City of Centerville <br />Res. #10-0;e� <br />A RESOLUTION RECEIVING BIDS AND MAKING A CONDITIONAL <br />AWARD AND AUTHORIZING A CONTRACT FOR CONSTRUCTION OF <br />IMPROVEMENT PROJECT <br />WHEREAS, pursuant to an advertisement for bids for the improvement of <br />approximately 25 residences by connection to city watermain the following bids were <br />received: <br />NAME OF BIDDER AMOUNT OF BID <br />Midwest Landscaping and Excavating $122,670.00 <br />GM Contracting $162,208.38 <br />Forest Lake Contracting $185,070.00 <br />WHEREAS, the city anticipates receiving Community Development Block Grant funds <br />from Anoka County to pay for the costs of the project, such approval is anticipated on <br />September 29, 2010. The aforementioned Grant calls for the City's contractor to <br />comply with disadvantage business solicitation requirements. <br />WHEREAS, Midwest Landscaping and Excavating did not appropriately respond to <br />material bid specifications relating to the contract deposit and disadvantaged business <br />solicitation. The variances from the bid specifications contained in the bid from <br />Midwest Landscaping and Excavating give it -a substantial and unfair advantage over <br />the other bidders, and thus is nonresponsive, and <br />WHEREAS, GM Contracting of Lake Crystal, Minnesota, is the lowest responsive, <br />responsible bidder, and. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />CENTERVILLE, MINNESOTA: <br />1. Award of this bid is delayed until such time as Anoka County issues a written <br />approval of Community Development Block Grant funds for this project. <br />2. Upon the City's receipt of written confirmation of the grant funding by the Anoka <br />County, this bid is awarded to GM Contracting, and without further action of the <br />Council, the mayor and clerk are hereby authorized and directed to enter into a contract <br />with GM Contracting in the name of the City of Centerville for the aforementioned <br />improvement according to the plans and specifications therefore approved by the <br />Council and on file with the City Clerk. <br />
