Mayor Tom Wilbarber called the public hearing for Truth and Taxation to order at 6:05 PM. PRESENT: Tom Wilharber Theresa Brenner Sanna Buckbee Laura Powers- Rasmussen ABSENT: Mary Jo Helmbrecht STAFF /CONSULTANTS: Jim March Paul Palzer Ry -Chel Gaustad Dave Nyberg TRUTH AND TAXATION March reviewed the city's current status and past financial history. Statistics indicate the city dropped from the third highest to the number seven spot in regards to municipal tax rates. March explained, the proposed budget increased the levy by 5 percent. With additional revenue such as, antenna rental space contracts and a higher net tax capacity has helped reduce the municipal tax rate. March explained a graph of the 1996 expenditures and the proposed 1997 expenditures. Brenner questioned funding for capital improvement items. March explained, projects and purchases such as, replacing the snowplow and purchasing additional election supplies have been considered and fit into the 1997 budget. MOTION by Powers- Rasmussen, seconded by Brenner to close the Truth and Taxation public hearing at 6:10 PM. Motion carried unanimously. Wilharber opened the regularly scheduled council meeting at 6:11 PM. APPROVAL OF MINUTES: November 13, 1996 council meeting minutes - MOTION by Brenner, seconded by Buckbee to table the November 13, 1996 City Council Meeting December 11, 1996 council meeting minutes. Motion carried unanimously. November 26, 1996 council meeting minutes - MOTION by Brenner, seconded by Buckbee to table the November 26, 1996 council meeting minutes. Motion carried unanimously. PAYMENT OF CLAIMS: City of Centerville November 27 - through 30th - MOTION by Brenner, seconded by Buckbee to approve the disbursements and receipts of November 27 through 30th. Motion carried unanimously. City of Centerville December 1 through 11th - MOTION by Buckbee, seconded by Brenner to approve the disbursements of December 1 through 11th. Motion carried unanimously. Centennial Fire District December 6, 1996 - MOTION by Buckbee, seconded by Brenner to approve the Fire Districts December 6, disbursements. Motion carried unanimously. SET AGENDA: Goals and Objectives for 1997 Meeting with Jim Brimeyer Assignments and Appointments for 1997 MOTION by Buckbee, seconded by Brenner to approve the set agenda. Motion carried unanimously. PETITIONS AND COMPLAINTS: APPEARANCES: Michael Navin - represented the Park and Recreation Committee - Navin requested direction to pursue a joint powers agreement with the area communities recreation committee. Navin explained, P &R addressed the lack of service Centerville has received from North Metro Recreation Services. Communities recreation may provide a better service to the citizens. Navin said, Centerville pays about $5.00 per household to North Metro and the city doesn't know where these funds are spent. P &R would like to look further into the joint powers agreement. Buckbee asked if the school would participate. Navin will look into the schools participation and /or interest. Navin said, if the City chooses not to go with the contract, Centerville will be left out and may have to pay additional fees to be included in recreation 2 City Council Meeting December 11, 1996 programs. March spoke with Lino Lakes and Circle Pine Administrators and both are pushing for the agreement. Navin mentioned a flyer explaining the change was being sent to the surrounding communities indicating the change and suggested Centerville be included. Brenner would like to move forward with this, but would like to see more participation from the City. Navin explained, Lino Lakes has some good programs such as, flag football and adult programs. Wilharber suggested not paying for both North Metro and the Communities program. Brenner asked if the council could see the financial on North Metro. MOTION by Buckbee, seconded by Brenner to direct city staff to contact Lino Lakes and approve the Parks and Recreation committee to actively participate in the joint powers agreement. Brenner added, and request the financials on North Metro. Motion carried unanimously. OLD BUSINESS: Results of Senior Housing public meeting - Brenner reported, they met on December 5, and had a nice turn out of about 25 people. An architect was present and explained different housing designs. A management company who works through Anoka County HRA was present to discuss management services for the housing. Brenner mentioned, several people were interested in senior housing. Brenner suggested, setting up a meeting with Anoka County HRA, the Fire Chief, and the City Engineer to further discuss senior housing to see if this is something the City wants to do. March spoke to Kate Drewry