ADJOURNMENT WEEK IN REVIEW Edition # 74 9/14-9/18 Building Permits this Period = 4 Building Permits YTD = 171 New Homes YTD = 100 * The preliminary tax levy and dates for the Truth in Taxation hearing were sent to Anoka County on Monday. * I received a call from Roger Kolstad on Tuesday. Mr. Kolstad is the realtor representing the bank that is still interested in locating in our downtown area. Mr. Kolstad indicated that they are interested in pursuing this location for a project in the spring. * A meeting was held with Mr. Willie Lessard and his engineer's on Tuesday. Mr. Lessard is going to pursue his latest concept plan for developing the Lake Area Utilities property. This new plan is designed to work within the existing zoning. The new plan is designed to accommodate 22 single family homes. Mr. Lessard will be having a public hearing on this new preliminary plat at the October Planning and Zoning meeting. * A meeting was held with Mr. Gerald Rehbein on Tuesday. Mr. Rehbein was asked to sign a new letter of commitment for a donation of 9,710 square feet of wetland credits to the City to be used in our development of LaMotte Park. An earlier letter from Mr. Rehbein had been signed for this donation of wetland credits. The donation was to come from credits that were earned from the construction of the pond he had created next to his shop. Those credits had already been allocated by the Rice Creek Watershed District. This new letter that I asked Mr. Rehbein to sign committed available wetland credits that he has from a development known as Fairview Farms in Forest Lake Township. Mr. Rehbein did agree to donate credits from this development and the Rice Creek Watershed Dist.- has received this letter and processed our watershed permit for LaMotte Park. This donation to the City would be worth $4,467 in the open market if we had to purchase the wetland credits separately from an available source. A copy of the donation letter has been placed in your mailbins. * In the above mentioned meeting with Mr. Rehbein, he had mentioned that he was meeting with the representatives from Sewall Gear on Wednesday. Mr. Rehbein also mentioned that he had held a meeting earlier in the day with the school's consultant for the proposed kindergarten building. The school is interested in signing the lease for the new building to be located on the property south of Eagle Trucking. They would like to have footings installed for the building this year. * I heard a rumor that Eagle Trucking has closed on some property in Forest Lake Township and that they may have plans to move their trucking operations. * I received a letter from Mr. Dennis Schudy who resides in Lino Lakes just south of Centerville. He has submitted a written proposal to see if the City is interested in selling the two acre City owned parcel in the industrial park. Mr. Schudy has offered $ 80,000 for the two acres. Water main (6" PVC) was installed by City forces from Centerville Road to Lamotte Drive, Currently we have been attempting to make contact with Lino Lakes to get their approval on a modification of the designed drainage patterns. The goal Is to intercept the drainage along the east Aide of the park building and hockey rink with concrete stood sewer and outlet the water westerly in the drainage ditch which separates the cities. See attached sketch for details. Currently we are seeking estimates for the abandonment of the well. Electrical quotes will be obtained for rewiring the building and hockey lights. CLEARWATER MEADOWS No new issues to report on this project. EAGLE PASS The park pathway was paved last week. Paul, Jim, and Eric met with the developer to discuss the following issues: Street sweeping -which will be completed this week Park costs to date -the developer will be submitting the incurred costs to date. The plan is to finish sanitary sewer, water main, storm sewer, and house services within the roadway before installing the water main loop to the west. It is anticipated that loop water main installation will begin September 18 or September 21, Comments and corrections to the HR Green construction plan were made and submitted. Signed plans have not been received yet. BUECHLER ESTATES No new issues to report. FLASHING CROSSWALK LIGHTS ON CSAH 14 Anoka County has been contacted and maps am being obtained to design the lights, Inspection will be by Bonestroo, with periodic checks by the County. CENTER VILLA A meeting was held on Tuesday, September 15 with Mr. Lessard, Charles Plowe (engineer), Matt Davich (EG Rud), and Jim March, Their preliminary plat was reviewed, with several comments and questions answered. Mr. Lessard plans to start grading September 24 and complete Phase I (west half of plat), this season. Drainage will be directed to the east through a series of ponds, wetlands, and ditches. 