HomeMy WebLinkAbout2002-06-04 P & ZCity of Centerville Planning and Zoning Minutes June 4, 2002 CITY OF CENTERVILLE PLANNING AND ZONING COMMISSION JUNE 4, 2002 Pursuant to due call and notice thereof, the Planning and Zoning Commission held their regularly scheduled meeting on June 4, 2002, at 6:30 p.m. PRESENT: John McLean Ray DeVine Tom Wilharber Brian Hanson ABSENT: David Kilian Mary Jo Helmbrecht COUNCIL: Council Member Travis STAFF: None. I. CALL TO ORDER 1.Roll Call The meeting was called to order at 6:42 p.m. II. PUBLIC HEARING(S) None. III. APPEARANCES None. IV. OLD BUSINESS 1. Ordinance #4 The Commission reviewed Ordinance #4 and agreed that the changes intended had been made. Motion by Commissioner Wilharber, seconded by Commissioner DeVine to ask Staff to publish notice of the public hearing on Ordinance #4. All in favor. Motion carried unanimously. Page 1 of 4 City of Centerville Planning and Zoning Minutes June 4, 2002 2. Tattooing, Body Piercing & Massage Parlors Commissioner DeVine indicated he liked the New Brighton Ordinance. Chair Hanson asked that Staff put the New Brighton Ordinance into Centerville format. Commissioner DeVine questioned whether the Anoka County Health Department regulates tattooing and body piercing because that would keep the City from having to regulate these businesses and save taxpayer dollars. Chair Hanson indicated that Anoka County does not regulate body piercing. Commissioner McLean indicated that the Ordinance refers to an enforcement body. He then indicated that the Commission would need to recommend to Council who that enforcement body would be either the Police or by complaint at the Council level. Chair Hanson indicated he felt Council should decide who should enforce the Ordinance. Commissioner Wilharber indicated he would like to recommend that the Police Department do the enforcing and have Staff draft an ordinance based on the New Brighton format. He also indicated that the County Health Authority needs to be listed in the Ordinance. Commissioner DeVine asked whether the City Manager could utilize the County Health Authority. Commissioner DeVine indicated the enforcement officer would be the County Health Officer and asked that Staff add a paragraph on enforcement by the Police Department. Chair Hanson asked if the disposal of biohazard materials needed to be addressed. Commissioner McLean noted the handling of biohazard materials was covered in the New Brighton ordinance. Commissioner DeVine commented that the City could pull the license per the Ordinance and asked what type of enforcement beyond pulling the license the Commission was looking for. Commissioner Wilharber commented that these types of businesses cannot be conducted as a home occupation and then said he feels home occupations take away from the commercial tax base. Motion by Commissioner DeVine, seconded by Commissioner Wilharber to ask Staff to draft an ordinance for review based on the New Brighton form adding a paragraph concerning enforcement, and to ask Staff to schedule the public hearing on this Ordinance at the July meeting. All in favor. Motion carried unanimously. Page 2 of 4 City of Centerville Planning and Zoning Minutes June 4, 2002 Commissioner Wilharber asked whether the City needed to contact New Brighton to ask for permission to utilize that Ordinance. The Commission agreed that it did not feel it was necessary to ask for permission to use New Brighton’s ordinance. V. NEW BUSINESS 1.Joint Meeting with Council (NEMO) Consensus was reached to ask Staff to schedule the joint meeting with NEMO for the July Planning Commission meeting. The Commission Members also indicated they were open to coming to a Council meeting if Council preferred to have NEMO at its meeting. VI. DISCUSSION ITEMS Chair Hanson indicated the Commission had asked that the right-of-way ordinance be placed on this agenda. He then asked that it be placed on next month’s agenda. Commissioner McLean indicated that the Ordinance on tattooing and body piercing did not address massage parlors. Commissioner Wilharber commented that the minutes of the last meeting indicate that the Commission agreed to schedule the NEMO training for the June meeting. Commissioner Wilharber indicated he had seen a recent court decision concerning a right-of-way issue and the court sided with the utility company. Commissioner DeVine asked the recording secretary to bold the items in the minutes being asked of staff. The Commission asked that the right-of-way ordinance, Ordinance 70, 71 and 4 be placed on the agenda for public hearings. The Commission asked that Staff send an e-mail to the members to indicate whether the NEMO training would be placed on the July agenda. The Commission asked that the agenda for the meetings be changed to reflect the new format agreed to by Council. Page 3 of 4 City of Centerville Planning and Zoning Minutes June 4, 2002 VII. CONSIDERATION OF MINUTES 1.May 7, 2002 Planning and Zoning Meeting Minutes Commissioner Wilharber asked that the statement closing the public hearing be moved up to be underneath the motion closing the public hearing for the Tratar variance. Motion by Commissioner DeVine, seconded by Commissioner Wilharber to approve the May 7, 2002 Meeting Minutes as amended. All in favor. Motion carried unanimously. VIII. ADJOURNMENT Motion by Commissioner Wilharber, seconded by Commissioner DeVine to adjourn the June 4, 2002 Planning Commission Meeting at 7:11 p.m. All in favor. Motion carried unanimously.
