Motion carried ed an updated disbursements list before the Ms. Moore-Sykes indicated that the change was to bring the City to the current da,te on disbursements. VOTE: All in favor. Motion carried unanimouslY. v. AWARDSIPRESENTATIONS/APPEARANCES 1. Fire Chief Milo Beilnett - Fire District Budget 2004 Fire Chief Bennett appeared before Council to present the 2004 budget for the Centennial Fire District noting that they are aware of reduced funding. He then provided an overview of the budget and indicated they have been careful to reduce in areas where it was possible. Fire Chief Bennett indicated that the budget for 2004 is 1.12% below that of 2003. He then indicated that the cost per citizen has been moving very slightly down since 1990 and for 2004 the cost per citizen in Centervi1le is $24.10. Council Member Capra indicated that one of the things that the steering committee agreed to is that the capital equipment had to remain at $100,000 as that is the only way to keep up with costs for replacing vehicles. Fire CI-Jef Bennett indicated that the trucks are on a 20-year replacement cycle but are very expensive to replace when the time comes. Council Member Lee commended Chief Bennett on reducing the budget. Motion carried unanimouslv. 2. 70 I 6 and 7020 Brian Court (property Line Dispute) Mr. Jerry Carlson, 7020 Brian Court, indicated that Ms. Jarosz was told this matter was a civil issue and he does not understand why Staff is not handling a basic code issue. Ms. Moore-Sykes indicated that this was initially a lot line dispute. . Mr. Carlson asked where Staff got that information because that is not the issue. He then said he made a complaint because his neighbor's shed is 36 3/8 inches off the property line and not the required 60 inches. He further indicated that there are be arks at the corners. Ms. Moore-Sykes indicated that and Staff has been r Council Member C Ms. Jarosz concerning the matter and then indicated the matte as left at bringing a survey to City Hall for Staff to verify and measure from the irons. Mr. Carlson indicated that both benchmarks are there and a line could be strung to make the lot line determination. Mr. Carlson indicated that Mr. Cook confirmed that the shed is too close to the property line. He then indicated he feels the shed is able to be moved and that is what he has asked for. Mr. Carlson indicated he has had problems with them and earlier this spring every day someone was knocking on his door but 90 days have elapsed and nothing has been resolved with his complaint. City Attorney Hoeft indicated the survey provided does not help and said that an as built survey for the other property indicating where the shed is located is needed. Ms. Moore-Sykes indicated she looked in the property files and has nothing for the other property but they maintain the shed was approved when they built it. Council Member Broussard Vickers indicated the City needed to find out when the shed was built. City Attorney Hoeft indicated that he would need the survey to prove in court where the shed is located orr the property. He then indicated that Staff should look into whether there is a drainage and utility easement that the shed is located in as well as what kind of Page 3 of 14 approval process the property owners went through for the shed, when it was built and what the size of the shed is. Council Member Broussard Vickers asked if Staff could send a letter to ask for the dimensions of the shed and when it was built. City Attorney Hoeft indicated tJIat if the property owner would like to disclose that information it would be to their advantage but they are not required to do so. Council Member Broussard Vickers directed Staff to determine if the shed is in the easement, the size of the structure and the year it was built. Mr. Carlson asked for a timeline of when to expect action. 1. Tower 500 000 Gallons Council asked S!affto provide anupdate at the next Council VL Mayor Sweeney opened Fire Chief Bennett asked if the City was planning on removing the old water tower. Council indicated that the old tower would be removed. Council Member Capra indicated the existing water tower had been purchased used and Council has discussed selling it for the cost of removing it. She then indicated that the City has a healthy water fund that will be funding the construction of the tower. Mayor Sweeney indicated the proposed costs to construct the water tower are approximately $1.086 million but that cost will not be assessed to .residents. He then indicated that the composite water tower column is concrete and does not have to be painted which will save the City a lot of money in maintenance. Council Member Capra indicated the estimated cost to paint the tower was $60,000 - $100,000 each time so, even though the composite tower costs more initially to construct, the City will come out ahead in long term maintenance as it does not need to be painted. Council Member Broussard Vickers indicated the study is available at City Hall for review. Motion bv Council Member Lee- seconded bv Council Member Paar to close the Dublic hearini!. All in favor. Centerville Lion's Recwest to Use 1694 Sorel (Old Public Works Site) for Haunted House Mayor Sweeney indicated the Lion's are seeking approval to use the old public works site for the haunted house again this year. Centennial Lakes Police Department Letter Ms. Moore-Sykes indicated that the City of Circle Pines has submitted a letter indicating that they cannot afford to contribute the dollar amount requested by the Police Commission for the 2004 budget and indicating they intend to contribute the same amount as 2003. Mayor Sweeney indicated the percentages changed and the City of Circle Pines has gone up while the other two have gone down. He then said that if the City of Circle Pines does not provide the amount asked by the Commission then it means that they cannot hire the two officers that they are down or it puts them in a position of hiring the two replacement officers and asking the other officers not to take pay increases. Council Member Capra asked if the City of Circle Pines is saying they cannot afford their contribution. Page 5 of 14 Mayor Sweeney indicated the police budget is a 3% increase for 2004 but it figures to a little more than that for the City of Circle Pines. He then indicated that if the cities cannot come to an agreement then there is a default increase of2.5%. Council Member Capra expressed concern that the City of Circle Pines cannot afford the 2004 budget but is proposing a new police building. Mayor Sweeney indicated that the new building is not something that comes up in 2004 it comes up later and can be assessed or bonded for. Council Member Broussard Vickers asked if the City of Centerville and the City of Lexington choose to put the amount in, is there a way to allocate that staff serve those two cities and not the City of Circle Pines. Mayor Sweeney indicated that was not possible. Council Member Capra asked whether the City of Lexington has ~ concerning the police budget. y feedback Mayor Sweeney indica did not seem happy Council asked Staff letter to the City of Circle Pines indicating that the City of Centerville would Ii e them to cOntribute the amount requested as the City feels it is important to fund the police department even in tight budget times. 4. Pheasant Marsh. Phase ill Developer's Agreement Council Member Capra asked for clarification of the location of the trail. Council Member Broussard Vickers indicated it was the intention fOf the tfail to go behind and hit the high spot on the edge and up to the comer with the thought that from that point the City would work on getting it to 20th Avenue. Council Member Broussard Vickers asked whether the agreement had the wording regarding prepayment or if Staff was structuring the bond appropriately to account for that. City Attorney Hoeft indicated that Staff would structure the bond to account for the prepayment. He then reviewed the changes to the agreement including increasing the building pad sizes to 60 x 60 as requested by Mr. Patzer. He also reminded Council that the improvements were getting close to the amount of the waiver. Council Member Broussard Vickers asked if the City could ask for a waiver on this phase. City Attorney Hoeft indicated that there is a waiver on the original agreement and Page 6 of 14 based upon the value of the property he does not think: the City would have an issue proving that the benefit exceeds the costs. Council Member Broussard Vickers commented that the only way to protect the City from incurring costs if the amounts were contested would be to require a waiver for this phase. She then indicated that she would like to see new waiver language to protect the City in this phase of the development especially in light of the fact that there. was not contesting in the formal sense, but significant questions during the previous phase. Council Member Capra commented that the original bonding is costing the City $130,000 because of early payoffs and she is concerned about any fi.rtu,re costs being brought on by Phase m. Council Member Lee indicated he would like to see a waiver as we to protect the City from unexpected costs. Council Member Paar agreed. [~ent indicated that she and Mr. Hoeft for Phase I extensively and this document is no questions. She then indicated that Mr. Runkle is concerned e fees and would like an explanation. Ms. Karen had gone thro very similar with some of Mr. Runkle indicated that there were four street sweepings at $150 and now that price is $250. He also indicated that graveVsilt fencing increased from $150 to $500 and the increased costs have increased the required letter of credit from $4.200 to $14.000. City Attorney Hoeft indicated that the developer's concern lies in the fact that the increased estimated costs results in a higher dollar figure for the 150010 retainage required for the letter of credit. Council Member Broussard Vickers commented that she did not feel that $15.000 was going to significantly impact a corporation the size of Ground Development. Council Member Capra commented that this developer has asked in the past to reduce the 150% retainage amount and the previous Council said no. Council Member Broussard Vickers indicated she did not feel that it was a significant cost especially since the City had to payout for the first phase. She further commented that any costs associated with the increased financing for the development could be absorbed in the sale prices of the lots. Ms. Marty indicated there is an Exhibit B but the document does not refer to an Exhibit B. City Attorney Hoeft indicated the document was for informational purposes. Page 7 of 14 Ms. Marty indicated that the waiver in the developer's contract waived the right to appeal for all three phases. city Attorney Hoeft indicated that the situation before Council is that the development contract is asking the City to put in improvements under the 429 process and part of the question is if the City chooses not to do that, the developer may have some costs involved in that. He then said that it needs to be worked out how the