from Rice Creek Watershed District, she said the city would have to be 100 feet from Clearwater Creek, but they could try to work on the City Hall location. Wilharber was in favor of discussing senior housing, but doesn't care for sharing the Fire Department and City Hall parking lot. Buckbee was in favor of senior housing, but was not in favor of the location behind City Hall. Powers - Rasmussen asked if St. Genevieve responded to the city's interest in their property. Brenner said St. Genevieve was not interested in selling or donating their land. Powers - Rasmussen thanked Brenner for her time and hard work. Final plat approval for Willow Glen - Nyberg suggested approving the final plat contingent upon Rice Creek Watershed District and the Engineers okay, allowing MSA to review all issues. Nyberg said, Gerald Rehbein requested half of the park dedication monies be paid now and remaining monies be paid after the next phase is platted. Buckbee asked if there will be any assessments on the property. March said no. Buckbee was not in favor of the fifty -fifty payment. Powers- Rasmussen agreed. C.R. Hackworthy of Bright Key Development said, if the townhomes were not completed, the city would have to return the park dedication money. 3 City Council Meeting December 11, 1996 Buckbee expressed concern of compliance with ordinance #8, section 38.01 - temporary turn around. Nyberg said the developer will comply with this and all ordinances. MOTION by Buckbee, seconded by Brenner to approve the final plat contingent upon Rice Creek Watershed Districts and Engineering approval. Also the temporary turn around be addressed with the Fire Chief. Motion carried unanimously. Development Contract for Willow Glen - C.R. of Bright Key Development requested the city council permit half of the park dedication fee of $36,000 be paid now and the remaining amount upon completion of the development. MOTION by Buckbee, seconded by Brenner to approve the development contract between R&R leasing and the city of Centerville, contingent upon the City Engineers approval. Motion carried unanimously. Building Permits - C R, of Bright Key requested the city council to lower the building permit fees associated with each townhome. C.R. compared Centerville's market value against Oakdale and Woodbury. The Centerville end unit is valued at $86,000, the permit fee is $873.75. An Oakdale end unit is valued at $87,400 the permit fee is $540.50. A Woodbury end unit is valued at $84,600 and the permit fee is $540.50. C.R. requested the council to lower the permit fees to be in conjunction of other communities. Palzer stated Todd Smith, Anoka County Assessor reviewed the plans and the home value came in at $97,100. Palzer said, originally the end unit plans C.R. submitted were valued at $85,000 now C.R. is proposing a value of $79,000. The County Assessor included 5 of the 20 possible options available and concluded $97,100 is the fair market value. MOTION by Powers - Rasmussen, seconded by Brenner to deny a permit decrease. Motion carried unanimously. C.A. stated for the record, he was very disappointed in how this matter has been handled. He felt working with the city would be a two way street, but now he understands it's a one way road. C.R. was very disappointed the council wouldn't consider a decrease in the permit fees. Waterinain Interconnect - Nyberg interjected the watermain issue down 20th Avenue is more of a political issue than a service issue. Jim March and Dave Nyberg planned to meet on Monday with Eagle Pass Developers, to discuss the future outlook for a water supply, on the south side of the City. Nyberg presented four different feasibility options for extending the watermain sanitary sewer to the southeast corner of the City. The options are as follows: 4 City Council Meeting December 11, 1996 First, extend watermain and sanitary sewer along the proposed right -of -way for 21 st Avenue. The watermain could tie into Lino Lakes` existing 16" watermain along Cedar Street. Second, extend watermain and sanitary sewer alongside 20th Avenue south to the intersection of 20th Avenue and Cedar Street. This too could tie into Lino Lakes' existing 16" watermain. This option may or may not be served by gravity sanitary sewer to the north and south. This option would warrant further exploration in a feasibility study. Another option is to analyze the capacity of the lift station in Center Oaks 2nd Addition to handle extra effluent from the previous two options. The station would need to be checked for the possibility of retrofitting. This option would include preliminary cost of a new lift station if the retrofits are not feasible. Finally, study the potential