(11) Permitted encroachments. The following shall not be considered as
encroachment`s on setbacks subject to other conditions within this chapter: off - street
parking spaces, flues, belt course, leaders, sills, pilaster, lintels, cornices, eaves, gutters,
awnings, open terraces, service station pump islands, open canopies, steps, chimneys,
flagpoles, ornamental features, open fire escapes, sidewalks and fences, except as
hereinafter amended.
(1) Driveways.
(1) No driveway shall be located within 100 feet of any right -of -way line of a
street intersection. The distances shall be measured along the property line from the
comer right - of - way and county line.
(2) Access drive onto county roads shall require a review by the City Engineer.
This review shall be measured along the property line from the corner right -of -way and
county line.
(J) Refuse.
(1) Garbage and rubbish containers shall be placed at the rear of the premises or
in a manner as to be out of view from the street. In no event shall containers or their
enclosures be placed or maintained in a way to unreasonably interfere with the use or
enjoyment of adjoining property.
(2) All garbage containers shall be screened with a suitable enclosure_
(K) Permitted uses.
(1) Retail sales and service, but excluding adult - oriented businesses;
(2) Daycare centers;
(3) Hotels and motels;
(4) Full service gasoline sales and service;
(5) Eating and drinking establishments;
(6) Financial institutions;
(7) Personal and professional business offices;
(8) Public buildings;
(9) Barber/beauty salons;
(10) Commercial schools;

(11) Hospitals and clinics;
(12) Nursing homes;
(13) Commercial recreation;
(14) Car washes; and
(15) Liquor stores.
(L) Conditional uses.

(a) the outside sales lot shall not be larger in square footage than the one
and one -half times the square footle of the building devoted to the related
business.
(b) the sales lot used to park vehicles to be sold or serviced shall be a
separate and distinct from the area of the premises used to park vehicles necessary
to satisfy the minimumparking_requited by this Code.
(c) all repair assembly disassembly or maintenance of vehicles shall occur
within a closed building except minor trtaingpance including tire inflation, adding
oil and wiper replacement. Vehicles that an inoperable or are missingbody parrs
shall be stored inside a building for a properly screened area, provided
however that vehicles which are inoperable, missing body parts, or are
unlicensed may not be stored outside a building longer than 90 days),

Section 2. Effective Date: This ordinance shall be effective immediately upon its passage
and publication of the summary attached as Exhibit A, according to law.

Summary of Ordinance T , Second Series
Notice is hereby given, that on , 2012, Ordinance Number , Second
Series, entitled "AN ORDINANCE AMENDING CITY CODE, CHAPTER 156
REGARDING B -1 CONDITIONAL USES," was adopted by the City Council of
Centerville, Minnesota.
Notice is further given that due to the lengthy nature of the ordinance, the City
Council has directed that this title and summary be prepared for publication pursuant to
Minn. Stat. 412.191, Subd. 4_
Notice is further given that a complete printed copy of the ordinance is available
for inspection by any person during normal business hours of the City Clerk, 1880 Main
St., Centerville, MN, or will be mailed to anyone requesting it by telephone (651) 429-
3232.
Notice is further given that the general purpose of the ordinance is to establish
standards and procedures for considering Conditional Use in the B -1, Commercial
District.
Section 1. This section amends Chapter 156, section 156.030 by providing listed
conditional uses and the standards that should be attached to consider them.
Section 2. This section provides that the effective date shall be upon publication
of this summary.
Notice is further given that the Council has by a minimum 4/5 vote approved this
public notice on the day of , 2012.

Pursuant to due call and notice thereof, the Planning and Zoning Commission held its regular
meeting on April 3, 2012, at 6:30 p.m.

Commissioner Olaf Lee (Arrived at 6:34 p.m.)

Commissioner Matthew Montain

I. CALL TO ORDER.
The meeting was called to order by Chairperson Mosher at 6:30 p.m.

All present except Lee.
Commissioner Lee arrived at 6:34 p.m.
II. PUBLIC HEARING - Proposed amendment to City Code Section 156.030, (L)
Conditional Uses in Commercial B -1 Zoning District.
Notice was duly given by publishing in the Citizen. No one was present to speak with
regard to the proposed amendment.
The Commission discussed the proposed amendment. Consensus was that the changes
were acceptable, but it was suggested that the amendment Change 156.030, L, c, allow
vehicle storage in a screened area in addition to storage within buildings, but that outside
storage should have a 90 day time limit.
Motion by Commissioner Lee, seconded by Commissioner Montain to close the public
hearing at 7:40 p.m. All in favor. Motion carried unanimously.

IV. NEW BUSINESS.
Proposed amendment to City Code Section 156.030, (L) Conditional Uses in
Commercial B -1 Zoning District. The Commission agreed to modify the draft text in
subsection c, to permit outside storage of vehicles in a screened area with a maximum limit
of 90 days, if there are parts missing from the vehicle, the vehicle is inoperable or is
unlicensed.
Motion by Commissioner Mosher, seconded by Commissioner Koski to recommend
approval of the the code amendment as modified. Voting in favor of the motion:
Mosher, Koski, Flint and Wood. Voting against the motion: Larson, Lee and
Montain. The motion was declared to have passed.
Council member Love asked those voting against the motion to explain their concerns.
They indicated a desire not to further restrict the use of private property. Council member
Love will share this concern with the City Council.
V. DISCUSSION ITEMS
1) Snowmobile Regulations. Nothing new to report, discussion is still taking place
between the neighboring cities. Goal is to have something back by August.
VI. CONSIDERATION OF MINUTES
Motion by Commissioner Larson, seconded by Commissioner Mosher to approve
minutes from the February 8, 2012, meeting. All in favor except Montain who
abstained. Motion carried.
VI. PLANNING AND ZONING COMMISSION MEETING ADJOURNMENT
Motion by Commissioner Wood, seconded by Commissioner Montain to adjourn the
meeting at 7:55 p.m. All in favor. Motion carried unanimously.