improvements are put in and who pays for it. Council Member Broussard Vickers indicated she did not think that posed a significant financial risk to the developer. . g the waiver Ms. Marty indicated she di and when the bi those bids came that and it does that much high or all three phases aeveloper was not consulted and d the developer has had no control over per is responsible for accepting a bid that was Council Member Broussard Vickers indicated that if that is the case, the City could withdraw the offer of 429 and the developer could find his own people to do the work. City Attorney Hoeft indicated that the court would need to make the determination that the assessed amount is equal to the benefit to the property. He then said that looking at the number of lots and having an idea of the sales price he feels there is no significant issue because he feels the City can prove the benefit to the property is there, but there would be costs to do so. Ms. Marty indicated that they have not.had any involvement in how the numbers came in and to put them in a position of paying for that does not seem right. She then commented that if the City wants to talk: about litigation expenses they could finish out the project and see whether it is worth Ground Development going forward with a challenge for the amount over the $1.8 waiver or we could litigate now over whether or not the City has the contractual obligation to go ahead with the 429. She then said she would rather go on the friendly basis of going forward and seeing if there is a need for further litigation down the road. Council Member Broussard Vickers indicated that if the developer is not willing to agree to a waiver she will make a motion to table approval of the agreement to allow time for consideration as to whether the City is interested in sponsoring the development through the 429 process without that waiver. Resolution #03-049 - Ordering Improvement and PrqJaration of Plans (21st Avenue) Ms. Moore-Sykes indicated that the Resolutions concerning 21 st Avenue are housekeeping items to bring Centerville in line with the timeframe of the City of Lino Lakes and to proceed to the public hearing phase of the process. Council Member Broussard Vickers commented that she tho going to push the property owners into this project ," agreeable. , City Attorney Ho appraisal done that indicates a per lot benefit of rouglft 0 and the rest of the cost would be City obligation. e City was not ere in were not Mr. Jim Kozar, Automotive Drive Line, asked for clarification of the proposed assessment. Council indicated the proposed number is $24,000 per property. Council Member Broussard Vickers indicated the actual cost is a lot more than that and the City is trying to figure out what can be assessed based on the benefit provided. Mayor Sweeney asked what the City had budgeted for this project. Mr. Peterson indicated the original amount was a total of $120,000. Ms. Paulseth indicated that using the City's current policy, the assessments are roughly $16,000 for each property. Mr. Kozar indicated that he does not care to have the road reconstructed and he does not want to pay assessments on it. He then said that last year there were no numbers. Mr. Peterson indicated there was a feasibility study and the numbers were $166,000 for the City and now that is down to $120,000. City Attorney Hoeft asked that Council keep the discussion on a more basic level indicating that at this point in time;there is an appraisal that gives a ballpark benefit number of $23,000 to $25,000. He then indicated the property owners have the option to challenge the assessment amount, but not the option of saying they do not want the road. Mr. Kozar asked how this road would benefit his building. City Attorney Hoeft indicated that he meant no offense to Mr. Kozar but said that neither he nor Council are prepared to give information or testimony of where the benefit comes from or how it is determined as the City would use a professional appraiser to determine that. Page 9 of 14 Council Member Broussard Vickers indicated the City could make that appraisal available to the property owners. She then asked whether it would affect the timeline to poStpone approval for further information. Ms. Moore-Sykes indicated the public hearing on the assessments was noticed for the next Council meeting. City Attorney Hoeft indicated the only legal question for the City is whether the City wants to pay for the street and if the project is cost effective. Mayor Sweeney indicated he felt the street needed to be paved. Council Member Broussard Vickers indicated that she was not sure that the residents of this City should pay for a road that benefits the businesses in the City ofLin es. efit to the businesses there, as well vel that road to get to those businesses. Council Member Capra indicated that businesses. Mayor Sweeney indi as, the residents of Ce Council Member Broussard Vickers indicated she has not made the decision whether there is enough benefit to residents to warrant the cost. Mr. Kozar commented that if you build a house it is your obligation for a driveway and his portion is so small he does not feel it is fair to ask that he pitch in with everybody and he does not understand it. He then commented that they have paved most of that road themselves with Arcade Asphalt putting tar down when they had extra. Mayor Sweeney indicated the City is trying to get the road up to standards. Council Member Broussard Vickers asked what would happen if there is a change in the roadway due to the reconstruction of Main Street. City Attorney Hoeft indicated that if the County comes through they will have to make a determination of benefit. Council Member Capra indicated that if County Road 14 is redone there is the potential that the intersection at 21 at Avenue may need to be moved. Mr. Kozar asked what the tonnage of the road would be because the heavy trucks tear it up. Mr. Peterson indicated the roadway would be constructed to 9-ton standards. Council Member Paar indicated he could see both sides of the situation but he feels it is time to improve the street for the benefit of the majority. Page 10 of 14 . Council Member Lee indicated his only hesitation would be because it is unknown what will happen with Main Street. Council Member Capra indicated she bad no issue with Resolutions 49, 50 and 51 but would like to table 52. city Attorney Hoeft indicated that the Joint Powers Agreement with the City of Lino Lakes indicates that Centerville sball have the right to comment on the project, the right to review and approve final plans and specifications prior to advertising for bids. He then indicated that Resolutions 49 and 50 approves the plans and specifications so the argument may be lost that the City of Lino Lakes went forward at its own risk before approval so the question becomes who pays for what and how much. City Attorney I!oeft recommended making the determination as to whether t with this project before approving any of the Resolutions. Council Member Capra . would like to have the p , the assessment hearing. and he Council Member Broussard Vickers indicated the City does not give anyone else more or less time for considering assessments. She then said that her question is whether or not she feels like she wants this for the City with her vote on behalf of residents based on what is best for the City as a whole. Council Member Capra indicated she had no problem with the road project and she thinks - it should be done. She then said her concern is the amount to be assessed to the property owners. ANNOUNCEMENTSIUPDATES 1. Re.port on Anoka Co1lIltY Senate District Meeting Ms. Moore-Sykes indicated that she, along with Mayor Sweeney and Council Member Capra, attended the Anoka County Senate District meeting. She then indicated that there were interesting and informative discussions. Mayor Sweeney commented that the light rail is popular with those on the western side of the County, posing a bit of east/west conflict. Council Member Capra indicated that they were looking for som~ne to serve on a committee to review a County-wide housing and redevelopment for Anoka.County. She then commented that there is concern from those cities on the eastern side of the County that their residents would be paying for development in the western cities. Ms. Paulseth indicated the BRA has the ability to levy and as far as EDA levies, they typically have very little impact on the individual property owner. Page 12 of 14 , Council Member Paar indicated he would be interested in serving on the committee and then said if light rail will be a topic of discus.sion he would be happy to tell them what a fraud and waste of money he feels it is. 2. Mound Trail Reconstruction Ms. Moore-Sykes indicated that the contractor is preparing to start the reconstruction on Monday, September 29, 2003 and property owners in the area were notified by the City. 3. Council/CommitteelCommission/County Joint Meeting Ms. Moore-Sykes indicated that it would be January or February before the joint meeting would be able to be scheduled. She then indicated that Staff provided feedback on the RFP to the County. 4. Quarterly Business Meeting 5. Council Member Capra indic someone else take over the Council agreed to do so. Ms. Moore-Sykes indicated that the liquor license renewal forms were received and will be going out. Ms. Moore-Sykes indicated that Mr. Peterson had informed her via email that the City has received a $60,000 grant for the storm water system and it can be used in conjunction with the reconstruction of the HeritageILaMotte roadway. Motion bv Council Member Broussard Vickers.. seconded bv Council Member Lee to authorize the exoenditure of 53.500 for the work ulan for the Metro Environmental Partnershiu Grant. AD in favor. Motion carried unanimouslv. Fire Chief Bennett asked that the fire department be allowed to do a quick inspection before the liquor licenses are renewed. Council Member Paar indicated the EDC meeting had been cancelled for this month. Mayor Sweeney indicated that the Centerville Lions are scheduled to re-roofthe warming house on October 11, 2003 and asked for volunteers. Page 13 of 14 Ms. Moore-Sykes indicated she met with the facility planning task force last week and reviewed site plans once again and the next phase would be meeting with the architect. Council Member Lee indicated there was a meeting of the police task force to discuss the building on Thursday, September 25, 2003. X. Adoption by the Council of the proposed assessment may occur at the hearing. The following properties are proposed to be assessed: 7055 -21st Avenue 7075 -21st Avenue 7095 -21st Avenue R24-31-22-23-OO 13 R24-31-22-23-OO12 R24-31-22-23-OO11 The amount to be specially assessed against your particular lot, piece, or parcel of land will not exceed $30,000. Such assessment is proposed" to be payable in equal annual installments extending over a period of ten (10) years, the first of the installments to be payable on or before the first Monday in January 2004, and will bear interest at the rate of eight (8) percent per annum from the date of the adoption