Dear Dallas:
Thank you fOJ; the opportunity to oomment on the proposed plan amendment and
rezoning. We have the following comments.
1. The southern border of the subject area is the municipal boundary between Lino
Lakes and Centerville.
2. The Lino Lakes comprehensive plan guides the land immediately south of the
boundary for Medium Density Residential uses.
3. We recognize that there are existing uses on the subject site. We note that the public
notice states that an Industrial d~gnA1ion would better fit the current use.
4. While we are not fammRT' with the specific uses allowed.in your zoning ordinance, it
is typical that industrial zoning allows for more intense uses than commercial zoning.
We would ask that you consider the future uses of the site as well as the existing use,
and how future use of the site can be designed with sensitivity toward existing and
future residential uses.
5. Where an industrial district abuts a residential district, Lino Lakes requires a
landscape buffer area along the lot line. This buffer is not less that 40 feet in depth
and must include landscaping, planting, bennmg, or other effective screening.

6. Iffuture redevelopment of the site is contemplated, we would encourage working
with the Anoka County Highway Dept. to determine the appropriate, safe design for
access to CSAH 54 (20th Ave.).
7. In our experience, there have been numerous difficulties both for the City and the
landowners when zoning boundaries divide individual parcels. Questions likely will
arise in the future regarding allowable uses, appraisal values, subdivision potential,
and the like.

115. The petitioner requests to construct a roadway/driveway 9' 3" from the property
line of6995 Centerville Road. The meeting is scheduled for Tuesday, March 7, 2006 at

A .viriance is a use that is not generally permitted by the City's zoning ordinances but which is
allowed in .specia1 cases only. A request for a variance from the City's zoning ordinances will ~e
granted upon a showing of undue hardship by a property owner who is determined to have a unique
situation. . "Undue hardship" means that the property cannot be put to a reasonable use if the
conditions of the zoning ordinances are followed, that the property owner's particular circumstances
are unique and not self-created, and that granting a variance Will not alter the essential character of
the locality or neighborhood. Economic hardship alone will not constitute un<lue hardship if some
reasonable use cmrently exists Wider the terms of the City's zoning ordinance. If the property
owner purchased the property knowing that the City's zoning ordinances proluoited a use, the
property owner's circumstances are self-created.
Minnesota Statutes (MS 462.357, Subd. 6) and City Ordinances (Ord. #4, Division 180) require that
the following oonditions must be satisfied for approval of this request. Please respond to these
conditions using additional sheets of paper if necessary. .
1. Because of the particular physical surrOlJDdin~) shape or topographical
cOJiditions of the parcel ot lo~ the proposed variance would relieve an undue
hardship, as ~hed from a mere inconvenience, should the applicable
ordinance be stiictly enforced.
2. The pmpose of the proposed variance is not based exclusively upon a desire ~o
increa.selhe value or income potemii1 of the parcel of land, but would correct
extraordinary circumstances .applicable to this property but not applicable to other
property in the vicinity or zoning district.
3. The alleged. difficulty or hardship is .caused by the City Ordinance and has not
been created by any persons presently having an interest in the parcel of land.
4. The variance will not adversely affect public health, 'welfi1re and Safety and will
not be detrimental or injurious to property or improvements in the neighborhood
5 . Variances will not be granted that allow a use that is otherwise not a permitted use
in the zoning district that the subject property is located.

Re: Proposed entrance drive
Dear Mr. Larson:
I have been asked to comment on the proposal of St. Genevieve Parish to construct an
entrance drive from Heritage Street. The issue as I understand it is whether the City
should grant a variance to permit the entrance drive to line up exactly with Goifon Road
or require a property line setback that would result in the two sides of the intersection not
to line up.
It is not my place to judge a variance request, but I can say that most road authorities will
not only encourage, but in fact require, that intersections with roadways line up with
drives across the street. This creates a better flow of traffic and reduces the number of
intersecting points on the roadway. Anything that can be done to reduce conflicts and
confusion for drivers will serve to reduce the number of vehicle accidents, thus ma1cing
for a safer roadway.