21" AVENUE ROAD CONSTRUCTION John Powell, Lino Lakes engineer, has indicated their desire to proceed with 21" Avenue this year. A set of preliminary plans was received on September 17. Bids are proposed to he opened October 21, I998. I will be reviewing their plans this week and submitting comments or concerns. Mady Reiter (Chair of the Police Commission) will be present to answer any questions that the Council may have on their selection. It was mentioned that at the present time Centerville is being asked to approve the selection of the Chief as a courtesy. Box 533, Circle Pines, MN, hereinafter referred to as the "Developer". Site Development Issues 1) Coordinate with the utility companies to provide for gas main, telephone lines, cable lines, and power lines to service the properties developed on the final plat according to the City's joint trench policy. 2) Provide seeding and vegetation maintenance and erosion control over denuded or graded areas and mitigation area, at the City's direction. 3) Reimburse the City for street name signs and stop signs that will installed by the City. 4) Establish lot corner monumentation within 60 days of grading completion or by November 1, 1998, after filing the final plat, whichever is sooner. 5) Provide such street maintenance and control of builder's actions to maintain roadways clear of mud, soil, and debris to provide safe driving Page 2 Woods of Clearwater Creek Development Agreement DRAFT August 27, 1998 surfaces. The Developer shall provide street sweeping within 24 hours of the City's request for such services. 6) Provide for landscaping in accordance with City ordinances and other requirements The Developer shall accomplish or cause to be accomplished these actions according to generally accepted trade standards. The Developer will cause to be furnished to the City a schedule of proposed operations at least five days prior to commencement of his construction activities. Construction vehicles for site grading, streets, and utilities will utilize the existing blacktop surface on 20` Avenue to access the site. At no time shall vehicles associated with the plat development be allowed to access the site from Brian Drive. b. Site Grading Street Construction and Building Permits No certificate of occupancy shall be issued without installation of bituminous base course across the front lot line of that property. No building permit shall be issued for any lot without the finished grading in accordance with the approved grading plan. No building permits will be issued until the rough grading for the site has been completed and approved by the City Engineer. Furthermore, only one building permit will be issued prior to installation of the bituminous base course, and this permit shall be at the discretion of the City, to allow for emergency vehicle access. C. Erosion Control The Developer shall control erosion insuring: 1) All development shall conform to the natural limitations presented by the topography and soil of the subdivision in order to create the best potential for preventing soil erosion. The Developer shall submit an erosion control plan, detailing all erosion control measures to be implemented during construction. Said plan shall be approved by the City prior to the commencement of site grading or construction. 2) Erosion and siltation control measures shall be coordinated with the different stages of development. Appropriate control measures as required by the City shall be installed prior to development when necessary to control erosion. 3) Land shall be developed in increments of workable size, as determined by the City, such that adequate erosion and siltation controls as directed by the Engineer can be provided as construction progresses. The smallest practical area of land, as determined by the City, shall be exposed at any one period of time. Page 3 Woods of Clearwater Creek Development Agreement DRAFT August 27, 1998 4) Where the topsoil is removed, sufficient arable soils shall be set aside for respreading over the developed area. The topsoil shall be restored to a depth of at least four (4) inches and shall be of a quality at least equal to the soil quality prior to development and the Developer shall install four (4) inches of topsoil on all boulevards and seed or sod as approved by the City. The Developer shall make all necessary adjustments to the curb stops to bring them flush with the topsoil (before occupancy). All disturbed areas shall be seeded. The quality of the top soil restored shall be equivalent to the top soil on the development prior to the removal. d. Inspection All of the work shall be under and subject to the inspection and approval of the City and the City Engineer and, where appropriate, any other governmental agency having jurisdiction. e. Easements The Developer shall make available to the City, at no cost to the City, all permanent or temporary easements necessary for the installation and use of the both the Private Improvements and the Street and Utility Improvements, as determined by the City Engineer. All such easements requested by the City shall be in writing, in recordable form, and on the standard easement form of the City and on such other terms and conditions as the City shall determine. The Developer shall be fully responsible for the recording of such easements. f Faithful Performance of Construction Contracts and Letter of Credit The Developer will fully and faithfully comply with all terms and conditions of any and all contracts entered into by