* Mr. Joe Goetz of Goetz Landscaping has indicated that they would now like to build a 5000
square foot building all on one level in the Industrial Park. They are going to be revising their
plans and hold a public hearing for a special use permit in November.
* The Planning and Zoning Commission rescheduled their next meeting to November 10, 1998,
since their regularly scheduled meeting date conflicts with election day.
* City Hall will be closed on Monday, October 12 in observance of Columbus Day.
* I received a copy of an appraisal that was performed on the Lake Area Utilities building. The
appraisal was conducted in November of 1995. At that time the property appraised at $290,000.
The Lessards are interested in selling the building to the City for a potential public works site.
Mr. Lessard is going to be meeting with his accountant to see what type of terms he could offer.
I will place a copy of the appraisal in Council mailbins to be circulated. The tower on the
property generates $3600 /year from antenna rental. The firm Case corporation currently leases
the warehouse space from them at a rate of $2625 /month and they also pay 90% of the utilities,
taxes and general maintenance. The property currently generates $7,749 in annual taxes.
* The curb and gutter has been constructed on the development known as the Woods of
Clearwater Creek. The pavement is scheduled to be installed on Monday.
* A fire steering committee meeting has been scheduled for 3:30 on Tuesday, October 13.
* Gerald Rehbein indicated that the school has authorized up to $70,000 to be spent on the
designing of the kindergarten building. The building would probably be started in the spring of
1999. He also indicated that he should have a purchase agreement in hand from the County Bank
by next week.

Pursuant to due call and notice thereof, the City Council of the City of Centerville held it s
regularly scheduled Council meeting and Special Emergency Meeting on Wednesday, September
23, 1998, at City Hall, 1880 Main Street.

The City Council met in closed session beginning at 5:00 p.m. Mayor Wilbarber called the
September 23, 1998 Council meeting to order at 6:30 p.m.
PUBLIC HEARING (S)

Ms. Mady Reiter (Circle Pines - Lexington Police Department Commission Chairperson) was
present to address the City Council. Moreover, Ms. Reiter thanked the Mayor, Council and City
Adminstrator for attending the 1999 Circle Pines - Lexington Police Department ( CPLPD) budget
meeting.
Ms. Reiter also was present to request the Councils resolution on the recommendation of the
CPLPD Comnussions recommendation to hire Joel Heckman as the Chief of Police. Ms- Reiter
explained the interview process. Foremost, June 30 was the application and supporting
documentation deadline, fourteen applications were received. Next, all applicants were rated and
six candidates had oral interviews. The top two candidates are, Mr. Joel Heckman and Mr.
Robert Makela. Ms. Reiter noted the Commission recommended Mr. Joel Heckman, If selected,
the Commission will begin negotiating a contract with hire date of December 1, 1998.

Mayor Wilharber expressed his appreciation to all the Police officers for picking up the slack in
the absences of a Chief.

PETITIONS AND COMPLAINTS
Councilmember Brenner shared that she received a complaint from a resident in regards to the
noise and dust generated from the construction site east of the Willow Glen Development.
Councilmember Buckbee requested Staff execute a letter to the resident informing them that the
City plans to address the issue during the October Planning and Zoning Meeting.
Mayor Wilharber commented he received a call from a resident regarding low water pressure.
Mayor Wilharber called Public Works and Tim Danielson immediately returned his call and
- --solved the problem.
UNFL'4SHED BUSUINESS
The Woods of C! anvat r Creek Approve Variance for Temaorat5 cu -de -sac & R Length
Mr. March gave a synopsis of the Woods of Clearwater Creek Development and he noted the
Planning and Zon ng recommendation to approve the road over 800' in length with a temporary
cul -de -sac and that the dimensions are to meet with the City Engineers approval.
Mayor Wilharber questioned Staff if the Fire Department had comments in regard to the variance
request. Ms. Gaustad responded that the Fire Deparment did not have any concern with neither
the road length nor the temporary cul-de-sac.
Councilmember Buckbee offered to move as per the Planning and Zoning Commissions
recommendation to approve the road length over 800' into a tem oorary cul -de -sac.

Laurie I a Votte Memorial Park Update
TAx. Peterson updated the Council on Laurie LaMotte Memorial Park. Basically, the park
modifications include ponds dug, swale up to the parking lot, and the catch basin next to the
hockey rink will be shallower because Lino Lakes will not allow water to drain onto its prope ty.
Councilmember Brenner acknowledged Public Works efforts installing the watermain, thus,
saving the City nearly $20,000. Mayor Wilharber requested the Public Works /Building Official to
extend the Councils gratitued to the Public Works employees.
Mr. March requested the Council direct Staff in accordance with Laurie LaMotte Park and its

development. In addition, several residents called requesting that the hockey rink be in operation
this winter. Mr. Peterson explained proposed changes to contract qualities as it pertains to the
storm se�Ner between the building and the hockey rink. The Council discussed the 540,000 cost
to ensure the hockey rink and the surrounding area is operational for 1999 winter activities.
Councilmember Buckbee moved to accept BRA proposal {616- 98 -80 -'1 dated September 17,
1998 including the amendment to 15' RCP storm sewer Councilmember Bremier seconded
the motion. Motion carried unanimously.
21stArenue Roadwar Inmrovement
Mr. March initiated a discussion on 21st Avenue roadway improvements and he noted that the
City of Lino Lakes wanted to ensure that the project is not delayed. The City of Lino Lakes
would like to advertise the project this winter and to have work commence spring of 1999.
Councilmember Buckbee noted the 21 st Avenue business owners had concern about turn lanes.
Councilmember Buckbee moved to direct Citv Staff to contact Lino Lakes Staff and inform
them that the Centerville City Council authorized bidding for winter of 1999.
Councilmember Brenner seconded the motion. Motion carried unanimousiy.
Emnloree Benefit Program
Councilmember Buckbee inquired about deferred compensation/health benefits for City Staff.
Mr. March confirmed Councilmember Buckbee's inquiries that all part-time and full -time
employees can either apply their monthly (city) allocation toward health benefits, deferred
compensation or a combination of the two.
NEW BUSINESS
$neeial Use Permit - Pe yen eer
Mr. March commented on a Special Use Permit (SUP) request the City received from Mr. Tim
Peppenger, to operate an auto electric repair shop at 7129 20th Avenue North. Mr. March added
the Planning and Zoning recommendation was to approve the SUP request.

