* The DaBruzzi's have decided that they want to continue to own
and lease their building. I was able to find a company that
would have appraised their building for $800. They had
recalculated their options and decided they would be further
ahead to continue to lease their current buildings.
* The Lessard's (owners of Lake Area Utilities) have petitioned
the City to provide municipal improvements to their property.
If the 20th Avenue project is awarded, they would like to
develop their property right away.
* Reminder! We will be meeting at the Chauncey Barett Gardens
for a tour at 5:00 prior to the next Council meeting.
* The public works department will be flushing hydrants next
week.
* Reminder! A workshop has been scheduled for May 20th to
discuss the engineering proposals. I am going to post this as
a special meeting. I have some recommendations for summer
staffing needs. I asked the office staff to log the following
information. The information was gathered over one weeks
time. We had also logged at the same time last year.

Begardlne: Assessments for proposed 20th Avenue water main and sanitary sewer
extension.
The purpose of thle lanor is to express opposition to assessments based on "From Footage ", "Area" end
"Area minus Wetlands" as discussed at the April 29th City Councll meeting.
It is my feeling that assessments, as mentioned above, would unfairly burden Herman Strehlow due to the
minimal benefit to him. Herman Strehlow has no Intention of hooking -up to the city sewer or water. City
sewer and water would not be of benefit for his intended use, which is farming. It is my understanding that
one cannot build on property that is designated as floodplain. Even if he, at some date, wanted to build
an his property there Is no guarantee that the various government agencies would allow it. Also the cast
of raising the property out of the floodplain, which 97% of it is considered, would be extremely high.
Should one of the above assessments be accepted, further action will be pursued.

Re: 20th Avenue North Sanitary Sewer and Watermain Improvements
Attached are schedules indicating the following:
Exhibit 1.00: An estimated capitalization schedule for the issuance of $720,000 general
obligation bonds to finance the improvements on 20th Avenue North;
Exhibit 2.00: A proposed debt service schedule for maturing the bonds over a ten year
period, coordinating with the receipt of the special assessments over the same period of
time;
Exhibit 3.00: A spreadsheet reflecting the requirements of the principal and interest of
the bond issue, the 5% excess which is required by law to protect against delinquencies in
collection of assessments; the receipt of special assessments to be collected at 8% interest
on the unpaid balances from year to year, and the remaining non - assessed portion which
is expected to be paid from utility revenues.
We understand the City has received construction bids and has held an assessment hearing on
this project. If the Council feels the project is at an appropriate stage at tonight's meeting, we
would suggest that action be taken "to authorize City staff to work with Ehlers and Associates,
Inc. to solicit proposals for the sale of $720,000 General Obligation Bonds and report the results
to the Council for consideration on June I0, 1998."
Parkview Addition improvements: Our understanding is that the Parkview development
project is not quite at a stage where bonds could be issued based upon construction bids. This
makes it difficult to sell bonds for the Parkview project at the same time as the improvements on
20th Avenue North are financed. This could be accomplished if the Council was interested in
selling bonds based upon estimated costs rather than final construction bids.
We look forward to discussing the financing of these improvements this evening.

Water Availability Charge (WAC):
Water availability charges are the costs to connect to and become a
part of the Centerville water system. This charge pays for the costs
associated with water systems such as elevated storage, water
treatment facilities, and maintenance. The WAC charge is $2800 per
SAC unit.
Sewer Availability Charge (SAC):
Sewer availability charges are the costs to connect to and become a
)art of the Centerville sewer system. This charge pays for the costs
associated with the sewer system, such as lift station rehabilitation and
operation costs, sewer cleaning, and system maintenance. The SAC
charge is $1750 per SAC unit for the City of Centerville. The
Metropolitan Council of Environmental Services also issues a SAC
charge. This charge is $1000 per SAC unit.
Property Owner Costs:
The individual property owner will be responsible for the connection
between the property line and the individual building. Because of the
many different configurations, this cost varies considerably, and is
difficult to estimate. Property owners may also have costs associated
with taking individual well systems and septic systems out of service.
The current City Ordinance requires property owners to connect to the
sewer once sewer service is available. Property owners must connect
o the water system once a private well system is in need of repair.

ASSESSMENT HEARING/WORKSHOP

Pursuant to due call and notice thereof, the City Council of the City of Centerville held an
assessment hearing and workshop on Wednesday, April 29, 1998 in the Council Chambers of City
Hall, 1880 Main Street.

