§ 90.01 DEFINITIONS.
For the purpose of this chapter, the follo�ving definitions shall apply unless the
context clearly indicates or requires a different meaning.
ANIMAL. Any mammal, reptile, amphibian, fish, arachnid, birds (including all fowl
and poultry) or other member commonly accepted as a part of the animal kingdom.
Al�'IMALS shall be classified as follows:
(1) Domestic. DOMESTIC Al�'IMALS shall mean those animals commonly
accepted as domesticated household pets. Unless other��ise defined, these animals shall
include dogs, cats, caged birds, gerbils, hamsters, guinea pigs, white mice and rats,
ferrets, domesticated rabbits, fish, nonpoisonous, non-venomous and non-constricting
reptiles or amphibians and other similar animals.
(2) Nondomestic. 11'ONDOMESTIC ANIMALS shall mean those animals
commonly considered to be naturally wild and not naturally trained or domesticated, or
which are commonly considered to be inherently dangerous to the health, safety and

(a) Any member of the large cat family (family felidae) including lions,
tigers. cougars, bobcats, leopards and jaguars, but excluding commonly accepted
domesticated house cats;
(b) Any naturally wild member of the canine family (family canidae) �
including ���olves, foxes, coyotes, dingoes and jackals, but excluding commonly accepted
domesticated dogs; �
(c) Any crossbreeds such as the crossbreed between a wolf and a dog. I
unless the crossbreed is commonly accepted as a domesticated house pet; �
(d) Any member or relative of the rodent family including any skunk �
(whether or not de-scented), raccoon or squirrel, but excluding those members otherwise
defined or commonly accepted as domesticated pets;
(e) Any poisonous, venomous, constricting or inherently dangerous
member of the reptile or amphibian families including rattlesnakes, boa constrictors, pit
vipers, crocodiles and alligators; and
(t) Any other animal which is not explicitly listed above but which can be
reasonabl�� defined by the terms of this definition, including but not limited to bears, deer,
monkeys and game fish.

§ 90.05 FARA? ANIMALS.
Farn� animals shall only be kept in an agricultural district of the city or on a
residential lot of at least ten acres in size, provided that no animal shelter shall be within
300 feet of an adjoining piece of property. Except that honev bees may be kept in other

THE CITY COUNCIL OF THE CITY OF CENTERVILLE ORDAINS:
Section L City Code Chapter 90, Section 90.01 is hereby amended by substituting
the following definitions for definitions with the same name:

and turkeys), fowl (ducks and geese), swine (including Vietnamese pot-bellied ��
pigs), goats, honey bees and other animals associated with a farm, ranch or
stable.
Section 2. City Code Chapter 90, Section 90.05, is hereby amended to read as follows:

Series, entitled "AN ORDINANCE AMENDING CITY CODE, CHAPTER 90, was
adopted by the City Council of Centerville, Minnesota.
Notice is further given that due to the lengthy nature of the ordinance, the City
Council has directed that this title and summary be prepared for publication pursuant to
Minn. Stat. 412.191, Subd. 4.
1�'otice is further given that a complete printed copy of the ordinance is available
for inspection by any person during normal business hours of the City Clerk, 1880 Main
St., Centerville, MN, or will be mailed to anyone requesting it by telephone (651) 429-
3232.
NoNce is further given that the general purpose of the ordinance is to amend the
code as it relates to keeping of honeybees in the city.
Section 1. This section amends the definition of non-domestic and fann animals
to define honeybees as farm animals.
Section 2. This section amends the regulations to allow keeping of honeybees in
residential areas of the city, subject to conditions.
Section 3. This section provides that the effective date shall be upon publication
of this summary.

