Regarding Chapter 94. Please. Re -read 94.01. (A) says it is unlawful to conduct events without
a special permit. (B) defines the term events. That last sentence simply list examples of sports
included in the term events.
An I missing something here ? ??
Did you intend to attach the Schwann Center agreement? I did not get the attachment.

Subsequent to discussions with Dallas regarding the adding of "races" to City Code,
Chapter 94 - Dallas desires you to consider the following:
If the language is left out "Races" Bike /Run /In -Line would require a Special Event Permit to
be issued. If the language is contained, they could just happen even on the same days.
Schwan Annual Hour of Ice Time - I will include the agreement which contains the language
regarding it. Dallas believes we would need to discuss "donation" to a youth group of some
type with them.

PARKS AND RECREATION COMMITTEE
MEETING MINUTES
Wednesday, October 3, 2012 - 6:30 p.m.
Pursuant to due call and notice thereof, the Parks & Recreation Committee of the City of Centerville
held a scheduled meeting on Wednesday, October 3, 2012 at the Centerville City Hall.

I. CALL TO ORDER
Chairperson Branch called the October 3, 2012 Parks & Recreation Committee Meeting to
order at 6:45p.m., at Centerville City Hall council chambers.
II. SET AGENDA
Motion was made by Committee Member Haiden seconded by Committee Member
Amundsen to add number 13 "Schwan's Skate Night" under Updates. All in favor.
Motion carried unanimously.
III. APPEARANCES - NONE
IV. CONSIDERATION OF MINUTES
Consideration of the September 5, 2012 Parks and Recreation Committee meeting minutes:
The voting procedure of the committee was discussed. There are 7 votes allowed and there
are currently 8 members on this committee. If all are in attendance then the chairperson will
not vote; if one person is absent then all may vote. This was done with the consensus of the
Committee members.
Motion was made by Committee Member Amundsen, seconded by Committee Member
Seeley to approve the September 5, 2012 meeting minutes with the following
corrections: 1. Under V. Committee Business #2 & the motion - change spellin g of
stripping to striping & under Committee Business #6 remove the words "was present"
and add "via email" between "stated" and "that" & in the motion listed to add

"Grahek" as the person who seconded the motion. All in favor. Motion carried
unanimously.
V. COMMITTEE BUSINESS
1. City Council Goals and Objectives — 2012
(Modified Addendum for Parks & Recreation)
Motion was made by Committee Chairperson Branch, seconded by Committee
Member Amundsen to submit the Modified- Proposed Addendum for the
Committee to the City Council for approval and adoption into the City Goals
and Objections for 2013. All in favor. Motion carried unanimously.
2. Park Facility Permit Application: September 22, 2012 for use of pavilion at Laurie
LaMotte Park for a picnic. Permission was given by staff, due to the timing conflict
and the Committee agreed with the decision.
3 Park Facility Permit Application: LaMotte Park Hockey Rink from October 15,
2012 through November 20, 2012, Mondays & Thursdays from 7 — 8 pm for dry land
practice.
Motion was made by Committee Member Amundsen, seconded by Committee
Member Grahek to approve the application as presented. All in Favor. Motion
carried unanimously.
4. Hidden Spring Park or LaMotte Park Clean-Up and Storm Drain Stenciling by Girl
Scouts on October 13, 2012
It was noted that the Girl Scouts had submitted stenciling; however, it did not meet
the City's existing stenciling pattern and Mr. Palzer stated that all drains had been
previously marked. Chairperson Branch suggested one or more members of the
Committee attend the clean up and thank them for their efforts.
5. Tulip Planting — October 6, 2012 — meet at City Hall at 9:OOam
Several members of the Committee are unavailable to participate in this event.
6. Upcoming Events for 2013 and the remainder of 2012

7. Proposed Snowmobile Ordinance
After discussion, this topic was tabled to the November meeting; Chairperson
Branch will obtain additional information.