of the assessment resolution. To the first installment shall be added interest on the entire assessment from the date of the assessment resolution until December 31, 2003. To each subsequent installment when due shall be added interest for one year on all unpaid installments. You may at any time prior to certification of the assessment to the county auditor, pay the entire assessment on such property, with interest accrued to the date of payment, to the City Clerk No interest shall be charged if the entire assessment is paid within 30 days from the adoption of this assessment. You may at any time thereafter, pay to the City Clerk the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year. If you decide not to prepay the assessment before the date given above, the rate of interest that will apply is eight (8) percent per year. The proposed assessment roll is on file for public inspection at the City Clerk's office. The total amount of the proposed assessment is not to exceed $90,000.00 with the City paying $30,000.00. Written or oral objections will be considered at the meeting. No appeal may be taken as to the amount of an assessment unless a written objection signed by the affected property owner is filed with the Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. The Council may upon such notice consider anY objection to the amount of a proposed individual assessment at an adjomned meeting upon such further notice to the affected property owners as it deems advisable. An owner may appeal an assessment to district court pmsuant to Minnesota Statutes Section 429.081 by serving notice of the appeal upon the Mayor or Clerk of the Cityof Centerville within thirty (30) days after the adoption of the assessment and filings such notice with the district court within ten (10) days after service upon the Mayor or City Clerk. If an assessment is contested or there is an adjomned hearing, the following procedure will be as follows: 1. The City will present its case first by calling witnesses who may testify by narrative or by examination, and by the introduction of exhibits. After each witness has testified, the contesting party will be allowed to ask questions. This procedure will be repeated with each witness lDltil neither side has finther questions. 2. After the City has presented all its evidence, the objector may call witnesses or present such testimony as the objector desires. The same procedure for questioning of the City's witnesses will be followed with the objector's witnesses. 3. The objector may be represented by legal counsel. 4. Minnesota rules of evidence will not be strictly applied; however, they may be considered and argued to the council as to the weight of items of evidence or testimony presented to the cOlDlcil. 5. The entire proceedings will be tape-recorded (video-taped). 6. At the close of presentation of evidence, the objector may make a final presentation. to the council based on the evidence and the law. No new evidence may be presented at this point. 7. The council may adopt the proposed assessment at the hearing. The City Hall is ADA accessible. Requests for hearing assisted devices or a sign language interpreter must be received before 4:00 p.rn. September 26, 2003. Imac IaI 001/001 DEVELOPMENT CONTRACT PHEASANT MARSH, PHASE ill CENTERVll..LE, MINNESOTA THIS AGREEMENT, made and entered into this day of ,20-, by and between the City of Centerville, a -municipal corporation organized under the laws of the State of Minnesota (the "City''), and Ground Development. a Minnesota Corporation (the "Developer"). RECITALS: WHEREAS, the Developer has received approval from the City Council for a preliminary plat of land within the corporate limits of the City, which plat is known as Pheasant Marsh Phase ill, hereinafter called "Subdiyision"; and WHEREAS, the Developer has requested the City to construct all surface streets, sidewalks, curb and gutter, recreational trails, storm sewer, drainage facilities, water main and sanitary sewer facilities, hereinafter referred to as "Street and Utility Improvements"; and WHEREAS, the Developer and the City desire to establish herein the financial responsibility for the Street and Utility Improvements; and WHEREAS, the Developer is to be responsible for the installation and financing of certain private improvements within the plat, hereinafter referred to as "Private Improvements". NOW, THEREFORE, in consideration of the mutual promises of the parties made herein, it is agreed by and between the parties as follows: A. REPRESENTATIONS OF DEVELOPER. As inducement to the City's approval and authorization to proceed with construction and entering into this Agreement, the Developer represents and warrants to the City: 1. That the Developer is the fee owner of the property and has authority to enter into this Agreement. 2. That the subdivision complies with all City, County, State and Federal laws and regulationS, including but not limited to City subdivision ordinances and zoning ordinances. 3. The subdivision complies with all wetland protection legislation. B. PRNATE IMPROVEMENTS. The Developer will construct and install at Developer's expense the general improvement construction according to Ordinance #8 and other improvements specific to the development herein set forth: 1. Also included as items associated with the Private Improvements, the Developer shall undertake or arrange to accomplish the following: a. Site Development Issues ' I. Coordinate with the utility companies to provide for gas main, telephone lines, cable television lines, and power lines to service the properties developed on the final plat according to the City's joint trench policy. 11. Provide seeding and vegetation maintenance and erosion control over denuded or graded areas and niitigation area, at the City's direction. lll. Establish lot comer monumentation within 180 days after filing the final plat. IV. All building pads shall not be less than 60' x 60' to accommodate the construction size of the home. v. Provide such street maintenance and control of builder's actions to maintain roadways clear of mud, soil, and debris to provide safe driving surfaces. The Developer shall provide street sweeping within 24 hours of the City's request for such services. v. Provide for landscaping in accordance with the City ordinances and Developer's approved landscape plan. VI. All construction vehicles associated with the construction of private, street and utility improvements and residential construction shall follow street and road routes as determined by Council and obey all postings on said streets. The Developer shall accomplish or cause to be accomplished these actions according to generally accepted trade standards. The Developer will cause to be furnished to the City a schedule of proposed operations at least five days prior to commencement of the construction activities. b. Site Grading, Street Construction and Building Permits. No certificate of occupancy shall be issued without installation of bituminous base course across the front lot line of that property. No building permit shall be issued for any lot without the finished grading in accordance with the approved grading plan. c. Erosion Control. The Developer shall control erosion insuring: 3 1. The Developer shall submit an erosion control plan, detailing all erosion control measures to be implemented during construction. Said plan shall be approved by the City prior to the commencement of site grading or construction. ll. Erosion and siltation control measures shall be coordinated with the different stages of development. Appropriate control measures as required by the City shall be installed prior to development when necessary to control erosion. ill. Land shall be developed in increments of workable size, as determined by the City Engineer, such that adequate erosion and siltation controls as directed by the engineer can be provided as construction progresses. The smallest practical area of land, as determined by the City Engineer, shall be exposed at anyone period of time. IV. Where the topsoil is removed, sufficient arable soils shall be set aside for respreading over the developed area. The topsoil shall be restored to a depth of at least four (4) inches and shall be of a quality at least equal to the soil quality prior to development. The Developer shall also install four (4) inches of topsoil on all boulevards and seed or sod as approved by the City. The Developer shall make all necessary adjustments to water service. curb stops to bring them flush with the topsoil (before occupancy). All disturbed areas shall be seeded. d. Inspection. All of the work shall be under and subject to the inspection and approval of the City, City Engineer, and where appropriate, any other governmental agency having jurisdiction. e. Faithful Performance of Construction Contracts and Letter of Credit. The Developer will fully and faithfully comply with all terms and conditions of any and all contracts entered into by the Developer for the installation and construction of all Private Improvements and hereby guarantees the workmanship and materials for a period of two years following the City's final acceptance of the Private Improvements. The Developer agrees to guaranty for a period of one year the tree plantings required as part of the Developer's Agreement. Each specific tree guaranty period shall begin with the planting of each specific tree. Concurrently with the execution hereof by the Developer, the Developer will furnish to, and at all times thereafter maintain with the City, a cash deposit, certified check, or an Irrevocable Letter of Credit, based on one hundred fifty percent (150%) of the total estimated cost of the Private Improvements as indicated in Paragraph B 1. The Irrevocable Letter of Credit shall be for the exclusive use and benefit of the City of Centerville and shall state thereon the same 4 is issued to guaranty and assure performance by the Developer of all the terms and conditions of Paragraph Bl of this Development Contract. Such Letter of Credit may be reduced upon completion and acceptance of the Private Improvements by the City. to an amount deemed adequate by the City Engineer to cover the two year warranty period described herein. The City shall have the right during said warranty period to draw on the Letter of Credit for any warranty work that is necessary. The Irrevocable Letter of Credit shall be renewed or replaced by not later than twenty (20) days prior to its expiration with a like letter. f. Reduction of Escrow Guaranty. The Developer may request a reduction of the Letter of Credit or cash deposit based oil prepayment or the value of the completed Private Improvements at the time of the requested reduction. The amount of reduction will be determined by the City and such recommendation will be submitted to the City Council for action. g. Approval 9f Contractors. Any contractor selected by the Developer to construct and install any Private Improvements must be determined in writing by the City Engineer to be acceptable. The City reserves the right to. require satisfactory proof of successful