I. CALL TO ORDER
Mayor Tom Wilharber called the April 13, 2011, City Council meeting to order at
6:30 p.m.
II. PUBLIC HEARING(S)
None.
III. APPROVAL OF AGENDA
Council was presented with a set agenda which contained additional checks
(#26286-26304), Page 7a & 7b issued since the packet was completed on April 8,
2011.
The City Administrator requested that the Closed Session that was already
scheduled for his appraisal also contain discussions regazding outstanding 2009
street project contractor issues.
Council Member Paar requested that an Item 7 be added under New Business to
discuss the 2010 Sealcoating Project.

Mayor Wilharber questioned whether there were additions or modifications.
Council Member King requested that under New Business, paragraph 2, contain

language that Commissioner Sivirajah stated that only Anoka County
municipalities would be utilizing this system." Council Member King also stated
that he requested that information regarding sustainable development that he
provided at the previous meeting become a part of the official record and
questioned whether it had.
Consensus of the Council was that it was not significant to become a part of the
official record.

VI. AWARDS/PRESENTATIONS/APPEARANCES
1. Mr. Steve McDonald, ABDO, Eick & Meyers — 2010 Annual Audit
Mayor Wilharber welcomed Mr. McDonald. �Mr. McDonald reviewed the
Management Letter and Audit with the Council. Mr. McDonald sta.ted that the
audit was completed several weeks ahead of previous years, and noticeable
improvements have been by the City and its Sta.ff to ensure legal compliance and
internal controls. Mr. McDonald stated that at least one new GASB rule would
affect the 2011 audit and that StafF and ABDO, Eick & Meyers will be working
closely together in the next few months to ensure compliance with this new �
requirement.
2. Mr. Jim VanHoudt, President, Twin Town Homes of Eagle Pass
Representatives from the Twin Town Homes of Eagle Pass Association were
present to discuss their request to have Council consider ownership
responsibilities of curb stops and reimbursement of associated expenditures
endured by them this winter due to a curb stop failure. ,
Discussion was had regarding other failures during the winter season and prior '
seasons with the Public Works Director reporting that approximately 5 have failed I
in 16 years. Council stated that several years prior they discussed this same issue
and they instituted an ordinance that addressed ownership of the curbstop.
Council also discussed alternative funding for these types of repairs similar to
insurance or a minimal fee added to resident's utility bills to cover similar
situations throughout the community.
Motion bv Council Member Wilharber. seconded bv Council Member
Fehbrenbacher to reimburse the Twin Town Homes of Eagle Pass half of the
` ezpenditures incurred for tlus failure. Not to Ezceed $3.800. All in favor.
Motion failed.
Discussion: Consensus of the Council was to treat this failure similarly to another
incident that happened and the City incurred the costs.

I VII. OLD BUSINESS
1. Downtown Intersections — Concrete Failing — Update from Engineer
City Engineer Statz updated Council on the status of the intersection and
premature deterioration of the joints on the north side of the intersections.
Lengthy discussion was had regarding'possible reasons for the colored
cement's failure and how to proceed. Mr. Statz stated that meetings have
transpired with the contractor and Anoka County and no one is accepting
responsibility. Mr. Statz stated that the Minnesota Department of
Transportation (MNDot) has approached them/the City to participate in a
research study for the deterioration of the colored concrete; however, there
would not be a decision whether Centerville would be included in that
study until June, 2011. Mr. Statz reminded Council that several meetings
ago they were presented with a proposal to attempt to determine
responsibility for the premature failure. Mr. Statz stated that the next step
is to look into the cost of a viable repair or wait until June for
determination from MNDot on whether this would be part of a research
project.
Administrator Larson suggested that Council wait for MNDot's
determination prior to moving forward on this issue and that Staff would
update Council on a regular basis.

Discussion: Council Member Parr questioned whether he should refrain from
voting on this matter due to the fact that he has two children that are involved in
the organization. Legal Council stated that there was no need to refrain from
voting.
All in favor. Motion carried unanimouslv.
4. Approval of Connect Anoka County Project Service Agreement —
Broadband Services wiAnoka County
Legal Counsel reviewed with Council the current agreement, stated that he felt
that this agreement was the best possible agreement that could be obtained and it �
would allow cities bargaining power with the provider (Zayo) in the future and
allow modifications. Legal Counsel discussed possible financial ramifications of
the agreement and felt that the com itments would not exceed the value of this ,
venture. Council questioned how other municipalities felt about approving the
agreement and Mr. Glaser stated that with the exception of Columbia Heights, all
would likely vote in favor of approving the contract to connect to services but not
accepting the service until the network is completed. �'
Council again felt that with the attraction of businesses, this would also be an I
important tool to assist that.

