scheduled meeting on November 9, at 6:30 p.m.

I. CALL TO ORDER. The meeting was called to order by Chairman Mosher.

1. Proposed Code amendment to permit hydro-seed as an alternative to sod.
The Commission again reviewed a draft ordinance amending the City Code to
permit use of hydro-seed as an alternative to sod in some situations. No changes
were suggested. The Commission previously granted authority to notice for a
public hearing.
2. I-1 Uses - Latitude to decide if a use is similar to listed uses and therefore
determined to be permitted.
Dallas Larson reported that the City Attorney recommended a different way to give
the Commission some discretion in determining permitted uses. The attorney
recommended that the authority be placed in the district provisions for B-1 and I-1
districts. Draft language was reviewed by the Commission.

Motion bv Commissioner Larson, seconded bv Commissioner Wood to
schedule a public hearing on the proqosed code amendments. Voting in favor:
Lee, Flint, Mosher, Larson & Wood. Voting asainst: None. Motion nassed.
3. Updating zoning to correspond with the Comprehensive Plan.
Commissioners at the last meeting agreed that informal meetings should be held
with affected property owners before scheduling the formal public hearing. No
meetings had yet been scheduled. Staff will schedule informal meetings by the end
of December so the hearing can be scheduled for early next year.
IV. NEW BUSINESS.
1. Variance Application —1540 Peltier Lake Drive (Garage Construction)
The Commission reviewed an application for Variance from Derek Gavin, 1540
Peltier Lake Drive, to construct a garage on an existing slab that is approximately
six feet from the side property line. Anoka County had purchased right of way
from this property and in the process closed the driveway access to CSAH 14 and
constructed a new driveway to Peltier Lake Drive. Mr. Gavin wants to construct a
new garage on the existing slab, if it meets the building code. He should know that
by next week.
Motion bv Commissioner Larson, seconded bv Commissioner Mosher that the
Commission authorize a nublic hearin� at the next meeting to consider the �
pronosed variance. Voting in favor: Lee, Flint, Larson. Mosher & Wood.
Voting against: None. Motion passed.

It was noted that, due to the official paper being a bi-weekly publication, the next
meeting may need to be moved to meet the timelines for publication.
V. DISCUSSION ITEMS
It was noted that Matthew Montain has applied to Council to be appointed to the Planning
and Zoning Commission. He is scheduled for an interview with Council on November 10.
If he is appointed, the Commission will be back to full strength.
Administrator Larson reviewed the Anoka County Broadband project noting that the route

A variance is a use that is not generally permitted by the City's zoning ordinances but which is
allowed in special cases only. A request for a variance from the City's zoning ordinances will be
granted upon a showing of undue hardship by a property owner who is determined to have a unique
situation. "Undue hardship" means that the property cannot be put to a reasonable use if the
conditions of the zoning ordinances are followed, that the property owner's particular circumstances I
are unique and not self-created, and that granting a variance will not alter the essential character of
the locality or neighborhood. Economic hardship alone will not constitute undue hardship if some
reasonable use currently exists under the terms of the City's zoning ordinance. If the property
owner purchased the property knowing that the City's zoning ordinances prohibited a use, the �
property owner's circuxnstances are self-created.
Minnesota Statutes (MS 462.357, Subd..6) and City Code 156, Section 156.310 requires that the
following conditions must be satisfied for approval of this request. Please respond to these
conditions using additional sheets of paper if necessary.
1. Because of the particular physical surroundings, shape or topographical
�conditions of the parcel or lot, the proposed variance would relieve an undue
hardship, as distinguished from a mere inconvenience, should the applicable
ordinance be strictly enforced.
2. The purpose of the proposed variance is not based exclusively upon a desire to
increase the value or income potential of the parcel of land, but would correct
extraordinary circumstances applicable to this property but not applicable to other
property in the vicinity or zoning district.
3. The alleged difficulty or hardship is caused by the City Ordinance and has not
been created by any persons presently having an interest in the parcel of land.
4. The variance will not adversely affect public health, welfare and safety and will
not be detrimental or injurious to property or improvements in the neighborhood.
5. Variances will not be granted that allow a use that is otherwise not a permitted use
in the zoning district that the subject property is located.

A variance request is being submitted so that I may build a garage using the
existing concrete slab that my former garage was located on. As it is now, the corner of
the garage would be located aproximately eight feet from my property line.
Upon purchasing my home it was disclosed to me that a new intersection would
be completed on the corner of my lot. The disclosure papers that I recieved stated that I
should contact Mike Kelly for further details. I contacted Mr. Kelly and it was explained
to me that during this project Anoka County would like to relocate my driveway location
from C.S.A.H. 14 to Peltier Lake Drive. It was agreed that a new driveway would be put
in, and the existing garage entrance would be switched around to face the appropriate
side. After receiving several bids on the work to be done, it was decided that it would
make the most sense to put forth my own money in addition to the money coming from
Anoka. County to tear down the old garage and build a newer, updated garage in the same
location. After demolishing the old garage, I applied for a building permit only to find out
that the location was not within the boundaries as required by the City of Centerville.
My plans are to build a new updated garage that will be more appropriate by
todays standards and that will also enhance the appearance and properly value of my
home. Although the location is not within the required boundaries, I do not believe it
wonld interfere or be disruptive in any sort of a negative fashion. It would still be
fourteen feet from the road, located in position thats appropriate to the location of the
home, sized to match the lot, and have siding, color, and trim that will match up to the
existing house. Furthurmore, having the building in this location would allow misc.
storage such as a boat, construction equipment or trailer, to be located on the inside of the �
lot instead of the side closest to C.S.A.H. 14. This too would enhance the appearance of
the lot by keeping clutter out of sight from all the passerbys on 14 and the adjoining
sidewalk.
I do not believe the situation I'm facing is by my own doing nor would it impact
the neighborhood or surrounding properties.

NOTICE IS HEREBY GIVEN that the Planning and Zoning Commission of the City of
Centerville, Minnesota will be meering and considering resident input regarding proposed
City Code modifications to Chapter 153, Section 153.44, J, Chapter 156, Section
156.030, K, and Section 156.040, N and a variance request for 1540 Peltier Lake Drive to
be allowed to construct an accessory structure on an existing cement slab with footings
encroaching the required set back T'he amended language is as follows:

ADDING NEW LANGUAGE: Hydro-seeding may be substituted for sod subject to: 1)
Two rows of sod shall be placed along the curb and any other adjoining pavements,
erosion control as approved by the Building Off'icial shall be placed at the property lines
and next to water features. 2) An automated in-ground irrigation system shall be in place
and 3) the site deposits shall be retained until the vegetation is fully established. This
shall not prevent a developer from establishing lot covenants requiring sod, in which case
this substitution shall not be allowed.