My name Is Joe Highland and I live at 1680 Heritage st, which Is the ajoining property to where St. Genevieve's
is asking to a variance for their driveway. I understand that a publiC hearing wiD be held in February regarding
this. Reading the minutes of the January 4th meeting, I feel I have to comment on what was said there. I am not
going to make arguments at this time about the setback requinnents, but I need to say that I feel,Mr. Wilharber
has unfairly portrayed me. The reason that I called the mayor at one point ~ that Sl Genevieve's started
construction on the driveway without getting a variance from the city on a Saturday morning and she was the only
person I could get a hold of at that time. Had I waited until the following Monday it Is Dkely that most of the
construction would have been finished. I have not at any time refused to disCU$S matters with the Church.. nor
have I ever been unsupportlve of how they are using thier site. I do not want the planning and zoning .
commission to have an unfavorable Impression of me before they get a chance to even meet me. I know that Mr.
Wilharber has been very involved with the city, and that the member of the city council and planning and zoning
commission know him very well. However, I would ask you not to get an Image of me based on his comments at
the January 4th meeting. Thank you, and I look forward to meeting with you in the future.

Ref: St Genevieve new building site
To whom it may concern,
After reviewing the site plan for this site I believe that a driveway that loops
from Heritage Street to Centerville Road would make it easier for the
Centennial Fire District to access this property especially if there was an
incident that required multiple fire vehicles.
With a site as large as this site, it would be easy to get the one driveway
plugged with an emergency vehicle making it hard to get additional vehicles
to the building.

IUs that time of year to start planning for the Annual Earth Day Event Celebration! ' The actual event
will take place at Wargo Nature Center on April 22, 2006. The County-wide Service Project will run
9:30-11:30 am, lunch will be served for volunteers at Wargo from 11:30-12:15, and the Celebration will
take place from 12:30-2:30. We are putting together our planning committee to make the event as
wonderful as in past years. ,There is plenty of room for creativity 'and participation from a wide
variety of organizations.

Several months ago, the Planning and Zoning committee recommended updates
on the snowmobile ordinance. I walked away from the meeting with assurance
that there would be monitoring of snowmobilers.
Update:
Why are so many snowmobilers traveling above the speed limit? At least 75
percent using Old Mill Rd are speeding.
Why is It necessary for property owners to place sticks and reflectors along the
boulevard in an attempt to keep snowmobilers off their property?
Why do I see evidence of snowmobilers traveling across private property,
including church property?
Why do I see yellow tape attempting to keep snowmobilers from going across
driveways?
There have been two citations gMng out to snowmobilers this season in the trI-
city area. One was due to an accident with a snowmobile. Many people will
place poles and tape on their property to keep snowmobilers off their property but
do not report to the police. Driving through the city, it Is evident snowmobilers
are driving in places they do not belong.
One frightening incident I heard was a snowmobiler crossing through the church
property and running over a mat that covered a fuel line connecting propane gas
into the building under construction. The propane gas is used as temporary heat
for the building.
Obviously some people don't seem to use common sense when using these
machines. They have no respect for others property.
You have given two warnings to the snowmobilers, telling them If ordinances
aren't observed, the city will ban them from use in the city. How many warnings
are you willing to give? Is It three sticks and your out? Is It like the parents
gMng empty warnings to their children when they misbehave?

City A.dministrator Larson reviewed with the Commission language concerning
regulating signs in an attempt to regulate the nuisance Halloween signs. City
Administrator Larson indicated the City could attempt to add language to the nuisance
ordinance to regulate adult content visible from the street.

Commissioner Wright said he liked the wording.
After discussion, the Commission agreed to go this route first and, if it does not work,
then look to add something to the nuisance ordinance regarding content.
Motion by Commissioner Pant!e1L seconded by Commil...ioner Wood.. to recommend
Council aooroval of the ChAD.es as recommended by StatT. AQ in favor. Motion
carried unanimouslv.
2. BridBes in F.A!lements
City Administrator Larson indicated that the Public Works Director and City Engineer
both feel there may be situations where a culvert would be better than a bridge but each
situation would need to be reviewed on a case-by-case basis.
Council Liaison Terway indicated he would like to see language that states that
permission is granted to do this and have a disclaimer that states that it can be removed at
any time regardless of it being previously approved.
Staff indicated that the language would be clarified to ensure that residents are aware that
the structures can be removed at owner expense at any time.
Motion by Commissioner RAD7.A1. seconded by Commissioner Love. to recommend
Council aooroval of the CbADft to allow either bridaes or culverts in easements as
recommended with clarification on removal authoritY. All in favor. Motion carried
UDADimouslv.
v. NEW BUSINESS
1. Church of St. Genevieve - ProJ)Osed ReqJ,lest for Variance
Mr. Wilharber of 6849 Centerville Road, appeared on behalf of the Church as the Project
Coordinator for the building project and explained that the survey has been corrected and
there is 9.3 feet between the road and the adjoining property owner and 11 feet from the
other side. The alignment of this road would serve a number of purposes in terms of
exiting and entering the property as this is a five phase building program with this first
building being a parish hall used for a number of purposes and the City has even asked
about using the building for voting rather than using the school.
Mr. Witharber indicated that the surveys in Centerville to the south are off and the same
was true of even his own property finding it was ofFby 10 feet.
Mr. Wllbarber indicated that in 1984 the Church gave a quit claim deed to the LaMotte
family of 43 feet to them for a buildable site of 100 feet there.