Motion carried unanimously.
Mr. Peppenger was present and informed the Council his plan is to open for business on October
15, and he will specialize in auto electric services. On behalf of the City, Mayor Wilharber
welcomed Mr. Peppenger to Centerville.
Extend Garhaae Contract
Mr. March reported on the current residential refuse contract. Foremost, U.S.A. Waste was sold
and now is Waste Management. Next, Waste Management is interested in extending the current

contract for one year under the current contract terms.
Councilmember Buckbee moved to extend the current contract with Waste Nlanaoement
one year at t he current contract rues Councilmember Br enner second the motion.

Executive Session
City Attorney James Hoeft, announced the Council had an executive sess.en on September 23, at
5:00 p.m. On Friday, September 18, 1998 an incident occurred 'between Receptionist Jill Lein and
Deputy Clerk Danell Westbrock. There was inappropriate conduct by both employees and the
Council took the following action: Deputy Clerk Danell Westbrock is to be immediztely
terminated. Receptionist Jill Lein is to be suspended five (5) working days, be on nine (9) months
probation and a letter of reprimand is to be placed in her personnel file.
COMMITTEE REPORTS
EDC Committee
With re_-et, Councilmember Brenner informed the Council that Cha er member N.I. Dan
Tourviile resigned from the EDC Committee.
Councilmember Buckbee moved to direct Staff to write a letter thanking Mr. Tourville for
his service on EDC. Councilmember Brenner seconded the motion. Motion carried
unanimously.
ADMINISTRATORS REPORT

Mr. March indicated that the City received a request from Dennis Shudy to purchase one acre of
property, located at the City's very southeast corporate boundary.
Councilmember Brenner commented she was not interested in eliminating any potential Public
Works building sites until one is selected. Mayor Wilharber suggested the Parks and Recreation
Committee get involved and that the City explore where and how the city obtained the land.
Councilmember Buckbee favored the idea to retain the property for a future Public Works
location or for a bargaining tool. City Attorney Jim Hoeft advised exploring how the city
obtained the land and if there are any selling restrictions. The Council consensus was to explore
how the city obtained the property.

Mr. March added, the Park and Recreation Committee plan to explore the park fees and then
review its options during the October meeting.
Center Villa Grading-Plan
Mr. March reported that Mr. Willie Lessard was present to request a grading permit for the
property at Lake Area Utilities (6994 20th Avenue). In addition, the west two - thirds of the
property will be residential and the east one -third commercial. He also noted that the Planning
and Zoning Commission favored the sketch plan presented during its September meeting.
Mr. March commented that ordinance "8 indicates that the grading permit can be issued after the
preliminary plat is approved. The Planning and Zoning Commission plans to consider the
preliminary plat during its October meeting. Moreover, RCWD is reviewing the Center Villa
Development this evening and is expected to approve the grading elevations and plans.
Mr. March commented that Mr. Lessard understands that if the Council grants a grading permit it
will be at his own risk. Mr. Peterson said he and NU. March reviewed the proposed grading plan
and it met with their preliminary approval.
Councilmember Buckbee moved to aonrove the aradiva permit. contingent upon RCWD
enroval and the Developer is aware this is at his own risk Niavor Wilharber seconded
the motion. Motion carried unanimously.
Advertisements for bids on a Public Works Tractor
Mr. March commented that the city is accepting bids on a tractor for public works. Also, the
Council will be made aware of the bids received and the publication indicated the City reserved
the right to reject any and all bids.

Dear City Council Members:
My name is Cindy Wegmann and my husband, Lido, and I are the Safety Patrol Monitors for Centerville
Elementary School. Every morning at 8:45 a.m. and every afternoon at 3.20 p.m. we are assisting the
School Patrols with their duties. Udo assists the School Patrols at the comer or Progress and Main Street
and I assist the School Patrols at the corner of Centerville Road and Main Street.
Lido and I, on a regular basis, turn in license plate numbers and descriptions of vehicles and drivers to the
Circle Pines/Lexington Police Department for violations pertaining to the School Patrol's. We tr) to do the
best we can in protecting not only the Patrols but also the children that have to cross the streets to get
home.
I am writing to ask for your help in making the streets saner for the children as well. When the children that
need to get to Centerville Road and Main Street, we call it Kelly's Komer, they must walk up the sidewalk in
front of the school, walk in front of the buses across the street. Paul had met me out there a week ago and
we came up with a number of problems that are unsafe for the children that need to get to Centerville Road
and Main Street.
A few of those problems, are two mailboxes in the sidewalk that could be moved on the Northwest side of
Centerville Road North of Main Street. Trees and bushes that need to be cut back, a retaining wall that is
falling and crumbling onto the sidewalk. There is also apart of the sidewalk that is to narrow for the children
to walk on because of the retaining wall. There is also a section where there is no sidewalk at all but orass.
Also on Friday's the homeowners along the sidewalk, on the Northwest side or Centerville North of Main
Street, put their garbage cans and recycle bins on the sidewalk, directly in the path of the walkers, =_o they
have to walk into the street in front of the buses as the buses are leaving the school
There is also a sign on the Northwest side of Centerville Road North of Main Street that says no parking
from here to corner. At times we have anywhere from 1 to 4 vehicles parked alone that road so the children
have to walk in the street even farther to get around the cars.
Ry -Chel Gaustad called me the other day and informed me that letters were written and sent out about the
problems we have along that small stretch of the road. I thank you all very much for your help in trying to
keep these children safe. There is one thing I would like to ask your help on and that is the sign on the
Northwest side of Centerville Road North of Main Street. Would it be possible to get the same identical
signs that are on the Northeast side of Centerville Road North of Main Street that says "No Parking 8 a. m. to
4 p.m. during school day=_ ", instead of the no parking from here to comer? It would take the children out of
the middle or the road and make it less liking to be run over by a bus.

