PRESENT: Mayor Tom Wilharber Council Member Ben Fehrenbacher Council Member Steve King Council Member D. Love Council Member Jeff Paar ABSENT: None STAFF: City Administrator Dallas Larson City Attorney Kurt Glaser City Engineer Mark Statz I.CALL TO ORDER Mayor Wilharber called the meeting to order at 6:30 p.m. II.PUBLIC HEARING(S) None scheduled. III.APPROVAL OF AGENDA Mayor Wilharber reviewed the additional items that were contained on the set agenda. City Attorney Glaser stated that Council would be holding a Closed Executive Session following the regular meeting to discuss pending litigation with Sheehy Construction. Motion by Council Member Paar, seconded by Council Member Love to approve the set agenda as amended. All in favor. Motion carried unanimously. IV.APPROVAL OF MINUTES 1. May 25, 2011 City Council Meeting Minutes “Mayor Wilharber reported that he and Council Member Fehrenbacher had met with the Mayor and one Council Member from Lino Lakes, Circle Pines and Lexington to discuss sharing and collaboration. They expect to meet one more time to discuss ideas and will at that point provide a list of ideas for staff to work on.” City of Centerville Council Meeting June 8, 2011 Motion by Council Member King, seconded by Council Member Paar to approve the minutes as amended. All in favor. Motion carried unanimously. 2. May 25, 2011 City Council Work Session Meeting Minutes Motion by Council Member Paar, seconded by Council Member Love to approve the Work Session meeting minutes as presented. All in favor. Motion carried unanimously. V.CONSENT AGENDA 1.City of Centerville May 26, 2011 through June 8, 2011 Claims (Check #26411- 26426) & (Check #26428-26442) w/Check #26427 Voided 2.Centennial Lakes Police Department Claims through May 26, 2011 (Check #8428-8450 3.Centennial Fire District Claims through May 20, 2011 (Check #4818-4834) 4.Approve Restated Plan Document for Nationwide 457 Deferred Compensation Plan (Updated to include Roth Contribution Amendment) 5.P & R Recommendation to Allow Ms. Thia Cassanova, Image Attitudes, to Hold a Yoga Session @ Hidden Spring Park on Saturday, July 30, 2011 from 3-4:00 p.m. Subject to Providing Liability Insurance w/City Named as Additionally Insured Motion by Council Member Fehrenbacher, seconded by Council Member Paar to approve the Consent Agenda as presented. All in favor. Motion carried unanimously. VI.AWARDS/PRESENTATIONS/APPEARANCES Karen Blaska, Anoka County Park Planner, was present and gave a brief review of the County’s request for a waiver of a portion of sewer connection fees for the Rice Creek Chain of Lakes Camp Ground. Ms. Blaska stated that the County’s plans for upgrading the buildings was included in phase one with the construction of the visitor center; phase two is upgrading the infrastructure to the buildings. Ms. Blaska stated that the Park is currently experiencing electrical issues and it is felt that while these issues are being addressed if would be advantageous to update their current sewer facilities and connect to the City’s sewer. It is projected that 22 SAC units (Met. Council determination) and Met Council’s fee would be approximately $49,000 and the City’s connection fee would also be about $49,000. Ms. Blaska stated that the County is requesting a reduction of 50% of the City’s fees due to the fact that the amenities that utilize the sewer services are only used 6 months of the year. Ms. Blaska stated that the County has also requested a reduction in the same percentage from Met. Council. Concensus of the Council was that reducing this fee for the County would be unjust for residents and developers that do not receive the same benefit. Council Member Fehrenbacher stated that the City has residents that are “snowbirds” who are also in the Page 2 of 5 City of Centerville Council Meeting June 8, 2011 community for only six months and they did not receive reductions. Consensus was that the City would consider a payment plan of up to five years for the County and suggested that Ms. Blaska return with a proposal at the next Council meeting. VII.OLD BUSINESS 1.Xcel Energy Franchise Ordinance ~ Tabled From Previous Meeting City Attorney Glaser requested that this item be tabled to the next meeting due to a lack of response from Xcel Energy. VIII.NEW BUSINESS 1.Res. #11-012 – Support for H.R. 1746, Community Access Preservation Act City Administrator Larson briefly reviewed the aspects of the bill along with City Attorney Glaser. Attorney Glaser recommended Council’s support of the resolution and stated the significance of informing the FCC of the ramifications of their desire to regulate/or not, PEG (Public, Educational & Government) Access and the impacts that it would have on communities. Motion by Council Member Fehbrenbacher, seconded by Council Member King to approve Res. #11-012 as presented. All in favor. Motion carried unanimously. 2.Consider Turning Off Part of the Downtown Street Lighting Mayor Wilharber stated that he requested that this item be placed before Council for discussion. Mayor Wilharber suggested that with the delay in the Downtown Redevelopment Project, all of the downtown lighting was unnecessary and a potentially small savings for the City if every other light were not utilized. Discussion ensued regarding current operation, public safety, the necessity of lighting, cost effectiveness, appropriate staggering and the concern for wear on the infrastructure. Consensus of the Council was to direct Staff to request in put from the Police Department prior to making the decision. Motion by Council Member Love and seconded to Paar to table this item to next meeting allowing ample time to obtain public safety information. All in favor. Motion passed unanimously. 3.Anoka County Parks & Recreation Request for Reduced Sanitary Sewer Availability Fees Associated w/Campground Facilities Previously discussed. 4.Stormwater Drainage Problem – East of Centerville Road Between Center Street & Meadow Circle Page 3 of 5 City of Centerville Council Meeting June 8, 2011 Mayor Wilharber stated that many residents desire to appear before Council at their next meeting regarding this issue. Mayor Wilharber stated that he inspected the area and it is saturated. Discussion ensued regarding definitions of wetland, items constructed in the drainage/utility easement, grade/elevations, maintenance, financial funding and priorities of ponds, etc. Mayor Wilharber stated that he solely desired that Council be aware of the residents that would be in attendance and possible options for them. IX.ANNOUNCEMENTS/UPDATES Administrator Larson reported that the scheduled I35W/E Coalition meeting in Hugo had been cancelled and reschedule to July. Council Members questioned the importance of their attendance. Administrator Larson stated that these meetings are for information sharing and for updates on the status of current and future projects in the area. Usually one or two council members attend along with the Administrator. City Engineer Mark Statz provided the Council with an update of the trail project: storm sewer work on Mill Road’s completion within several days with gravel and sand being placed following this, bridge work on Brian Drive and concrete work continuing, the second phase of the project along CSAH54 is commencing, concrete work along Centerville Road is also commencing, with other areas receiving temporary gravel and sand. Mr. Statz cautioned residents that the levels of these trails comparative to driveways is only temporary. Mr. Statz stated that the City’s website is consistently updated and the Lead Project Coordinator’s contact information is also available. Council Member King gave a brief Parks and Recreation update: Yoga at Hidden Spring, Signage for Trails, Bald Eagle Waterski Club’s dock installation and the Concession Stand at Laurie LaMotte Memorial Park operation. Administrator Larson stated that the Planning & Zoning Commission continues to work on the Comprehensive Plan zoning alignment and it is felt that items will be brought before Council in July. Council Member Paar reviewed several upcoming events and their dates stating that the City’s website is updated regularly and event information is available there. Parks & Recreation Chair, Patrick Branch was in the audience and questioned whether Council had considered purchasing the homes in the downtown area that are currently for sale and the ability to rent these homes until such time that the Downtown Redevelopment Project takes place. Concensus of the Council was to direct staff to research this possibility with the knowledge that funding was unlikely.