Generally covers sporting, athletic and music concert events in the residential
districts of the city. After review and discussion, a suggestion was made to add
"racing events" in paragraph (B) (1).
9. Special Use Permit Application — Centerville Lions use of Laurie LaMotte Memorial
Park Warming House for Haunted House on October 19, 20, 26 & 27, 2012.
Motion was made by Chairperson Branch, seconded by Committee Member
Amundsen to approve the presented application. All in favor. Motion carried
unanimously.
10. End E d of Year Budget Review — Allocation of Reserves for 2013. (Volleyball Court &
Other Items)
Lengthy discussion ensued regarding the best use of reserves for the upcoming
� Y g 8 Y ear -
including the following purchases: park benches for Eagle Park and Trailside Park;
bulletin board for the exterior of the warming house, larger popcorn machine, etc.
along with the construction of one (1) volleyball court.
Finance Director Jeziorski provided the Committee with reserve amounts or
previously committed funds from the 2011 8K Walk/Run Proceeds, $2,037.71;
Donations, $7,750; Signage, $1,585.53; proceeds from the 2012 8K Walk/Run,
$1,381.82; all totaling $12,755.06. Consensus of the Committee was to earmark all
of existing reserves /committed funds and $1,000 of unspent funds from the 2012
Budget line item Park Programs and request that Council assist in obtaining their
goal in 2013 by providing an additional $5,000 for a total of $16,755.06 allowing
construction of one sand volleyball court.
Motion was made by Chairperson Branch, seconded by Committee Member
Haiden to commit the above stated funds ($11,755.06) and request assistance
from Council ($5,000) totaling $16,755.06 for the construction of one (1) sand
volleyball court at Laurie LaMotte Memorial Park in 2013. All in favor.
Motion passed unanimously.
Additional discussion was had regarding the necessity of irrigating either Hidden
Spring Park or Cornerstone Park. Consensus of the Committee was to continue
discussions regarding this item.

5. Rescheduling of Little League games to Lexington
Chairperson Branch will not be contacting the coordinator to determine the reason
the games were moved from Centerville to Lexington; monies were lost due to the
cost of the concession stand not be utilized. There will be no concessions in 2013.
6. Thank You Letters (Music in the Park & 8K Sponsors)
These need to be written as soon as possible.
7. Enhancement Items for Music in the Park (Grahek & Amundsen)
Committee Member Peterson offered to check prices on the headphones and cables.

8. Movie in the Park — Peterson
This event was a huge success with over 200 people in attendance. It was suggested
that volunteers begin making popcorn at least an hour prior to the start of this event.
9. Email Account for people to receive information on community recreation
activities and events on the City web site - Tabled
10. Supplies on hand for Skate Night
Popcorn and hot cocoa mix — need to inventory supplies on hand and purchase
additional popcorn, oil and cocoa mix with milk powder in bulk.
11. Bunker Hills Stable Skate Night, Hayride and Bonfire
Needs to be scheduled.
12. Schwan's Ice -Skate Night
Only a few people showed up. It was suggested that this hour of free skating be
donated to a youth or community group. Need to research the legalities involved.

October opening.

SUPER RINK EXPANSION
GUARANTEE AGREEMENT
THIS AGREEMENT is made this ..t day of March 2006, by and between
the State of Minnesota acting through the Minnesota Amateur Sports Commission
( "MASC "), the National Sports Center Foundation ( "NSCF "), a Minnesota non -profit
corporation, and the City of Centerville ( "City of Centerville ").
WITNESSETH:
WHEREAS, MASC, pursuant to Minnesota Statutes Chapter 240A, has the
authority to design, construct, own and operate an ice arena and auxiliary facilities; and
WHEREAS, MASC has determined the need for additional ice sheets at the
Schwan Center, and has requested the issuance of tax exempt bonds ( "Bonds ") by the
Anoka County Housing and Redevelopment Authority ( "ACHRA ") for the purpose of
assisting in the financing of an additional ice arena ( "Facility ") consisting of at least four
ice sheets to be located on property ( "Property ") owned by the MASC at the National
Sports Center ( "NSC ") at 1700 — 105th Avenue NE, Blaine, Minnesota; and
WHEREAS, it is contemplated that the total cost of the Facility including the cost
of the design, construction and securing financing will be approximately $11,100,000.00;
and
WHEREAS, the ACHRA has agreed to issue Bonds for the purpose of financing
a portion of the construction of the Facility pursuant to certain terms and conditions all to
be set forth in various bond documents ( "Bond Documents "); and
WHEREAS, the Property has been leased by MASC to ACHRA in connection
with the issuance of the Bonds; and
WHEREAS, ACHRA has subleased the Property to the NSCF; and
WHEREAS, pursuant to the sublease, the NSCF is responsible for the
construction and operation of the Facility; and
WHEREAS, the Centennial Youth Hockey Association ( "CYHA "), a Minnesota
non -profit corporation, has entered into an ice sheet rental agreement ( "Ice Sheet Rental
Agreement ") with NSCF and MASC through which CYHA will receive certain priority
rights in scheduling and purchasing up to 1,340 ice sheet hours per year in return for
agreeing to purchase each year a minimum of 860 ice sheet hours. The City of Centerville
is willing to assist in the financing of the Facility by guaranteeing each year 16% of the
1340 ice sheet hours and in consideration of the CYHA guarantee of 860 hours, the
remaining hour guarantee would be 16% of 480 hours annually.