experience and adequate financial status by any such contractor. C. STREET AND UTILITY IMPROVEMENTS. In accordance with the policies and ordinances of the City, the "Street and Utility Improvements" include those improvements as described by the plans, specifications, and contract documents entitled Pheasant Marsh, Phase ill Street and Utility Improvements, as prepared by the City Engineer and as adopted and approved by the City Council. The Developer hereby requests that the City install and/or modify the necessary streets, sanitary sewer, water, municipal storm sewer to service the proposed development. The City agrees to proceed pursuant to Minnesota Statutes. Chapter 429, the Petition for Local Improvement signed by Developer dated August 22, 2001, and the Agreement of Assessment and Waiver of Irregularity and Appeal signed by Developer dated August 22, 2001, and to specially assess 100% of the cost of said improvements to the subject property, with the exception of those costs attributable to the oversizing of the watermain, which costs are as set forth in the Pheasant Marsh, Phase ill Street and Utility Improvements as prepared by the City---Engineer. Said oversizing costs will be the responsibility of City. Prior to the preparation of final plans and specifications for the construction of said improvements, the Developer shall provide to the City a cash escrow in the amount of $12,500 to provide for financing the cost of preparing the Development Contract and said final plans and specifications by the City Engineer. Furthermore, the Developer shall also provide a cash escrow to the City in an amount indicated in writing to provide for financing the cost of inspection, staking, and construction administration by the City Engineer. 5 ~ . . The developer ~a concrete sidewalk on the north and west side of Dupre Road froD;l Pheasant Lane to existing Dupre Road in the Center Oaks development. The developer will construct a bituminous trail along the south side of Dupre Road from an existing trail at Pheasant Lane to the southeast comer of Outlot E, then north along the easterly side of Outlot E to the northeast comer of Outlot E. The alignment of the Pheasant Marsh, Phase III trail may be adjusted in the field by the City Engineer and Public Works Director to follow the best route to avoid trees and low areas. Sidewalks and trail ways will be constructed to City of Centerville standards. D. COVENANTS/RESTRICTIONS. Developer hereby agrees to place certain covenants against the subj~t property, restricting its development to single family home construction. Said covenants shall be approved by the City and recorded against the Property. E. RECORDING AND RELEASE. The Developer agrees that the terms of this Development Contract shall be a covenant on any and all property included in the Subdivision. The Developer agrees that the City shall have the right to record a copy of this Development Contract with the Anoka County Recorder/Registrar to give notice to future purchasers and owners. F. REIMBURSEMENT OF COSTS. Except as limited by Minnesota Statute 462.3531, the Developer agrees to fully reimburse the City for all costs incurred by the City including, but not limited to, the actual costs of construction of said improvements, engineering fees, legal fees, inspection fees, interest costs, costs of acquisition of necessary easements, if any, and any other costs incurred by the City relating to this Development Contract and the installation and financing of the aforementioned improvements. G. OCCUPATION OF PREMISES. The Developer further agrees that it will not cause to be occupied any premises upon the plat or any property within the plat until the completion of the gas, electric, telephone, cable television, water, and sewer improvements required by this Development Contract have been installed, unless the City has agreed in writing to waive this requirement as to a specific premises. Furthermore, Developer shall be granted no certificates of occupancy for homes within the plat prior to substantial completion of all Private and Street and Utility Improvements described in this Contract, and as detailed in paragraph B.2(b). Building Permits shall be issued only within the constraints as set forth previously herein. H. OWNERSHIP OF IMPROVEMENTS. Upon completion of the work and construction required by this Contract and acceptance by the City, the improvements lying within the public easements shall become City property without further notice or action. 6 I. INDEMNIFICATION AND HOLD HARMLESS. The Developer shall hold the City and its officers and employees harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from subdivision plat approval and development. The Developer shall indemnify the City and its officers and employees for all costs, damages, or expenses which the City may payor incur in consequence of such claims, including reasonable attorneys fees. Provided that nothing herein shall require Developer to indemnify the City, its officers or employees from any violation of law or from the consequences of their own negligence. J. PROHIBITIONS AGAINST ASSIGNMENT OF AGREEMENT. Developer represents and agrees that prior to the completion of the Developer improvements as certified by the City: 1. Except by way of security for, and only for the purpose of obtaining financing necessary to enable the Developer to perform its obligations with respect to the construction of the improvements under this Agreement and any other purpose authorized by this Agreement, the Developer (except as so authorized) will not make or create, or suffer to be made or created, any total or partial sale, assignment, conveyance, or transfer in any other mode or form, with respect to this Agreement or any interest therein, or any contract or agreement to do any of the same, without the prior written approval of the City. 2. In the absence of specific written agreement by the City to the contrary, no such transfer or approval by the City shall be deemed to relieve Developer from any of its obligations. In the event that the City approves a substitute Developer and the property is transferred to said substitute, the City agrees to relieve the Developer of liability from performance as described in this Contract. Said substitute shall assume all responsibilities and rights of the Developer under this Contract. Nothing in paragraphs 1 and 2 of this paragraph J shall be construed to limit or restrict Developer's right of ability to sell lots to builders. K. MISCELLANEOUS PROVISIONS. 1. Reimbursement of Costs for Defense. The Developer agrees to reimburse the City for all costs incurred by the City in defense of enforcement of this Contract, or any portion thereof, including court costs and reasonable engineering and attorney's fees. 2. Validity. If any portion, section, subsection, sentence, clause, paragraph, or phrase in this Contract is for any reason held to be invalid by a court of competent jurisdiction, such decision shall not affect or void any of the other provisions of the Development Contract. 3. Waiver. The action or inaction of the City shall not constitute a waiver or amendment to the provisions of this Agreement. To be binding, amendments or 7 waivers shall be in writing, signed by the parties, and approved by written resolution of the City Council. The City's failure to promptly take legal action to enforce this Agreement shall not be a waiver or release. 4. Binding Effect. The terms and provisions hereof shall be binding upon and inure to the benefit of the heirs, representatives, successors, and assigns of the parties hereto and shall be binding upon all future owners of all or any part of the Subdivision and shall be deemed covenants running with the land. 5. Notice. Whenever in this Contract it shall be required or permitted that notice or demand be given or served by either party to this Contract to or on the other party, such notice or demand shall be delivered personally or mailed by United States mail to the addresses set forth below by certified mail (return receipt requested). Final plat approval shall be conditioned upon execution and delivery of this Contract and of all required documentation, fees, and securities as set forth herein. 7. Incorporation by Reference. All approved plans, special provisions, proposals, specifications, and contracts for the improvements furnished and let pursuant to this Contract shall be and hereby are made a part of this Contract by reference as fully as if set out herein in full. 8. Violation of Agreement. In the event that Developer violates any of the covenants and agreements contained in this Development Contract and to be performed by the Developer, the City, at its option, in addition to the rights and remedies as set forth hereunder may refuse to issue building permits to any property within the plat until such time as such default has been corrected to the satisfaction of the City. 8 9. Park Dedication. The parties mutually recognize and agree that park dedication requirements as provided in the City Code. shall be satisfied by cash payment of $8;4.000 calculated at $3.000.00 per lot multiplied by 28 lots. 10. Storm Water Fees. The storm water fee shall be paid by the Developer prior to approval of the final plat. This fee is $9.569.55. based on a charge of $.01546 per square foot of 14.21 acres of platted area. 11. Liability Insurance Requirement. The Developer shall provide to the City, at the Developer's expense, general public liability and property damage insurance including vehicle coverage protecting the City and the Developer from all claims for personal injury, including death, and all claims for construction of or damage to property, arising out of or in connection with any operations under these contract documents, whether such operations be by the Developer, its contractor, or by any subcontractor, or anyone directly or indirectly employed by the contractor .or by a subcontractor under it. Insurance shall be written with a limit of liability of not less than $600,000 for all damages arising out of bodily injury including death, at any time resulting therefrom, sustained by anyone person in anyone accident; and a limit of liability of not less than $1,000,000 for any such damage sustained by two or more persons in anyone accident. Insurance shall be written with a limit of liability of not less than $300,000 for all property damage sustained by one person in anyone accident, and a limit of liability of not less than $700,000 for any such damage sustained by two or more persons in anyone accident. The insurance policies shall accompany the contract for its execution by the Developer and the City of Centerville. The above insurance policies shall remain in full force and effect at all times during the process of constructing all improvements set forth herein, and until six (6) months after city acceptance of the Private Improvements and completion of the Street and Utility Improvements. Phase Three - TraU Chairperson Peterson requested a discussion of the trail through Pheasant Marsh, Phase Three be added under Committee Business. Chairperson Peterson started the discussion by saying the original trail proposal winds through the east side of the development in a low area. There is quite a bit of green space, probably because it is low. What Chairperson Peterson would like the committee to consider is readjusting the placement of the trail along the far east edge where there is higher ground and the trail would overlook the edge of the pond on the adjacent property. The original proposal shows the trail ending at Outlot A, Center Oaks II, with the idea of the trail eventually being continued east to 20th Avenue. Chairperson Peterson proposes a trail stub be added heading north across Outlot A to Center Street. If the trail cannot be connected to 20th Avenue in the near future, at least this trail would continue to Center Street instead of dead-ending. The trail stub would be paid for from Parks & Recreation trail funds: Chairperson Peterson estimates the stub to be 270' - 300' in length. The committee felt this was a better alternative to the trail dead-ending and not being used by residents. Chairperson Peterson also reported there is a 6 foot county ditch which runs through this property to the south. It will be necessary for a culvert to be installed in the south-east comer. Council Member Lee suggested attaching a map with the suggested changes to the motion for the next council meeting. Ground Development is currently looking for approval on the Developer's Agreement and Final Plat for Pheasant Marsh, Phase Three. Chairperson Peterson will supply Ms. Stephan with a map of the proposed changes!