THIS AGREEMENT, made this day of 1998, is by and
between the City of Centerville, whose address is 1880 Main Street, Centerville, Minnesota
55038, a municipal corporation organized under the laws of the State of Minnesota, hereinafter

plat of land within the corporate limits of the City known as Woods of Clearwater Creek,
hereinafter called" Subdivision"; and
WHEREAS, the Developer has applied to the City to be allowed at the Developer's
expense to construct all surfaced streets, curb and gutter, required landscaping, storm sewer,
stormwater ponds, drainage facilities, water and sanitary sewer facilities, hereinafter
referred to as Street and Utility Improvements; and
WHEREAS, the Developer is to be responsible for the installation and financing of certain
private improvements within the plat, hereinafter referred to as Private Improvements;
NOW, THEREFORE, in consideration of the mutual promises of the parties made herein,
IT IS AGREED BY AND BETWEEN THE PARTIES HERETO:
A. PRIVATE IMPROVERIENTS The Developer will construct and install at Developer's
expense the general improvement construction according to ordinance #8, Section 38.01
and other improvements specific to the development herein set forth.
1. Cost of Private Improvements, description:

All of the above items under Section 1 with the exception of the trees and sod on
unbuilt lots shall be completed and/or provided to the City by November 30, 1999.
2. Also included as items associated with the Private Improvements, the Developer shall
undertake or arrange to accomplish the following:
a. Site Development Issues
1) Coordinate with the utility companies to provide for gas main, telephone
lines, cable lines, and power lines to service the properties developed on
the final plat according to the City's joint trench policy.
2) Provide seeding and vegetation maintenance and erosion control over
denuded or graded areas and mitigation area, at the City's direction.
3) Reimburse the City for street name signs and stop signs that will installed
by the City.
4) Establish lot corner monumentation within 60 days of grading completion
or by November 1, 1998, after filing the final plat, whichever is sooner.
5) Provide such street maintenance and control of builder's actions to
maintain roadways clear of mud, soil, and debris to provide safe driving

surfaces. The Developer shall provide street sweeping within 24 hours of
the City's request for such services.
6) Provide for landscaping in accordance with City ordinances and other
requirements
The Developer shall accomplish or cause to be accomplished these actions
according to generally accepted trade standards. The Developer will cause to be
furnished to the City a schedule of proposed operations at least five days prior
to commencement of his construction activities.
Construction vehicles for site grading, streets, and utilities will utilize the
existing blacktop surface on 20` Avenue to access the site, At no time shall
vehicles associated with the plat development be allowed to access the site from
Brian Drive.
b. Site Grading, Street Construction and Building Permits No certificate of
occupancy shall be issued without installation of bituminous base course across
the front lot line of that property. No building permit shall be issued for any lot
without the finished grading in accordance with the approved grading plan.
No building permits will be issued until the rough grading for the site has been
completed and approved by the City Engineer. Furthermore, only one building
permit will be issued prior to installation of the bituminous base course, and this
permit shall be at the discretion of the City, to allow for emergency vehicle
access.
C. Erosion Control The Developer shall control erosion insuring:
1) All development shall conform to the natural limitations presented by the
topography and soil of the subdivision in order to create the best potential
for preventing soil erosion. The Developer shall submit an erosion control
plan, detailing all erosion control measures to be implemented during
construction. Said plan shall be approved by the City prior to the
commencement of site grading or construction.
2) Erosion and siltation control measures shall be coordinated with the
different stages of development. Appropriate control measures as required
by the City shall be installed prior to development when necessary to
control erosion.
3) Land shall be developed in increments of workable size, as determined by
the City, such that adequate erosion and siltation controls as directed by
the Engineer can be provided as construction progresses. The smallest
practical area of land, as determined by the City, shall be exposed at any
one period of time.

4) Where the topsoil is removed, sufficient arable soils shall be set aside for
respreading over the developed area. The topsoil shall be restored to a
depth of at least four (4) inches and shall be of a quality at least equal to
the soil quality prior to development and the Developer shall install four
(4) inches of topsoil on all boulevards and seed or sod as approved by the
City. The Developer shall make all necessary adjustments to the curb
stops to bring them flush with the topsoil (before occupancy). All
disturbed areas shall be seeded. The quality of the top soil restored shall
be equivalent to the top soil on the development prior to the removal.
d. Ins ection All of the work shall be under and subject to the inspection and
approval of the City and the City Engineer and, where appropriate, any other
governmental agency having jurisdiction.
e. Easements The Developer shall make available to the City, at no cost to the
City, all permanent or temporary easements necessary for the installation and
use of the both the Private Improvements and the Street and Utility
Improvements, as determined by the City Engineer. All such easements
requested by the City shall be in writing, in recordable form, and on the
standard easement form of the City and on such other terms and conditions as
the City shall determine. The Developer shall be fully responsible for the
recording of such easements.
f. Faithful Performance of Construction Contracts and Letter of Credit The
Developer will fully and faithfully comply with all terms and conditions of any
and all contracts entered into by the Developer for the installation and
construction of all Private Improvements and hereby guarantees the
workmanship and materials for a period of two years following the City's final
acceptance of the Private Improvements. The Developer agrees to guarantee for
a period of one year the tree plantings required as part of the Developer's
Agreement, including one tree per lot or two per corner lot, as per City
Ordinance. Each specific tree guarantee period shall begin with the planting of
each specific tree. Concurrently with the execution hereof by the Developer,
the Developer will furnish to, and at all times thereafter maintain with the City,
a cash deposit, certified check, or an Irrevocable Letter of Credit, based on one
hundred fifty percent (150 %) of the total estimated cost of the Private
Improvements as indicated in Paragraph Al. The Irrevocable Letter of Credit
shall be for the exclusive use and benefit of the City of Centerville and shall
state thereon the same is issued to guarantee and assure performance by the
Developer of all the terms and conditions of this Development Contract and
construction of all required improvements in accordance with the ordinances
and specifications of the City. Such Letter of Credit may be reduced upon
completion and acceptance of the Private Improvements by the City to an
amount deemed adequate by the City Engineer to cover the two year warranty
period described herein. The City shall have the right during said warranty
period to draw on the Letter of Credit for any warranty work that is necessary.
The City reserves the right to draw, in whole or in part, on any portion of the
Irrevocable Letter of Credit for the purpose of guaranteeing the terms and

