meeting of August 10, 2011, at City Hall, 1880 Main Street. n

1. CALL TO ORDER
Mayor Wilharber called the meeting to order at 6:30 p.m.

None scheduled.
Hl. APPROVAL OF AGENDA
Mayor Wilharber reviewed the agenda with Council and requested adding the following items
under Updates; Rush Line Corridor, 135EAV Coalition and Trail Maps.
Motion by Council Member Love, seconded by Council Member Fehrenbacher, to
auprove the Agenda with the additions reauested by Mayor Wilharber. All in favor.
Motion Passed Unanimously.
IV. APPROVAL OF MINUTES

1. Xcel Energy Franchise Ordinance -- Tabled from Previous Meetings.
Attorney Glaser stated that be had recently contacted Xcel Energy requesting an updated
document; however, Xcel was unable to provide. Item was tabled.
VIII. NEW BUSINESS
None.
IX. ANNOUNCEMENTS /UPDATES
City Administrator Larson requested Council schedule a work session following the next City
Council meeting to continue budget discussions as the preliminary levy for 2012 needs to be
adopted in September.
City Administrator Larson reported that Veit has made a claim for extras on the trail project, due
to the State shutdown, that total over $40,000. The City Engineer will determine if all of the
claims are justified.
City Administrator Larson discussed with Council the possibility of tearing down the buildings
on property the city owns at 1688 Sorel. The matter will be placed on the next agenda.
Mayor Wilharber updated the Council on meetings he attended for the Rush Line Corridor and
135E/W Coalition. The Counties are to approve a second year of the Rush Line Corridor Transit

Carrier as ridership has increased and all reports are favorable. Mayor Wilharber informed the
I35E/W Coalition members of the dissatisfaction in the way the traffic is diverted at the
intersection of CSAH14 and 21' Avenue and the problems it is causing residents and business
owners.
Mayor Wilharber discussed the possibility of working with adjoining Cities and Anoka County
on trail maps and signage as a cost saving effort to not reproduce the same materials.
City Attorney Glaser updated the Council on the web based ticket payment and education system
he is currently working on as a potential diversion program. The City has potential to receive
additional revenue from traffic tickets.
City Engineer Statz reported Veit has begun paving some trail segments. Due to the state shut
down Veit will be asking for an extension.
Council Member King stated the Parks & Recreation Committee had questions regarding the
installation of the flag pole at Cornerstone Park and the high cost of the bid for electrical. The
committee requests that staff break down the electrical costs and solicits two additional bids.
Council Member Love stated the Planning & Zoning Commission was able to resolve the last
rezoning suggested by the 2030 Comprehensive Plan and approved new standards for granting
zoning variances. This will come to City Council for review and approval.
Mayor Wilharber stated the Fire Steering Committee meeting did not have a quorum and was
rescheduled for next week.
Council Member Fehrenbacher questioned when Anoka County was going to do the speed study
requested by City Council. City Administrator Larson said the County wanted to wait until the
interchange at 35E was completed, but he will contact the Highway Department to determine if
the speed study has been scheduled.
X. ADJOURNMENT
Motion by Council Member Love, seconded by Council Member Fehrenbacher to
Adiourn the meeting of August 10, 2011 at 7:05 D.m.. All in favor. Motion carried
unanimouslv.

September 17 — 23, 2011
WHEREAS, our Founding Fathers, in order to secure the blessings of liberty for
themselves and their posterity, did ordain and establish a Constitution for the United
States; and,
WHEREAS, it is important that all citizens fully understand the provisions and
principles contained in the Constitution in order to effectively support, preserve and
defend against all enemies; and,
WHEREAS, September 17, 2011, marks the two hundred twenty - fourth anniversary of
the drafting of the Constitution of the United States of America by the Constitutional
Convention; and,
WHEREAS, it is fitting and proper to accord official recognition of this magnificent
document and its memorable anniversary; and,
WHEREAS, the independence guaranteed to American citizens, whether by birth or
naturalization, should be celebrated during Constitution Week, September 17 through 23,
2011, as designated by proclamation of the President of the United States of America in
accordance with Public Law 915;

October of 2011 is proclaimed as
Domestic Violence Awareness Month
WHEREAS, the community problem of domestic violence has become a critical
public health and welfare concern in Anoka County; and
WHEREAS, domestic violence is a crime, the commission of which will not be
tolerated in Anoka County and perpetrators of said crime are subject to prosecution and
conviction in accordance with the law; and
WHEREAS, over thousands of women and children have and will continue to access
assistance from Alexandra House, Inc., a domestic violence service provider; and
WHEREAS, domestic violence will be eliminated through community partnerships of
concerned individuals and organizations working together to prevent abuse while at the
same time effecting social and legal change; and
WHEREAS, October is National Domestic Violence Awareness Month; and
WHEREAS, during National Domestic Violence Awareness Month, Anoka County
organizations will inform area residents about domestic violence, its prevalence,
consequences and what we, as a concerned community can do to eliminate its existence.
NOW, THEREFORE, BE IT RESOLVED AND KNOWN TO ALL that
the City of Centerville proclaims October to be Domestic Violence Awareness Month
on August 24, 2010.

WHEREAS, a certain special project construction fund was established to account for
revenue and expenses related to an improvement project, and
WHEREAS, project costs have been paid and such fund is no longer needed.