the Developer for the installation and construction of all Private Improvements and hereby guarantees the workmanship and materials for a period of two years following the City's final acceptance of the Private Improvements. The Developer agrees to guarantee for a period of one year the tree plantings required as part of the Developer's Agreement, including one tree per lot or two per comer lot, as per City Ordinance. Each specific tree guarantee period shall begin with the planting of each specific tree. Concurrently with the execution hereof by the Developer, the Developer will furnish to, and at all times thereafter maintain with the City, a cash deposit, certified check, or an Irrevocable Letter of Credit, based on one hundred fifty percent (150 %) of the total estimated cost of the Private Improvements as indicated in Paragraph Al. The Irrevocable Letter of Credit shall be for the exclusive use and benefit of the City of Centerville and shall state thereon the same is issued to guarantee and assure performance by the Developer of all the terms and conditions of this Development Contract and construction of all required improvements in accordance with the ordinances and specifications of the City. Such Letter of Credit may be reduced upon completion and acceptance of the Private Improvements by the City to an amount deemed adequate by the City Engineer to cover the two year warranty period described herein. The City shall have the right during said warranty period to draw on the Letter of Credit for any warranty work that is necessary. The City reserves the right to draw, in whole or in part, on any portion of the Irrevocable Letter of Credit for the purpose of guaranteeing the terms and Page 4 Woods of Clearwater Creek Development Agreement DRAFT August 27, 1998 conditions of this contract. The Irrevocable Letter of Credit shall be renewed or replaced by not later than twenty (20) days prior to its expiration with a like letter or bond. g. Reduction of Escrow Guarantee The Developer may request reduction of the Letter of Credit or cash deposit based on prepayment or the value of the completed Private Improvements at the time of the requested reduction. The amount of reduction will be determined by the City and such recommendation will be submitted to the City Council for action. h. Approval of Contractors Any contractor selected by the Developer to construct and install any Private Improvements must be determined in writing by the City Engineer to be acceptable. The City reserves the right to require satisfactory proof of successful experience and adequate financial status by any such contractor. B. STREET AND UTILITY IMPROVEMENTS. In accordance with the policies and ordinances of the City, the following described improvements (hereinafter collectively called the "Street and Utility Improvements "), to include improvements as described by the plans, specifications, and contract documents entitled Woods of Clearwater Creek Streets and Utilities, as prepared by the City Engineer, Bonestroo, Rosene and Aderlik, and as adopted and approved by the City Council of the City of Centerville. Said improvements shall be constructed and installed by the Developer to serve the Subdivision on the terms and conditions according to rdinance #8, Section 38.01, and other improvements specific to the development herein set forth: 1. Street Construction The base course shall be completed before November 15, 1998. The wear course shall be completed before September 1, 1999, or when the City deems appropriate according to the progress of work on the individual lots. The Developer shall be liable for any increase in cost for construction of the wear course due to delays in construction on the individual lots. 2. Construction Procedures All such improvements set out in Ordinance 48, Section 38.01, and as additionally specified herein shall be instituted, constructed, and financed as follows: a. . The Developer shall provide to the City in writing an indication of the contractor selected by the Developer to construct and install the Street and Utility Improvements. The City shall reserve the right to determine if the contractor selected by the Developer is acceptable. The City reserves the right to require satisfactory proof of successful experience and adequate financial status by any such contractor. b. Construction shall not begin until written notice authorizing construction to start is received by the Developer from the City. Construction shall be completed to the standards and specifications described in the plans and specifications entitled Woods of Clearwater Creek Streets and Utilities. d. The Developer shall provide a Disbursement Agreement as Security for the construction of the Street and Utility Improvements as referenced in paragraph B above, Street and Utility Improvements. e. As outlined in the Disbursement Agreement, the City shall give written notice to the Developer and the Lender whether the City approves or rejects the Street and Utility Improvements pay estimate through that particular stage of construction submitted for approval. f. The Developer agrees to pay a portion of the cost of the watermain loop Connection between Brian Drive and Revoir Street, as defined by the watermain loop south and east of the northeast comer of the Park property Adjacent to the plat. g. The Developer shall provide a cash escrow in the amount of $10,000 to pay for utility and street improvements to the cul -de -sac to extend Brian Drive in the future to the property north of the development. 