NOW THEREFORE, for good and valuable consideration the parties hereto
hereby agree as follows:
SECTION 1
TERM
This Agreement shall be effective as of the date set forth above, and shall terminate on
the earlier of January 1, 2026, or the final maturity date of the Bonds. In the event the
Bonds are redeemed prior to the final maturity date, this Agreement shall still remain in
effect until January 1, 2026.
SECTION 2
GUARANTEE OBLIGATION
2.1 Centennial Cities. The Centennial Cities (the cities of Centerville, Circle
Pines and Lino Lakes) agree to guarantee for each year during the term of this Agreement,
rental income to the Facility at the Hourly Rate for the one thousand three hundred forty
(1340) Priority Hours only if annual gross rink revenues are insufficient to pay annual
bond & operating costs. This guarantee obligation shall be allocated to each member city
as follows: Lino Lakes (72 %), Centerville (16 %), and Circle Pines (12 %). It is
acknowledged that CYHA has entered into an Ice Sheet Rental Agreement with NSCF to
guarantee 860 of these 1340 hours.
2.2 Such guarantee of rental income shall not be required after the initial bond
debt, which finances the facility, is paid in full.
SECTION 3
NOTIFICATION
3.1 Notification. On or before June 1 of each year, NSCF shall provide to the
City of Centerville a written notification ( "Notice ") if any portion of the 1360 ice sheet
hours have not been committed to in the manner provided for by the joint board.
3.2 Right to call for Joint Board Meeting. The City of Centerville shall have
thirty (30) days from the date of the Deficiency Notice to request in writing that the NSCF
call a meeting of the Joint Board for the sole purpose of exploring any available
opportunities for the sale of all or any portion of the Uncommitted Hours. Upon receipt
of such written request for a meeting of the Joint Board, NSCF shall schedule a meeting as
soon as practical and notify the City of Centerville of the date of such meeting.
3.3 Payment of Deficiency. As soon as practical after March 31 of each year,
NSCF shall provide to the City of Centerville written notification of the number of
Uncommitted Hours that remained unsold as of March 31 and the dollar amount due
( "Deficiency Assessment ") NSCF based on the Regular Hourly Rate. Payment by the City

of Centerville of the Deficiency Assessments shall be made within thirty (30) days of its
receipt.
SECTION 4
ESTABLISHMENT OF JOINT BOARD
4.1 Joint Board. NSCF and MASC agree to the establishment of a joint board
( "Joint Board ") consisting of one member appointed by the Blaine Youth Hockey
Association, one member appointed by the Centennial Youth Hockey Association, two
members appointed by the NSCF, and 2 members appointed by the MASC. MASC may
also appoint non - voting ex- officio members as needed. With respect to the two members
to be appointed by the NSCF, one such member shall be appointed to represent the
interest of the users of the Columbia Ice Arena and one such member shall be appointed to
represent the interests of the Herb Brooks Foundation.
4.2 Powers of Joint Board. The Joint Board shall exercise the following
powers and such other powers as are set forth in the Ice Sheet Rental Agreement or as
may be required by any of the Bond Document:
(a) Establish procedures for the fair and equitable exercise of rights relatins to
the Ice Sheet Rental Agreement.
(b) Approval of an annual operating budged consistent with the Ice Sheet
Rental Agreement and the Bond Documents.
(c) Establish fair and equitable use and programming policies and procedures
not covered by and not inconsistent with the Ice Sheet Rental Agreement
and the Bond Documents.
(d) Recommend programming decisions.
(e) Establishing the Regular Hourly Rate.
SECTION 5
SPECIAL TERMS
5.1 Scheduling Rights for the Centennial Cities. Each city member of the
Centennial Cities shall be entitled to the following for 40 years until January 1, 2046:
(a) The right to schedule one fall session for free skating.
(b) 300 single use passes for open skating on an annual basis. Distributed
as follows; 216 to Lino Lakes, 36 to Circle Pines and 48 to Centerville.
(c) The right to schedule and purchase up to 12% of CYHA 1340 hours if
requested by April 1st prior to each season and shall be prorated as per
each cities Proportionate Share.