conditions of this contract. The Irrevocable Letter of Credit shall be renewed or
replaced by not later than twenty (20) days prior to its expiration with a like
letter or bond.
g. Reduction of Escrow Guarantee The Developer may request reduction of the
Letter of Credit or cash deposit based on prepayment or the value of the
completed Private Improvements at the time of the requested reduction. The
amount of reduction will be determined by the City and such recommendation
will be submitted to the City Council for action.
h. Approval of Contractors Any contractor selected by the Developer to construct
and install any Private Improvements must be determined in writing by the City
Engineer to be acceptable. The City reserves the right to require satisfactory
proof of successful experience and adequate financial status by any such
contractor.
B. STREET AND UTILITY IMPROVEMENTS. In accordance with the policies and
ordinances of the City, the following described improvements (hereinafter collectively
called the "Street and Utility Improvements "), to include improvements as described by
the plans, specifications, and contract documents entitled Woods of Clearwater Creek
Streets and Utilities, as prepared by the City Engineer, Bonestroo, Rosene and Aderlik,
and as adopted and approved by the City Council of the City of Centerville. Said
improvements shall be constructed and installed by the Developer to serve the Subdivision
on the terms and conditions according to Ordinance #8, Section 38.01, and other
improvements specific to the development herein set forth:
1. Street Construction The base course shall be completed before November 15, 1998.
The wear course shall be completed before September 1, 1999, or when the City
deems appropriate according to the progress of work on the individual lots. The
Developer shall be liable for any increase in cost for construction of the wear course
due to delays in construction on the individual lots.
2. Construction Procedures All such improvements set out in Ordinance 48, Section
38.01, and as additionally specified herein shall be instituted, constructed, and
financed as follows:
a. The Developer shall provide to the City in writing an indication of the
contractor selected by the Developer to construct and install the Street and
Utility Improvements. The City shall reserve the right to determine if the
contractor selected by the Developer is acceptable. The City reserves the right
to require satisfactory proof of successful experience and adequate financial
status by any such contractor.
b. Construction shall not begin until written notice authorizing construction to start
is received by the Developer from the City.

C. Construction shall be completed to the standards and specifications described in
the plans and specifications entitled Woods of Clearwater Creek Streets and
Utilities.
d. The Developer shall provide a Disbursement Agreement as Security for the
construction of the Street and Utility Improvements as referenced in paragraph
B above, Street and Utility Improvements.
e. As outlined in the Disbursement Agreement, the City shall give written notice to
the Developer and the Lender whether the City approves or rejects the Street
and Utility Improvements pay estimate through that particular stage of
construction submitted for approval.
f. The Developer agrees to pay a portion of the cost of the watermain loop
Connection between Brian Drive and Revoir Street, as defined by the
watermain loop south and east of the northeast corner of the Park property
Adjacent to the plat.
g. The Developer shall provide a cash escrow in the amount of $10,000 to
pay for utility and street improvements to the cul -de -sac to extend Brian
Drive in the future to the property north of the development.
3. Security and Required Pavment Therefor Prior to the preparation of final plans and
specifications for the construction of said improvements, the Developer shall provide
to the City a cash escrow in an amount indicated in writing to provide for financing
the cost of preparing said final plans and specifications by the City Engineer.
Furthermore, the Developer shall also provide a cash escrow to the City in an amount
indicated in writing to provide for financing the cost of inspection, staking, and
construction administration by the City Engineer. Said cash escrow, including
accrued interest thereon, may be used by the City upon default by Developer.
C. RECORDING AND RELEASE The Developer agrees that the terms of this
Development Contract shall be a covenant on any and all property included in the
Subdivision. The Developer agrees that the City shall have the right to record a copy of
this Development Contract with the Anoka County Recorder to give notice to fiiture
purchasers and owners. This shall be recorded against the Subdivision described en page 1
hereof.
D. REIMBURSEMENT OF COSTS The Developer agrees to fully reimburse the City for
all costs incurred by the City including, but not limited to, the actual costs of construction
of said improvements, engineering fees, legal fees, inspection fees, interest costs, costs of
acquisition of necessary easements, if any, and any other costs incurred by the City relating
to this Development Contract and the installation and financing of the aforementioned
improvements.
E. OCCUPATION OF PREMISES The Developer further agrees that they will not cause
to be occupied any premises upon the plat or any property within the plat until the
completion of the gas, electric, telephone, water, and sewer improvements required by this