3. Security and Required Payment Therefor Prior to the preparation of final plans and specifications for the construction of said improvements, the Developer shall provide to the City a cash escrow in an amount indicated in writing to provide for financing the cost of preparing said final plans and specifications by the City Engineer. Furthermore, the Developer shall also provide a cash escrow to the City in an amount indicated in writing to provide for financing the cost of inspection, staking, and construction administration by the City Engineer. Said cash escrow, including accrued interest thereon, may be used by the City upon default by Developer. C. RECORDING AND RELEASE The Developer agrees that the terms of this Development Contract shall be a covenant on any and all property included in the Subdivision. The Developer agrees that the City shall have the right to record a copy of this Development Contract with the Anoka County Recorder to give notice to future purchasers and owners. This shall be recorded against the Subdivision described on page 1 hereof. D. REIMBURSEMENT OF COSTS The Developer agrees to fully reimburse the City for all costs incurred by the City including, but not limited to, the actual costs of construction of said improvements, engineering fees, legal fees, inspection fees, interest costs, costs of acquisition of necessary easements, if any, and any other costs incurred by the Cite relating to this Development Contract and the installation and financing of the aforementioned improvements. E. OCCUPATION OF PREMISES The Developer further agrees that they will not cause to be occupied any premises upon the plat or any property within the plat until the completion of the gas, electric, telephone, water, and sewer improvements required by this Page 6 Woods of Clearwater Creek Development Agreement DRAFT August 27, 1998 Development Contract have been installed, unless the City has agreed in writing to waive this requirement as to a specific premises. Furthermore, Developer shall be granted no certificates of occupancy for homes within the plat prior to substantial completion of all Private and Street and Utility Improvements described in this Agreement, including the base course layer of pavement. Building Permits shall be issued only within the constraints of Section A, Part 2b. F. CLEAN UP . The Developer shall be responsible to keep new and existing streets clean and shall conduct routine sweeping of the project area. The Developer shall clean streets no later than 24 hours after being notified by the City. G. HOMEOWNER NOTICE Developer agrees to provide the owner of each lot purchased within the development on or before the date of closing a statement in substantially the form shown as Exhibit A hereto. A signed copy of such agreement shall be returned to the City within ten (10) days following execution by the homeowner. H. OWNERSHIP OF IMPROVEMENTS Upon completion of the work and construction required by this contract and acceptance by the City, the improvements lying within the public easements shall become City property without further notice or action. I. REIMBURSEMENT OF COSTS FOR DEFENSE The Developer agrees to reimburse the City for all costs incurred by the City in defense of enforcement of this contract, or any portion thereof, including court costs and reasonable engineering and attorney's fees. J. VALIDITY If any portion, section, subsection, sentence, clause, paragraph, or phrase in this contract is for any reason held to be invalid by a court of competent jurisdiction, such decision shall not affect or void any of the other provisions of the Development Contract. K. GENERAL 1. Binding Effect The terms and provisions hereof shall be binding upon and insure to the benefit of the heirs, representatives, successors, and assigns of the parties hereto and shall be binding upon all future owners of all or any part of the Subdivision and shall be deemed covenants running with the land. - 2. Notice Whenever in this Agreement it shall be required or permitted that notice or demand be given or served by either party to this Agreement to or on the other party, such notice or demand shall be delivered personally or mailed by United States mail to the addresses herein before set forth on Page 1 by certified mail (return receipt requested). Such notice or demand shall be deemed timely given when delivered personally or when deposited in the mail in accordance with the above. The addresses of the parties hereto are as set forth on Page 1 until changed by notice given as above. 