5. Staff Recommendation for Replacement of Bolts (Hydrants & Gate
Valves) in Advance of Trail Project — Burschville Construction, Not to
Ezceed $28,625
� Public Works Director Palzer stated that in the past, the City experienced
numerous failures of these bolts due to corosive and due to the close proximity of
the hydrants and valves in the area of the trail project he would recommend

disru tion of the trails and ossible reconstruction ex enses.

6. Res. #11-008 — Authorizing the Closing of Fund #312
City Administrator Larson stated that this fund was originally established for the
2004 Street Improvement Project and bonds associated with it; however, recently
the Council consolidated this bond and another during the recent refinancing bond
so the fund is no longer needed.
Motion bv Council Member Fehrenbacher, seconded bv Council Member
Paar to Aaurove Res. #11-008 — Authorizing the Closing of Fund #312 as
�resented. All in favor. Motion carried unanimouslv.
7. 2010 Sealcoating Project (Meadow Lane — Dupre Road)
Council Member Paar stated that there are a large amount of loose rocks on Dupre
Road near Main Street and Meadow Lane is similar and possible down to just the
sealcoating. City Engineer Statz st ted that he would be looking at these areas
along with Staff.
IX. ANNOUNCEMENTS/LJPDATES
1. City Administrator Larson
City Administrator stated that the City will be utilizing the City of Hugo's street
vacuum this season rather than street sweeping that has occurred in the past. Mr.
Larson also stated that this winter straight salt was used on tlie streets ratlier than
the usual salt/sand mixture.
X. RECESS
The meeting was at 8:20 p.m. for a Council work session -
I The City Council, reconvened their regular meeting of this date at 9:53 p.m. and
then met in a closed session. Present were Mayor Tom Wilharber, Council
Members Jeff Paar, Steve King, D Love, and Ben Fehrenbacher. Also present
� were Engineer Mark Statz, City Attorney Kurt Glaser and Administrator Dallas
Larson. The purpose of the closed meeting was to review the status of potential
litigation regazding the 2009 Street Improvements and to complete the annual
performance evaluation of City Administrator Dallas Larson.

� Minutes of Work Session
Present were Mayor Tom Wilharber, Council members Jeff Paar, Steve King, D Love,
and Ben Fehrenbacher. Also present were Mark Statz, Bonestroo & Assoc., City Attorney

Budget Update. Finance Director Mike Jeziorski presented a draft budget for 2012
and reviewed the assumptions that were used. No COLA for employees (for the third
year), no insurance inerease for staff (for the third year), inflation adjustments are
included in supplies and utility costs, estimates of permit fees were further reduced to
reflect current conditions, and Market Value Homestead Credit is expected to
continue at a severely reduced level. Capital expenses included $10,000 for election
equipment, $30,000 for replacement of two trucks and $75,000 for crack sealing and
seal coating. Bond levies are slightly reduced due to the recent debt refinancing. The
resulting combined tax levy is up about 3.6% over the current year.
Public Works Director Paul Palzer reviewed his estimates to maintain city streets. He
expressed concern that the stability of city streets is not uniform, even where
specifications were the same and a high level of soil correction was done. He
suggested that with the cost of maintenance, using current standards of construction,
the city would need to expend approximately $1.7 million annually. He suggested an
alternative plan that would require an annual budget of about $260,000. Seal coating
would be curtailed and instead an overlay would be installed about every fifteen
years. The council seemed interested in allocaring more funds toward street
maintenance, but desired to have more time to review the suggestions.
Council discussed the issue of laptop computers and whether the city should reduce
council pay and use some of the savings to purchase computers for council. The
savings for printing and distributing council packets would be about $800 per year. It
was noted that two members had their own computers that were being used for this
purpose. City Attorney Glaser indicated that there is a possibility the computers could
be subject to discovery in the case of a lawsuit against the city. The reason that city
emails were issued to council members was an attempt to avoid this. Consensus was
that Council members should decline having their agendas printed if they are using a
portable computer for the same purpose, but that the city would not provide
computers at this time.
The council discussed the insurance benefit provided to city employees. Consensus
was that new hires should not be allowed to take any unused insurance benefit if they
did not need family coverage, as deferred compensation or taxable wages. Future
labor agreements will take this guidance into consideration.