5.2 Additional Rights for Centennial Cities. If subsequent to the date of this
Agreement, a Minnesota Hockey Association sanctioned club /association is organized to
serve all or part of a city member of the Centennial Cities, the Centennial Cities may, at
their discretion, choose to assign a portion of the Priority Hours that CYHA has under
Section 3.2(c) to the new association.
5.3 Recognition for the Centennial Cities. The Centennial Cities shall receive
recognition in 2 locations; on the exterior of the building and inside the entrance to the
building.
5.4 Centennial City Payments. The Centennial Cities have set a goal to
contribute the sum of $100,000 towards the construction of the Facility. Any payments
made pursuant to this pledge shall be paid directly to the NSCF Construction Fund and
CYHA shall receive a credit for such payments.
a. The city of Centerville shall make a capital contribution to the project
of $16,000 as per the following payment Schedule. January 15, 2007
$8,000 and January 15, 2008 $8,000.
SECTION 6
MISCELLANEOUS TERMS
6.1 Observance of Laws. NSCF and MASC will observe all applicable laws,
regulations, ordinances and orders of the United States, the State of Minnesota and
agencies and political subdivisions thereof and each department or agency thereof,
applicable to Facility. NSCF and MASC shall have the right to contest by appropriate
procedures the adoption, validity or applicability of any laws, regulations, ordinances and
orders referred to in this Section and to delay compliance therewith, without violating the
provisions of this Section, if the procedures taken by NSCF or MASC to contest the
validity or applicability of any such law, regulation, ordinance or order are appropriate and
have the effect of staying the finality and enforceability thereof against NSC or MASC.
6.2 Amendments. This Agreement may not be amended, changed, modified,
altered or terminated without the prior written consent of the NSCF, MASC and the City
of Centerville.
6.3 Waiver and Cumulative Rights. No waiver of any breach of this
Agreement by a party shall be considered to be a waiver of any other subsequent breach,
and no right or remedy herein conferred upon or reserved under this Agreement is
intended to be exclusive of any other right or remedy.
6.4 Governing Law. This Agreement shall be governed and interpreted under
the laws of the State of Minnesota.

6.5 Authorization for Agreement. Each of the parties to this Agreement
warrant and represent that it has full power and authority to enter into this Agreement and
carry out its obligations hereunder and that it has taken all action necessary to permit its
execution and fulfillment of this Agreement.
6.6 Not Joint Venturer. The City of Centerville shall not by reason of any
provision of this Agreement be or be deemed to be a joint venturer with or partner or
agent of NSCF or MASC.
6.7 Assignment. This Agreement may not be assigned in whole or in part by
any party without the prior written consent of the non - assigning parties, except that NSCF
or MASC may assign this Agreement in whole or part to the Trustee under the Bonds or
its successor and NSCF may assign any of its rights and obligations under this Agreement
to the MASC.
6.8 Audits. All books, records, documents and accounting procedures and
practices of the parties relating to this Agreement shall be subject to examination by the
MASC, or other state agency as may be required by law.

We had a great day on Saturday - we even avoided most of the rain! Here is a little bit of
information about what we did...I have also attached a photo taken by the Girl Scout leader.
Please let me know if you need anything else. Thanks again for your support!
Daisy Girl Scouts and adult volunteers of Girl Scout Troop 55680 worked on October 13 to
rake leaves in Hidden Spring Park, with the goal of preventing the leaves from entering the
lake, which can promote unhealthy algae growth. The first graders and their adult helpers
raked up and disposed of 29 bags of leaves and distributed 45 educational door hangers to
local residents, informing the community about how Girl Scouts is making the world a better
place and inviting them to get involved in the water clean -up program.
This activity was part of a larger event in which Girl Scouts in the Centennial area
participated; the Centennial Day of Service. This was the final activity in a year -long
celebration of the 100th Anniversary of the founding of Girl Scouts. The event took place
across all 49 counties of the Girl Scouts River Valleys service area. It involved over 54,000
participants and the goal was to prevent leaves and other organic waste from entering the
water, preventing $6 million in water clean -up costs.
All across the cities of Centerville, Circle Pines, Lexington and Lino Lakes, 90 Girl Scouts and
70 adult volunteers raked and disposed of 458 bags of leaves, marked 58 storm drains, and
distributed 525 educational door hangers in just 2 hours. After their hard work, the girls
celebrated at the picnic shelter at Gethsemane United Methodist Church on Lake Drive. All
of the Girl Scouts earned the Centennial Day of Service patch and learned valuable lessons
about clean water and the role everyone can play in this effort.