3. Final Plat Approved The City agrees to give final approval to the plat of the Subdivision upon execution and delivery of this Agreement and of all required petitions, bonds, fees, and securities indicated in Exhibit B. Incorporation by Reference All plans, special provisions, proposals, specifications, and contracts for the improvements furnished and let pursuant to this Agreement shall be and hereby are made a part of this agreement by reference as fully as if set out herein in full. L. VIOLATION OF AGREEMENT In the event that Developer violates any of the covenants and agreements contained in this Development Contract and to be performed by the Developer, the City, at its option, in addition to the rights and remedies as set out hereunder may refuse to issue building permits to any property within the plat until such time as such default has been corrected to the satisfaction of the City. M. PARK DEDICATION The Developer agrees to provide park dedication to the City in the form of a cash payment of $7,500 calculated at $750 per lot multiplied by 10 lots. N. TRAIL DEDICATION The Developer agrees to provide trail dedication to the City in the form of a cash payment of $1,500 calculated at $150 per lot multiplied by 10 lots. O. STORMWATER FEES The stormwater fee shall be paid by the Developer prior to approval of the final plat. This fee is $13,002.94, based on a charge of $0.01546 per square foot of 19.31 acres of platted area. P. LIABILITY INSURANCE REQUIREMENT The Developer shall provide to the City, at the Developer's expense, general public liability and property damage insurance including vehicle coverage protecting the City and the Developer from all claims for personal injury, including death, and all claims for construction of or damage to property, arising out of or in connection with any operations under these contract documents, whether such operations be by the Developer, its Contractor, or by any subcontractor, or anyone directly or indirectly employed by the Contractor or by a subcontractor under him. Insurance shall be written with a limit of liability of not less than $600,000 for all damages arising out of bodily injury including death, at any time resulting therefrom, sustained by any one person in any one accident; and a limit of liability of not less than $1,000,000 for any such damage sustained by two or more persons in any one accident. Insurance shall be written with a limit of liability of not less than $700, 000 for any such damage sustained by two or more persons in any one accident, and a limit of liability of not less than $600,000 for any such damage sustained by two or more persons in any one accident. The insurance policies shall accompany the contract for its execution by the Developer and the City of Centerville. The above insurance policies shall be in full force and effect during the life of this contract. The City, City Engineer and Developer's engineer shall be an additional named insured on any such policy or policies. Q. INDEMNIFICATIONAND HOLD HARMLESS. The Developer shall hold the City and its officers and employees harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from subdivision plat approval and development. The Developer shall indemnify the City and its officers and employees for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including reasonable attorneys' fees. Provided that nothing herein shall require Developer to indemnify the City, its officers or employees from any violation of law or from the consequences of their own negligence. Developer represents and agrees that prior to the completion of the Developer improvements as certified by the City. a. Except by way of security for, and only for the purpose of obtaining financing necessary to enable the Developer to perform its obligations with respect to the construction of the improvements under this Agreement and any other purpose authorized by this Agreement, the Developer (except as so authorized) will not make or create, or suffer to be made or created, any total or partial sale, assignment, conveyance, or transfer in any other mode or form, with respect to this Agreement or any interest therein, or any contract or agreement to do any of the same, without the prior written approval of the City. b. In the absence of specific written agreement by the City to the contrary, no such transfer or approval by the City shall be deemed to relieve Developer from any of its obligations. In the event that the City approves a substitute Developer and the property is transferred to said substitute, the City agrees to relieve the Developer of liability from performance as described in this Contract. Said substitute shall assume all responsibilities and rights of the Developer under this Contract. S. WAIVER. The action or inaction of the City shall not constitute a waiver or amendment to the provisions of this Agreement. To be binding, amendments or waivers shall be in writing, signed by the parties, and approved by written resolution of the City Council. The City's failure to promptly take legal action to enforce this Agreement shall not be a waiver or release. CITY OF CENTERVILLE COUNTY OF ANOKA STATE OF MINNESOTA SPECIAL USE PERMIT This Special Use Permit is granted by the City of Centerville, Anoka County, Minnesota this 23rd day of September, 1998. In the event that Permittee fails to comply with any of the terms and conditions set out herein or ordinances, or rules and regulations of the State Minnesota, County of Anoka, City of Centerville or any other governmental agency having jurisdiction over this project, the City Council shall have the right to immediately revoke the Special Use Permit. Any and all costs incurred by the City in the event of default by Permittee in any of the terms, conditions, ordinances or rules and regulations as provided above shall be the responsibility of the Permittee. 