Honey bees may be kept in other residential areas subject to the following conditions:
1. Lot size shall be a minimum of one-half acre.
2. No more than two honey bee colonies (hives) shall be allowed in the first year of
beekeeping. If no nuisance complaints are received by the city from the beekeeper's
neighbors during the initial year, the number of honey bee hives may be expanded
based on property size as follows:
• 2 hives on one-half acre
� 4 hives on three-quarters of an acre
• 6 hives on three-quarters to one acre
• 8 hives on one to five acres
[This proposed amendment provides a trial period in which the new beekeeper demonstrates
the ability to manage honey bees safely. The suggested number of hives based on property
size is the same as that allowed in the Minneapolis ordinance.]
If a beekeeper captures a swarm of honey bees, the bees may be kept on the
beekeeper's property temporarily without violating restrictions on the number of
allowed hives.
[When a hive duplicates itself, a mass of bees (a "swarm") collects near the original hive
while the bees locate a new home. This provision allows a beekeeper who already has the
maximum number of hives to capture a swarm and keep it until a suitable location is found.]
3. Hives shall be set back from property lines a minimum of 25 feet.
4. Permission must be obtained from owners of all property abutting the proposed site.
[Suggested rewording and clarification based in part on the Minneapolis ordinance] To
receive an initial permit from the City, new beekeeping applicants must receive
permission from (a) 100 percent of abutting homeowners who have homes and
maintained yard space within 150 feet of the hive(s), and (b) 75 percent of abutting
homeowners who have homes and maintained yard space greafer than 150 feet from
the hive(s).
[This provision takes into account the actual location of the hives relative to their distance
from a neighbor's house and maintained yard space. While permission should of course be
obtained from all neighbors closest to the hives, gaining permission from those whose homes
and living spaces are farther away (especialiy when undeveloped or wild spaces intervene)
should not carry the same weight as those who live closer to the hives.]
5. A permit shall be obtained from the city with payment of a fee as noted in the city fee
schedule.
6. The applicant must document either having received formal training in
beekeeping from a recognized institution or organization or have previous experience
in beekeeping.
[Setting a specific number of hours of training is an arbitrary requirement, since there is no
standardized training for beekeepers and respected institutions or organizations might offer
courses of different lengths yet achieve the same outcome. The ordinance should also
recognize that people may already have previous experience in beekeeping and not need
training.)

THE CITY COUNCIL OF THE CITY OF CENTERVILLE ORDAINS:
Section 1. City Code Chapter 156, Section 156.030 is hereby amended by adding a

(1) Industrial uses that existed on a site in the I-1 Industrial district as a legal,
fully conforming use prior to the site being rezoned from I-1 to B-1, may
continue and be expanded on that site as if located in an I-1 District until the
use is changed to a use that is permitted in this district. After it is changed to
a use permitted the B-1 district, it may not thereafter be used except as
permitted in this district. Where the proposed change from I-1 to B-1 has
been initiated by the City, the Planning and Zoning Commission shall
simultaneously with making such zoning change, determine whether such
parcel is a fully conforming industrial use qualifying for interim use status.
Where a positive determination is made, the action shall be filed with the
Anoka C'ounty Recorder.
Section 2: Effective Date: This ordinance shall be effective immediately upon its passage
and publication, according to law.

(A) Pur�ose. It is intended that the B-1 District provide opportunities for retail and
� service business uses which require larger development sites, l�igh���ay visibility or
highway access.
(B) Ge�aeral mr�nin�um reyuirements. The following ininimum requirements, as set
forth, shall apply to all buildings that may be erected, converted or structurally altered in
commercial districts.
(C) Off-sn•eet parki�rg. Off-street parking shall be provided as required in ttiis
chapter.
(D) Bu�ferzo�ie bcnr�en comn7ercial cmd residcntial dist��icts. Where a commercial
district abuts a residential district, any new development shall include a buffer zone.
There shall be a protective strip of not less than ten feet in width. This protective strip
shall contain no structures, shall not be used for parking off-street loading or storage, and
shall be landscaped. The landscape treatment shall include a compact screen wall or
fence, but shall not extend within 15 feet of the street right-of-way. The planting or fence
design must be approved by the site plan revie„� process. The site plan review process
requires review by the Planning and Zoning Committee and the City Council, as set fortl�
in this chapter.
(E) Screening requirements. If the City Council requires any type of screening as a
condition for a variance, conditional use, or interim use pernlit, the applicant shall
comply with the following conditions:
(1) File a copy of the screening plans with the Zoning Administrator;
(2) The screening, planting or construction, or both shall be complete within
one year from the date of the building permit, subject to extension by the City Council;
and
(3) The screening shall be maintained after completion.
(F) Landscaping. A minimum of ten percent of any lot shall be green space. Three
percent of the surface area of the land within a parking area shall be landscaped with
grass and shrubbery or other approved ground cover. Landscaped areas will continue to
be maintained by the property owner on a continuous basis. Green areas within abutting
street rights-of-way will also be maintained by the property owner. Other requirements
are set forth in this chapter.
(G) Accessor}� Structures. Garages, aceessory structures, screen walls, buildings and
exposed areas of retaining walls shall be of similar type, quality and appearance as the
principal structure. The height of an accessory structure shall not exceed the height of the
principal structure.
(H) Permi�t�d c�icroacluncnrs. The follo���ing shall not be considered as
encmaclvnents on setbacks subject to other conditions within this chapter: off-street
parking spaces, flues, belt course, leaders, sills, pilaster, lintels, cornices, eaves, gutters,
awnings, open terraces, service station pump islands, open canopies, steps, chin7neys,
f7agpoles, onian�ental features, open fire escapes, sidewalks and fences, except as
hereinafier amended.
(I ) Drive�ti�ays.
(1) No driveway shall be located witliin 100 feet of any right-of-way line of a
street intersection. The distances shall be measured along the property line from the
corner rigl�t-of-way and county line.
(2) Access drive onto county roads shall require a review by the City Engineer.

