HomeMy WebLinkAbout2011-07-05 P & Z Minutes - Approved CITY OF CENTERVILLE PLANNING AND ZONING COMMISSION Pursuant to due call and notice thereof, the Planning and Zoning Commission held its regularly meeting on July 5, 2011, at 6:30 p.m. PRESENT: Chairperson Darrin Mosher Commissioner Thomas Wood Commissioner Eric Larson Commissioner Matthew Montain ABSENT: Commissioner James Flint Commissioner Olaf Lee STAFF: Administrator Dallas Larson OTHERS PRESENT: Council Member D. Love I. CALL TO ORDER. The meeting was called to order by Chairperson Mosher. 1.Roll Call II.PUBLIC INPUT/HEARING - None III.OLD BUSINESS . 1. Comprehensive Plan Alignment – Zoning R-2 (Single Family Residential) Change to M-2 (Mixed Use) There was much discussion about the proposed change. Commissioner Larson suggested that the commission go back and revise the plan to eliminate this change. Motion by Commissioner Wood, seconded by Commissioner Mosher to approve the findings and recommendation for approval of the rezoning. Voting in favor: Mosher & Wood. Voting against: Larson. Commissioner Montain abstained. The motion failed. NEW BUSINESS. IV. 1.Commission decision regarding which industrial uses in the area rezoned to B-1 that qualify for Interim Use. Motion by Wood that the Commission approve findings and Decision Related to B-1 Interim Use Status. Motion seconded by Commissioner Larson, all present voted in favor. Motion carried. 2.Amend City Code as it relates to granting variances. Page 1 of 2 City of Centerville Planning and Zoning Commission July 5, 2011 It was noted that recent legislation passed into law by the State modifies variance authority of Cities. The change will necessitate a modification to the Zoning Chapter of City Code to conform to the State law. Motion by Commissioner Larson that the Commission schedule a public hearing for its next meeting to consider an amendment to conform the Zoning Chapter of City Code to match legislative authority.. Motion seconded by Commissioner Wood, all present voted in favor. Motion carried. V.DISCUSSION ITEMS None VI. CONSIDERATION OF MINUTES Motion by Commissioner Larson, seconded by Commissioner Mosher to approve minutes from the June 7, 2011, meeting. All in favor. Motion carried unanimously. VI. PLANNING AND ZONING COMMISSION MEETING ADJOURNMENT Motion by Commissioner Wood, seconded by Commissioner Larson to adjourn the meeting at 7:12 p.m. All in favor. Motion carried unanimously. Findings and Decision Related to B-1 Interim Use Status The Planning & Zoning Commission met on May 3, 2011, to consider rezoning certain property in accordance with the 2030 Comprehensive Plan, guided uses. Findings: 1) The City adopted its 2030 Comprehensive Plan on August 26, 2009. 2) The 2030 Comprehensive Plan provided guidance for future land uses in several parts of the city. ' 3) The City approved rezoning of certain properties from Industrial I-1 to Commercial B-1, to bring the Official Zoning Map into conformance with the intended uses as indicated by the 2030 Comprehensive Plan. � 4) City Code Chapter 156.030, N, requires the Planning and Zoning Commission to i determine if any property that is rezoned from industrial to commercial qualifies as an interim use pursuant to this section. Su h review was undertaken by the Commission on May 3, 2011, and certain parcels were found to qualify for interim use status. i RECOMMENDATION: � The Planning and Zoning Commission determined the following properties are conforming industrial uses qualifying them for interim use status in the B-1 zoning district in accordance with City Code Chapter 153.030, paragraph N: Industrial Park, Block 1, Lots 3, 4, 5, 6, 7, 8& 9, in the City of Centerville, per the recorded plat thereof, on file with the Recorder of Anoka County, Minnesota. The Commission recommends that the council approve findings and recommendarions of the Commission and that these findings and decision be recorded with Anoka County. Approved by the Pla.nning & Zoning Commission of the City of Centerville on July 5, 2011.