Council discussed whether any city trucks should be replaced next year. Consensus
was that we should fixrther investigate the replacement of the two oldest trucks but
that the one-ton would likely be the only one with justification.

experienced. Generally, these Seasonal workers complete projects throughout the City
and it would be very unproductive for other staff members to drive these individuals
azound.
The Centennial Fire District has a 1995 Chevrolet Astro Van (All Wheel Drive, 3 Door, 8
passenger van, one owner, no rust, excellent condition with all maintenance records and
SOK miles) for sale. ,
The City has submitted a bid in an amount not to exceed $2,500.
This expenditure could be reflected from the cost savings of Staff completing inspection
with the Trail Project.

Mr. & Mrs. Kurt Frison have submitted a11 associated documentation (grading permit,
encroachment ageement and associated fees). They have received the Building
Inspector's approval to install the proposed drain pipe through the City's drainage/utility
easement in their rear yard. It is felt that the installation and their ma.intenance of the
pipe will not affect or harm others. They are now requesting Council's permission to
allow same with the encroachment agreement.

MEMORANDUM of AGREEMENT
City of Centerville and the Rice Creek Watershed District
This Memorandum of Agreement (MOA) is made by the City of Centerville and the Rice
Creek Watershed District (RCWD), governmenta) subdivisions of the State of Minnesota.
Recitals and Statement of Purpose
A. Pursuant to Minnesota Statutes §§1036.211, 103D.341 and 103D.345, the RCWD has
adopted and implements Rule C, Stormwater Management Plans, which imposes water quality
and runoff retention requirements on land-disturbing projects.
B. Centerville has prepared a general redevelopment plan for its downtown area that will
be implemented in phases and through actions of the city, private property owners and
redevelopers.
C. Centerville intends to construct a stormwater reuse facility ("Facility") that will use
existing Pond (identified as "existing pond" on attached Exhibit A) as a water supply for
irrigation of LaMotte Memorial Park, and wishes to use the Facility to satisfy water quality and
volume control requirements of District Rule C for properties that redevelop under RCWD
permits.
D. Construction of the Facility before redevelopment will ensure that stormwater flows
from redevelopment activities are timely managed and allow for operating levels to be
observed by Centerville and the RCWD. In order to proceed with construction, Centerville
needs an adequate assurance that the RCWD will accept use of the Facility by redeveloping
properties to meet Rule C requirements.
Terms ,
1. The following plans and specifications for the Facility are incorporated into this MOA:
• Phase 1(Contract A) Construction Plan Set (Sheets G1.01, C2.01, C5.01-05.03, C8.01,
D2.01) for the stormwater reuse facility dated 10-6-2010. Plans include Temporary
Erosion Control, Storm Pipe Plan and Profile, Intake Area Plan and Detail, Wet Well
Site Plan, Details, Irrigation Plan and Details.
• Phase 1(Contract B) Construction Plan Set (Sheets G1.01, C5.01, D2.01, E1.01) for