(J) Refuse.
(1) Garbage and rubbish containers shall be placed at the rear of the premises or
in a manner as to be out of vie�� from the street. In no event shall containers or their
enclosures be placed or maintained in a way to unreasonably interfere with the use or
eiijo��nent of adjoining property.
(2) All garbage containers shall be screened with a suitable enclosure.

(2) Exceptions to all masonry exteriors may be considered and approved by the
Planning and Zoning Commission provided the following findings are met:
(a) The combination of exterior materials is used as an architectural
complement to the structure; �
(b) The combination of exterior materials used is not inconsistent with tt�e
quality and appearance used on similar buildings in the same zoning district or
neighborhood;
(c) Site conditions limit public exposure to certain exterior surfaces where
masonry products are not proposed: and
(d) An exterior wall may be temporary and a future expansion area of a
structure and be subject to removal or redesign as an intenor «�all.
(3) Buildings are required to have contrasting architectural features and must be
designed to be aesthetically pleasing.

FINDINGS & CONCLUSIONS
Whereas, the Planning and Zoning Commission is tasked to fulfill the goals of the
Centerville Comprehensive Plan.
Whereas, that Comprehensive Plan guided certain industrial zoned areas to be
repurposed for commercial uses. (Hereinafter, "repurposed area.")
Whereas, prior to the formation of that Comprehensive Plan, the City created a
tax increment financing district (hereinafter, "TIF district") which successfully attracted
businesses to locate in the repurposed area.
Whereas, the existing and conforniing businesses in the repurposed area
(hereinafter, "businesses") desire to build upon their investments and goodwill.
Whereas, on , 2011, the Commission held a public hearing to discuss
changes to the repurposed area and Chapter 156.030 of the Centerville Code. As a result
of that hearing the Commission makes the following findings of fact.
Rezoning the repurposed area from industrial use (I-]) to commercial use (B-1) is
in keeping with the guidance set forth in the Comprehensive Plan.
The City can recover the maximum benefit from the TIF district in thc repurposed
area by maintaining high property values and retaining viable businesses. In order to do
so these businesses must remain and flourish in the repurposed area.
Businesses are likely to remain and flourish in the repurposed area if they can
continue their current industrial uses, and maximize their investments and goodwill. This
includes creating opportunities for these businesses to expand and grow in the future.
Allowing these businesses to continue in the new commercial zone with interim
industrial uses balances the need for business opportunities and investment growth while
allowing for future conversion of the repurposed area from industrial to commercial uses.
Based on these findings, the Commission concludes and proposed the attached
amendments to Chapter 156.030 of the Centerville Code. The Commission recommends
that the City Council adopt these findings and amendments to Chapter 156.030.

