vickers stated she did not believe there had been any good faith on the part of the Hasiaks. Mr.
March stated he had been told the Hasiaks were considering leaving the "lean to" up for a dog
shelter.
Council Member Sweeney stated it was his understanding the "lean to" was to be removed.
Mayor Wilharber suggested sending a registered letter to the Hasiaks giving them a time period to
obtain the building permit and informing them the "lean to" would need to be torn down
immediately.
