Res. #10- 0,Z17 <br />A RESOLUTION APPROVING JOINT SETTLEMENT AGREEMENT & <br />STIPULATION FOR DISMISSAL WITH PREJUDICE <br />WHEREAS, the City of Centerville took property rights for the Centerville Regional <br />Trail Link Project through a condemnation action, and <br />WHEREAS, property owner David Fisher appealed that condemnation action, and <br />WHEREAS, the parties have reached an agreement for settlement, attached hereto as <br />Exhibit A, "Joint Settlement Agreement and Stipulation for Dismissal with Prejudice." <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF <br />CENTERVILLE, MINNESOTA: <br />The Council hereby approves the Joint Settlement Agreement and Stipulation for <br />Dismissal with Prejudice attached hereto, and the Mayor and Clerk are authorized to <br />execute the agreement and make payment according to its terms. <br />Adopted by the City Council this,& <br />�`day of October, 2010. <br />C 641' <br />Mary C Mayo <br />__ <br />Teresa Bender, Clerk <br />