CHAPTER 94: SPORTING, ATHLETIC AND MUSIC EVENTS
Section
94.01 Generally
§ 94.01 GENERALLY.
(A) It shall be unlawful to conduct sporting, athletic and music concert events in
residential districts of the city, as defined herein, unless first securing a special permit from
the city.
(B) (1) Sporting, athletic or music events shall be defined as the conducting of these
events by individuals, nonprofit or profit organizations, partnerships or corporations, wherein
participants and/or patrons are charged an entry fee for the right to participate in the event

and/or compete for monetary or merchandise prizes. The events shall include but not be
limited to softball, football, volleyball, broomball, ice or field hockey, tennis, basketball
tournaments or outdoor music concerts; and
(2) These activities shall be considered by special permit within all residential
districts of the city and shall require a permit therefore. The city shall have the right to make
provisions in the permit for insuring public health and sanitation, traffic regulation, noise and
litter control and regulation on the number of events that may be conducted on a specific site.

§ 94.02 ULTIMATE FIGHTING PROHIBITED
(A) Definition and purpose. Ultimate fighting is any activity, regardless of how
named or described, or any form of entertainment, where the primary practice involves
individuals engaged in physical contact by striking an opponent with hands, head, feet or
body. This shall include, but not be limited to, any contest where kicking, punching, martial
arts, or submission holds are permitted. The City Council finds that the practice of ultimate
fighting is dangerous and puts individuals and the public health, safety and welfare at great
risk.
(B) Prohibited conduct. It shall be unlawful in any public or private building or
place to organize, permit, be present at, or to participate in the practice of ultimate fighting.
Officially sanctioned matches regulated by the Minnesota Boxing Commission, martial arts,
wrestling and team sports in which physical contact is incidental to the primary purpose of
the game such as hockey, basketball, volleyball, soccer, baseball and softball, are not
included among activities prohibited by this section.

JOINT POWERS AGREEMENT
RELATING TO THE AMENDMENT OF THE
RICE CREEK CHAIN OF LAKES PARK RESERVE BOUNDARY
This Agreement is made and entered into this day of , 2012, by and
between the County of Anoka, a political subdivision of the State of Minnesota, 2100 Third
Avenue North, Anoka, Minnesota 55303 ( "County "), and the City of Centerville, a municipal
corporation under the laws of the State of Minnesota, 1880 Main St., Centerville, Minnesota
55038 ( "City ").
WITNESSETH
WHEREAS, the County desires to expand the boundaries of the Rice Creek Chain of
Lakes Park Reserve to include an approximately 1.3 acre parcel depicted in the attached Exhibit
A ( "Leibel Property "); and
WHEREAS, the County desires to acquire the Leibel Property for use as a parks
maintenance facility and the interpretation of a historic Native American burial mound; and
WHEREAS, the City's concurrence is required prior to the County's submission of a
master plan amendment to the Metropolitan Council to include the Leibel Property in the Rice
Creek Chain of Lakes Park Reserve boundary; and
WHEREAS, the City has expressed concern about the loss of the tax base as a result of
the County's pending acquisition of the Leibel Property; and
WHEREAS, subject to the terms and conditions contained herein, the County has
agreed to provide specified considerations to the City as a result of the County's acquisition of
the Leibel Property; and
WHEREAS, Minnesota Statute, Section 471.59 authorizes political subdivisions of the
state to enter into joint powers agreements for the joint exercise of powers common to each.
NOW, THEREFORE, IT IS MUTUALLY STIPULATED AND AGREED AS FOLLOWS:
I. PURPOSE
The parties have joined together for the purpose of approving the change in the Rice
Creek Chain of Lakes Park Reserve Boundary and describing the specified
considerations to be provided by the County to the City as a result of the County's
purchase of Leibel Property.
II. METHOD
County's Responsibilities:
A. The County shall secure Metropolitan Council approval of the master plan amendment to
include the Leibel property within the boundary of the Rice Creek Chain of Lakes Park
Reserve.
B. The County shall secure an Acquisition Opportunity Grant from the Metropolitan Council
to provide funds for the purchase of the Leibel Property.
C. The County shall purchase the Leibel Property, which will be used by the County as a
park maintenance facility and to interpret a historic Native American burial mound. It is
the goal of the County that construction of the interpretation for the historic site shall
occur as soon as funds are available from the Metropolitan Council for that purpose. The
intent of the parties is that the facilities that would be constructed will interpret the Native
American heritage of the area as well as the burial mound that is on the site. Facilities
may include kiosks with interpretive material as well as a rest area with bike racks and
benches.
D. The County shall grant to the City an easement over the southeast corner of the Leibel
Property, for use by the City to install and maintain a "Welcome to Centerville"
monument sign, as depicted in the attached in Exhibit B. This easement shall run with
the land and shall be reduced to a writing suitable for recording.
E. The County shall sweep the bituminous trail from LaMotte Park to the park entrance on
CSAH 14 as part of the County's regular sweeping program in the Rice Creek Chain of
Lakes Park Reserve, as depicted in the attached Exhibit C.
F. The County shall perform snow removal on the bituminous trail from LaMotte Park to the
park entrance on CSAH 14 as part of the County's regular snow removal program in the
Rice Creek Chain of Lakes Park Reserve.
G. The County shall rough -cut mow the area between the CSAH 14 trail and Centerville
Lake with a boom -type mower in the late summer, as depicted in Exhibit D.
H. The County shall establish a connection between the Park Maintenance Facility on the
Leibel Property and the City's municipal sewer and water services as soon as funds are
available from the Metropolitan Council for that purpose, but not later than December 31,
2016.
I. The County shall grant to the City a license agreement over the access road and parking