Development Contract have been installed, unless the City has agreed in writing to waive
this requirement as to a specific premises. Furthermore, Developer shall be granted no
certificates of occupancy for homes within the plat prior to substantial completion of all
Private and Street and Utility Improvements described in this Agreement, including the
base course layer of pavement. Building Permits shall be issued only within the constraints
of Section A, Part 2b,
F. CLEAN UP . The Developer shall be responsible to keep new and existing streets clean
and shall conduct routine sweeping of the project area. The Developer shall clean streets
no later than 24 hours after being notified by the City.
G. HOMEOR'NER NOTICE Developer agrees to provide the owner of each lot purchased
within the development on or before the date of closing a statement in substantially the
form shown as Exhibit A hereto. A signed copy of such agreement shall be returned to the
City within ten (10) days following execution by the homeowner.
H. OWNERSHIP OF IMPROVEMENTS Upon completion of the work and construction
required by this contract and acceptance by the City, the improvements lying within the
public easements shall become City property without further notice or action.
I. REIMBURSEMENT OF COSTS FOR DEFENSE The Developer agrees to reimburse
the City for all costs incurred by the City in defense of enforcement of this contract, or any
portion thereof, including court costs and reasonable engineering and attorney's fees.
J. VALIDITY If any portion, section, subsection, sentence, clause, paragraph, or phrase in
this contract is for any reason held to be invalid by a court of competent jurisdiction, such
decision shall not affect or void any of the other provisions of the Development Contract.
K. GENERAL
1. Binding Effect The terms and provisions hereof shall be binding upon and insure to
the benefit of the heirs, representatives, successors, and assigns of the parties hereto
and shall be binding upon all future owners of all or any part of the Subdivision and
shall be deemed covenants running with the land.
2. Notice Whenever in this Agreement it shall be required or permitted that notice or
demand be given or served by either party to this Agreement to or on the other party,
such notice or demand shall be delivered personally or mailed by United States mail
to the addresses herein before set forth on Page 1 by certified mail (return receipt
requested). Such notice or demand shall be deemed timely given when delivered
personally or when deposited in the mail in accordance with the above. The
addresses of the parties hereto are as set forth on Page I until changed by notice given
as above.
I Final Plat Approved The City agrees to give final approval to the plat of the
Subdivision upon execution and delivery of this Agreement and of all required
petitions, bonds, fees, and securities indicated in Exhibit B.

4. Incorporation by Reference All plans, special provisions, proposals, specifications,
and contracts for the improvements furnished and let pursuant to this Agreement shall
be and hereby are made a part of this agreement by reference as fully as if set out
herein in full.
L. VIOLATION OF AGREEMENT In the event that Developer violates any of the
covenants and agreements contained in this Development Contract and to be performed by
the Developer, the City, at its option, in addition to the rights and remedies as set out
hereunder may refuse to issue building permits to any property within the plat until such
time as such default has been corrected to the satisfaction of the City.
M. PARK DEDICATION The Developer agrees to provide park dedication to the City in the
form of a cash payment of $7,500 calculated at $750 per lot multiplied by 10 lots.
N. TRAIL DEDICATION The Developer agrees to provide trail dedication to the City in the
form of a cash payment of $1,500 calculated at $ 150 per lot multiplied by 10 lots.
O. STORMWATER FEES The stromwater fee shall be paid by the Developer prior
to approval of the final plat. This fee is $6,747.85, based on a charge of $0.01546
per square foot of 10.02 acres of platted area.
P. LIABILITY INSURANCE REQUIREMENT The Developer shall provide to the City,
at the Developer's expense, general public liability and property damage insurance
including vehicle coverage protecting the City and the Developer from all claims for
personal injury, including death, and all claims for construction of or damage to property,
arising out of or in connection with any operations under these contract documents,
whether such operations be by the Developer, its Contractor, or by any subcontractor, or
anyone directly or indirectly employed by the Contractor or by a subcontractor under him.
Insurance shall be written with a limit of liability of not less than $600,000 for all damages
arising out of bodily injury including death, at any time resulting therefrom, sustained by
any one person in any one accident; and a limit of liability of not less than $1,000,000 for
any such damage sustained by two or more persons in any one accident. Insurance shall be
written with a limit of liability of not less than $700, 000 for any such damage sustained by
two or more persons in any one accident, and a limit of liability of not less than $600,000
for any such damage sustained by two or more persons in any one accident. The insurance
policies shall accompany the contract for its execution by the Developer and the City of
Centerville. The above insurance policies shall be in full force and effect during the life of
this contract. The City, City Engineer and Developer's engineer shall be an additional
named insured on any such policy or policies.
Q. INDEMNIFICATIONAND HOLD HARMLESS. The Developer shall hold the City and
its officers and employees harmless from claims made by itself mid third parties for
damages sustained or costs incurred resulting from subdivision plat approval and
development. The Developer shall indemnify the City and its officers and employees for all
costs, damages, or expenses which the City may pay or incur in consequence of such
claims, including reasonable attorneys' fees. Provided that nothing herein shall require
Developer to indemnify the City, its officers or employees from any violation of law or from
the consequences of their own negligence.

R. PROHIBITIONS AGAINST ASSIGNMENT OF AGREEMENT. Developer represents
and agrees that prior to the completion of the Developer improvements as certified by the
City.
a. Except by way of security for, and only for the purpose of obtaining financing
necessary to enable the Developer to perform its obligations with respect to the
construction of the improvements under this Agreement and any other purpose
authorized by this Agreement, the Developer (except as so authorized) will not
make or create, or suffer to be made or created, any total or partial sale,
assignment, conveyance, or transfer in any other mode or form, with respect to
this Agreement or any interest therein, or any contract or agreement to do any of
the same, without the prior written approval of the City.
b. In the absence of specific written agreement by the City to the contrary, no such
transfer or approval by the City shall be deemed to relieve Developer from any of
its obligations. In the event that the City approves a substitute Developer and the
property is transferred to said substitute, the City agrees to relieve the Developer
of liability from performance as described in this Contract. Said substitute shall
assume all responsibilities and rights of the Developer under this Contract.
S. WAIVER. The action or inaction of the City shall not constitute a waiver or amendment to
the provisions of this Agreement. To be binding, amendments or waivers shall be in
writing, signed by the parties, and approved by written resolution of the City Council. The
City's failure to promptly take legal action to enforce this Agreement shall not be a waiver
or release.