Mayor Wilharber opened the executive session at 5:30 p.m.
Ms. Julie Wolfe (Minnesota Human Rights Department) gave an overview on a pending claim
against the City of Centerville. Ms. Wolfe requested authority to negotiate the best offer for the
City. In addition, the proceedings are confidential. However, the settlement is public.
Councilmember Buckbee moved and it was seconded to close the executive session at 5:55
p.m. Motion carried unanimously.
Mayor Wilharber opened the assessment public hearing at 6:05 p.m. Mayor Wilharber noted the
assessment public hearing will adjourn by 7:00 p.m because the Metropolitan Council has
scheduled a public hearing on the Centerville interceptor at 7:00 p.m.
Mr. Nyberg gave a brief overview of the proposed improvements on the 20th Avenue north
sanitary sewer and watermain improvements. The proposed sewer will operate by gravity to the
lift station. There will be turf restoration by way of seed and sod. Erosion control measures will
be implemented.
Mr. Nyberg noted the project bid was held on April 21, 1998. Bonine Excavating bid
$508,790.65. The bid process included an east watermain extension, SCADA/Telemetry System
and a directional bore forcemain. Mr. Nyberg addressed three exhibits for the 20th Avenue
improvements, first an overall proposed project area, the proposed watermain improvement and
last the proposed sanitary sewer improvement.
Mr. Nyberg added, the truck watermain construction cost project total is $227,179.32. However,
if alternate A "East Watermain Extension" is included in the project there will be an additional
$45,620.00 cost. The 20th Avenue trunk sanitary sewer construction costs will be $281,611.33
which includes the forcemain, lift station, sitework, street and storm sewer. Therefore, the total
construction cost will be $508.790.65. Furthermore, the total project costs including overhead,
without alternates will be $702.120.00.
Mr. Nyberg explained the proposed project schedule. Two public informational meetings were
held on both February 26, 1998 and August 13, 1997. A public hearing was held on September
24, 1997. The plans were approved and a petition to order advertisement bids was completed on
February 11, 1998. The City held the bid opening on April 21, 1998. Currently, the Council is
holding a public assessment hearing. The City Council is scheduled to award the project on May
13, 1998. The City will begin construction in May 1998 and the project should be complete by
August 1998.
Mr. Nyberg presented a synopsis of four watermain and sanitary sewer assessment scenarios: one
by property front footage, one by total area, one by area minus wetlands and one by area minus
floodplain. Mr. Nyberg informed the property owners the water availability charges (WAC) and
sewer availabity charges (SAC) are the costs to connect to and become a part of the Centerville
water system. The WAC charge pays for the cost associated with water systems such as elevated
storage, water treatment facilities and maintenance. The WAC charge is $2800 per unit. In
addition, the SAC charge pays for the costs associated with the system, such as lift station

Mr. Kenny & Ms. Colleen Carpenter (6885 -20th Avenue) stressed concerns about the assessment
and hook ups. Mr. Carpenter questioned, "Why is this project taking place ?" Mr. Nyberg
responded that Mr. Gerald Rehbein petitioned the City for improvements to his property east of
20th Avenue. Mr. Carpenter commented since Mr. Rehbein petitioned the City, he should pay the
cost for the improvements. Mr. Carpenter added, he invested $30,000 for his current well and
septic and both are in good condition. In addition, he is paying taxes on the installed
improvements. Therefore, "Why should he have to hook up when the sewer is installed ?"
Mr. March noted the current City Ordinance requires property owners to connect to the City
sewer, once sewer service is available. Property owners must connect to the water system once a
private well system is in need of repair. Also, the City can only assess what the improvements will
increase the value of the land. However, if a property owner disagrees with the city's estimated