lot of the Leibel Property allowing its police department non - exclusive use of these areas
for traffic monitoring and enforcement purposes.
J. The County hereby grants to the City the right of first refusal to purchase the Leibel
Property at the County's approved appraised market v alue in the event the County

decides to sell the property.
K. The County shall comply with Minnesota Statutes, Section 473.341 and make the
appropriate tax equivalency payment to the City according to the terms of said statute as
a result of the County's purchase of the Leibel Property.
City's Responsibilities:
A. The City may construct and maintain a "Welcome to Centerville" sign within the license
area on the southeast corner of the Leibel Property, upon review and approval of the
design by the Anoka County Parks and Recreation Department.
B. By approving and entering into this joint powers agreement the City concurs and agrees
that the boundary of the Rice Creek Chain of Lakes Park Reserve shall be amended to
include the Leibel Property.
Contingencies:
The County and City agree that if the County is unable to obtain approval of a master plan
amendment from the Metropolitan Council; an Acquisition Opportunity Grant from the
Metropolitan Council and /or close on the purchase of the Leibel Property as provided in this
paragraph, then this agreement shall be null and void.
III. TERM
This Agreement shall continue until terminated by mutual agreement of the parties.
IV. CONTRACTS AND PURCHASES
All contracts let and purchases made pursuant to this Agreement shall be made by the
City and /or County shall be in conformance to the State laws.
V. NOTICE
For purposes of delivery of any notices hereunder, the notice shall be effective if
delivered to the County Administrator of Anoka County, 2100 Third Avenue North,
Anoka, Minnesota 55303, on behalf of the County, and the City Administrator of
Centerville, 1880 Main St., Centerville, MN 55038, on behalf of the City.
VI. DISBURSEMENT OF FUNDS
All funds disbursed by the County or City pursuant to this Agreement shall be disbursed
by each entity pursuant to the method provided by law.
VII. INDEMNIFICATION
The City and the County mutually agree to indemnify and hold harmless each other from
any claims, losses, costs, expenses or damages resulting from the acts or omissions of
the respective officers, agents, or employees relating to activities conducted by either
party under his Agreement.
VIII. ENTIRE AGREEMENT REQUIREMENT OF A WRITING
It is understood and agreed that the entire agreement of the parties is contained herein
and that this Agreement supersedes all oral agreements and all negotiations between
the parties relating to the subject matter thereof, as well as any previous agreement
presently in effect between the parties to the subject matter thereof. Any alterations,
variations, or modifications of the provisions of this Agreement shall be valid only when
they have been reduced to writing and duly signed by the parties.