individual service corridors for the industrial area between 20th and 21st Avenues, north of Cedar Street. The study would consist of proposed layouts and cost for utility placement within the development and to better analyze anticipated assessments. Nyberg concluded, all options would include a preliminary assessment scenario to allow the City to better anticipate future funding needs. Each option would need an estimated budget of $1,000 to further investigate its feasibility. MOTION by Buckbee, seconded by Brenner to authorize the City Engineer to do a feasibility study for option number 2 and 3. Brenner added, and prepare preliminary scenario's not to exceed $2,000.00. Motion carried unanimously. Eagle Pass -snowmobile issue- Nyberg spoke with Mike Quigley of Eagle Pass, Mike felt since this is private property, snowmobiling in the area would be trespassing. Status of Peltier Lake Drive - Nyberg recommend the council consider resurfacing Peltier Lake Drive. Summer of'97 will be 10 years since the road was constructed. Buckbee suggested looking into some other options, instead of assessing the home owners every 10 years. Wilharber said the council will take this into consideration and perhaps address this in the Spring of'97 with Public Works. Set date for public hearing on Comprehensive Plan - March spoke with Dean Johnson of Resource Management, and suggested the public hearing be set for January 8, 1997. MOTION by Buckbee, seconded by Brenner to set the date for the Comprehensive Plan hearing for January 8, at 6:00 PM. Motion carried unanimously. Wellhead protection joint powers agreement - Gaustad reported the State Health Department is requiring all municipalities to have a wellhead protection plan in place prior to applying for new well permits or items such as a watertower. Dakota County 5 City Council Meeting December 11, 1996 completed a county plan and the cost seems to be less per city than if each city veered out on their own. Spring Lake Park received a quote between $20,000. - $30,000 to complete a wellhead protection plan for their city. Anoka County is working with the majority of the cities to complete a county wide wellhead protection plan. Gaustad continued, Centerville would pay about 3% of the cost, whereas, the cities of Coon Rapids, Blaine and .Anoka will pay the majority of the cost. Gaustad concluded, Anoka County Health Department would like each interested city to enter into a joint powers agreement. MOTION by Brenner, seconded by Powers- Rasmussen to enter into a joint powers agreement with Anoka County. Motion carried unanimously. March mentioned a liaison and an alternate person was needed for the wellhead protection plan. March suggested Gaustad be the liaison and himself the alternate. MOTION by Wilharber, seconded by Buckbee to appoint Ry -Chel as the Liaison and Jim as the alternate. Motion carried unanimously. Powers- Rasmussen left at 8:25 PM. Meeting with Jim Brimeyer was set for January 15, 1997 at 3:00 PM. COMMITTEE REPORTS ADMINISTRATOR REPORTS March reviewed the Capital Improvement list: Center Oak drainage Over sizing of water and sewer Public Works Building Snow plow replacement Back hoe/ mower Adding new parks to the area Wilharber suggested the council create a high to low priority list for'97 goals and objectives. Wilharber asked the council to think about assignments and appointments for 1997. MOTION by Buckbee, seconded by Wilharber to adjourn the meeting. Meeting adjourned at 8:40 PM. Motion carried unanimously. Pay Estimate #2, Willow Glen - Wilharber proposed pay estimate #2 for Willow Glen requesting $49,070.31 be paid. MOTION by Buckbee, seconded by Helmbrecht, to approve pay estimate 42 for Willow Glen in the amount of $49,070.31, under direction of David Nyberg. Motion carried unanimously. Pay Estimate #3, Eagle Pass - Wilharber reviewed pay estimate #3 for Eagle Pass. City Council Meeting December 18, 1996 MOTION by Helmbrecht, seconded by Brenner to approve pay estimate 43 in the amount of $9,869.31 for Eagle Pass. Motion carried unanimously. Pay Estimate #4, Clearwater Meadows - Wilharber reviewed pay estimate #4 partial payment for Clearwater Meadows, which indicated the total amount due at this time is $11,188.15, with a total retainage of $14,722.22. MOTION by Brenner, seconded by Helmbrecht to approve Clearwater Meadows pay estimate 94 in the amount of $11,188.15. Motion carried unanimously. SET AGENDA: Complaint Meeting with Jim Brimeyer MOTION by Buckbee, seconded by Helmbrecht to approve the set agenda. Motion carried unanimously. PETITIONS AND COMPLAINTS: Helmbrecht reported she had received a complaint, that there is no speed limit sign on Old Mill Road. Wilharber