2. On Centerville's certification that Facility construction has been substantially completed
in material conformance to the above plans and specifications and RCWD confirmation, for the
purpose of Rule C the RCWD will: (a) recognize the areas delineated and labeled as
"Redevelopment Area" on the map attached hereto as Exhibit A and incorporated into this
MOA (all together, "Delineated Area") as the "contributing area" to the Facility; and (b)
recognize the Facility as providing water quality treatment and volume control for land-
disturbing activities within the Delineated Area. The RCWD will not require a permit applicant
within the Delineated Area to demonstrate infeasibility of on-site management or perform
other location or method sequencing required by Rule C before it uses the Facility.
3. On substantial completion of the Facility, the RCWD will calculate the capacity of the
Facility for the purpose of Rule C compliance. In doing so, the RCWD will apply its irrigation
volume guidance spreadsheet as it may be in effect at that time and all other guidance or
policies in effect. The RCWD will require three full growing seasons of irrigation records (i.e.
the volume of water irrigated) be provided to the District. At the end of the third full growing
season, the average of the three seasons irrigated volume will be used to determine the final
capacity of the facility.
4. Before approving use of the Facility, the RCWD may require a permit applicant to
provide a written statement from Centerville that the applicant is authorized to use the Facility
and that the Facility continues to operate in accordance with the built design. Centerville is
responsible for allocating Facility capacity among properties within the Delineated Area. To the
extent that a permit applicant cannot fully meet Rule C by use of the Facility, it will be required
to provide for additional stormwater management in order to do so. This MOA does not limit
the RCWD's authority or discretion to revise its permitting rules. RCWD acknowledges that a
change in its rules could have a significant impact on the Facility capacity and its ability to
adequately serve the Delineated Area. As such, RCWD agrees it will consult with Centerville, if
requested, to specifically review the potential impacts of a change. A permit applicant will be
subject to RCWD rules as in effect at the time of permitting.
5. Centerville will inspect and maintain the Facility in perpetuity in accordance with the
terms stated in Exhibit B, attached hereto and incorporated into this MOA. This obligation is
established for the benefit of the RCWD as a public body and appurtenant public resources, and
is not intended as a"private covenant, condition or restriction" within the meaning of
Minnesota Statutes §500.20 or like term as the statute may be amended. Centerville may,
subject to its policies and law, recoup its cost to inspect and maintain the Facility.
6. The parties concur that this MOA is binding and rests on good and valuable
consideration. Nothing in this MOA creates or establishes a partnership, joint venture or
agency relationship between the parties. RCWD review or approval of any plan, certification or
other construction document is solely for its own assessment of its responsibilities under this
MOA. As between the parties, Centerville is solely responsible for design of the Facility; the
means, method and manner of construction; and ensuring that it conforms to all applicable

laws. Nothing in this MOA creates any right in any third party or affects any immunity, defense
or liability limitation enjoyed by either party.
7. This MOA is effective as of the date on which it is executed by both parties. tt may be
amended only in a writing signed by both parties. The recitals stated above are incorporated as
part of this MOA.

Centerville, at its cost, will operate, inspect and maintain the stormwater management facilities
indicated within the plans and specification under section 1 of the MOA as follows: pond, storm
water reuse / irrigation system. Centerville will:
a. Operate the water reuse/irrigation system for irrigation suppiy when weather
conditions and pond water elevations are suitable for irrigation activities.
b. Inspect stormwater reuse/irrigation system at least once annually.
c. Accumulated sediment and debris will be removed and erosion or structural problems
will be corrected when reasonably necessary so that the facility continues to operate as
designed.
d. Perform routine maintenance activities on the water reuse/irrigation system.
e. Collect pump run-time data or flow meter data on an annual basis following the
installation of the system. These data and pump capacity ratings will be submitted to
the RCWD on an annual basis once the system is in operation for the first full three years
of operation. At the end of the third growing season, the average of the three full I
seasons' irrigated volume will be used to determine the final capacity of the facility.
After the �rst full three years of operation of the system, pump run-time data or flow I
meter data must be collected on an annual basis and reported to the RCWD to verify the �
system is operating at the approved capacity.