156.025 HIGH-DENSITY MULTI-FAMILY RESIDENTIAL DISTRICT
(R-3).
(A) Pu�7�ose. It is intended that the R-3 District provide for higher-density
residential district where a variety of dwelling types are permitted, provided the
overall density of the property meets the district goal of 12 units per acre. The
design and circulation of new residential areas are also intended to be
complementary with and enhance the community's small-town atmosphere. All
development within this district shall be submitted for consideration through the
Planned Unit Development process. A site submitted for Planned Unit
Development in this district shall be a minimum of two acres.
(B) Permitted uses and structu��es.
(1) Multi-family projects.
(2) Single-family attached or detached dwellings where in
combination with multi-family dwellings on the development property meet the
district density goal;
(3) Accessory uses;
(4) Daycare facility;
(5) Home occupations.
(6) Public parks and buildings.
(C) Special Requirements.

(1) Existing uses that are not in conforn�ance «�ith this section may
liot be expanded, but inay continue as nonconforn�ing uses. These nonconfonning
uses may be repaired and maintained and are allowed minor improvements that do
not expand the use.
(2) In makin� decisions about land use compatibility and
dimensional criter for uses and structures, the City shall have broad discretion to
protect the public health, safety and welfare; and to protect the integrity of
surrounding residential neighborhoods. Development or redevelopment of any
parcel shall be accomplished by submitting application as a Planned Unit
Development.
(3) No development in this district is permitted without city water
and sanitary service.
(4) Appendix A, lot and yard requirements shall apply to this
district. Appendix A is hereby amended by adding requirements for R-3 as shown on
tlie attached Exhibit A.
Section 2: Effecti��e Date: This ordinance shall be effective immediately upon its

Notice is hereby given, that on , 2011, Ordinance Number , Second
Series, entitled "AN ORDINANCE AMENDING CITY CODE, CHAPTER 90, ���as
adopted by the City Council of Centerville, Minnesota.
Notice is further given that due to the lengthy nature of the ordinance, the
City Council has directed that this title and swnmary be prepared for publication
pursuant to Minn. Stat. 412.191, Subd. 4.
� Notice is further given that a complete printed copy of the ordinance is
available for inspection by any person during normal business hours of the City
Clerk, 1880 Main St., Centerville, MN, or will be mailed to anyone requesting it by
telephone (651) 429-3232.
Notice is further given that the general purpose of the ordinance is to amend
the code as it relates to keeping of honeybees in the city.
Section 1. This section amends the City Code Chapter 156 by adding a new
"High Density Multi-Family Zoning District (R-3), including permitted uses and the
requirement that applications shall be made by Planned Unit Development.
Section 2. This section provides that the effective date shall be upon
publication of this summary.
Notice is further given that the Council has by a minimum 4/5 vote appi•o��ed

1. Updating zoning to correspand with the Comprehensive Plan.
Lallas Larson reportcd that r,e r,ad sent letters to all of the property owners iii tl�e area
south of Main Street between 20 and 21 Avenues advising them of the proposed change
from industrial to commercial business zoning. They have been asked to respond with
comments by January 15.
Larson will also send letters to other property owners impacted by zoning changes
proposed in the new comprehensive plan.
IV. NEW BUSINESS.
1. Request of Ms. Terry Johnson for a change in the City Code, Chapter 90, to
allow beekeeping.

Ms. Johnson ���as present to advocate for a change in the city code to pernlit the keeping of
bees in the city. She shared ordinance requirements from the City of Minneapolis where
beekeeping is peimitted subject to certain restrictions, which include lot size, setbacks for
locations of hives, restrictions on number of hives permitted, and requiring approval by
adjoining neighbors. Commissioners were generally supportive if a change, but directed
staff to prepare a summary and that it be presented to the City Council for feedback before
proceeding. The City Code changes if approved by Council would include the following:
1. Minimum one-half acre lot size
2. No more than two bee colonies shall be allowed.
3. Hives shall be setback from property lines a minimum of 25 feet.
4. Applicants shall have a minimum of 16 hours of training on keeping bees.
5. Permission must be obtained from owners of all property abutting the proposed
site.
6. A permit must be obtained from the City.
7. Honey bees will be added to the code as farnl animals which are allowed in R-1
properties of ten acres or more, however no permit would be required.
Consensus was that if the Citv Council is supportive, the details of a proposed
ordinance will be developed at the next meetin� and submitted to Council for
approval.
