<br />TYPICAL MINNESOTA STATUE 429 <br /> <br />IMPROVEMENT PROJECT PROCESS <br /> <br />1. Project Initiation <br />a. Petition of more than 35 percent of affected property owners. <br />b. Unanimous petition of affected property owners. <br /> <br />b. City Council action. <br /> <br />2. Resolution of City Council ordering preparation of report on <br />improvement and declaring adequacy of petition if appropriate. <br /> <br />Note: This resolution should be published in the official newspaper <br />after adoption. Unless there is a challenge to the deter- <br />mination of adequacy within 30 days, the determination can <br />not be challenged in the future. <br /> <br />3. Engineer's Report <br /> <br />a. Feasibility of proposed improvement. <br /> <br />b. Whether improvements should be made as proposed or with other <br />improvement. <br /> <br />c. Cost of improvement as recommended. <br /> <br />4. Resolution of City Council receiving the feasibility report and <br />calling for hearing on the improvement. <br /> <br />Note: If 100% of affected property owners petition for the improve- <br />ment, they may also waive their rights to this public hearing. <br /> <br />5. Notice of Public Hearing <br /> a. Time and place of hearing. <br /> b. Genera 1 nature of improvement. <br /> c. Estimated cost of improvement. <br /> d.