8. This Special Use Permit shall be subject to annual review by the City of Centerville. In the event the activities conducted on such property are injurious to the public health, safety and welfare, the City Council shall have the right to immediately revoke the Special Use Permit. Any and all costs incurred by the City in the event of default by Permittee in any of the terms, conditions, ordinances or rules and regulations as provided above shall be the responsibility of the Permittee. 9. CITY OF CENTERVILLE ANOKA COUNTY STATE OF MINNESOTA ORDINANCE NO. 67 AN ORDINANCE ADOPTING THE 1997 UNIFORM HOUSING CODE The City Council of the City of Centerville does ordain as follows: Chapter 1: Title and Scope. The purpose of this code is to provide minimum standards to safeguard life or limb, health, property, and public welfare by regulating and controlling the use and occupancy, location, and maintenance of all residential buildings and structures. Chapter 2: Enforcement. The building official is hereby authorized and directed to enforce all of the provisions of this code. For such purposes, the building official shall have the powers of a law enforcement officer. Chapter 3: Permits and Inspections. Buildings or structures within the scope of this code and all construction or work for which a permit is required shall be subject to inspection by the building official in accordance with and in the manner provided by this code and Sections 108 and 1701 of the Building Code. Chapter 4: Definitions. Chapter 5: Space and Occupancy Standards. All buildings shall be located with respect to property lines and to other buildings on the same property as required by Section 503 and Chapter 6 of the Building Code. Chapter 6: Structural Requirements. Buildings or structures may be of any type of construction permitted by the Building Code. Roofs, floors, walls, foundations and all other structural components of buildings shall be capable of resisting any and all forces and loads to which they may be subjected. Chapter 7: Mechanical Requirements. All heating devices shall be of an approved type. All electrical equipment shall be of an approved type. Ventilation for rooms and areas and for fuel- burning appliances shall be provided as required in the Mechanical Code and in this code Chapter 8: Exits. Dwelling units or guest rooms shall have access directly to the outside or to a public corridor. All buildings or portions thereof shall be provided with exits, exitways and appurtenances as required by Chapter 10 of the Building Code. Chapter 9: Fire Protection. All buildings or portions thereof shall be provided with the degree of fire - resistive construction as required by the Building Code for the appropriate occupancy, type of construction and location on property, and shall be provided with the appropriate fire - extinguishing systems or equipment required by Chapter 9 of the Building Code, Chapter 10: Substandard Buildings. Chapter 11: Notices and Orders of the Building Official. The notice and order, and any amended or supplemental notice and order, shall be served upon the record owner, and posted on the property; and one copy thereof shall be served on each of the following if known to the building official or disclosed from official public records: the holder of any mortgage or deed of trust or other lien or encumbrance of record, the owner or holder of any lease of record, and the holder of any other estate or legal interest of record in or to the building or the land on which it is located. Chapter 12: Appeal. Upon receipt of any appeal filed pursuant to this section, the building official shall present it at the next regular or special meeting of the board of appeals. My intent for this property would be to construct two five thousand sq. foot buildings to be used for storage. Because of the building within the city of new homes and townhomes, the residents could use a building like this that would be close to them and have the protection of the local police force. I By 12/27/9 GENIR- U-47 JL CITY OF CENTERVILLE PLANNING AND ZONING COMMISSION MEETING SEPTEMBER 1, 1998 Pursuant to due call and notice thereof, the Planning and Zoning Commission of the City of Centerville held its regularly scheduled meeting at City Hall, 1880 Main Street. PRESENT: Chairwoman Kathy Welk Commission Members: Al LaMotte Linda Broussard- Vickers ABSENT: Commission member John Buckbee STAFFICONSULTANTS: Jim March, City Administrator Ry -Chel Gaustad, City Clerk Tom Peterson, Consulting Engineer OPENING Roll Call PUBLIC HEARING (S) Preliminary Plat Consideration for Mound Trail (Carl Buechler 1 Mr. Carl Buechler was present to discuss the proposed