~dditions. The modifications were made to Pages 2, 6 & 12. I spoke with Mr. Carlson, Hunters Crossing and he was agreeable to the modifications. I also spoke with Mr. Dale Runkle, Pheasant Marsh, Phase ill and he was agreeable with all modifications except for the mailbox issue on Page 2. , - Effective 1/10190 City ofCenterville Ord. #49 STATE OF MINNESOTA COUNTY OF ANOKA CITY OF CENTERVILLE ORDINANCE #49 AN ORDINANCE RELATING TO NOISE, PROVIDING FOR THE ELIMINATION AND PREVENTION OF PROHIBITED NOISE, AND IMPOSING PENALTIES FOR VIOLATION. THE COUNCIL OF THE CITY OF CENTERVILLE DOES ORDAIN: SECTION 1. NOISES PROHIBITED. The City Council fin~ that within the City, certain loud, avoidable, unnatural and unnecessary noises, which under certain circumstances and conditions constitute a serious threat to the health, welfare, contentment and the feeling of well-being of our residents. Excessive noise degrades the environment of the City and the City has a substantial and, in some situations, compelling interest in controlling such noise. Subdivision 1. General Prohibition. No person shall make or cause to be made any distinctly audible, continuous, objectionable noise due to intermittence, frequency, beat, shrillness, or intensity that annoys, disturbs, injures, or endangers the comfort, repose, health, peace, safety, or welfare of any person or precludes their enjoyment of property. This general prohibition is not limited by the specific restriction of the following subdivisions. Subdivision 2. Radios. Phonol!raphs. Paeine: Systems. Etc. No person shall use or operate or permit the use or operation of any radio receiving set, musical instrument, phonograph, paging system, machine, or other device for the production or reproduction of sound in violation of the noise standards'set forth in Section 3, Subdivision 1. Subdivision 3. Participation in Noisv Parties or Gatherine:. No person shall participate in any party or other gathering of people in violation of Section 1, subdivision 1. Subdivision 4. Animals. a. Refer to Ordinance #24, Section 24.08 - Nuisances. SECTION 2. HOURLY RESTRICTION ON CERTAIN OPERATIONS Subdivision 1. Recreational Vehicles. No person shall, between the hours of 10:00 p.m. and 7:00 a.m., drive or operate any mini-bike/dirt bike, snowmobile, or any other recreational vehicle not licensed for travel on public highways. Subdivision 2. Domestic Power Eauipment. No person shall operate a power lawn mower, hedge clipper, chain saw, mulcher, garden tiller, edger, drill, or other similar domestic power maintenance equipment between the hours of 10:00 p.m. and 7:00 a.m. Snow removal equipment is exempt from this provision. Subdivision 3. Refuse Hanline. No person shall collect or remove garbage or refuse in any residential district between the hours of 10:00 p.rn. and 7:00 a.rn. Subdivision 4. Construction Activities. No person shall engage in or permit construction activities involving the use of hammers or the use of any kind of air. electric, diesel, or gas powered machine or other power equipment between the hours of 10:00 p.m. and 7:00 a.m. Subdivision 5. Noise Impact Statements. The Council may require any person applying for a change in zoning classification or a permit or license for any structure, operation, process, installation or alteration, or project that may be considered a potential noise source to submit a noise impact statement. It shall evaluate each such statement and take its evaluation into account in approving or disapproving the license or permit applied for or the zoning change requested. The determination of land use shall be by its zoning designation. Subdivision 2. Sounds Exempt from Noise Level Requirements. Sounds emanating from the operation of outdoor implements, such as power lawnmowers, snowblowers, power hedge clippers, power saws, pile drivers, jackhammers, and other construction equipment, are exempt from the sound level requirements but shall observe the time restriction provisions of this subdivision Subdivision 3. Exceptions for Special Events. The City Council shall have the authority, consistent with this section, to grant exceptions from the requirements of any section of this ordinance for special events. Any person seeking an exception shall file an application at City Hall with the City Clerk or his/her designee on a form prescribed by the City. The application shall state the dates during which the application is proposed, the location of the noise source and time of operation, the nature of the noise source, reasons why the exception is sought, steps to be taken to minimi7.e the noise level, and such other information as is required by the City. Effective .111 0/90 City of Centerville Ord. #49 / The application will be presented to the City Council for consideration and may be approved only if the City Council finds that full compliance with the requirements of the ordinance would constitute an unreasonable nardship on the applicant, on other persons, or on the community. In determining whether to grant or deny the application, the City Council shall balance the hardship to the applicant against the adverse impact on the health, safety, and welfare of the persons affected, the adverse impact on property affected, and any other adverse effects of granting the application. The application may be granted subject to conditions, including a time limit, which shall be clearly stated. If the City finds that sufficient controversy exists regarding the proposed exception to the provisions of this ordinance, a pu~lic hearing may be held on the proposed application at which all persons affected shall be given an 'opportunity to be heard. Subdivision 4. Exception for Emergency Work. Noise created exclusively in the performance of emergency work to preserve the public health, safety, or welfare, or in the performance of emergency work necessary to restore a public service or eliminate a public hazard shall be exempt from the provisions of this ordinance for a period not to exceed 24 hours after the work is commenced. Persons responsible for such work shall inform the police department, Building Inspector and City Administrator of the need to initiate such work or, if the work is commenced during non-business hours of the City, at the beginning of business hours of the first business day thereafter. Any person responsible for such emergency work shall take all reasonable actions to minimi'Ze the amount of noise. Subdivision 5. Criminal Penalties. Every person who violates any provision of this ordinance is guilty of a misdemeanor and shall, upon conviction, be subject to a fine, imprisonment, or both, and in either case, the cost of prosecution. In trying to deal with recent issues that have caused disagreement between neighbors, Staffhave again discussed the idea of requiring administrative zoning permits for fences and small accessory buildings. In this way, the City has at least of paper trail of what was constructed, size, location, materials, etc., so when neighborhood disagreement arise, we can at least have the information we need to determine what exactly the facts are. Staff also suggested that if the City did not charge for this permit, or only charged a nominal fee, then residents would be more likely to apply for this permit. This would also provide Staffwith an opportunity to review the project before it's constructed and offer Ordinance requirements and other suggestions. This idea was discussed with the Planning and Zoning Commission earlier this year. They were not in favor of this permit primarily because of the fee that was associated with it. They did not believe that the City should be "nickeling and diming" the residents. But because of all the neighborhood issues Staffhave dealt with this year, we are again bringing the idea of the Administrative Zoning Permit. Stafffeels that requiring a permit would alleviate many of these issues. Provide such street maintenance and control of builder' s actions to maintain roadways clear of mud, soil, and debris to provide safe driving surfaces. The Developer shall provide street sweeping within 24 hours of the City's request for such services. v. Provide for landscaping in accordance with the City ordinances and Developer's approved landscape plan. The Developer shall accomplish or cause to be accomplished these actions -- according to generally accepted trade standards. The Developer will cause to be furnished to the City a schedule of proposed operations at least five days prior to commencement of the construction activities. b. Site Grading, Street Construction and Building Permits. No certificate of occupancy shall be issued without installation of bituminous base course across the front lot line of that property. No building permit shall be issued for any lot without the finished grading in accordance with the approved grading plan. i. The City agrees to allow two (2) building permits to be issued for model homes upon the following conditions: . Preliminary Plat approval by the City; . Execution of the developer's agreement; 3 . Providing all letters of credit, cash escrow and other securities as required by the developer's agreement are fulfilled; . Final lot grade approval is obtained by the City Engineer; . Construction limited to maintain a minimum distance of 150 feet from the farthest exterior wall to an improved street as per the State Fire Code. c. Erosion Control. The Developer shall control erosion insuring: 1. The Developer shall submit an erosion control plan, detailing all erosion control measures to be implemented during construction. Said plan shall be approved by the City prior to the commencement of site grading or construction. 