HomeMy WebLinkAboutOrd. #58, Second Series - Amending City Code, Chapter 156, Sections 156.006 Definitions & 156.016-156.052 Zoning Districts Findings and Decision Related to Chapter 156.006 & 156.016- 156.052 October 2, 2012 Findings and Decision Related to Chapter 156.006 & 156.016- 156.052 The Planning & Zoning Commission met on September 4, 2012 and again on October 2, 2012, to consider amending the city Code Chapter 156. Findings: 1) The City Code, Chapter 156 regulates land use and zoning matters. 2) The Commission held a public hearing on September 2, 2012, to consider amendments to Chapter 156 that would clarify the allowed uses and restate the allowed uses in the various zoning districts in a chart format. The Commission considered public comment in making these findings and its decision. 3) The Commission finds that the chart format, identified as Table 156 -A.1 will be easier to use than the previous method of stating the uses within the text of the Code. 4) The Commission determined that it should clarify various group residential uses and day care. 5) The Commission finds that "Residential Care For Juvenile Sex Offenders" is a use appropriate for the R -3 district, but determines that in order to protect the safety of children and other vulnerable persons, this use should be located away from places that children and other vulnerable persons frequently are present. The Commission determined that an appropriate distance would be 1500 feet from any bike path or trail, bus stop, school, day care, nursing home, residential facility serving children or vulnerable persons, public park, recreational use facility, or other public or private place where children or vulnerable persons would normally frequent or congregate. DECISION: The Planning and Zoning Commission recommends that the City Council adopt the attached Ordinance amending Chapter 156, including Table 156 -A.1.