RE CenterVilla Preliminary Plat
The developer is revising the preliminary plat for the development to be known as CenterVilla. A
few minor changes were suggested based on a meeting with the developer, engineer and staff on
Friday, October 9. The developer is proposing to finance the project independently. The plat is
scheduled for Rice Creek Watershed approval on October 14. If the developer is able to make the
changes to his preliminary plat in time for engineer review, then the preliminary plat could be
approved Wednesday night contingent on Rice Creek Watershed District approval.
The Planning and Zoning Commission recommended approval of the preliminary plat at their
meeting on October 6. The Commission recommended variances be granted on Lots 3,4,5,9,10
and any other lots that the lot width at building setback did not meet the required 100 feet per the
R2 zoning. The rationale for this was based on the generous lot sizes and the protection of the
existing wetlands. The variances would consist of less than ten feet per lot at building setback.
This will be explained in more detail at the meeting. The commission also recommended a
variance be granted for the extra width requirement for Lot 20 due to the fact that it is a butt lot
and is 3 feet too narrow. The rationale for this was to allow a straight road connection with Eagle
Trail. This will also be explained in more detail at the meeting.

Re: Center Villa Plan Review
I have reviewed the preliminary plans for Center Villa and have the following comments:
1. The current floodway and floodplain are not identified on the plans. According to the
EEMA map, the current building and lot are in the floodway and would require at a
minimum a "Letter of Map Amendment' showing the building is out of the floodway.
2. The existing watermain from the north on Brian Drive is a 10" main. This main should
be extended as a 10" main out to 20th Ave. and connected to the new 12" main.
3. The watermain used in town is PVC, not DIP ( ductile iron pipe).
4. A variance will have to be granted for the butt lots on the plan.
5. A Rice Creek Watershed permit is required prior to approval.
G. The Plan does not show the continuation of the sidewalk from Brian Drive and Eagle
Trial.
7. The plan should show the existing floor elevations of the existing buildings.
S. Lot 12 Block 2 appears to have a elevation approaching 10% slope for the driveway
for its length.
9. The street design needs to show the drain tile in the sand.
10. The lots on the cul -de -sacs have less than 100 feet of width at the house setback line.
11. The minimum rear yard setback is 25 feet, not '35 feet as detailed on the plans.

12. The NWL (normal water level) and HWL (high water level) for the northern pond is
not identified.
13. The grading contour on the adjacent residential properties needs to be shown so that
the grading for the new subdivision can be matched to the existing grades.

I have the following comments and revisions regarding the plat:
1) Move C.B. 5 6 -feet south, so pipe from C.B. 5 to C.B. 3 stays within right -of-
way.
2) Show defined emergency overflow &wale between lots 17 -18, from the low point
catch basins to the pond. Set E.O.F. at elevation 906.5.
3) The 4 -foot high earthen berm east of the hou&e pad for Lot 13 will not have much
effect on screening the business to the east. May want to consider a fence at the
back lot line instead.
4) The Comprehensive Water Main Plan shows existing 10 -inch main on Brian
Drive. Show new 10 -inch main on Brian Drive and along Eagle Trial. Extend
10 -inch train from Eagle Trait to C,R. 54 (2e Ave. S.). Connect the 10 -inch

5) A wider easement will be necessary on the east side of the north side of Lot 12 to

RE Buechler Estates - Park Dedication Fees
Mr. Carl Buechler was present at the Park and Recreation Committee meeting that was held on
Wednesday, October 7. Mr. Buechler was present to request a recommendation from the
committee on the appropriate park dedication fees for his development on Mound Trail. The
developer would like to see the park dedication fees set at 900 per lot and not 10% of the price he
is willing to pay for the property. The committee recommended that the Council make the
decision on this issue and they will support the Council's decision. They felt that the ordinance
does need to be changed in some manner. A representative from the committee may be present at
the Council meeting to answer Council questions. The Committee indicated that they would like
to write a memo to the Council on the issue, prior to the meeting if they were able to receive
input from the two members who were not present at the meeting.

Dear Ry -Chel:
As a follow -up to our meeting with the City Council last evening, please accept this letter
as a summary of our position. We had been told that the Park and Roo fees would be $950.00
per lot for 5 lots, for a total = $4,750.00, and we reasonably relied on those statements in all of
our work done up to this point. We have incurred substantial fees already in getting the project
to this stage. Had we been told up front the truth about the Park and Rec Fees, we may have
scrapped this project altogether, or at least would have considered developing only four lots
instead of five. Instead, we were Informed of the additional fees wet] after the fact, and after
considerable fees had already been spent by us. We feel that the Council is potentially being
short- sighted in this matter, particularly those members that stated that they would like to see
the fees set at 10% of the costs of the land. You are currently receiving next to nothing in taxes
on that property, even though you have some responsibilty for maintenance. If our development
was approved as we have proposed, you would not only receive $4,750.00 in Park & Rec fees,
you would also have five homes paying approximately $6,000.00 per year in property taxes.
The cost impact on the City of these five homes would be extremely minimal, much less than
virtually any other proposed use. In short, our development, as proposed, would be a win -win
situation for both us and the City. However, if the City insists on getting 10% of the costs of the
and in Park and Rec fees, they will not only lose our development (we would either have to
withdraw it completely or modify it), they will be discouraging other potential developers for any
other areas, particularly those on the Lake. Those lands would continue to be vacant, and the
City would be wasting more potential tax base. We will consider, but not commit to, a very
modest increase in the fees over $950.00 per lot. Any substantial increase will kill this project,
at least as it is currently designed.
Our understanding of the Park & Rec fees is the same understanding as that of all of the
other developers we have spoken to who have dealt with the City recently, none of them claim
to have ever even heard of a potential 10% charge. Thus, we feel that we are being singled out.
We will wait anxiously to hear the report on the previous five developments, to see what they
were charged. Assuming that we get the report fairly quickly, we will respond at that time.
However, it it becomes readily apparent that the City is going to insist on receiving 10% of the
purchase price of the land in Park and Rao fees, or that this decision is going to be significantly
delayed, please let us know, and we will then quickly take appropriate action.