AN ORDINANCE AMENDING CITY CODE CHAPTER 91 PRESCRIBING CONTROL
MEASURES FOR SHADE TREE PESTS
THE CITY COUNCIL OF THE CITY OF CENTERVILLE ORDAINS:
Section 1. City Code Chapter 91 is hereby amended to insert Sections 91.10 and 91.11 to read as
follows:
§ 91.10 SHADE TREE PEST CONTROL.
(A) Declaration of policy. The health of the trees in the City is threatened by shade tree
pests, and the loss or ill health of trees growing upon public and private property substantially
depreciates the value of property within the City and impairs the safety, good order, general welfare
and convenience of the public. In addition to and in accordance with Minn. Stat. §§89.001, 89.01,
and 89.51-.64, the provisions of this section are adopted as an effort to control and prevent the
spread of these shade tree pests.
(B) Jurisdiction. The City shall have control of all street trees, shrubs, and other plantings
now or hereafter in any street, park, public right-of-way or easement, or other public place within
the City limits, and shall have the power to plant, care for, maintain, remove, and replace such trees,
shrubs, and other plantings.
(C) Declaration of a shade tree pest. The Council may by ordinance declare any vertebrate or
invertebrate animal, plant pathogen, or plant in the community threatening to cause significant
damage to a shade tree or community forest, as defined by Minn. Stat. §89.001, to be a shade tree
pest and prescribe control measures to effectively eradicate, control, or manage the shade tree pest,
including necessary timelines for action.
(D) Public nuisances defined. A shade tree pest, as defined in this chapter, occurring within a
defined control zone is a public nuisance.
(E) Shade tree pest nuisances are unlawful. It is unlawful for any person to permit any public
nuisance as defined in this section to remain on any premises the person owns or controls within the
, City. The nuisance may be abated as provided in this section.
(F) Tree Inspector. The Council hereby designates its tree inspector to coordinate the
activities of the City relating to the control and prevention of damage by shade tree pests. The tree
inspector will recommend to the Council the details of any program for the declaration, control, and
prevention of shade tree pests. The tree inspector is authorized to enforce or cause to be enforced the
tasks incident to such a program adopted by the Council. The term "tree inspector" includes any
person designated by Council or the tree inspector to carry out activities authorized in this section.
Unless the Council has made another designation of Tree Inspector, such duties shall be allocated to
the Public Works Director.
(G) Abatement of shade tree pest nuisances.
(1) In abating a shade tree pest nuisance, the organism, condition, plant, tree, wood, or

material identified as injurious to the health of shade trees shall be removed or effectively treated so
as to destroy and prevent as fully as possible the spread of the shade tree pest. Such abatement
procedures shall be carried out in accordance with the control measures and areas prescribed by this
chapter.
(2) In addition, if the appropriate abatement procedure is removal, and the tree(s)
and/or hedge(s) are within the limits of a highway in a rural azea within the City's jurisdiction,
Minn. Stat. § 160.22 shall be complied with as necessary.
(H) Reporting discovery of shade tree pest. Any owner or occupier of land or any person
engaged in tree trimming or removal who becomes aware of the existence of a public nuisance
caused by a shade tree pest as defined in this chapter shall report the same to the City.
(I) Registration of tree care firms. Any person, firm, or corporation that provides tree care,
tree trimming, or removal of trees, limbs, branches, brush, or shrubs for hire must be registered with
the Minnesota commissioner of Agriculture under Minn. Stat. § 18(1.07.
(J) Inspection and application of control measures.
(1) The tree inspector is authorized to inspect premises and places within the City to
determine whether shade tree pests exist thereon and to investigate all reported incidents of shade
tree pests. The tree inspector is authorized to take all reasonable measures to prevent the
maintenance of public nuisances and may enforce the provisions of this chapter relating to
abatement of shade tree nuisances. Diagnosis of shade tree pests may be by the presence of
commonly recognized symptoms; by tests as may be recommended by the commissioner of the
Minnesota Department of Agriculture or the commissioner of the Minnesota Deparirnent of Natural
Resources; or other reliable means. '
(2) Except in situations of imminent danger- to human life and safety, the tree inspector
shall not enter private property for the purpose of inspecting or preventing maintenance of public
nuisances without the permission of the owner, resident, or other person in control of the property,
unless the tree inspector has obtained a warrant or order from a court of competent jurisdiction
authorizing the entry.
(3) No person, firm, or corporation shall interfere with the tree inspector or with anyone
acting under the tree inspector's authority while engaged in activities authorized by this chapter.
(K) Standard abatement procedure. Except as provided in sections L and N, whenever a tree
inspector determines with reasonable certainty that a public nuisance, as described by this
ordinance, is being maintained or exists on premises in the City, the tree inspector is authorized to
abate a public nuisance according to the procedures in this subdivision.
(1) The tree inspector will notify in writing the owner- of record or occupant of the
premises that a public nuisance exists and order that the nuisance be terminated or abated. The
notice may be given in person or by mail. Failure of-any party to receive the mail does not
invalidate the service of the notice. A copy of the notice sha11 be filed with the City Clerk.
(2) The notice of abatement shall state that unless the public nuisance is abated by the
owner or occupant, it will be abated by the City at the expense of the owner or occupant. The notice
shall specify the control measures to be taken to abate the nuisance, and provide a reasonable

i amount of time to abate the nuisance. The notice will also state that the owner or occupant has the
right to appeal the determination that a ublic nuisance exists b submittin a r uest in wririn to