Mr. W'tlharber indicated the Church is looking for a variance from the setback
requirements of20 feet.
Chair Hanson asked how the property owner to the east feel about this.
Mr. W'1lharber indicated he is not pleased with it being there and explained that he has
been keeping him informed and asking if he has questions but rather than discuss it with
the Church he has called the Mayor and he has not been willing to discuss the matter with
the Church.
Commissioner Klennert Hunt indicated that she sees the road is close to the house but it
would be terrible if the road would have to jog. She then said that the safety of the
intersection is important.
Mr. Wilharber indicated that there are 410 families that belong to St. Genevieve's and it
continues to grow.

2. B & R Properties - 6805 - 20th Avenue Request for Rezone
Ray Olson of B & R Properties appeared before the Commission and asked for
clarification of the zoning of his property.
City Administrator Larson explained that in the Comprehensive Plan this property was
zoned B 1 in 1997 but until very recently it was industrial zoning on the zoning map and,
the Comprehensive Plan takes precedence over the zoning map so, during housekeeping
items held last summer this was one to make the zoning map match the Comprehensive
Plan. He then explained that Mr. Olson's Bank has asked for a zoning letter as part of its
financing requirements and, as a B 1, they would be a legal nonconforming use in this
area so he could not expand and, if this is industrial not business, that expansion may not
be appropriate but it has been industrial in its use for a long time.
Commissioner Wood said he appreciates the changes done at this location and he does
not feel that rezoning would be an issue at this time.
Chair Hanson indicated he feels that the City is obligated to allow the use to be there and
do either a special use permit or rezone the property as this went through the steps with
the City and was approved.
city Administrator Larson indicated that a public hearing for rezoning and a
Comprehensive Plan amendment would be necessary to fix the situation.

Chair Hanson said he would be okay with going north to the point recommended by Staff
but not any further as it is more residential and would cause issues with residents.
City Administrator Larson asked who is originating the request and who would pay the
costs associated.
The Commission agreed that the City should correct the situation and pay the costs to do
so.
Motion bv Commissioner Klennert Hunt. seconded bv Commissioner Love to set a
public hearinl! for consideration of a Comorehensive Plan amendment and rezone
to 1-1 from B-1. AD in favor. Motion carried unanimouslv.
Mr. Wilharber indicated that the present public works site originally was Rehbein and
Rehbein built Mr. Olson's building and he thinks there is a Comprehensive Plan and
zoning map issue and the zoning map is correct. He then noted the same thing happened
with the Church but that whole strip was considered to be for a light industrial type
project.
3. Comments on AllAR Comprehensive Plan Amendment
Commissioner Klennert Hunt indicated that the new church has caused a lot of traffic
issues and the . huge development across the street will cause even more issues.
Chair Hanson said that Lino Lakes is pushing this because they have a plan they are
considering for the area.
Commissioner Klennert Hunt indicated she is opposed to growth before the traffic issues
with existing roads is handled but not to growth itself.
City Administrator Larson indicated the City can make comments but has no control over
the situation. He then suggested reasonable comments concerning the infrastructure
issues may be received better.
Council Liaison Terway indicated he is going to bring this up at the next Council meeting
concerning the plans for congestion related to the Church in Lino Lakes.
Commissioner Love-indicated that he feels that flow through traffic will assist with the
downtown redevelopment.
Chair Hanson said that the roads cannot handle it as they are and the City would like
roads improved.

city Administrator Larson reminded the Commission of the meeting on January 4, 2006
to discuss the status of the plan with the Park and Planning Commissions.
City Administrator Larson updated the Commission on the ponds as part of the MOll
with the County. He then indicated that Staff will be meeting with Mr. Rehbein on
January 24, 2006 along with the County to further discuss it.