11. Erosion and siltation control measures shall be coordinated with the different stages of development. Appropriate control measures as required by the City shall be installed prior to development when necessary to control erosion. Hi. Land shall be developed in increments of workable size, as . determined by the City Engineer, such that adequate erosion and siltation controls as directed by the engineer can be provided as construction progresses. The smallest practical area of land, as determined by the City Engineer, shall be exposed at anyone period of time. IV. Where the topsoil is removed, sufficient arable soils shall be set aside for respreading over the developed area. The topsoil shall be restored to a depth of at least four (4) inches and shall be of a .- quality at least equal to the soil quality prior to development. The. Developer shall also install four (4) inches of topsoil on all boulevards and seed or sod as approved by the City. The Developer shall make all necessary adjustments to wa~er service curb stops to bring them flush with the topsoil (before occupancy). All disturbed areas shall be seeded. d. Inspection. All of the work shall be under and subject to the inspection and approval of the City, City Engineer, and where appropriate, any other governmental agency having jurisdiction. e. Faithful Performance of Construction Contracts and Letter of Credit. The Developer will fully and faithfully comply with all terms and conditions of any and all contracts entered into by the Developer for the installation and construction of all Private Improvements and hereby guarantees the workman~hip and materials for a period of two years following the City's 4 final acceptance of the Private Improvements. The Developer agrees to guaranty for a period of one year the tree plantings required as part of the . Developer's Agreement. Each specific tree guaranty period shall begin with the planting of each specific tree. Concurrently with the execution hereof by the Developer, the Developer will furnish to, and at all times thereafter maintain with the City, a cash deposit, certified check, or an Irrevocable Letter of Credit, based on one hundred fifty percent (1500A,) of the total estimated cost of the Private Improvements as indicated in Paragraph B 1. The Irrevocable Letter of Credit shall be for the exclusive use and benefit of the City of Centerville and shall state thereon the same is issued to guaranty and assure performance. by the Developer of all the terms and conditions of Paragraph Bl of this Development Contract. Such Letter of Credit may be reduced upon completion and acceptance of the Private Improvements by the City to an amount deemed adequate by the c'jty Engineer to cover the two year warranty period described herein. The City shall have the right during said warranty period to draw on the Letter of Credit for any warranty work that is necessary. The Irrevocable Letter of Credit shall be renewed or replaced by not later than twenty (20) days prior to its expiration with a like letter. f. Reduction of Escrow Guaranty. The Developer may request a reduction of the Letter of Credit or cash deposit based on prepayment or the value of the completed Private Improvements at the time of the requested reduction. The amount of reduction will be determined by the City and such recommendation will be submitted to the City Council for action. g. Approval of Contractors. Any contractor selected by the Developer to construct and install .any Private Improvements must be determined in writing by the City Engineer to be acceptable. The City reserves the right to require satisfactory proof of successful experience and adequate financial status by any such contractor. C. STREET AND UTILITY IMPROVEMENTS. In accordance with the policies and ordinances of the City, the "Street and Utility Improvements" include those improvements as described by the plans, specifications, and contract documents entitled Hunters Crossing 2nd Addition Street and Utility Improvements, as prepared by the City Engineer and as adopted and approved by the City Council. The Developer hereby requests that the City install and/or modify the necessary streets, sanitary sewer, water, municipal storm sewer to service the proposed development. The City agrees to proceed pursuant to Minnesota Statutes Chapter 429, the Petition for Local Improvement signed by Developer dated June 15, 2003 signed June 15, 2003, and the Agreement of Asse$Sment and Waiver of Irregularity and Appeal signed by Developer dated August 8, 2003, and to specially assess 100% of the cost of said improvements to the subject property, with the exception of those costs attributable to the oversizing of the watermain, which costs are as set forth in the Hunters Crossing 2nd Addition Street and 5 Utility Improvements as prepared by the City Engineer. Said oversizing costs will be the responsibility of City. As provided by Minnesota Statute 429, this waiver of rights of appeal is effective for the amount of $1,244,134.00 (excluding change orders during construction). Prior to the preparation of final plans and specifications for the construction of said improvements, the Developer shall provide to the City a cash escrow in the amount of $12,500.00 to provide for financing the cost of preparing the Development Contract and said final plans and specifications by the City Engineer. Furthermore, the Developer shall also provide a cash escrow to the City in an amount indicated in writing to provide for financing the cost of inspection, staking, and constructiQn administration by the City Engineer. The developer will construct a concrete sidewalk on the north side of Dupre Road from Centerville Road to Beaver Pond Way. The walk will be 750' long and 5' wide. The develor: will construction a bituminous trail along the west side of the Hunters Crossing 1 Addition (within the St. Paul Water Utility easement) and between Lot 8, Block 1 and Lot 1, Block 5. The trail will be 1,000' long and 10' wide. All sidewalks and trail ways will be constructed to the City ofCenterville's standards. D. COVENANTSIRESTRICTIONS. Developer hereby agrees to place certain covenants against the subject property, restricting its development to single family home construction. Said covenants shall be approved by the City and recorded against the Property. E. RECORDING AND RELEASE. The Developer agrees that the terms of this Development Contract shall be a covenant on any and all property included in the Subdivision. The Developer agrees that the City shall have the right to record a copy of this Development Contract with the Anoka County Recorder/Registrar to give notice to future purchasers and owners. F. REIMBURSEMENT OF COSTS. Except as limited by Minnesota Statute 462.3531, the Developer agrees to fully reimburse the City for all costs incurred by the City including, but not limited to, the actual costs of construction of said improvements, engineering fees, legal fees, inspection fees, interest costs, costs of acquisition of necessary easements, if any, and any other costs incurred by the City relating to this Development Contract and the installation and financing of the aforementioned improvements. G. OCCUPATION OF PREMISES. The Developer further agrees that it will not cause to be occupied any premises upon the plat or any property within the plat until the completion of the gas, electric, telephone, cable television, water, and sewer improvements required by this Development Contract have been installed, unless the City has agreed in writing to waive this requirement as to a specific premises. Furthermore, Developer shall be granted no certificates of occupancy for homes within the plat prior to 6 substantial completion of all Private and Street and Utility Improvements described in this Contract, and as detailed in paragraph B.2(b). Building Permits shall be issued only within the -constraints as set forth previously herein. H OWNERSIDP OF IMPROVEMENTS. Upon completion of the work and construction required by this Contract and acceptance by the City, the improvements lying within the public easements shall become City property without further notice or action. I. INDEMNIFICATION AND HOLD HARMLESS. The Developer shall hold the City and its officers and employees harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from sub4ivision plat approval and development. The Developer shall indemnify the City and its officers and employees for all costs, daroages, or expenses which the City may payor incur in consequence of such claims, including reasonable attorneys fees. Provided that nothing herein shall require Developer to in~emnify the City, its officers or employees from any violation of law or from the consequences of their own negligence. 1. PROIDBmONS AGAINST ASSIGNMENT OF AGREEMENT. Developer represents and agrees that prior to the completion of the Developer improvements as certified by the City: 1. Except by way of security for, and only for the purpose of obtaining financing necessary to enable the Developer to perform its obligations with respect to the construction of the improvements under this Agreement and any other purpose authorized by this Agreement, the Developer (except as so authorized) will not make or create, or suffer to be made or created, any total or partial sale, assignment, conveyance, or transfer in any other mode or form, with respect to this Agreement or any interest therein, or any contract or agreement to do any of the same, without the prior written approval of the City. 2. In the absence of specific written agreement by the City to the contrary, no such transfer or approval by the City shall be deemed to relieve Developer from any of its obligations. In the event that the City approves a substitute Developer and the property is transferred to said substitute, the City agrees to relieve. the Developer of liability from performance as described in this Contract. Said substitute shall assume all responsibilities and rights of the Developer under this Contract. Nothing in paragraphs 1 and 2 of this paragraph J shall be construed to limit or restrict Developer's right of ability to sell lots to builders. K. MISCELLANEOUS PROVISIONS. 1. Reimbursement of Costs for Defense. The Developer agrees to reimburse the City for all costs incurred by the City in defense of enforcement of this Contract, or any portion thereot: including court costs and reasonable engineering and attorney's fees. 7 2. Validity. If any .portion, section, subsection, sentence, clause, paragraph, or phrase in this Contract is for any reason held to be invalid by a court of competent jurisdiction, such decision shall not affect or void any of the other provisions of the Development Contract. 3 . Waiver. The action or inaction of the City shall not constitute a waiver or amendment to the provisions of this Agreement. To be binding, amendments or waivers shall be in writing, signed by the parties, and approved by written resolution of the City Council. The City's failure to promptly take legal action to enforce this Agreement shall not be a waiver or release. 