CALL TO ORDER. The meeting was called to order by Commissioner Wood. 1.Roll Call II.PUBLIC INPUT/HEARING 1. Proposed amendment to Chapter 156, Section 156.025(R-3 Zoning District~High- Density Multi-Family Residential District) 2.Proposed ordinance amendment-City Code Chapter 156, Section 156.030 (B-1 Commercial Zoning District- Interim Uses. The Commission opened the public hearing to consider the proposed changes to City Code, Chapter 156, Sections 156.025 & Chapter 156, Section 156.030. No one was present to comment on the hearing matters. Motion by Commissioner Wood, seconded by Commissioner Larson to close the public hearing regarding the proposed changes to Chapter 156, Sections 156.025 and 156.030. All in favor. Motion carried unanimously. III.OLD BUSINESS . 1.Comprehensive Plan-zoning issues-Proposed code amendments to facilitate changes to zoning as guided by the 2030 Comprehensive Plan. a.Amend Chapter 156, adding Section 156.025 (adding new R-3 Zoning District. Page 1 of 3 City of Centerville Planning and Zoning Commission March 1, 2011 Meeting Minutes Motion by Commissioner Wood, seconded by Commissioner Wekseth to approve the prepared findings and recommendation for Council adoption of proposed changes to Chapter 156, Sections 156.025. All in favor. Motion carried unanimously. b.Amend Chapter 156, Section 156.030 (Interim Uses in B-1 Zone) Motion by Commissioner Larson, seconded by Commissioner Wood to approve the prepared findings and recommendation for Council adoption of proposed changes to Chapter 156, Sections 156.030. All in favor. Motion carried unanimously. 2.Update zoning to correspond with the Comprehensive Plan. a. R1 Changeto R-2 b. R-2 Change to R-3 c. R-2A Change to R-3 d. R-2 Change to M-2 e. I-1 Change to B-1 The Commission reviewed the list of properties that will need to be rezoned to conform to the 2030 Comprehensive Plan. It was pointed out that the multi-family area known as Willow Glenn should be included in the areas that are rezoned to R-3. Motion by Commissioner Wood, seconded by Commissioner Mosher to approve to call for public hearing to be held on May 3, 2011 on the rezonings required to make the properties in the areas identified comply with the 2030 Comprehensive Plan. All in favor. Motion carried unanimously. IV.NEW BUSINESS. 1. Metropolitan Transit Parking Facility proposed for Lino Lakes. City Administrator Larson reviewed preliminary plans of Metropolitan Transit for a 300 st car park and ride facility in Lino Lakes immediately east of 21 Avenue and north of Main Street. The Commission discussed traffic and access issues that will need to be addressed. V.DISCUSSION ITEMS Dallas Larson reminded Planning & Zoning Commission to take on-line land use basics training offered by the League of Minnesota Cities. All present agreed to take the training. VI. CONSIDERATION OF MINUTES Motion by Commissioner Larson, seconded by Commissioner Wekseth to approve minutes from the February 1, 2011, meeting. All in favor. Motion carried unanimously. Transcribed by: Dallas Larson, Administrator Page 3 of 3 CITY OF CENTERVILLE PLANNING & ZONING COMMISSION FINDINGS & CONCLUSIONS Whereas, the Planning and Zoning Commission is tasked to fulfill the goals of the Centerville 2030 Comprehensive Plan. Whereas, that Comprehensive Plan guided certain areas to be repurposed for high density residential uses. Whereas, the City Code, Chapter 156, Zoning does not contain an appropriate zoning district to implement the desired high density zoning. Whereas, the Planning and Zoning Commission proposes a new R-3 High- Density Multi-Family zoning district to accomplish the desired zoning densities. Whereas, on March 1, 2011, the Commission held a public hearing to consider proposed changes to City Code, Chapter 156, adding a new Section 156.025 with appropriate regulations to implement the desired high density housing. As a result of that hearing the Commission makes the following findings of fact. Implementation of the high density areas of the city can best be accomplished by establishing a new R-3 zoning district in keeping with the guidance set forth in the Comprehensive Plan. Based on these findings, the Commission proposes the attached amendments to Chapter 156 of the Centerville Code. The Commission