Buechler Estates preliminary plat and to request the Commissions approval. He also planned to independently finance the utilities and to pay park funds in place of park dedicated property. Mr. Peterson noted the city plans to install utilities along the southeast property boundaries and he suggested the developer provide a 20 -foot wide utility easement along the sanitary sewer, east of the plat. A 20 -foot easement should be provided for the entire length of the easement, not a 10- foot easement. The easement will allow the city to maintenance and repair the lines. He also commented a tree may need to be removed to install the proposed utilities. Mr. Joe Holiday (1295 Mound Trail) noted the willow tree is located on his property and felt no concern to remove the tree. Ms. Cathy Holiday (1295 Mound Trail) voiced concern pertaining to the developer ensuring the 1 w , proper drainage. Also, the Holiday property is adjacent to Lot 1, of the proposed development. Mr. Buechler commented the drainage has been addressed and will not affect the property at 1295 Mound Trail. Mr. Peterson stressed the bad soils in the area and suggested soil borings on each lot and prior to building permit approval. Ms. Broussard - Vickers noted a potential concern with draining from lot 5 onto lot 4, and she noted item #5 of the Public Works Directors/Building Officials comments. 45. "The proposed drainage swale in the roadway ditch doesn't meet with the City's requirements of a I% minimum grade." Mr. Peterson suggested a drainage swale between lot 5 and west of the existing lots. Mr. Rod Holhizer (7193Mound Trail) questioned the Developer about the slope between lot 5 and his lot and hoped that no future drainage problems would occur. Mr. Lloyd Drilling (7185 Mound Trail) addressed and questioned the Commission in regards to the Mound Trail and its condition, who owns and maintains the road and who is responsible for road repair. Furthermore, he confirmed an RCWD permit is required and that a Saint Paul Utilities (City of St. Paul) permit is not required. Mr. Holhizer had a point of information considering this house is located in the City of Lino Lakes, his mail box is in the City of Centerville and his mailing address is in the City of Hugo - will the cities consider redesigning the corporate boundaries or annexing the last two lots on Mound Trail, Mr. LaMotte moved to close the public hearing. Ms. Broussard- Vickers seconded the motion. Motion carried unanimously, Special Use Permit for Tim Peppenger - Operate an Auto Electrical Repair Shop Mr. Tim Peppenger (7129 20th Avenue North) was present to request a special use permit recommendation from the Planning and Zoning Commission to the Councilo. Chair Welk confirmed traffic and parking would not hinder the area businesses. She also confirmed the business hours will be from 8:00 a.m. to 6:00 p.m. Mr. March confirmed Mr. Peppenger would not have exterior storage and adequate parking was available. Mr. LaMotte moved to close the public hearing. Ms. Broussard - Vickers seconded the motion Motion carried. A variance - Road to be over 800' in Length with a Temporary Cul- de-sac Mr. Thomas Peterson (City Engineer) updated the Commission on the proposed variance. He suggested the cul -de -sac be constructed at 60' (right -of -way) because the north property may not afford a road to be constructed. 2 I Ms. Broussard - Vickers suggested shortening the road from 960' to 800'. Mr. Peterson commented, the road and cul -de -sac should be constructed to the north property line for future construction. Mr. LaMotte moved to close the public hearing. Ms Broussard - Vickers seconded the motion Motion carried unanimously. Amend Cable Ordinance #40 Chair Welk acknowledged the audience. Ms Broussard - Vickers moved to close the public hearing Mr. LaMotte seconded the motion Motion carried unanimously. A variance - Reconstruction of a shed at 1563 Peltier Lake Drive for Phippen Ms Broussard - Vickers moved to close the Phippen variance public hearing Mr. LaMotte seconded the motion Motion carried unanimously. Rezone Property From RI to PUD (Planned Unit Development) For Rehbein Chair Welk addressed the audience and requested comments in regards to the rezone request for the property identified as the west 10 acre portion of 7305 & 7353 20th Avenue. Mr. Rod Henslin (1967 73rd Street) was present to discuss the rezone request from Rl to PUD. He also said that the proposed development did n t include grass, nor playground equipment because of the blacktop requirements. Mr. Henslin requested the Commission to deny the request based on a noncompliance of the R5 zoning requirements and since the developers lacked to address the PUD items in Ordinance #4. Mr. LaMotte moved to close the public hearing Ms Broussard - Vickers seconded the motion Motion carried unanimously, APPEARANCES Willie Lessard - Sketch Plan for Lake Area Utilities - 6994 20th Avenue Mr. Lessard (6994 20th Avenue) presented a sketch plan for the Lake Area Utilities property. He also explained the proposed plan of 23 lots are in compliance with the R2 zoning requirements. All the lots are a minimum, of 15,000 sq. ft. Mr. Lessard explained that all concerns express from pass meetings have been addressed: lights, traffic the through road from Brain Drive to 20th Avenue and a desire to have homes instead of townhomes /commercial. He also noted he proposed to provide a trailway easement on the east side of 20th Avenue in exchange of park dedicated land. Mr. Lessard requested the Commissions approval to pursue preliminary plat consideration during the October Commission meeting. The Planning Commission suggested Mr. Lessard attend the Park and Recreation meeting the following night. 