valued increase, the property owner can have the property appraised and then contest the
assessment cost.
Mr_ Carpenter questioned, "Why does the property owner have the burden of proof?' Mr.
March explained the burden of proof lays on the Council and the engineer, to fairly distribute the
assessment cost.
Mr. Jack & Ms. Joyce Green (7007 20th Avenue) expressed concern about saving the treeline and
shrubs along their south property line. Mr. Nyberg noted one of the alternate bids (Bore
Forcemain) cost $18,000 more to redirect the forcemain, which is cost prohibited. However,
H.R. Green plans to explore other options to preserve the trees.
Councilmember Buckbee clarified letters contesting the assessments and letters of appeal are to be
submitted by the end of the public hearing. Mr. March suggested the Council consider continuing
the public hearing until the next Council meeting, May 13, 1998. Mr. Nyberg emphasized H.R.
Green tried to produce several alternatives to accommodate all parties involved.
Councilmember Buckbee noted if the City elected to assess the area minus floodplain and a hook
up was not available to 6885 -20th Avenue, then the Carpenters would not be assessed. Mr.
Nyberg agreed, because the property is considered in a floodplain.
Mr. Carpenter felt a stub should be put in place for future property use. Mayor Wilharber
confirmed fill can be brought to the floodplain properties and then the land could be taken out of
the floodplain. Therefore, the property value would increase and potentially be completely
developed. Mr. Nyberg agreed.
Moreover, Councilmember Buckbee stated if the Carpenters elected not to hook up now and in
the future they bring in fill, they could be assessed then for the stated improvements. Mr. Nyberg
agreed. Councilmember Buckbee concluded this would place the assessment burden on the larger
property owners.
Mr. Carpenter suggested the city place a connection to his property for future improvements.
Then the cost would be off set when the property is brought up to code.
Mr. Russel Strehlow (property legally identified as 24- 31 -22 -32 -0003) clarified the four
assessment options and the Council's time line to elect an assessment option. Mayor Wilharber
replied an appeal must be received by the City no later than 4:00 p.m. on Wednesday, May 13,
1998.
Mr. Strehlow questioned, "Does the area minus floodpWn include wetlands ?' Mr. Nyberg
replied no, the city has copies of the wetlands and they would not be included in the floodplain.
Councilmember Brenner moved and it was seconded to continue the 20th Avenue

assessment hearing until Wednesday. May 13 199$ Motion carried unanimously.
The Council elected to meet at 5:00 p.m. on Wednesday, May 13, 1998 to tour the Senior
Housing Facility.
Mr. March reported Anoka County requested Parkview Development allocate a sixty -foot
easement onto the properties west of Centerville Road. The Council concluded the sixty -foot
easement would hinder the property value in the Parkview Development.
Councilmember Buckbee moved and it was seconded to adjourn the meeting at 6:50 p.m. Motion
carried unanimously.

Dear Mr March:
As you requested, we are providing a cost estimate for preparation of plans and specifications
for watermain and sanitary sewer extensions Into the proposed Centerville Business Park.
We understand that this plat wilt be reviewed at the May Planning and Zoning meeting, If so
dlrected by the City Council, preparation of plans and specifications could begin immediately
after this meeting. If the developer of the parcel petitions for the improvements, we could also
begin wo-k on a feasibility study for the project at the direction of the City Council,
Sanitary sewer is available in the vicinity of the Business Park along Main Street and 20"
Avenue. Watermain is also available along the same corridors. Once the preliminary plat has
been approved, we can configure a proposed sanitary sewer and watermain alignment through
the Business Park that will provide sewer service and domestic and fire flow water supply to
each proposed lot and building.
We recommend that the sanitary and sewer trunk lines follow along Interior road corridors to the
greatest extent possible. We further recommend that the water and sewer system be Installed
and operated as City improvements, Interior streets can be maintained as private streets, much
like the Willow Glen development.
Our cost estimate for preparation of the plans and specifications for this project is $11,000-
$16,000, depending on revisions based on grading plan and plat changes. If the developer
petitions for the improvements under the 429 rules for public improvement projects, we would
complete a feasibility study for this work and have a public hearing prior to beginning work on
the plant
With your authorization, we will proceed with this work in the direction you provide to us. We
es0'mate that we could have plans and specifications for approval by the Centerville City Council
in about *our to sex weeks, depend! on on action by the developer. A feasibility study could be
ready for your review by the June 10t City Council meeting.

RESOLUTION 98 -08 ADOPTING 20TH AVENUE NORTH ASSESSMENT ROLL
WHEREAS, pursuant to proper notice duly given as required by law, the council has met and
heard and passed upon all objections to the proposed assessment for the improvement of 20th
Avenue north.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CENTERVILLE, MINNESOTA:
1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is
hereby accepted and shall constitute the special assessment against the lands named therein, and
each tract of land therein included is hereby found to be benefited by the proposed improvement
in the amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments extending over a period of
years determined by the Council, the first of the installments to be payable on or before the first
Monday in January 1999, and shall bear interest at a rate percent per annum determined by the
Council, from the date of the adoption of this assessment resolution. To the first installment shall
be added interested on the entire assessment from he date of this resolution until December 31,
1998. To each subsequent installment when due shall be added interest for one year all unpaid
installments.
3. The owner of any property so assessed may, at any time prior to certification of the
assessment to the county auditor, pay the whole of the assessment on such property, with interest
accrued to the date of payment, to the city treasurer, except that no interest shall be charged if the
entire assessment is paid within 30 days from the adoption of this resolution; and he may at any
time thereafter, pay to the city treasurer the entire amount of the assessment remaining unpaid,
with interested accrued to December 31 of the year in which such payment is made. Such
payment must be made before November 15 or interest will be charged through December 31 of
the next succeeding year.
4. The clerk shall forthwith transmit a certified duplicate of this assessment to the county
auditor to be extended on the property tax lists of the county. Such assessments shall be collected
and paid over in the same manner as other municipal taxes.

