<br />~" <br /> <br />r <br /> <br />~SOLUTION VACATING CERTAIN STREET AND <br />UTILITY ~ASEMENTS <br /> <br />WHEREAS, . a majority of the owners of property abutting on the <br />street and utility easements described below have requested <br />the City Council in a petition dated the 13th day of August, <br />1981, to vacate such street and utility easements according <br />to law; and <br /> <br />WHEREAS, a public hearing was held before the City Council <br />in the City Hall on January 13, 1982, continued January 27. <br />1982, continued February 17, 1982, on such petition after <br />due published and posted notice had been given by the Clerk <br />on December 3 and 10, 1981, and all persons interested were <br />given an opportunity to be heard; and <br /> <br />WHEREAS, it appears that it will be for the best interest <br />of the City to approve such petition. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that such petition is hereby <br />granted and the street and utility easements described as <br />follows and hereby vacated. <br /> <br />PARCEL A <br /> <br />A permanent easement and right-of-way for the purpose of <br />installation, inspection, repair, and maintenance of a sanitary <br />sewer system, including but not limited to, the laying of pipe. <br />installing manholes, and other appurtenances for a sanitary <br />sewer system, over that part of the fOllowing described parcel. <br /> <br />That part of Lots 6, 8 & 9, AUDITOR'S SUBDIVISION NO. ~7, Anoka <br />County, Minnesota which lies within a 40 foot strip of land 20 <br />feet on each side of the following described line. Beginning <br />at the Northeast corner of Lot 10, said Auditor's Subdivision <br />No. 47; thence on an assumed bearing of North 89 degrees 22 <br />minutes 44 seconds West along the North line of said Lot 10, <br />a distance of 296 feet; thepce Westerly 195.95 feet along a <br />tangential curve concave to. the North having a radius of 398.17 <br />feet and a central angle of 28 degrees 11 minutes 48 seconds; <br />thence Westerly 195.95 feet along a reverse curve concave to the <br />South having a radius of 398.17 feet and a central angle of <br />28 degrees 11 minutes 48 seconds; thence North 89 degrees 22 <br />minutes 44 seconds West and tangent to said reverse curve a . <br />distance of 650 feet; thence North 0 degrees 37 minutes 16 <br />seconds East 30 feet; thence Northerly along a tangential curve <br />concave to the West having a radius of 175 feet, an arc distance <br />of 110 feet, more or less, to the Southeasterly line of Tract <br />"D", Registered Land Survey No.5 and there terminating. <br /> <br />PARCEL B <br /> <br />A permanent easement for road and utility purposes over the <br />following described parcel. <br /> <br />'---' <br /> <br />I <br /> <br />I <br />I <br />I <br />\ <br />