Re: Tractor Replacement
The City has solicited bids for replacing the 1989 John Deere tractor. The City advertised
in the paper and also sent quotes by fax to six dealers. We received one "No Bid" and one
quote per the bid specifications. The quote was from Olson Power Equipment of North
Branch for a Massey Ferguson 253x4 tractor. Mr. Dan Olson has informed me that he
could supply a 263x4 tractor for the same price. The difference between the two tractors
is that the 263 has five more horsepower and meets the more strigent California emission
standards.
We have spent over $1,500.00 dollars on repairs to the tractor so far this year and had to
rebuild the valve bank last year. The hydrostatic transmission feels loose and may need
extensive repairs in the near fixture. The City did receive a quote from Olson Equipment
prior to the advertisement for bids and the more recent quote is a better bargain.
I would like the Council to approve the purchase of the tractor and the implements per the
quote except to upgrade the tractor to a 263 model at the same cost as a 253. The tractor
would be delivered in about three to four weeks, except for the cab which will take eight
to ten weeks for delivery.
The $32,225.00 would come from the following funds as listed below:

Enclosed in your packet is a copy of Ordinance 4 Subd. 34.01 -3 Shoreland set back regulations
The Phippen family (1563 Peltier Lake Drive) requested a variance to reconstruct a shed on an
existing concrete slab. During the October Planning and Zoning meeting the Commission
recommended approving the variance to reconstruct the shed to the same dimensions of the
concrete slab. Approval was based on the fact that the shed was an existing structure.

VARIANCE FOR STORAGE SHED - less than 75 feet from lake shore.
Reason for request:
We have owned our property since 1978. When purchased there was an existing
storage structure on an 11' x 11' cement slab next to the lake shore. The structure
may very well date back to 1957 when the original home was built. Over the years,
the shed has been hit by fallen trees in storms, etc. In an effort to straighten the shed
and improve its appearance, we attempted to straighten it and replace the siding dur-
ing the fall of 1997. But, as we removed siding it became clear that the structure was
bad, so we pulled it to the ground, cleaned up the debris and planned to put a new
shed in the following spring, We were certain that because there had been a shed in
that spot, there would be no problem replacing it. And, replacing it was the only way to
improve the appearance of the shed.
When we visited the City of Centerville to get a building permit, we were informed of
the "new" rule that states the shed would need to be 75 feet from the lake shore.
Unfortunately, we do not have the option to comply with that rule and build a shed 75
feet from the shore or we would have chosen to do that instead of pay the variance
fee. The only open property that we have 75 feet from the shore is on one side of the
house and must be kept open to drive through because we must pull our dock and
boat lift in and out of the water each year.
During the 20 years we have lived in our home and had this shed, we have watched
both neighbors put it sheds that are NOT 75 feet from the lake shore and did interfere
with our view of the lake. One neighbor didn't only put in a shed, they brought in an
entire garage. (see photos) We understand why the City has this rule. However, we
feel that because the shed was there all along and a new shed should be viewed as
an improvement over leaving the deteriorating shed up (which we could have done)
and because both neighbors have a shed within 75 feet of the lake, we should be
allowed to rebuild the shed. There is also the cement slab to consider, which remains.
We also only have a one and a half car garage and having a shed will mean that our
yard will be kept neater beause without the shed we do not have storage for many
things. This should be in the neighbors' best interests as well.

The regular sessions will begin at 2 PM.
We have also scheduled several social events during the meeting to give you the
opportunity to relax and discuss mutual concerns with other area officials.
Therefore, we will feature our city's famous "Swedish Donuts" at our afternoon break
along with pop, coffee and other non - alcoholic beverages.
Our city's Swedish heritage turns global for the 5 PM social hour where we will
feature traditional Oktoberfest beverages (beer & wine) and hors d'oeuvres. The
price of all social hour food and beverages is included in your registration fee.
Your 6 PM supper will feature a delicious meal with a decidedly Oktoberfest flavor
including roast pork, German potato salad, sweet & sour red cabbage and other
Bavarian type food. Plus we will have German chocolate cake for desert. If anyone
from your city has special dietary needs, please call and we will make those
arrangements.

The City needs to change the initial hearing date for our truth in taxation meeting in December.
The initial hearing was going to coincide with our first Council meeting in December. This date
conflicts with the hearing date for metropolitan special taxing districts and is not allowed. The
date should be set for December 7, 1998. The Council meeting could be moved to that date as
well. The second meeting in December is scheduled two weeks later on Monday, December 21,
1998.

