PRESENT: Mayor Tom Wilharber Council Member Steve King Council Member D. Love Council Member Jeff Paar ABSENT: Council Member Ben Fehrenbacher STAFF: City Administrator Dallas Larson City Attorney Kurt Glaser City Engineer Mark Statz I.CALL TO ORDER Mayor Wilharber called the meeting to order at 6:30 p.m. II.PUBLIC HEARING(S) None III.APPROVAL OF AGENDA Council was presented with a set agenda which was reviewed by Mayor Wilharber. Motion by Council Member King, seconded by Council Member Paar to approve the set agenda as amended. All in favor. Motion carried unanimously. IV.APPROVAL OF MINUTES 1.April 27, 2011 City Council Meeting Minutes Mayor called for modifications and hearing none Motion by Council Member Paar, seconded by Council Member Love to approve the April 27, 2011 City Council Meeting Minutes as presented. All in favor. Motion carried unanimously. 2.April 27, 2011 City Council Work Session Meeting Minutes Motion by Council Member Paar, seconded by Council Member Love to approve the April 27, 2011 City Council Closed Session Meeting Minutes as presented. All in favor. Motion carried unanimously. City of Centerville Council Meeting May 11, 2011 V.CONSENT AGENDA 1.City of Centerville April 28, 2011 through May 11, 2011 Claims (Check #26337-26357) & (Check # 2.Centennial Fire District Claims through May 6, 2011 (Check #4794-4811) 3.Special Event Permit – Cub Scout Rocket Launch, Laurie LaMotte Memorial Park, June 18, 2011 ~ 9:00 a.m. – 3:00 p.m. 4.Encroachment Agreement – Fence, 7296 Brian Drive 5.Successful Review of Public Works Director/Building Official Palzer, Completion of Year 17 6.P & R Support of Eagle Scout Project Flag Pole Installation at Corner Stone Park, 1670 Main Street 7.Purchase of 1994 Cushman Truckster w/Drag From City of Fridley in an Amount Not to Exceed $2,500 (Field Maintenance & Utility Vehicle) 8.Approve Use of Concession Trailer Agreement (Centerville Lions/City of Centerville The Mayor requested that Item #6 be removed from the consent agenda for discussion. Motion by Council Member Paar, seconded by Council Member King to approve the Consent Agenda as presented. All in favor. Motion carried unanimously. The Mayor had concern that the Eagle Scout Project could interfere with construction activities and suggested that scheduling take this into consideration. Administrator Larson and Engineer Statz both concurred. Motion by Council Member Paar, seconded by Council Member Love to approve Item #6 of the Consent Agenda as presented. All in favor. Motion carried unanimously. VI.AWARDS/PRESENTATIONS/APPEARANCES 1.Centerville Lions, Mr. Greg Kieselhorst a.Beer & Brat Event b.Park & Recreation Donation Mr. Greg Keiselhorst was present and stated that Council may not be aware of an agreement reached with City Staff to utilize the Lion’s Concenssion Trailer for the 2011 Little League Baseball games for a concession stand with profits going toward Parks & Recreation projects. Mr. Keiselhorst also stated that the Lions had received two anonymous donations in the amount of $450 and $525 and the Lions themselves desired to donate to this venture. Funds totaled $1,475 and were designated for the Little League Baseball Concessions. Mr. Keiselhorst stated that Item a was a new event for the Centerville Lions and it would be held in conjunction with the City Wide Garage Sale Days. Mr. Keiselhorst stated that this event would be held outdoors weather permitting, on the grounds of St. Genevieve, be handicap accessible and 21 and over with wristbanding at the door. Page 2 of 6 City of Centerville Council Meeting May 11, 2011 Council Member Love desired to have it noted that this was a 21 and over event. Motion was made by Council Member Love, seconded by Council Member King to accept the anonymous donations and the Lions donation in the amount of $1,475 to be utilized for offsetting expenditures associated with the Little League Baseball Concessions. All in favor. Motion carried unanimously. Motion was made by Council Member Paar, seconded by Council Member King to approve the Centerville Lions Special Event Permit Request and Temporary On- Sale Liquor License – (Strong) Beer & Brat Event, June 11, 2011 from 2:00 p.m. – 7:00 p.m. @ 6995 Centerville Road (Church of St. Genevieve Community Parish Center) as presented. All in favor. Motion carried unanimously. Council Member Paar requested that Mr. Keiselhorst pass along the City’s and the Parks & Recreation Committee’s appreciation for the donation to the anonymous donors and the entire Lions Club for their donation. Mayor Wilharber stated that last evening was the first evening for the concession stand to be at Laurie LaMotte Park and their gross revenue was marginal; however, the Parks & Recreation Committee anticipates that support will grow throughout the Little League season. VII.OLD BUSINESS 1.FCC Response (Staff/City Attorney/North Metro Cable) Administrator Larson reported that member cities and Staff felt that the North Metro Cable Commission’s attorney Steve Gazetta would respond as a whole rather than each individual member City. Council Member King stated that Attorney Gazetta preferred that each individual member City respond. Administrator Larson stated that Staff and Legal Counsel could spend a minimal amount of time and respond to only key questions. Motion by Council Member Paar, seconded by Council Member Love to authorize Staff to respond only to the items deemed pertinent to preserving the City’s authority to govern right-of-ways, permitting, etc. All in favor. Motion carried unanimously. 2. Res. #11-010 – Endorsing & Supporting P & R’s Nomination for the 2011 C.C. Ludwig Award Submission Administrator Larson stated that the Parks & Recreation Committee had been working on nominating previous Mayor Mary Capra for the C.C. Ludwig Award sponsored by the League of Minnesota Cities. Administrator Larson stated that the award is bestowed upon an individual serving in the capacity of a City Official who has served their community above and beyond their position and improved municipal government in numerous ways and conducted themselves in a selfless fashion for the betterment of their community. Page 3 of 6 City of Centerville Council Meeting May 11, 2011 Motion by Council Member Love, seconded by Council Member Paar to adopt Res. #11-010 – Endorsing & Supporting the Parks & Recreation Committee’s Nomination of Previous Mayor Mary Capra for the 2011 C.C. Ludwig Award as presented. All in favor. Motion carried unanimously. Mayor Wilharber applauded Parks & Recreation for their nomination and he feels it is a deserved item. VIII.NEW BUSINESS 1.Acceptance of the Centerville Lions Park Donation Discussed Previously. 