the City clerk within seven (7) days after service of the notice, or before the date by which
, abatement must be completed, whichever comes first.
' (3) If no timely appeal is submitted, and the control measures prescribed in the notice
of abatement are not complied with within the time provided by the notice or any additional time
granted, the tree inspector or designated person sha11 have the authority to obtain permission or an
administrative search warrant, enter the property, and carry out abatement in accorda.nce with the
notice of abatement.
(L) High-cost abatement. If the tree inspector determines that the cost of abating a nuisance
will exceed $5,000 based on a reasonable, good faith estimate, the written notice referred to in
Section K must provide that if the nuisance is not abated within the reasonable amount of time
provided, the matter will be referred to the City Council for a hearing. The date, time, and location
of the hearing must be provided in the notice.
(M) Appeal procedure. If the City clerk receives a written request for a hearing on the
question of whether a public nuisance exists, the City Council shall hold a hearing within fourteen
(14) calendar days following receipt by the clerk of the written request. At least three (3) days notice
of the hearing shall be given to the individual who rnade the written request for the hearing. The
Council may modify the abatement notice or extend the time by which abatement must be
completed. Each owner, agent of the owner, occupant, and lienholder of the subject property or
properties in attendance, if any, shall be given the opportunity to present evidence at the hearing.
After holding the hearing, the City Council may issue an order requiring abatement of the nuisance.
(N) Abatement procedure in event of imminent danger.
(1) If the tree inspector determines that the danger of infestation to other shade trees is
imminent, and delay in control measures may put public health, safety, or welfare in immediate
danger, the tree inspector may provide for abatement without following subdivision 11 or 12. The
tree inspector must reasonably attempt to notify the owner or occupant of the affected property of
the intended action and the right to appeal the abatement and any cost recovery at the next regularly
scheduled City Council meeting.
(2) Nothing in this section shall prevent the City, without notice or other process, from
immediately abating any condition that poses an imminent and serious hazard to hutnan life or
safety.
(0) Recovery of cost of abatement; liability and assessment.
� (1) The owner of premises on which a nuisance has been abated by the City shall be
personally liable for the cost to the City of the abatement, including administrative costs. As soon as
the work has been completed and the cost determined, the City clerk or other official shall prepaze a
bill for the cost and mail it to the owner. Thereupon the amount shall be immediately due and
payable at the office of the City Clerk.
(2) After notice and hearing, as provided in Minn. Stat. § 429.061 (which may be
amended from time to time), the City Clerk sha11, on or before Sept. 1 next following abatement of
the nuisance, list the total unpaid charges as well as other charges for current services to be assessed

under Minn. Stat. § 429.101 against each separate lot or parcel to which the charges are attributable.
The City Council may then certify the charges against the property to the county auditor for
collection along with current taxes the following year or in annual installments as the City council
may determine in each case.
(P) Penalty. See §91.99
(1) In addition to any penalties provided for in this section, if any person, firm, or
corporation fails to comply with any provision of this section, the City Council or any official
designated by it may institute appropriate proceedings at law or at equity to restrain, correct, or
abate the violation.
(Q) Severability. Should any part or provision of this ordinance be declared by a court of
competent jurisdiction to be invalid, the same sha11 not affect the validity of the ordinance as a
whole or any part thereof other than the part held to be invalid.
§91.11 DECLARED SHADE TREE PESTS, CONTROL MEASURES, AND CONTROL
AREAS
(A) Oak Wilt.
(1) Oak wilt disease is a shade tree pest and is defined as any living or dead tree, log,
firewood, limb, branch, stump, or other portion of a tree from any species of the genus Quercus
existing within the control area defined that has bark attached and that exceeds three (3) inches in
diameter or ten (10) inches in circumference and contains to any degree any spore or reproductive
structures of the fungus Ceratocystis .fagacearum.
(2) Control measures that may be taken to abate oak wilt disease are:
(a) Installation of a root graft barrier.
A root graft barrier can be ordered installed to prevent the underground
spread of oak wilt disease. The City will mark the locarion of the root
graft barrier. The barrier disrupts transmission of the fungus within the
shared vascular systems of root grafted trees. The barrier is created by
excavating or vibratory plowing a line at least forty-two (42) inches deep
between any oak tree infected with oak wilt disease and each nearby and
apparently healthy oak tree within fifty (50) feet of the infected tree.
(b) Removal and disposal of trees.
(i) On property zoned for residential and commercial use.
On property that is zoned residential and commercial the City may
mark for removal trees that have the potential to produce spores of
the fungus Ceratocystis fagacearum. After, and in no case before,
the installation of the root graft barrier and no later than May 1 of
the year following infection, all marked trees must he felled and
disposed of. The stump from such felled trees must not extend more