CENTERVILLE ECONOMIC DEVELOPMENT COMMITTEE
REGULAR MEETING MINUTES
SEPTEMBER 14, 1998
Pursuant to due call and notice thereof, the Centerville Economic Development
Committee held their regular scheduled meeting on September 14, 1998. Chairperson Tim
Rehbein called the meeting to order at T05 p.m. Present. Mary Capra, Theresa Brenner,
Jim March, Paul Montain, and John MaGill. Others present: Lucy Thompson and Penny
Simonson, both from the Minnesota Design Team.
Approval of August 1998 Minutes
Motion by Mary Capra to approve the August 1998 meeting minutes. Motion was
seconded by Paul Montain. Motion was carried with John MaGill abstaining.
Downtown revitalization
Thersesa Brenner passed out the fifth draft of the proposed schedule, for the Design Team
visit. Only minor changes were made.
Facilities - They will have a site manger at the school for $12 per hour. The position
would entail approximently 13 hours, for a total of about $156.00 We will need
volunteers for set up and tear down. We will need to find a cordless mike to use. Paul
Montain could find a slide projector if the school cannot supply one. TJ from the Cable
Commission will be available for taping a lot of the time.
Presentation - Centerville Lake Association and Rice Creek Trail Association to date have
not responded. Randy Hagerty would like to give a presentation. Confirmation letters
have been sent out to all others. Jim March has all the maps ready. Paul Montain will
drop off the topography map.
Fund Raising - Is now completed. Some collection is still necessary.
Lodging - Mary Capra stated lodging is completed. There will be twelve members visiting
with the students.
Public - Working on direct flyer. The school did a write -up in their newsletter. Could
possibly do a flyer with the agenda on it, or possiblibly do an ad in the Quad. Flyers are
available at St. Genevives Church.
Food - Theresa Brenner and Mary Capra checked out Sams Club and also met with Bill
Bisek. They decided that it was more cost effective to do it ourselves with help from the
church volunteers. Sunday Brunch will be held at Kelly's.
Tour - Tim Rehbein and Theresa Brenner came up with a route for the walking and bus
- tour. Tim Rehbem will do the lead on the bus. Then Mary Capra and Tim will lead the
walking tour.
Community Survey - Surveys were distributed to residents in postage paid envelopes.
41% were returned.
Photo Surveys - Lakes and Churches were favored.
Downtown area was the least favored.
Volunteers - Theresa Brenner stated that more volunteers would be needed for set -up and
tear down of the chairs and tables at the school.
Budget - Theresa Brenner stated that the total revenue would be approximently $5300.00,
and the total estimated expenses are at $4770.00. There are still a few minor expenses
that are still outstanding.
Star Citv_C a and Objectives - Cities Week th s year is being held October 5 - 11. An
option would be to do an open house to show sketches of the design team visit. This
could just happen all week long during office hours.
Grant for recycling -Currently there is $10,000 in the preliminary budget. Intern James
Bownik is studying the information and will be working on this grant.
Studebaker - No update.
Newsletter ads - Money will continue to go to EDC with the exception of the charge for
set -up fees charged by the printer.
Adjournment - Motion to adjourn at 8:55 p.m. was made by John. Motion seconded by
Mary Capra. Motion carried unanimously.

Concerns Regarding Centerville
With growth, noise level is too high, especially along the main traveled roads through
town.
Too many cars & too many people already.
The unappealing and "cluttered look" with the current downtown businesses.
Community pride
Poor water quality of Lakes, especially with new developments.
Garbage from Waterworks in lakes and around shores.
Underage drinking at Waterworks. Waterworks & Main Str. too much a police "troubled
area."
Current parks are too "tucked away", dark and not very inviting.
Would Never Like To See In Centerville
• No new businesses in what is considered the current downtown area.
• No new bars in Centerville.
No freeways through Centerville. (14 or Main Str., grand plan for future highways can
be found at public library.)
• No new duplexes or multiple- unit - housing complexes in Centerville (excluding Senior
Housing)
Never allow businesses on city's vacant land (Sorel Str. & Centerville Rd.)
Would Like To See Changed In Centerville
• Move all businesses down east toward freeway area -- Keep all businesses in the same
area, not peppered throughout the town.
Create a new area for "Downtown" (i.e. - more towards 35, 20th & Main) Turn current
downtown area into residential area.
Clean up look of current Centerville businesses. Give them more of a quaint look. Get
rid of multiple buildings per business, especially those that are falling apart.
Restore buildings and homes in Centerville to original condition.
Get regulations or covenants for businesses & homes "in the books" so as to ensure
consistent and constant esthetic appeal.
Take down old public works buildings on Sorel Str. and move out of downtown area arrd
closer to 20th & 14. p Keep all city offices together.

• Change Waterworks into a fancy supper club -(i.e. - Toby's By The Lake)
• Put up signs around town, "No Jake Brakes ", as in other towns.
Dreams For The Future
Have a coordinated Master Plan for all of Centerville, with immediate and specific
emphasis on the esthetic appeal of the current downtown area. Have Design Team help us
with these ideas.
Would like to see Design Team give us ideas on how to limit growth, even though some
growth is inevitable.
Like to live in homes in peace and quiet.
• Downtown area become more like that of White Bear Lake, with quaint shops. (i.e. -
Antique, gift and coffee shops) Shops and streets have a French theme decor, in keeping
with Centerville's French Canadian & Indian heritage.
• Walking path down Main Street & Centerville Road. Connect walking path of Lino Lakes
to future & current walking paths in Centerville.
A Centerville Community Center (indoor pool, game room, tennis, gyms, etc.- perhaps
on the church's 10 acres ?) - Others have expressed if that 10 acres sells, should be
kept residential. Move Community Center more towards the "new" downtown area (35 &
14). Perhaps corroborate with neighboring towns (Hugo, Lino, Circle Pines, Forest
Lake, White Bear Township) for Community Center on 14.
City's Vacant Lot (old public works & fire hall area):
• Put in a rose /flower garden, with fountain (very French), benches and Gazebo on the
city's vacant lot. Seniors from Senior Housing & other citizens could help to maintain
gardens.
Take down Public Works building,
• Preserve jail part of building at current public works - turn into a museum.
• Turn city's vacant lot into park.
Incorporate museum & park on city's vacant lot.
• Cemetery - paved road with better and more appealing fencing & lights.
For higher community pride: fashionable French lamp posts along sidewalks with
Centerville flags that would change with the seasons. Hanging flower baskets, garland
and light strands from telephone and lamp poles. A Centerville LOGO & phrase.
• Encourage all new Centerville businesses to be "high quality."
Give current parks a facelift.

As we have previously discussed the City of Centerville has a need for wetland credits for the LaMotte Park
project along Centerville Road. We have recently approved the first phase of construction for this project.
The proposed grading plan for the park will result in the filling of 9,855 square feet of jurisdictional wetland. We
understand that you have wetland credits at the Fairview Farms Development in Forest Lake Township available
with the Rice Creek Watershed District. We are requesting a donation from your wetland credits for the LaMotte
Park Project. To meet the mitigation requirements of the watershed district, we would need a dedication of 9,710
square feet of wetland credits (2 x [9,855 - 5,000 square foot de minimus]). We request your signature at the
bottom of this letter, indicating that you will in fact follow through on this commitment. The City of Centerville
expresses its appreciation for your generous donation.
