CALL TO ORDER Vice - Chairperson Grahek called the September 5, 2012 Parks & Recreation Committee Meeting to order at 6:45p.m., at Hidden Springs Park. Oath of Office The newly appointed committee Members, Mr. Chris Bettinger and Mr. Kevin Waeghe were administered the Oath of Office. They both shared information about their background, interests and families. Roll Call II. SET AGENDA Motion was made by Committee Member Amundsen, seconded by Committee Member Seeley to add number 5 "Upcoming Events for 2013 & balance of 2012" & number 6 "Voting Procedures for the Committee" under Committee Business, and to add number 11 "Skating Party" under Updates. All in favor. Motion carried unanimously. III. APPEARANCES None. W. CONSIDERATION OF MINUTES Consideration of the August 1, 2012 Parks and Recreation Committee meeting minutes: City of Centerville Parks & Recreation Committee September 5, 2012 Motion was made by Committee Member Seeley, seconded by Committee Member Peterson to approve the August 1, 2012 meeting minutes with one modification: add number 6. Music in the Parks as a heading, between the first and second paragraphs under number 5 on page 4. All in favor. Motion carried unanimously. V. COMMITTEE BUSINESS 1. City Council Goals and Objectives — 2012 (Proposed Addendum for Parks & Recreation) Motion was made by Committee Member Grahek, seconded by Committee Member Amundsen to table discussion of the Proposed Addendum for Parks & Recreation to the City Council Goals & Objectives — 2012 to the October meeting. All in favor. Motion carried unanimously. 2. Park Facility Permit Application: LaMotte Park Baseball Outfield #5 from August 13, 2012 th through October 31, 2012, Mondays through Thursdays, from 5:30 — 7:30pm — for 7 football (given preliminary use permission w/o stripping). STRIPPING 3. Park Facility Permit Application: LaMotte Park Field #1 from August 15, 2012 through October 12, 2012, Mondays, Wednesdays & Thursdays from 6:00 — 7:30pm for 2 "d & 3rd grade football (given preliminary use permission). 4. Park Facility Permit Application: Acorn Creek Park Field #1 from August 20, 2012 through October 31, 2012, Thursdays, from 5:00 — 8:OOpm for Youth 10 Girls Soccer (given preliminary use permission) Motion was made to Committee Member Peterson, seconded by Committee Member Grahek to approve the three (3) Park Facility Permit Applications as stated above and also to approve the stripping at the LaMotte Park Baseball Outfield #5. All in Favor. Motion carried unanimously. 5. Upcoming Events for 2013 and the remainder of 2012 There was a request for the Committee to set and approve dates for the remainder of 2012 and for 2013 for publication in the Citizen Resident Guide: 2012: • September 15 @ 7:30 p.m.: MOVIE IN THE PARKS @ Hidden Springs Park • September 29 SKATING PARTY @ Schwan Center • *October 6th, 7 13 or 14 @ 9 -l0am: PLANTING TULIP BULBS throughout the parks. All in favor. Motion carried unanimously. 6. Committee Voting Procedures Chairperson Branch was present and stated that the Committee had requested that the City Code be modified to allow nine (9) members rather than seven (7) and to be allowed to make a recommendation to Council on the candidate that they would choose if there were more than one vacancy. Administrator Larson had suggested to Chairperson Branch that one (1) of the two (2) individuals might be appointed as an ex officio /alternate of the Committee with voting rights only when an appointed committee member is absent from the meeting. There was discussion regarding several options on how to balance the vote to make it fair for all members. Motion made by Committee Member Haiden, seconded by , that the chairperson be considered a non - voting member with all other rights and responsibilities at the meetings where there are eight (8) members present. All in favor. Motion carried unanimously. VI. UPDATES 1. Council Updates — Council Liaison King None 2. Bald Eagle Ski Club — Benches & Portable Toilets at Trailside Park — Branch Tabled to March, 2013 3. Kiosk Inserts — Amundsen All information is out of date at this time & should be removed; the fall /winter activities /programs /events for Centerville, as well as Wargo, should be posted soon. Page 3 of 5 City of Centerville Parks & Recreation Committee September 5, 2012 In addition, the Centerville fall /winter information should also be posted at Wargo. The Committee would like to know what is and is not allowed in the Kiosk as far as promotional materials. Committee Member Seeley will give immediate upcoming activities to staff to include in city promotions. 4. Contact Area Schools — Monument Signs maintenance Tabled to March, 2013 5. Smart Phone Application — Peterson No update; Committee Member Peterson is still working on this project. 