' than three inches above the ground or, if taller, must be completely
debarked.
If, however, after the City prescribes the location for a root graft
barrier, the City determines that installation of the barrier is
im ossible because of r

such as a septic system or utility line, the City may mark for
removal a11 oak trees whether living or dead, infected or not and
located between an infected tree and the marked barrier location.
These marked trees must be felled and disposed of no later than
May 1 of the year following infection. The stump from such felled
trees must not extend more tha.n three inches above the ground or, if
taller, must be completely debarked.
(ii) On all other property.
On all other property, the City may mark for removal all oak trees
whether living or dead, infected or not and located between an
infected tree and the marked barrier loca.tion. These marked trees
must be felled and disposed of no later than May 1 of the year
following infection. The stuxnp from such felled trees must not
extend more than three inches above the ground or, if taller, must be
completely debarked.
All wood more than three (3) inches in diameter or ten (10) inches
in circumference from such felled trees must be disposed of by
burying, debarking, chipping, or sawing into wane-free lumber, or
by splitting into firewood, stacking the firewood, and immediately
covering the woodpile with unbroken four (4)-mill or thicker plastic
sheeting that is sealed into the ground until Oct. 1 of the calendar
year following the calendar year in which the tree was felled, or by
burning before May 1 of the year following infection. Wood chips
from infected trees may be stockpiled or immediately used in the
landscape.
(3) The control area for oak wilt disease is defined as all lands within the boundaries of
the City.
(B) Emerald Ash Borer.
(1) Emerald ash borer is a shade tree pest and is defined as an insect that attacks and
kills ash trees. The adults are small, iridescent green beetles that live outside of trees during the
summer months. The larvae are grub- or worm-like and live underneath the bark of ash trees.
(2) Control measures that may be taken to abate emerald ash borer are those provided
in the document, Minnesota Emerald Ash Borer Science Advisory Group Recommendations on
Preparing for Emerald Ash Borer in Minnesota.
(3) Definition of control areas. The control area for emerald ash borer is defined as all

lands within the boundaries of the City.
(C) Dutch Elm Disease.
(1) Dutch elm disease is a shade tree pest and is defined as a disease of elm trees
caused by the fungus Ophiostoma ulmi or Ophiostoma novo-ulmi, and includes any living or dead
tree, log, firewood, limb, branch, stump, or other portion of a tree from any species of the genus
Ulmus existing within the control area defined, that has bark attached and that exceeds three (3)
inches in diameter or ten (10) inches in circumference and could contain hark beetles or any spore or
reproductive structures of the fungus Ophiostoma ulmi or Ophiostoma novo-ulmi.
(2) Control measures that may he taken to abate Dutch elm disease are:
(a) Use of fungicide.
Fungicides rnay be effective in preventing Dutch elm disease when
injected into living trees that do not already show symptoms of Dutch
elm disease. Fungicide injections on private lands aze optional and, if
performed, are at the landowner's expense.
(b) Removal and disposal of trees.
Prompt removal of diseased trees or branches reduces breeding sites
for elm hark beetles and eliminates the source of Dutch elm disease '
fungus. Trees that wilt before July 15 must be removed within 30 days
of detection. Trees that wilt alter July 15 must be removed by April 1
o£ the following year. Diseased trees not promptly removed will be
removed by the City at the landowner's expense. Wood may he
retained for use as firewood or saw logs if it is debarked or covered
from April 15 to Oct. 15 with four (4)-mill plastic. The edges of the
cover must be buried or sealed to the ground.
(3) Definition of control areas. The control area for Dutch elm disease is defined as:
All lands within the City that are zoned for uses other than industrial and agricultural plus a buffer
strip extending one thousand feet beyond such lands into all adjoining lands within the City.
Section 2: Effective Date: This ordinance sha11 be effective immediately upon its passage and
publication of the summary hereby adopted and attached as Exhibit A, according to law.