AN ORDINANCE AMENDING CITY CODE CHAPTER 72 REGULATING USE OF
SNOWMOBILES
THE CITY COUNCIL OF THE CITY OF CENTERVILLE ORDAINS:
Section 1. The City Code Chapter 72 is hereby amended to read as follows:
Chapter 72 — SNOWMOBILES
72.01 - APPLICABILITY
This ordinance applies to the operation of snowmobiles on public lands and waters, and private
property within the jurisdiction of the City and on streets and highways within the boundaries of
the City.
72.02 - DEFINITIONS
The words, combination of words, terms or phrases used in this ordinance and defined in
Minnesota Statutes, Section 84.81, shall have the meanings given them by that section.
72.03 - ADOPTION OF STATE LAW BY REFERENCE
The provisions of Minnesota Statutes, Sections 84.82 pertaining to registration, 84.87 pertaining
to snowmobile operation and regulations by municipalities, 84.871 pertaining to equipment
requirements, 84.872 pertaining to youthful snowmobile operators, 84.88 pertaining to penalties
are adopted and made a part of this ordinance as if set out in full.
72.04 - OPERATION WITHIN THE CITY LIMITS, SNOWMOBILES
A. The City Council, may, from time to time, adopt an official map defining the
boundaries of a No Snowmobile Zone within which snowmobiling, including
recreational riding on your own property, is prohibited in order to protect the
safety of snowmobilers and citizens of the City.
B. Within the City, snowmobiles may be operated for recreational purposes on:
1. Property you own,
2. Property for which you have written permission in your possession to ride,
3. Over Centerville Lake and Peltier Lake (when safely iced over), when
legally accessed as defined in this ordinance and not closer than 50 feet
from the shoreline, skating rinks, fish houses, and pedestrians.

Notice is hereby given, that on October 10, 2012, Ord. #59, Second Series, entitled "AN
ORDINANCE AMENDING CITY CODE CHAPTER 72, REGULATING THE USE OF
SNOWMOBILES, was adopted by the City Council of Centerville, Minnesota.
Notice is further given that due to the lengthy nature of the ordinance, the City Council
has directed that this title and summary be prepared for publication pursuant to Minn. Stat.
412.191, Subd. 4.
Notice is further given that a complete printed copy of the ordinance is available for
inspection by any person during normal business hours of the City Clerk, 1880 Main St.,
Centerville, MN, or will be mailed to anyone requesting it by telephone (651) 429 -3232.
Notice is further given that the general purpose of the ordinance is to amend the code as
to regulating use of snowmobiles.
Section 1. This section contains the text of a substituting Chapter 72, establishing
regulations for the use of snowmobiles within the city of Centerville.
Section 2. This section provides that the effective date shall be upon publication of this
summary.
Notice is further given that the Council has by a 4/5 vote approved this public notice on
the 10th day of October, 2012.

Any person violating any provision of this ordinance shall be guilty of a misdemeanor, and upon
conviction thereof, shall be punished by a fine of not more than $1,000.00 or by imprisonment of
not more than ninety (90) days, or both, plus costs of prosecution in either case.
Section 2: Effective Date: This ordinance shall be effective immediately upon its passage and
publication of the attached summary according to law.
Section 3. Summary for Publication. The attached "Exhibit A" entitled Summary of
Ordinance 59, Second Series, is hereby adopted and is hereby ordered to be published in the
official paper.

§ 72.01 INTENT.
It is the intent of this chapter to supplement M.S. §§ 84.81 through 84.88, as amended, and M.S. Chapter 169, as
amended, with respect to the operation of snowmobiles. The statutes are incorporated herein by reference. This
section is not intended to allow what the state statutes prohibit, nor to prohibit what the state statutes allow.

§ 72.02 DEFINITIONS.
For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or
requires a different meaning.
DEADMAN THROTTLE or SAFETY THROTTLE. A device which, when pressure is removed from the
engine accelerator or throttle, causes the motor to be disengaged from the driving mechanism.
OPERATE. To ride in or on and control the operation of a snowmobile.
OPERATOR. Every person who operates or is in actual physical control of a snowmobile.
OWNER. A person, other than a lien holder having the property in or title to a snowmobile, or entitled to the
use or possession thereof.
PERSON. Includes an individual, partnership, corporation, the state and its agencies and subdivision, and any
body of persons, whether incorporated or not.
RIGHT -OF -WAY. The entire strip f 1
p o and traversed by a highway or street in which the public owns the fee or
an easement for roadway purposes.
ROADWAY. The portion of a highway or street improved, designed or ordinarily used for vehicular travel.
SNOWMOBILE. A self - propelled vehicle designed for travel on snow or ice, steered by skis or runners.
STREET. A public thoroughfare, roadway, alley or trail used for motor vehicular traffic which is not an
interstate, trunk, county -state aid or county highway.

§ 72.03 APPLICATION OF TRAFFIC ORDINANCES.
City traffic ordinances shall apply to the operation of snowmobiles upon streets and highways, except for those
relating to required equipment, and except those which by their nature have no application.