2.Special Event Permit & Temporary On-Sale (Strong) Liquor License – Beer & Brat Event, June 11, 2011 from 2:00 p.m. – 7:00 p.m. @ 6995 Centerville Road (Church of St. Genevieve Community Parish Center) Discussed Previously. 3.Church of St. Genevieve Request for Temporary On-Sale (Strong) Liquor License & Gambling Permit for Their Annual Chicken Dinner, August 21, 2011 Motion by Council Member King, seconded by Council Member Paar to approve the Request for Temporary On-Sale (Strong) Liquor License & Gambling Permit for St. Genevieve’s Annual Chicken Dinner, August 21, 2011 as presented. All in favor. Motion carried unanimously. IX.ANNOUNCEMENTS/UPDATES Administrator Larson reported that as Council may be aware, an Eagle Scout project (tree planting ~ 22) is taking place on May 21, 2011 at Laurie LaMotte Memorial Park, 6995 LaMotte Drive at 9:00 a.m. weather permitting and they are looking for volunteers. Anyone interested may call City Hall or visit the City’s website for additional information. Administrator Larson reported that the Centennial Lakes Police Governing Board has been entertaining ordinances/code that could be utilizing within the three member cities attempting to streamline regulations for ease of officer enforcement. Council discussed licensing or not licensing cats and ferrets and with the potential of not licensing dogs. Consensus of the Council was that Staff would work with the other communities (Circle Pines & Lexington) in an attempt to gain uniformity in ordinances/code and report back to Council with his findings. Mayor Wilharber stated that the trail project construction had commenced and requested that Engineer Statz provide Council with an update. Engineer Statz stated that the Page 4 of 6 City of Centerville Council Meeting May 11, 2011 beginning phases of construction have commenced in the areas of Mill Road, CSAH54, between Heritage and Sorel Streets and Brian Drive with staking and etc. Administrator Larson stated that the City is in the process of placing information on the website with construction plans, dateline, contact information and regular updates. Engineer Statz stated that on-site meeting with the contractor would be had and he would keep the City abreast of the issues/areas of construction. Administrator Larson stated that an issuearose earlier in the day with regards to a residents newly constructed driveway that the trail would cross and upon discussion with Engineer Statz it was suggested to slightly modify the location of the trail placing the trail on the north side of the street rather than the proposed side. Mayor Wilharber questioned whether the current easement allowed for the modification. Engineer Statz stated that the current easement has room; however, an additional pedestrian ramp would need to be constructed which would incur slight additional expense. No action was taken, staff will work on adjustments to resolve the conflict. City Attorney Glaser felt that there was no need for a closed session regarding the Special Assessment Litigation (Sheehy Construction) due to no new information. Mayor Wilharber stated that recently a Planning and Zoning Commission member resigned, thanked Mr. Jim Wekseth for his services and called interested individuals to apply for the vacant position. Council Member Love reported that a number of individuals attended a recent Planning & Zoning Public Hearing for re-aligning the zoning districts with the 2030 Comprehensive Plan. Council Member Love stated that about a half dozen had objections to the re-alignment and others had no comments. The Planning & Zoning Commission took all comments under advisement. Council Member Love requested that residents who walked their animals please pick up after them and dispose of the feces properly in a suitable container rather than in the storm sewer which lead to the ponds and contaminates ground water. Council Member Paar requested an update from Engineer Statz regarding the sealcoating near Dupre Road and Meadow Lane. Administrator Larson stated that he did not believe Mr. Palzer and Mr. Statz have had time to focus on this issue; however, they will review the situation and report back. Council Member Paar stated that the parade registration form is available on the City’s website. Council Member Paar reported that the annual audit of the Centennial Fire District had just been completed and Fire Chief Jerry Streich has been performing his duties phenomenally with budget constrains and depleting staff due to retirements. Chief Streich is research new and innovative avenues for attracting new volunteer firefighters and new revenue sources. Page 5 of 6 City of Centerville Council Meeting May 11, 2011 Council Member King stated that he previously reported on the FCC request. Council Member King also reported that he requested additional information from the Finance Director regarding the Parks & Recreation Committee budget. Council Member King also stated that the flag pole Eagle Scout Project would be needing footings and the Scout would be working with the contractor. Mayor Wilharber stated that street vacuuming is completed, hydrant flushing is commencing this week and if any individuals are interested in becoming firefighters, apply at Station 2, 7741 Lake Drive or speak with a current firefighter regarding the application process. Mayor Wilharber stated that the new Police Chief is impressed with the current department, has suggested several new ideas, feels that he has been welcomed to the department and is becoming more familiar with his position. Mayor Wilharber stated that there were several high school students in the audience and questioned whether they had any questions. No questions were asked. X.CLOSED EXECUTIVE SESSION (Pending Litigation – Sheehy Construction) It was determine that it was not needed at this time.