FINDINGS & CONCLUSIONS
Whereas, the Planning and Zoning Commission is tasked to fulfill the goals of the
Centerville 2030 Comprehensive Plan.
Whereas, that Comprehensive Plan guided certain areas to be removed from the
R -2 district and added to the M -2 zoning district.
Whereas, on March 1, 2011, the Commission held a public hearing to consider
proposed changes to City Code, Chapter 156, removing certain parcels from the R -2
zoning district and adding them to the M -2 zoning district. As a result of that hearing the
Commission makes the following findings of fact.
The Commission held a public hearing and considered comments and objections
to the proposed changes in zoning
Implementation of the 2030 Comprehensive Plan of the city can best be
accomplished by removing certain property from the R -2 zoning district and adding it to
the M -2 zoning district.
Based on these findings, the Commission proposes the attached amendments to
Chapter 156 of the Centerville Code. The Commission recommends that the City Council
adopt these findings and adoption of an ordinance amending Chapter 156.
Adopted by the Planning and Zoning Commission this 9 day of August, 2011.

THE CITY COUNCIL OF THE CITY OF CENTERVILLE ORDAINS:
SECTION 1. City Code Chapter 156, the City s zoning ordinance, is hereby amended by
removing the following parcels from the R -2 zoning district and adding them to the M -2
Mixed Use District:

SECTION 2. The Zoning Map of the City of Centerville referred to and described in
Chapter 156 shall not be republished to show the aforesaid rezoning, but the City
Administrator or the City Administrator's designee shall appropriately mark the Zoning
Map on file in the City Administrator's office for the purpose of indicating the rezoning
provided for in this ordinance and all of the notations, references, and other information
shown thereon are hereby incorporated by reference and made a part of this ordinance.
SECTION 3. This ordinance shall be effective immediately upon its passage and
publication according to law.

Findings and Decision Related to Code Amendments Regulating Variances
The Planning & Zoning Commission met on August 9, 2011, to consider proposed
changes to the city code that would modify the requirements for allowing variances.
Findings:
1) The Minnesota Supreme Court in its decision in the Krummenacher v. City of
Minnetonka, severely limited the City's authority to grant zoning variances.
2) The 2011 Legislature passed legislation that enables cities to once again consider
reasonable factors in granting variances.
3) The City staff drafted proposed changes to City Code Chapter 156, Section 156.310
which implement the authority on variances allowed by the new legislation.
4) The Planning & Zoning Commission held a public hearing on this date to consider the
proposed changes to Chapter 156, and the Commission considered public comments
regarding the proposed changes.
RECOMMENDATION:
The Planning and Zoning Commission determines that the proposed amendments to
Chapter 156 providing for standards to issue zoning variances, should be adopted
The Commission recommends that the council approve findings and recommendations of
the Commission and that the attached ordinance be adopted.

AN ORDINANCE AMENDING CITY CODE, CHAPTER 156, REGARDING
GRANTING OF ZONING VARIANCES.
THE CITY COUNCIL OF THE CITY OF CENTERVILLE ORDAINS:
Section 1 . PURPOSE. The purpose of this ordinance is to modify the city code to
conform with Minnesota Statutes 462.357 regulating the City's authority to grant zoning
variances.
Section 2 . City Code Chapter 156, section 156.310 is hereby amended to read as
follows:
§ 156.310 VARIANCES.
(A) Standards. The Planning and Zoning Commission shall recommend a variance
and the Council shall order the issuance of the variance only if it conforms to the
following standards:
(1) The variance is in harmony with the purposes and intent of the zoning
chapter of this code;
(2) The variance is consistent with the comprehensive plan; and
(3) The proposal puts the property to use in a reasonable manner; and
(4) There are unique circumstances to the property not created by the
landowner; and
(5) The variance if granted, will not alter the essential character of the locality;
and
(6) Any person filing a petition requesting a variance or an amendment of the
zoning chapter rezoning property or changing regulations within any use district shall pay
a fee according to the schedule established by resolution or ordinance of the City
Council. The fee is payable at the time of filing a petition and is not refundable.
(B) Board of Appeals and Adjustments. The Planning and Zoning Commission shall
act as the Board of Appeals and Adjustments and shall have the power to hear and
recommend requests for the following:

(1) Interpretation. Hearing appeals where it is alleged that there is an error in a
decision or judgment made by an administrative officer in the interpretation or
enforcement of this chapter or in the interpretation of zoning district boundaries; and
(2) Variances. Recommend variances from literal ordinance requirements in
instances where strict enforcement would cause undue hardship or practical difficulties
because of circumstances unique to the individual property under construction.
(C) Variance procedures.
(1) Applications provided by the city must be completed in writing prior to any
consideration of variance petitions. Fees required by the city shall be paid at the time of
application.
(2) The Board of Appeals and Adjustments may require the applicant to
provide copies of plans, maps, surveys and the like, as deemed necessary, to ensure
proper review and consideration of variance petitions.
(3) After filing an application, the Administrator shall set a date for a public
hearing. Notice of the hearing shall be posted and published at least ten days prior to the
date of the hearing, and notice shall be mailed to each property owner within 350 feet of
the property to which the variance relates. Defects in the notice or failure to notify
individual property owners shall not invalidate the proceedings, provided a good faith
effort was made to comply with these provi ions.
(4) Upon the hearing request, the Board of Appeals and Adjustments shall
either recommend approval or denial for the variance and shall state the reasons for the
action. Conditions which are designed to mitigate the adverse impacts of the variance
may be attached to any variance granted.
(5) Upon receipt of the recommendations of the Commission, the Council shall
hold whatever hearings it deems advisable and shall make its decision upon the request to
grant the variance. In granting the variance the Council may impose conditions which it
considers necessary to mitigate the adverse impacts of the variance. Violation of any
such condition is a violation of this chapter. The Board of Appeals and City Council
must find that the variance, if granted will conform with the "Standards" of this section.
(6) A variance granted but not used shall become void one year after its
effective date.
(7) No application for the same or essentially the same variance shall be made
within six months of the date of denial.
