Anoka County Contract No. 2010 -05 ?? JOINT POWERS AGREEMENT FOR THE CONSTRUCTION OF REGIONAL TRAIL LINKS IN THE CITY OF CENTERVILLE COUNTY PROJECT NO. S.P. 02- 090 -01 THIS AGREEMENT is made and entered into this day of , 2009, by and between the County of Anoka, a political subdivision of the State of Minnesota, 2100 Third Avenue, Anoka, Minnesota 55303, hereinafter referred to as "County ", and the City of Centerville, 1880 Main Street, Centerville, Minnesota, 55038, hereinafter referred to as the "City ". WITNESSETH WHEREAS, the parties to this agreement agree it is in the best interest of the public to construct an improved trail system throughout the City of Centerville, hereinafter referred to as the "Project "; and, WHEREAS, the parties to this agreement consider it mutually desirable to proceed with the construction, and construction engineering & administration for the reconstruction of the Project; and, WHEREAS, the City has jurisdiction over said regional trail system; and, WHEREAS, the City has applied for and obtained Federal Funds for the construction; and, WHEREAS, the County administer the construction of the Project given the City is less than 5,000 and not able to receive federal funds directly; and, WHEREAS, the parties agree that it is in their best interest that the cost of said land acquisition required for the Project be borne by the City; and, WHEREAS, the parties agree that it is in their best interest that all costs of the construction of the Project be borne by the City; and, WHEREAS, Minn. Stat. § 471.59 authorizes political subdivisions of the state to enter into joint powers agreements for the joint exercise of powers common to each.