RESOLUTION 98 -11 AWARDING THE 20TH AVENUE NORTH PROJECT
WHEREAS, the Centerville City Council authorized the preparation of the feasibility study on
December 11, 1996, and
WHEREAS, the Centerville City Council held a public informational meeting on August 13,
1997 and a public hearing on September 24, 1997, and
WHEREAS, after the public hearing plans and specifications were ordered, and
WHEREAS, the Centerville City Council approved the plans and specifications on February 11,
1998, and authorized advertisement for bids, and
WHEREAS, the bid opening occurred on April 21, 1998, and
WHEREAS, pursuant to proper notice duly given as required by law, the Council has met on
April 29, 1998 and conducted an assessment hearing, and
WHEREAS, on May 13, 1998 a continuation of hat assessment hearing has been conducted and
afforded an opportunity to all persons choosing to be heard, and
WHEREAS, the improvements as proposed by the City Engineer are ordered to be constructed,
and
WHEREAS, the plans and specifications for the improvements as prepared by the City Engineer
are approved, and
WHEREAS, the Centerville City Council declares its official intent to reimburse the costs of
improvements, now estimated to be $508,790.65, from the proceeds of tax exempt bonds to be
issued by the city.
NOW, THEREFORE BE IT RESOLVED pursuant to an advertisement for bids for the
improvement, bids were received, opened and tabulated according to law. And it appears that
Bonine Excavating of Minnesota is the lowest responsible bidder.
BE IT FURTHER RESOLVED it is authorized and directed that the city enter into a contract
with Bonine Excavating of Minnesota for the improvements of the 20th Avenue North sanitary
sewer and watermain improvements according to the plans and specifications therefore approved
by the Centerville City Council and on file in the office of the city clerk.

Dear Mr. March:
This correspondence is provided to update you on the status of several issues surrounding the
above - referenced project, As you know, we opened bids for this project on April 21 Boriine
Excavating, Inc., was the low bidder on the project.
Below are summaries of our progress to date on the issues of easements and assessments.
Easements
We are ocntinuing to negotiate easements with property owners. All of the easements, with the
exception of the forcemain easement along the Lake Area Utility property, should be signed and
in hand prior to the May 19 City Council meeting. Mr, W J. Lessard will be in attendance at
the May 13' Council meeting to discuss his proposed assessment an the project. We need to
acquire an easement from Mr. Lessard to install the forcemaln according to the plan. We hope
to come to an agreement on his easement soon.
If an agreement with Mr. Lessard cannot be reached regarding his easement, an alternavve
would be to install a temporary forcemain connection with the sanitary sewer manhole at the
south end of the Industrial Park. A permanent forcemain connection to the Brian Drive sanitary
sewer would occur in the future when the Lake Area Utllky property Is developed. Another
alternative would be to install the forcemain closer to the Stevens property, resulting in
significant tree loss. We hope to avoid both of these situations and come to terms with Mr.
Lessard on the proposed easement.
We recommend that the project not be awarded until the easement issues are resolved It
would be appropriate to award the project contingent upon receiving the required easements, so
that construction can begin immediately after all the easements are acquired.

Assessments
The Assessment Hearing for the project was opened on April 29, 1998. Two property ownsrs
were in attendance at the meeting. Mr. Ken Carpenter and his wife, representing Carpenter
Auto Body, and Mrs, Joyce Green Stevens, and her husband, Jack Green, expressed their
concern about the project during the hearing. No action was taken toward adoption of an
assessment roll at the hearing. The assessment hearing was continued until the regular City
Council meeting on May 13". We recommend adoption of an assessment roll at the May '3
meeting, prior to award of the project,
Summary
In conclusion, we recommend an award of the project If an assessment roll is adopted at the
May 13 City Council meeting. if the easements are not completed prior to the May 1 e Council
meeting, we would then recommend an award or the project contingent upon receiving the
required easements for the project.

On Tuesday, May 5, the Planning Commission readdressed the petition from Roger Kolsted to
vacate Clearwater Road and to rezone the property from residential to commercial. The Planning
Commission heard support and opposition to the request. The Planning Commission made the
following recommendation:
Buckbee moved and it was seconded to recommend to the Council to deny the request
because of spot zoning concerns and to wait for the downtown revitalization results. Motion
carried unanimously.
Mr. Kolsted requested this item be tabled, not denied until the Design Team has an opportunity to
review the city schemes and make recommendation to the Council.
