City of Centerville <br />Planning and Zoning Commission <br /> <br />Motion by Commissioner Parrucci, seconded by Commissioner Larson that <br />the Commission appoint Tom Wood as vice-chair of the P&Z. All in favor. <br />Motion carried <br /> <br /> <br /> <br />B. Residential Accessory Structures and Setbacks. The Commission reviewed a draft <br />code change that would allow accessory buildings to be 5 feet from interior side lot <br />lines. Definitions would change to treat attached garages in the same manner as <br />detached garages for the purpose of interior side-yard setback. The Commission felt <br />other restrictions that accessory buildings be limited to 2% of total lot area or 200 <br />square feet is too restricted and should be removed. The primary restriction on <br />accessory building (attached or detached) would be that the combined square footage <br />could not exceed the footprint of the main floor of the dwelling. The Commission <br />determined that the roof overhang should not be permitted to encroach into the five- <br />foot setback, if a drainage easement existed along the property line. <br /> <br />Motion by Commissioner Wekseth, seconded by Commissioner Lange that the <br />Commission hold a public hearing to consider the code changes at the next <br />meeting and that notice be given accordingly. All in favor. Motion carried <br /> <br /> <br /> <br />C. Nonconforming uses. The Commission discussed the input that was received from <br />the public this evening. The Commission reviewed a memo from City Attorney Glaser <br />outlining possible actions to permit more flexibility for nonconforming uses. The <br />suggestion was that an increase in the use be permitted to 25% of the footprint of the <br />dwelling as existed on May 23, 2006, which is the date that the downtown plan was <br />approved and the current zoning districts were established. Olaf Lee, 1724 Heritage <br />Street was present. Mr. Lee suggested that 25% isn’t high enough. After some <br />discussion the Commission suggested 33%. Some changes were suggested to the <br />accessory building regulations. It was then suggested that nonconforming uses be <br />allowed to construct accessory buildings as would otherwise be allowed if the property <br />was in a R-2 zoning district. <br /> <br />Motion by Commissioner Wood, seconded by Commissioner Lange that the <br />Commission draft a proposed ordinance amendment that would implement a <br />33% expansion of nonconforming uses and would allow accessory buildings <br />per residential R-2 regulations. All in favor. Motion carried <br /> <br /> <br /> <br /> <br /> <br />B.Zoning to conform to Comprehensive Guide Plan. <br /> <br />The Commission reviewed a memo from Tina Goodroad, Planner for Bonestroo, <br />suggesting certain zoning changes to conform to the new Comprehensive Plan. <br />Specifically, the plan directs that certain areas be changed from low to medium density <br />Page 2 of 3 <br /> <br />