recommends that the City Council adopt these findings and amendments to Chapter 156, adding a new section 156.025. CITY OF CENTERVILLE PLANNING & ZONING COMMISSION FINDINGS & CONCLUSIONS Whereas, the Planning and Zoning Commission is tasked to fulfill the goals of the Centerville Comprehensive Plan. Whereas, that Comprehensive Plan guided certain industrial zoned areas to be repurposed for commercial uses. (Hereinafter, “repurposed area.”) Whereas, prior to the formation of that Comprehensive Plan, the City created a tax increment financing district (hereinafter, “TIF district”) which successfully attracted businesses to locate in the repurposed area. Whereas, the existing and conforming businesses in the repurposed area (hereinafter, “businesses”) desire to build upon their investments and goodwill. Whereas, on March 1 2011, the Commission held a public hearing to discuss changes to the repurposed area and Chapter 156.030 of the Centerville Code. As a result of that hearing the Commission makes the following findings of fact. Rezoning the repurposed area from industrial use (I-1) to commercial use (B-1) is in keeping with the guidance set forth in the Comprehensive Plan. The City can recover the maximum benefit from the TIF district in the repurposed area by maintaining high property values and retaining viable businesses. In order to do so these businesses must remain and flourish in the repurposed area. Businesses are likely to remain and flourish in the repurposed area if they can continue their current industrial uses, and maximize their investments and goodwill. This includes creating opportunities for these businesses to expand and grow in the future. Allowing these businesses to continue in the new commercial zone with interim industrial uses balances the need for business opportunities and investment growth while allowing for future conversion of the repurposed area from industrial to commercial uses. Based on these findings, the Commission concludes and proposed the attached amendments to Chapter 156.030 of the Centerville Code. The Commission recommends that the City Council adopt these findings and amendments to Chapter 156.030. PROPOSED AMENDMENTS: 156.030 Commercial District (B-1) (N) Interim uses in B-1 District. (1) Uses existing on a site in the I-1 Industrial District as a conforming use prior to the site being rezoned from I-1 to B-1 may continue to be used for such conforming I-1 uses, regardless of site ownership. In addition, the activities and operations may be expanded on the site as if the use was located in an I-1 District, until such time the use is abandoned or changed to a use permitted in the B-1 District. After the use of the site is abandoned or is changed to a permitted use in the B-1 District, the site may not thereafter be used except as permitted in the B-1 District. In the event of a proposal by the City to rezone the site from I-1 to the B-1 District, the City Planning and Zoning Commission shall, simultaneously with such rezoning action, determine whether the site is a conforming industrial use qualifying for interim use status under this section. In the event a determination is made that the use of the site conforms to I-1 standards and this section, the City shall, within sixty (60) days of such determination, file a notice of compliance with the Anoka County Recorder. CITY OF CENTERVILLE ANOKA COUNTY, MINNESOTA ORDINANCE #______ SECOND SERIES AN ORDINANCE AMENDING CITY CODE , CHAPTER 156 THE CITY COUNCIL OF THE CITY OF CENTERVILLE ORDAINS: Section 1. City Code Chapter 156, Section 156.030 is hereby amended by adding a paragraph (N) which shall read as follows: (N) Interim uses in B-1 District. (1) Uses existing on a site in the I-1 Industrial District as a conforming use prior to the site being rezoned from I-1 to B-1 may continue to be used for such conforming I-1 uses, regardless of site ownership. In addition, the activities and operations may be expanded on the site as if the use was located in an I-1 District, until such time the use is abandoned or changed to a use permitted in the B-1 District. After the use of the site is abandoned or is changed to a permitted use in the B-1 District, the site may not thereafter be used except as permitted in the B-1 District.