4. Binding Effect. The terms and provisions hereof shall be binding upon and inure to. the benefit of the heirs, representatives, successors, and assigns of the parties hereto and shall be binding upon all future owners of all or any part of the Subdivision and shall be deemed covenants running with the land. 5. Notice. Whenever in this Contract it shall be required or permitted that notice or demand be given or served by either party to this Contract to or on the other party, such notiCe or demand shall be delivered personally or mailed by United States mail to the addresses set forth below by certified mail (return receipt requested). Such notice or demand shall be deemed timely given when delivered personally or when deposited in the mail in accordance with the above. All approved plans, special provisions, proposals, specifications, and contracts for the improvements furnished and let pursuant to this Contract shall be and hereby are made a part of this Contract by reference as fully as if set out herein in full. 8 . 8. Violation of Agreement. In the event that Developer violates any of the covenants and agreements contained in this Development Contract and to be performed by the Developer, the City, at its option, in addition to the rights and remedies as set forth hereunder may refuse to issue building permits to any property within the plat until such time as such default has been corrected to the satisfaction of the City. 9. Park Dedication. The parties mutually recognize and agree that park dedication requirements as provided in the City Code shall be satisfied by cash payment of $108.000.00 calculated at $3.000.00 per lot multiplied by 36 lots. 10. Storm Water Fees. The storm wat-er fee shall be paid by the Developer prior to approval of the final plat. This fee is $15.893.00. based on a charge of $.01546 per square foot of23.6 acres of platted area. 11. Liability Insurance Requirement. The Developer shall provide to the City, at the Developer's expense, general public liability and property damage insurance including vehicle coverage protecting the City and the Developer from all claims for personal injury, including death, and all claims for construction of or damage to propertY, arising out of or in connection with any operations under these contract documents, whether such operations be by the Developer, its contractor, or by any subcontractor, or anyone directly or indirectly employed by the contractor or by a subcontractor under it. Insurance shall be written with a limit of liability of not less than $600,000 for all damages arising out of bodily injury including death, at any time resulting therefrom, sustained by anyone person in anyone accident; and a limit of liability of not less than $1,000,000 for any such damage sustained by two or more persons in anyone accident. Insurance shall be written with a limit of liability of not less than $300,000 for all property damage sustained by one person in anyone accident, and a limit of liability of not less than $700,000 for any such damage sustained by two or more persons in anyone accident. The insurance policies shall accompany the contract for its execution by the Developer and the City of Centerville. The above insurance policies shall remain in full force and effect at all times during the process of constructing all improvements set forth herein, and until six (6) months after city acceptance of the Private Improvements and completion of the Street and Utility Improvements. The City, City Engineer, and Developer's engineer shall be an additional named insured in any such policy or policies. In addition to the information attached included is information I received during the interview process for Mr. Barett's nomination. Through the interview process I had an opportunity to speak with several different individuals and relatives to better understand what contributions to the community of Centerville Mr. Barett made. It became evident in the begjnnine of each interview Mr. Barett was a person who always took on "life's reasonability's with grace and dedication to do his best. He never complained about the hardships he had to filce and always took up his lot in life with a good heart and a spirit of "faith will guide me through. " He was a man of his beliefs and lived by the examples he had learned through his faith. Chauncey was a meniber of the Catholic Order of Foresters this group served the entire com11l1lnity in a variety of ways. It was also known in Centerville for its dedication to see that no child went without a holiday present during Christmas season. They organized and held holiday parties for the children of the area. Information on the Catholic Order of Foresten: COFs commitment to caring began in 1883 at Holy Family Parish in Chicago, Illinois. Back then, impoverished immigrtints were streaming into the United States, seeking a better life. When tragedy struck andfamilies lost their breadwinner, friends and neighbors typically collected money for burial expenses and to keep survivors from starving. Those making burial collections gradually formed associations, usually based on religious or ethnic backgrounds. Often "these societies became focal points for community life. It has been said that Chauncey served the comm1mity in Centerville as a quiet man behind the sense making it happen for those in need. Francis Burque who has received the Lifetime Achievement Award for his government service had told many within the city that he worked side by side with Chauncey within the com11l1m1ty of Centerville. Chauncey lived his entire life in Centerville and was a well respected member of the. community. His legacy lives on through his children and grandchildren, many who still live in the area today. Also, Centerville's SeniOl: Housing was named "after him. Chauncey Joseph Barett was born on March 21, 1907 on his grandparent's farm on 20th Avenue (then called Fort Tuyau Road). His family lived in the Centervi1le area while he was growing up. He and his four brothers received their education from Centerville School. Like many children in the Centerville community, Chauncey could only speak French when he began school. Tragedy struck his family in 1924 when Chauncey was 17 years old. His father, Robert Barett, was injured at his job on the St. Paul Water Department and died three days later. Chauncey took over his father's job to support his mother and brothers. This was a large responsibility for a teenager but typical of the kind of person that Chauncey was. He married Violet Arcand on June 21, 1927 and they set up housekeeping on the farm where Chauncey grew up. In the following years Chauncey and Vi raised 6 children and worked very hard running their farm, working and feeding their family. They were a wonderful example of what the institution of marriage is all about. In 1938, Chauncey and Vi move~ to Centerville at 7024 Centerville Road and lived there for more than 60 years. The property was not very well kept.up and the two worked very hard cleaning the yard and remodeling the house. Church was a very important part of Chauncey's life. He tirelessly volunteered hundreds of hours to St. Genevieve's Church. He served as a trustee for the parish and was chairperson of S1. Genevieve's Chicken Dinner and Festival for numerous years. He volunteered many hours helping to dig the basement of the church in the early 1940's. Chauncey also kept the sidewalks shoveled in the winter and planted many of the trees that are on the church property. I think his biggest contribution to the church and to the community was the over 30 years he devoted ringing the church bells. He rang the bells before every weekend Mass to announce to the community that church would begin in 5 minutes. He also rang the bells at 6:00 pm everyday for the Angelus and at funerals. Chauncey could often be seen riding his bike or walking to Church to carry on his responsibility. He did all these things as" a volunteer and never asked or expected to be paid or receive recognition for them. Chauncey spent many hours gardening and maintaining his yard. He was known for his beautiful roses and his immaculate garden. It was quite common to see people stopped on the side of the road to admire his handiwork. This was how the senior housing in Centerville got the name "Chauncey Barett Gardens". Chauncey Barett passed away on August 15, 1992 and is buried in St. Genevieve's cemetery. He will always be remeri:J.bered as a quiet, kind, honest, humble and trnstworthy IIla.!L His dedication to his family and Church will never be forgotten. ", .J J:.l1.t(j ~ ~ J TO: Honorable Mayor and Council Members FROM: Teresa Bender, City Clerk~l, SUBmCT: 7016 & 7020 Brian Court (Property Line Dispute/Shed) DATE: October 3, 2003 Upon discussing :Mr. Carlson/Ms. Jarosz complaint regarding the placement of an accessory structure with the Building Inspector Mr. Cook, Mr. Cook has stated that the accessory structure was constructed shortly following the construction of the residence in 1991 and that its approximate size is 8' x 10. You will find attachments that are a part of the Ordinance #4 that regulates accessory structures/tooVstorage sheds that was in effect at that time. It appears that there was an addition to the ordinance in 1991 that stated that storage sheds (up to 200 sq. ft.) shall be allowed to be constructed within 10' of a rear setback requirement, except in easement areas, in residentially zoned districts. You will also find attachments of Mr. Carlson's site survey and a plat map of the subdivision. It does appear that there is a 30' or more easement in the rear ,of 7016 Brian Court and this is where the accessory structuresltooVstorage shed is located. The City placed a correction notice at the residence of7016 Brian Court on July 16,2003 and requested that they contact staff within 10 days. Staff has made numerous attempts to discuss this matter with one of the residents at the address. Council may desire to direct staff to forward a letter via U.S. Postal Service (Certified Mail) requesting the sheds relocation within 30 days. If the owners do not become compliant within that timeframe, a Centennial Lakes Police Officer can cite them for non-compliance of Ordinance 4 (Violation). It is anticipated that you will be reviewing completed forms at the October 22, 2003 meeting. ~ Centennial Fire District 7741 Lake Drive Lino Lakes MN 55014 (651) 784-7472 March 13, 2003 Name Address Centerville MN 55038 Dear (name): Due to the disasters that occurred in Chicago and Rhode Island, I thought it was appropriate to contact all facilities within the Cities of Centerville, Circle Pines and Lino Lakes that operate places of assembly and remind them of the code requirements regarding your type of facility. The primary goal for enforcing the building and fire codes is to ensure life safety. The following information is provided to you, so that you have a clear understanding of the codes that apply and your responsibility to enforce these codes at all times. 