Anoka County Contract No. 2010 -05 ?? <br />JOINT POWERS AGREEMENT <br />FOR THE CONSTRUCTION OF REGIONAL TRAIL LINKS <br />IN THE CITY OF CENTERVILLE <br />COUNTY PROJECT NO. S.P. 02- 090 -01 <br />THIS AGREEMENT is made and entered into this day of , <br />2009, by and between the County of Anoka, a political subdivision of the State of Minnesota, <br />2100 Third Avenue, Anoka, Minnesota 55303, hereinafter referred to as "County ", and the <br />City of Centerville, 1880 Main Street, Centerville, Minnesota, 55038, hereinafter referred to <br />as the "City ". <br />WITNESSETH <br />WHEREAS, the parties to this agreement agree it is in the best interest of the public to <br />construct an improved trail system throughout the City of Centerville, hereinafter referred to as <br />the "Project "; and, <br />WHEREAS, the parties to this agreement consider it mutually desirable to proceed with <br />the construction, and construction engineering & administration for the reconstruction of the <br />Project; and, <br />WHEREAS, the City has jurisdiction over said regional trail system; and, <br />WHEREAS, the City has applied for and obtained Federal Funds for the construction; <br />and, <br />WHEREAS, the County administer the construction of the Project given the City is less <br />than 5,000 and not able to receive federal funds directly; and, <br />WHEREAS, the parties agree that it is in their best interest that the cost of said land <br />acquisition required for the Project be borne by the City; and, <br />WHEREAS, the parties agree that it is in their best interest that all costs of the <br />construction of the Project be borne by the City; and, <br />WHEREAS, Minn. Stat. § 471.59 authorizes political subdivisions of the state to enter <br />into joint powers agreements for the joint exercise of powers common to each. <br />NOW, THEREFORE, IT IS MUTUALLY STIPULATED AND AGREED: <br />PURPOSE <br />0.0, <br />