6. Sand Volleyball Court — Palzer & Haiden No addition quotes have been requested; tabled to October meeting. 7. Rescheduling of Little League Games to Lexington Chairperson Branch to contact the coordinator to determine the reason the games were moved from Centerville to Lexington; tabled to October meeting. 8. Thank You Letters (Music in the Park & 8K Sponsors) These letters need to be done ASAP. 9. Enhancement Items for Music in the Park (Grahek & Amundsen) Committee Member Peterson offered to check prices on the headphones and cables. 10. Movie in the Park — Peterson The movie, The Lorax and the projector have been rented at a cost of $350 for the movie and $125 for the projector. In addition, Committee Member Peterson purchased blackout material (110" x 150 ") for use as a screen at a cost of $72. The Committee has remained under the $750 that had been budgeted for this event. There are approximately 4 %2 cases of Sunny D and a case of water that can be distributed at the movie; an inventory of supplies needs to be completed prior to the 15 Volunteers are needed for set up at 6:15 p.m. with the movie beginning at 7:30 p.m. The following advertising needs to be done as soon as possible: City Website, ad in Citizen newspaper, inform the schools, etc. 11. Skating Party @ Schwan's Super Rink: September 29, 2012 @ 5:30pm By an agreement that was made when the Schwan Center was established, Centerville is granted a free one hour skating session each September. The 2012 session has been scheduled for 5:30 p.m., September 29. This community event is open to all Centerville residents and their guests. Information for this event is posted on the City website. As of today, I have revenues of $3,340.00 and expenditures of $1,770.71 so the reserve amount would be $1,569.29. Do you anticipate receiving any other late donations in regards to the 8K run or are these numbers final? The first order of business should be to have the Park and Recreation Committee approve a request to reserve these funds and then we can put it on the council agenda. Furthermore, you should discuss your prior reserves and determine if the proposed uses are still applicable. We will let the girls choose between Acorn Park and Hidden Spring Park. We would also like to know if we could mark some drains with the notification that it drains to the lake. The Girl Scouts have a template (see attached) - it will look very similar if not exactly like this. We would like to mark 4 drains in Centerville and need help in locating which ones to mark. We will be doing this on Oct 13th for the Girl Scouts of America's 100 year celebration. Thank you for your help - it is much appreciated! XXX.02 - DEFINITIONS The words, combination of words, terms or phrases used in this ordinance and defined in Minnesota Statutes, Section 84.81, shall have the meanings given them by that section. XXX.03 - ADOPTION OF STATE LAW BY REFERENCE The provisions of Minnesota Statutes, Sections 84.82 pertaining to registration, 84.87pertaining to snowmobile operation and regulations by municipalities, 84.871 pertaining to equipment requirements, 84.872 pertaining to youthful snowmobile operators, 84.88 pertaining to penalties are adopted and made a part of this ordinance as if set out in full. [The provisions of Minnesota Statutes, Sections 84.9et.al. pertaining to ATV regulations are adopted and made a part of this ordinance as if set out in full.] XXX.04 - OPERATION WITHIN THE CITY LIMITS, SNOWMOBILES [The City Council, may, from time to time, adopt an official map defining the boundaries of a No Snowmobile Zone within which snowmobiling, including recreational riding on your own property, is prohibited in order to protect the safety of snowmobilers and citizens of the City.] A. Within the City, snowmobiles may be operated for recreational purposes on: 1. Property you own, 2. Property for which you have written permission in your possession to ride, 3. over _ _____ Lake [and ______ Lake] (when safely iced over), when legally accessed as defined in this ordinance and not closer than 100 feet from the shoreline, skating rinks, fish houses, and pedestrians, and 4. [Over the Rice Creek Snowmobile Trail, when legally accessed as defined in this ordinance]. B. Within the City of , travel through the City on a snowmobile may occur within the bottom or outside slope of the ditches adjacent to County Roads and State Highways. In cases where paved trails or sidewalks are located on one side of the County Road or Highway, travel shall be limited to the side without the paved trail or sidewalk. In no case shall travel occur through a designated No Snowmobile Zone on the above - identified roads or highways. C. For local access to the above - identified through -city travel routes, snowmobiles may travel on the right hand side of local streets