1) No one shall be allowed to operate any type of pyrotechnics in any establishment within the Cities of Centerville, Circle Pines and Lino Lakes without specific written permission from the Centennial Fire District Fire Chief. The Minnesota Uniform Fire Code (MUFC), Article 78, Section 7801.3.2 Pyrotechnic special effects material. A permit is required to manufacture, compound, store or use pyrotechnic special effects material. A permit for use shall be granted only to a pyrotechnic operator. (That means a permit may be issued to a pyrotechnic operator, as defined by Minnesota Statute, if all city and state requirements are met.) 2) It is your responsibility as the owner/manager of your facility to meet with any organization (i.e. band, disc jockey etc.) that is allowed to perform in your facility and specifically inform them that firework! and pyrotechnics are not allowed inside your facility without a signed permit from the Centennial Fire District Fire Chief. It is my recommendation to have the above information in writing and require the responsible person (for any band, etc.) to sign the document that they understand and will comply with all requirements. The owner, manager or an approved designee from your facility should also sign the document as a witness. Assembly Safety Issues Page 1 of5 ., Centennial Fire District 3) It is your responsibility to maintain exits, means of egress and maintenance of emergency lighting, equipment, etc. The following sections of the MUFC address the issues you must enforce to comply with the requirements: ARTICLE 12-NUUNTENANCEOFMffiANS OFEGRESS&EMffiRGENCY ESCAPES Section 1201.1 Scope. Maintenance of means of egress and emergency escapes in buildings and structures used or intend~d to be used for human occupancy shall be in accordance with Article 12. A) Section 1203 - Means of Egress Obstructions Obstructions, including storage, shall not be placed in the required width of a means of egress, except projections as allowed by the Building Code. Means of egress shall not be obstructed in any manner and shall remain free of any material or matter where its presence would obstruct or render the means of egress hazardous. B) Section 1207-Doors Section 1207.1 GeneraL Exit doors shall be maintained in accordance with Section 1207. Exit doors shall be maintained in an operable condition. Doors installed as part of required fire assemblies shall be maintained in accordance with Section 1111. Section 1207.3 Locking Devices (As amended) Exit doors shall be openable from the inside without the use of a key or any special knowledge or effort. Exit doors shall not be locked, chained, bolted, barred, latched or otherwise rendered unusable. A1llockingdevices shall be of an approved type. Exception 1: In Group A, Division 3 (Under three hundred occupants with no legitimate stage) Key latching hardware may be used on the main exit when the main exit consists of a single door or pair of doors if there is a readily visible durable sign on or adjacent to the door stating: "This door to remain unlocked during business hours". The sign shall be in letters not less than 1 inch high on a contrasting background. When unlocked, the single door or both leaves of a pair of doors must be free to swing without operation of a latching device. The use of this exception may be revoked by the Fire Chief or Building Official for due cause. Assembly Safety Issues Page 2 of5 Centennial Fire District C) . Section 1208 - Gates and Barriers . Section 1208.2 - Latch. Gates and barriers shall be openable without the use of a key or any special knowledge or effort. Gates and barriers in a means~f egress shall not be locked, chained, bolted, barred, latched or otherwise rendered unopenable at times when the building or area served by the means of egress is occupied. _ D) Section 1211 MeansofEgress-Rlumination Section 1211.1 General Means of egress ill~tion (emergency lighting) shall be provided and maintained in accordance with the Building Code. Means of egress shall be illuminated when the building or structure is occupied. Section 1211.2 Emergency Power Equipment. Equipment providing emergency power for means of egress illumination aiJ.d exit signs shall be maintained in an operable condition. E) Section 1212- Means of Egress - Identification Section 1212.2 Where Required. The path of exit travel to and within exits in a building shall be identified by exit signs conforming to the requirements of the building code. Exit signs shall be readily visible from any direction or approach. Exit signs shall be located as necessary to clearly indicate the direction of egress travel. No point shall be more than 100 feet from the nearest visible sign. Section 1212.4 Rlumination. Exit signs shall be internally or externally illuminated. When the face of an exit sign is illuminated from an external source, it shall have an intensity of not less than 5 footcandles from either of two electric lamps. Internally illuminated signs shall provide equivalent luminance and be listed for the purpose. Section 1215.5 Power Source. All exit signs shall be illuminated at all times. To ensure continued illumination for a duration of not less than 1 ~ hours in case of primary power loss, the exit signs shall additionally be connected to an emergency electrical system provided from storage batteries, unit equipro.ent or an on-site generator set and the system shall be installed in accordance with the Electrical Code. Exception: Approved self-luminous signs that provide continuous illumination independent of an external power source. Assembly Safety Issues Page 3 of5 Centennial Fire District F) Section 1213 - Discharge, Dispersal and Refuse Section 1213.1 General. Areas designated for occupant discharge, dispersal or refuge shall be maintained unobstructed and clear of storage. Section 1213.4 Obstructions. (As amended) All exits shall be maintained free of obstructions, including the accumulation of snow and ice, which would restrict their use. ARTICLE 25 - PLACES OF ASSEMBLY A) Section 2501.16 - Maximum Occupant Load Section 2501.16.1 Posting of room capacity. Any room having an occupant load of 50 or more where fixed seats are not installed, and which is used for assembly purposes, shall have the capacity of the room posted in a conspicuous place on an approved sign near the main exit from the room. Such sign shall be maintained legible by the owner or the owner's authorized agent and shall indicate the number of occupants permitted for each room use. B) Section 2501.16.2 -Determination of Occupant Load. The number of persons in a building or portion thereof shall not exceed the amount determined as specified in the Building Code, except that where such additional exit facilities are provided the occupant load can be increased by not more than 10 percent, when approved by the Fire Chief, without being considered overcrowding. C) Section 2501.16.3 - Overcrowding. Overcrowding and admittance of persons beyond the approved capacity of a place of assembly are prohibited. The chief, upon finding overcrowding conditions or obstructions in aisles, passageways or other means of egress, or upon finding a condition which constitutes a serious menace to life, is authorized to cause the performance, presentation, spectacle or entertainment to be stopped until such condition or obstruction is corrected. ARTICLE 10 - FIRE PROTECTION SYSTEMS & EQUIPMENT A) Section 1002 - Portable Fire Extinguishers Section 1002.1 General. Portable fire extinguishers shall be installed in occupancies and locations as set forth in this code and as required by the Fire Chief. On February 28th 2003 at approx. 2200 hours Chief 3 and myself did a compliance check of this establishment and found the following violations 1: A turn style on one side and a cash register with a chair on the other side blocked the south exit. 2: The north exit had a 4 ft fan in front of the right side. This door also had dead bolts installed on the bottom and top of it. Exit width must be maintained with-in min. standards and have nothing that would impede egress. 3: The south entrance had a propane heater in it. This is a fire hazard and was removed immediately. 4: The occupant sign needs to be updated. On 6-15-03 there were numerous electrical violations (missing covers, extension cords, access to panel). . The City is responsible for paying use tax on all invoices where insufficient or no sales tax was collected. As shown in the year 2002, staff is closely monitoring invoices for sales tax due. THE COUNCIL OF THE CITY OF CENTERVILLE DOES ORDAIN: SECTION 1. NOISES PROHIBITED. The City Council fin~ that within the City, certain loud, avoidable, unnatural and unnecessary noises, which under certain circumstances and conditions constitute a serious threat to the health, welfare, contentment and the feeling of well-being of our residents. Excessive noise degrades the environment of the City and the City has a substantial and, in some situations, compelling interest in controlling such noise. Subdivision 1. General Prohibition. No person shall make or cause to be made any distinctly audible, continuous, objectionable noise due to intermittence, frequency, beat, shrUlness, or intensity that annoys, disturbs, injures, or endangers the comfort, repose, health, peace, safety, or welfare of any person or precludes their enjoyment of property. This general prohibition is not limited by the specific restriction of the following subdivisions. Subdivision 2. Radios. Phonoeraphs. Pame Systems. Etc. Subdivision 3. Participation in Noisv Parties or Gatherine. No person shall participate in any party or other gathering of people in violation of Section 1, subdivision 1. Subdivision 2. Domestic Power Equipment. No person shall operate a power lawn mower, hedge clipper, chain saw, mulcher, garden tiller, edger, drill, or other similar domestic power maintenance equipment between the hours of 10:00 p.m. and 7:00 a.m. Snow removal equipment is exempt from this provision. Subdivision 3. Refuse Hauline. No person shall collect or remove garbage or refuse in any residential district between the hours of 10:00 p.m. and 7:00 a.m. Subdivision 4. Construction Activities. The application may be granted subject to conditions, including a time limit, which shall be clearly stated. If the City finds that sufficient controversy exists regarding the proposed exception to the provisions of this ordinance, a pu1?lic hearing may be held on the proposed application at which all persons affected shall be given an .opportunity to be heard. Subdivision 4.. Exception for Emergency Work. Noise created exclusively in the performance of emergency work to preserve the public health, safety, or welfare, or in the performance of emergency work necessary to restore a public service or eliminate a public hazard shall be exempt from the provisions of this ordinance for a period not to exceed 24 hours after the work is commenced. Persons responsible for such work shall inform the police department, Building Inspector and City Administrator of the need to initiate such work or, if the work is commenced during non-business hours of the City, at the beginning of business hours of the first business day thereafter.