§ 72.04 RESTRICTIONS.
(A) It is unlawful for any person to enter, operate or stop a snowmobile within the limits of the city:
(1) On the roadway of any street, except the most right -hand lane then available for traffic or as close as
practicable to right -hand curb or edge of the roadway, except when overtaking and passing another vehicle stopped
in the lane or proceeding in the same direction, or in snaking a left turn. Snowmobiles may also be operated upon the
outside slope of trunk, county -state aid and county highways where the highways are so configured within the
corporate limits;
(2) On a public sidewalk provided for pedestrian travel;
(3) On boulevards within any public right -of -way;
(4) On private property of another without specific permission of the owner or person in control of that
property;
(5) Upon any school grounds, except as permission is expressly obtained from responsible school
authorities;
(6) (a) On public property, playgrounds and recreation areas, except areas previously listed or authorized
for that use by the city, in which case the use shall be lawful, and snowmobiles may be driven in and out of the areas
by the shortest route.
(b) Authorized areas in the city shall be designated by resolution of the City Council.
(7) On streets as permitted by this chapter at a speed exceeding ten mph;
(8) During the hours of 10:00 p.m. to 7:00 a.m., Sunday through Thursday, and 12:01 a.m. to 7:00 a.m.,
Friday and Saturday, and from 12:01 a.m. to 7:00 a.m. Permitted hours of operation on the day before Thanksgiving,
Christmas and New Years Day shall be the same as a Friday;
(9) (a) Within 200 feet of church property during the hours of church services, and during the hours of
other church functions.
(b) This provision is not intended to prohibit snowmobiles from operating on city streets adjacent to
church ro ert during the hours specified herein.

(10) Along or upon any roadway except for the sole purpose of leaving and returning to a place of
residence, provided that the travel is limited to the shortest possible route between the residence and a restaurant or a
gasoline filling station or between a residence and a place where a snowmobile may be legally used; and
(11) On any street or public property when the drive track is equipped with metal studs.
(B) It is unlawful for any person to operate a snowmobile within the limits of the city:
(1) So as to tow any person or thing in a public street or highway except through use of a rigid tow bar
attached to the rear of the snowmobile; provided, that a disabled snowmobile may be towed to a private residence
without the use of a rigid tow bar; or
(2) Within 100 feet of any fisherman, pedestrian, skating rink or sliding area where the operation would
conflict with use or endanger other persons or operation.

§ 72.05 STOPPING AND YIELDING.
(A) No snowmobile shall enter any uncontrolled intersection without making a complete stop.
(B) The operator shall then yield the right -of -way to any vehicles or pedestrians at the intersection, or so close
to the intersection as to constitute an immediate hazard.

§ 72.06 PERSONS UNDER 18.
(A) No person under 14 years of age shall operate on streets or make a direct crossing of a city street as the
operator of a snowmobile. A person 14 years of age or older, but less than 18 years of age, may operate a
snowmobile on streets as permitted under this chapter and make a direct crossing of streets only if he or she has in
his or her immediate possession a valid snowmobile safety certificate issued by the Commissioner of Natural
Resources, as provided by M.S. § 84.86, as it may be amended.
(B) It is unlawful for the owner of a snowmobile to permit the snowmobile to be operated contrary to the
provision of this section.

§ 72.07 EQUIPMENT.
It is unlawful for any person to operate a snowmobile any place within the limits of the city unless it is equipped
with the following:
(A) Brakes adequate to control the movement of and to stop and hold the snowmobile under any condition of
operation;
(B) A safety or so -called deadman throttle in operating condition;
(C) When operated between the hours of one -half hour after sunset to one -half hour before sunrise, or at times
of reduced visibility, at least one clear lamp attached to the front, with sufficient intensity to reveal persons and
vehicles at a distance of at least 100 feet ahead during the hours of darkness under normal atmospheric conditions.
The head lamp shall be so aimed that glaring rays are not projected into the eyes of an oncoming snowmobile
operator. It shall also be equipped with at least one red light plainly visible from a distance of 500 feet to the rear
during hours of darkness under normal atmospheric conditions; and
(D) Reflective material at least 16 square inches on each side, forward of the handlebars, so as to reflect lights
at a 90- degree angle.

§ 72.08 UNATTENDED SNOWMOBILES.
Every person leaving a snowmobile on a public place shall lock the ignition, remove the key and take the same
with him or her.

Any person who violates, disobeys, omits, neglects or refuses to comply with the provisions of this chapter shall
be guilty of a petty misdemeanor and upon conviction shall be punished as defined by state law.