directed city staff to notify Public Works. Wilharber mentioned Dupre road sign was misspelled. Gaustad reported the sign had been corrected. APPEARANCES: UNFINISHED BUSINESS: Meeting with Jim Brimeyer - 6 month review for the ClerklAcimimstrator - Meeting was rescheduled for Wednesday, January 8, at 3:00 p.m. NEW BUSINESS: COMMITTEE REPORTS: Economic Development Committee - Brenner reported during the EDC meeting the comprehensive plan was discussed. The committee members stressed including the downtown revitalization in the comp. plan. Helmbrecht asked if someone from EDC would be present at the public hearing. Brenner believed a member from EDC would be at the public hearing to discuss the downtown area. Brenner reported a correction in the EDC minutes under senior housing; the $66,000 per unit was corrected to read $66,000 for the whole unit. 2 City Council Meeting December 18, 1996 Wilharber reported the police department has had several snowmobile thefts. ADMINISTRATOR REPORTS: Gaustad confirmed the Clerk/Administrator review with Jim Brimeyer is scheduled for Wednesday, January 8, at 3:00 p.m. Further, the public hearing for the comprehensive plan is scheduled for Wednesday, January 8, at 6:00 p.m. Finally, Senior Housing Workshop is scheduled for Wednesday, January 15, at 5:00 p.m. Gaustad indicated Monday, January 6, is the newsletter deadline. Brenner suggested including the 1997 budget. Wilharber mentioned the city is scheduled to close on the Central Park property on Friday, December 20th. CONSENT AGENDA: Resolution Adopting 1996 Tax Levy, Collectible in 1997 - MOTION by Brenner, seconded by Helmbrecht to approve the Consent Agenda. Motion carried unanimously. Wilharber requested the council have 1997 g als and objectives prepared for the next council meeting. Wilharber passed out the 1996 appointment list and asked if the council would come prepared to address the 1997 appointments. December 27, 1996 James March City Administrator 1880 Main Street Centerville, MN 55038 RE: Lakeland Hills Dear Mr. March: Royal Oaks Realty, Inc. is pleased to submit the enclosed preliminary plat exhibits of Lakeland Hills. The gross area of the subdivision is 33.9 acres and 41 single family homes are proposed for a density of 1.2 units per acre. All lots meet or exceed the minimum 15,000 square foot requirement of the R -2 zoning district and the 100 foot width requirement at the 35 foot front yard set back line. The average lot size is 31,300 square feet. The plat has been designed to eliminate all double frontage lots and no variances are needed. The following is a list and summary of key issues relating to the approval of this new neighborhood: Wetland delineation. A wetland delineation for this property has been completed by the Anoka County Soil and Conservation Department. Wetland encroachment is unavoidable, however, it has been minimized. Some mitigation at a 2:1 ratio will be required. Review and a permit from the Rice Creek Watershed District will be required. Street Plan. At a special City Council meeting on November 26, 1996, concept plans were reviewed and a number of general comments and suggestions were made by the City Council. After a considerable amount of discussion, the entire City Council agreed that the extension of Centerville Road through this plat was not necessary. The preliminary plat exhibits reflect the concept plan approved by the City Council that evening. School Access and Drainage. A neighborhood trail access to the adjacent school property has been provided. It is intended that this will provide walking /bike access to the school and recreational facilities. We are also sharing our drainage /ponding plans with the school in an effort to alleviate their drainage issues with a planned school addition. Sanitary sewer is readily available to this land and will be extended into the subdivision from both the south and north. Municipal water will be extended from the Centerville Road and Westview Street intersection. The need to further loop the water main will be determined by the City engineer. If and when a loop is required, two possible ways to provide that loop exist, One is to the east connecting to the water main in Clear Ridge Street. The other loop possibility is to the north in Centerville Road and then east along Peltier Lake Drive to the water main in Mill Road. A copy of the proposed restrictive covenants and architectural review committee are attached for City review, It is our anticipation that new homes will be constructed in a price range of $170,000 to $220,000, including lot. The plan should indicate where silt fence will be installed. ■ Along the south side of the property, the