on the paved surface within the curb line from the operator's place of residence to the travel route via the most direct route. Any return trip must occur in the same manner. Travel for local access shall be at a rate not to exceed fifteen (15) miles per hour. Snowmobiles must travel single file in this instance. D. Additionally, a snowmobile may be operated upon a local street for the sole purpose of leaving and returning to a place of residence, provided that the travel is limited to the shortest possible route between the residence and a restaurant or a gasoline filling station. E. Lakes may be accessed directly from private property, by trailering sleds to a public boat landing, or via local access as defined above. F. Within the City of , snowmobiles shall not be operated 1. On public lands, including but not limited to: public parks, playgrounds, trails, sidewalks, paths, open spaces, scenic and historic sites, cemeteries, schools, golf courses, and other public buildings and structures. 2. Within one hundred (100) feet of any fisherman, fish house, shelter, pedestrian, skating rink, sliding area or in any other area where such operation would conflict with the use or endanger other persons or property. 3. At any place, while under the influence of intoxicating liquor, narcotics or habit - forming drugs 4. At a rate of speed greater than posted for the County Road or Highway, or reasonable for the surrounding circumstances, and in the case of local access, not to exceed twenty (20) miles per hour. 5. At any place in a careless, reckless or negligent manner so as to endanger the person or property of another or to cause injury or damage thereto G. Snowmobiles shall not be operated between the hours of 12:01 a.m. and 7:00 a.m., except for emergency purposes or except if the operator is returning to his residence at a speed not in excess of twenty (20) miles per hour. XXX.98 - APPLICATION OF OTHER LAWS The provisions of Minnesota Statutes, Chapter 169, pertaining to traffic regulations, which relate to the use and operation of snowmobiles, shall apply to the use and operation of snowmobiles upon the streets and highways of the City. However, those provisions which by their nature have no application shall not apply. XXX.99 - PENALTY Any person violating any provision of this ordinance shall be guilty of a misdemeanor, and upon conviction thereof, shall be punished by a fine of not more than $1,000.00 or by imprisonment of not more than ninety (90) days, or both, plus costs of prosecution in either case. CHAPTER 94: SPORTING, ATHLETIC AND MUSIC EVENTS Section 94.01 Generally § 94.01 GENERALLY. (A) It shall be unlawful to conduct sporting, athletic and music concert events in residential districts of the city, as defined herein, unless first securing a special permit from the city. (B) (1) Sporting, athletic or music events shall be defined as the conducting of these events by individuals, nonprofit or profit organizations, partnerships or corporations, wherein participants and/or patrons are charged an entry fee for the right to participate in the event and/or compete for monetary or merchandise prizes. The events shall include but not be limited to softball, football, volleyball, broomball, ice or field hockey, tennis, basketball tournaments or outdoor music concerts; and (2) These activities shall be considered by special permit within all residential districts of the city and shall require a permit therefore. The city shall have the right to make provisions in the permit for insuring public health and sanitation, traffic regulation, noise and litter control and regulation on the number of events that may be conducted on a specific site. (Ord. #4, adopted 8/23/2000) § 94.02 ULTIMATE FIGHTING PROHIBITED (A) Definition and purpose. Ultimate fighting is any activity, regardless of how named or described, or any form of entertainment, where the primary practice involves individuals engaged in physical contact by striking an opponent with hands, head, feet or body. This shall include, but not be limited to, any contest where kicking, punching, martial arts, or submission holds are permitted. The City Council finds that the practice of ultimate fighting is dangerous and puts individuals and the public health, safety and welfare at great risk. (B) Prohibited conduct. It shall be unlawful in any public or private building or place to organize, permit, be present at, or to participate in the practice of ultimate fighting. Officially sanctioned matches regulated by the Minnesota Boxing Commission, martial arts, wrestling and team sports in which physical contact is incidental to the primary purpose of the game such as hockey, basketball, volleyball, soccer, baseball and softball, are not included among activities prohibited by this section.