3 ACTION ITEMS Action on Planning and Zoning Candidate Ms. Gaustad reported on behalf of Mr. Buckbee he chose Mr. Brian Hanson to fill the Commission vacancy and secondly, Mr. Dick Travis as an alternate. Chair Welk agreed with Mr. Buckbee. Mr. LaMotte elected Mr. Travis and second, Mr. Brian Hanson. Ms. Broussard - Vickers questioned Mr. Travis if his position would cause a conflict of interest. Mr. Travis commented the Woods development is near completion and will be finished. Second, Glenn Rehbein Excavating seldom works in the Centerville area. Therefore, he did not foresee a conflict of interest. Ms Broussard - Vickers moved to approve Mr. Brian Hanson and as an alternate Dick Travis Chair Welk seconded the motion Motion carried unanimously. Action on Preliminazy Plat for Mound Trail (Buechler ) Ms Broussard- Vickers moved to recommend to the Council approval of the preliminary 12lat snhiect to the concerns of the City Engineer and Public Works Director with special attention to the road and that the plat is presented to the Park and Recreation Commission at its next scheduled meeting Chair Welk seconded the motion Motion carried unanimously. Action on Special Use Permit for an Auto Electrical Repair Shon Mr. LaMotte recommended the Council approve the Special Use Permit request for an Auto Electrical Repair Shop at 7129 - 20th Avenue Ms Broussard- Vickers seconded the motion Motion carried unanimously, Action on Variance Request for a Road Over 800' in Length with a Temporary Cul- de-sac Ms Broussard - Vickers moved to recommend to the Council approval of the variance request for a road over 800' in length with a temnora a cul -de -sac and the dimensions to meet with the city engineer's approval Mr. LaMotte seconded the motion Motion carried unanimously_ Action on Variance to Reconstruct a Shed at 1563 Peltier Lake Drive Ms. Gaustad updated the Commission on the variance requested to reconstruct a shed at 1563 Peltier Lake Drive. Ms. Gaustad suggested the Commission require the property owner to submit to the City a certificate of survey noting the location of the cement slab. The Commission did not take action. Action on a Rezone Request from Rl to PUD (Gerald Rehbein) Ms Brossard- Vickers moved to untable the Rezone request and to re -table the request subject to the developer signing a 60 -day rezone waiver form and that the resident duly noted specific PUD requirements as outlined in the ordinance is addressed Chair Welk seconded the motion Motion carried unanimously. 4 r DISCUSSION ITEMS Reschedule November 3. However, Mr. Rehbein will need to comply with Ordinance #4: Article 5 - Planned Unit Developments She also read aloud the above - mentioned ordinance. Mr. Tom Kennedy (1983 73rd Street) and Mr. Tom Hauge (1994 73rd Street) opposed further restricting, Ordinance #5 Discharge of Firearms. Chair Welk read aloud section 3 of ordinance #5. Ordinance #4 - Outbuildings - Saxton Mr, Dan Saxton (1949 73rd Street) was present to discuss ordinance #4. Particularly, Section 34.06 -1 AMOUNT OF YARD OCCUPIED In the R -2A R -2 and R -5 zoning districts a detached accessory building not over one story and not exceeding fourteen (14 ) feet in height may occult' not to exceed ten (10) percent square footage of the area of any rear yard. The hei hg t of the accessory building shall not exceed the height of the primary building. Mr. Saxton commented his neighbor erected a shed that is 14 feet wide, 24 feet long and 17 feet high. This shed is 10 feet from his property line and 25 feet from the back lot line. Mr. Saxton distributed photos of the shed while in various stages of construction. He then requested the Commissions consideration to amend the ordinance to ensure another property owner does not have a similar experience. 5 Ms. Broussard- Vickers interpreted the ordinance differently than Mr. Saxton and requested Staff provide clarity to the Comrission. Usually, additional language is intended to be more restrictive than the lack of words. The Commission discussed amending the ordinance to reduce rear yard accessory structures from 10 percent to 8 percent and specifically address corner lots. The Commission requested Staff investigate the items below and report to the Commission. * Shed permits that are added onto basement permits * The Building Inspectors interpretation of the ordinance & section in question. * Elevation requirements and changes for new structures. * Research to see if another similar permit has been issued and if one is pending, the Commission makes strong recommendation not to issue another similar permit until this issue is resolved.