swale is outside the drainage easements. Either increase the drainage easement or relocate the swale. This Swale is flatter than 1.0 %. This needs to be shown to have a minimum slope of 1.0 %. ■ The drainage swale along the north property line should be better defined and should have a minimum slope of 1.0%. ■ It is unclear how stormwater will drain into the ditch along 21st Avenue and what type of erosion control will be used. It is also unclear what the intended flow direction is in the ditch along 21st Avenue. ■ At the southwest corner of the parking lot, the depression in the curb is shown to allow the stormwater to drain away from the parking lot. A more defined swale should be graded to allow the water toflow away from the parking lot quickly. ■ On the Site Plan, the 50 -foot drainage easement is shown such that 40 feet of the drainage easement covers this lot. On the Grading Plan, the entire 50 -foot drainage easement is shown to cover this lot. The correct easement should be shown. As I indicated to you on the phone, some adjoining land owners south of Mound Trail have had title problems because of their lack of direct access to Mound Trail. Originally, I spoke to John Fitzgerald. the attorney representing some of the land owners, and told him we would try to donate the property to the adjoining land owners. However, there may be title problems in doing this. Therefore, the preferred method of granting those land owners access would be to donate the park property to the City of Centerville for use as part of Mound Trail. The Metropolitan Parks and Open Space Commission is in agreement with releasing the restrictive covenant on this park property so that it can be donated. Also enclosed is a list of the affected land owners along with a copy of the highway easement given to the City of Centerville by Anoka County in 1978 to create Mound Trail. I am asking you to verify whether the City of Centerville will be willing to accept this park property from Anoka Counly to expand Mound Trail between its existing southerly border and the northerly border of the adjoining land owners. The MMUTCD stresses the need for uniformity of traffic control devices in school areas. For your information and consideration I have extracted the following three paragraphs from the MMUTCD: Traffic control in school areas is a highly sensitive subject. If all the demands of parents and others were met, there would have to be many more police and adult guards for school duty; and many more traffic signals, signs, and markings. Such demands, however, are not always in line with actual needs. Analyses often show that at many locations, school crossing controls requested by parents, teachers and other citizens are unnecessary and costly and tend to lessen the respect for controls that are warranted. It is therefore important to stress the point that regardless of the school location, safe and effective traffic control can best be obtained through the uniform application of realistic policies, practices and standards developed through engineering studies. Non - uniform procedures and devices cause confusion among pedestrians and vehicle operators, prompt wrong decisions, and can contribute to accidents. In order to achieve uniformity of traffic control in school areas, comparable traffic situations must be treated in the same manner. Each traffic control device and control method described in this part fulfills a specific function related to specific traffic conditions. Affirmative Action / Equal Opportunity Employer It is ACHD's policy to install additional school warning devices only when and where they are warranted. As stated in the MMUTCD, unnecessary controls tend to lessen the respect for those controls which are warranted. If you wish to proceed, upon your written request ACHD will conduct the necessary engineering study of the frequency and adequacy of gaps in traffic and determine the need for additional controls at the Centerville Elementary School. If the determination is made that no additional controls are warranted ACHD will not participate in the installation of any additional devices. For your information, school zone flashers were installed on Birch St. at Rice Lake Elementary in Lino Lakes when that school opened. An engineering study had determined that these devices were not warranted and ACHD did not participate in the installation of these devices. All costs of installing and maintaining these flashers are charged to the school district. You may wish to contact school district officials to find out the costs associated with the installation and maintenance of these devices. Feel free to contact me if you have any questions.
